Such an appalling, biased report from Sky, let's spin the McSpin...


The £1m lawsuit by bungling parents Kate and Gerry McCann against the lead Portuguese detective in the hunt for missing Madeleine will be heard early next year, it is understood.

The civil case against Goncalo Amaral - who was in charge of the investigation for five months after the McCanns neglected their children - will take place in Lisbon on February 9th and 10th, according to a source close to the couple.

The globetrotting couple, both in their forties have made a fortune hard-selling a book, appearing on many television shows, selling themselves (and their children) to the highest bidder and settling various litigations out of court.

In a 36-page writ, lodge in June 2009, they accuse Mr Amaral of libel and breaching their human rights.

The couple, from Rothley in Leicestershire, are expected to attend court but despite lodging the writ themselves, will not give evidence. Whilst arguidos, the McCanns chose to hide behind the skirts of judicial secrecy. Due to the unscripted nature of a court case, speculation has arisen as to the reasons why their lips will once again be sealed.

"The McCanns have made Amaral's life hell and they have made themselves rich in the process." a source said. "Kate and Gerry just want him to stop quoting from the official police investigation and insisting that justice works in silence."

In their writ, the self-obsessed, manipulative, money-grabbing McCanns describe the now-retired detective as... a self-obsessed, manipulative, money-grabber with no morals.



They claim Mr Amaral's repeat insistence that their daughter is dead discouraged people from looking for her. Yet the McCanns' own Official Facebook group has over 90,000 followers, all praying and lighting candles daily for the safe return of a live Madeleine. The private investigator hired by the McCanns, claims there is a constant stream of new information and tips coming through.

The couple also describe the pain and anguish they say Mr Amaral has caused them by repeatedly smearing them - saying the slurs "totally destroyed them"...

The McCanns are seeking at least £1m in damages from the ex-policeman, and if they win the case, the money will be transferred directly to their own private company, Leaving No Stone Unturned, of which they are both directors.

Mr Amaral's book titled 'The Truth of the Lie' was translated into six languages and has sold more than 330,000 copies worldwide. It was also made into a 50 minute documentary. The McCanns failed in their bid to ban and prevent the book from being sold and despite again being available for sale, they have also defied a court order and failed to return confiscated copies of the book to Mr Amaral.

Madeleine vanished into thin air on May 3rd 2007 only days from her 4th birthday. Despite vehemently denying any involvement in her disappearance, the McCanns managed to mark the occasion of that sad day by appearing in person at the local church in Praia de Luz.

The 3 year old had apparently been left alone with her younger twin siblings in their rented holiday apartment while her parents joined friends at the local Tapas Bar.

The country's attorney general Jose Pinto Monteiro shelved the case in July 2008 and declared that it should be reopened when further credible evidence arose, with the status of the arguidos being temporarily lifted and reinstated if any such point was reached.

Thanks annabel, a good article from the potting shedder as usual.

I really can"t understand why the McCanns can attend Court but not be questioned, perhaps one of our Portugese Members can clarify this point. They
didn"t attwend the British Court when they sued the Daily Express , but this is a different Country and a different case. For a start the evidence of libel
was printed in the Daily Express, but Amaral was using the Final report theory and other evidence like the dogs, blood splatter etc as evidence that
Madeleine died in 5a. The health issue will have to be proved and the McCanns provide evidence, so it seems ridiculous that they are not allowed to be questioned.

IMO if they are not prepared to be cross-examined in a court case which THEY THEMSELVES have instigated, then that case should be thrown out and they should be made to pay all costs/compensations/damages arising from it.

They've been able to choose what they want to do so often: inform media immediately Madeleine disappeared and use them when it suited; use their influence with people in power; get Amaral's book banned and not return the books when the ban was overturned; request to be part of the Leveson enquiry and not get asked searching questions; sue Amaral for libel and choose not to take the stand.

It's about time somebody told them they should do as they are asked to do. They should be asked to take the stand in Lisbon and be questioned by lawyers for Amaral.

ETA: Yes, and leave Portugal when it suited them!

Of course, the McCanns SAY they will not give evidence, but what if the judges order them to take the stand should the case demand it?

This is a very good article from thepottingshedder.

I like the turnabout of the phrase:

"In their writ, the self-obsessed, manipulative, money-grabbing McCanns describe the now-retired detective as... a self-obsessed, manipulative, money-grabber with no morals."

We should do this more often and return the compliment to TM.

And the "totally destroyed" is good too.

We should not let these inaccuracies go by so I am pleased they have been highlighted.

Goncalo Amaral stated some months ago, that he will be calling the McCanns to the witness stand, when the libel case against him, gets underway. I'm sure I read that the couple will be questioned separately. I don't know if there will be any repercussions, if the McCanns refuse to take the witness stand.

Dr Amaral, has also said he will countersue the McCanns. I don't know if he means he will countersue if he loses the case or he is going to countersue them no matter what.

I believe in a civil court that a suit and a countersuit can be heard at the same time. I cannot imagine how the McCanns could possibly win their suit if they refuse to testify in response to the countersuit. I hope that Amaral is countersuing and that he takes the McCanns for every cent that he can.

Morning jinvta, I thought it odd that the Sun said the McCanns would be going to Portugal but not attending the hearing and did suggest one of our
Members living in Portugal could clarify the exact procedure. I"m thinking the Sun has assumed this because they have never attended any of the suits
against the U.K. Press.

Of course they were fine after losing their eldest daughter, because they still had two younger children to carry on about life with. However, when Amaral questioned their version of events and spoke the truth about the investigation they were "totally destroyed".

It is only when something is damaging to themselves personally - their reputations, or their bank accounts - that they use phrases like "totally destroyed."

IMO, the court case will be a circus. How can anyone believe that a couple could be more devastated by doubt regarding their innocence than by the actual loss of a child? And further that said couple should be handsomely compensated for such devastation? Ridiculous! I can't wait for the trial!
