Further statement by Silvia Batista

I just came across this while reading from the Joanna Morais site.

Witness statement of Sílvia Maria Correia Ramos Batista

Concerning the matter of the process, the witness said:

That she has given statements for several times within the process, and
remembers the contents of what she stated before, therefore reproducing
the contents of the previous statements into this statement.

The deponent offers another statement because with the passage of time,
since Madeleine’s disappearance, she has remembered some details of the
facts that she witnessed, which she considers of some interest to the
investigation.

Like she said before, she was alerted to Madeleine’s disappearance
between 10.30 and 11 p.m. She was at home and was informed about the
event through a telephone call. She immediately went to the Ocean Club,
where she arrived only minutes before the GNR officers. When she arrived
at the resort, she went immediately to apartment 5A, where she met
several persons both on the inside and on the outside of the apartment.
She went into the apartment but left it right away without speaking to
anyone, because she was informed that the GNR officers were at the main
reception, so she went to meet them.

When she arrived near the GNR officers, she verified that Gerry,
Madeleine’s father, was behind her, in the company of another individual
whose identity she doesn’t remember. At that moment, Gerry placed both
knees on the floor, hit the floor with both hands, too, placing himself
like a praying Arab, and shouted out twice in rage, and it was not
possible to understand what he said. Then Gerry got back on his feet and
accompanied the deponent and the other individual who was in the GNR
car, to apartment 5A.

Already on location, the deponent entered the apartment and asked those
who were present both for the passports of all family members and
photographs of the missing person. The deponent walked Gerry to the GNR
car, so he could deliver the requested documents. She states that she
carried out these diligences, and other diligences, at the request of
the GNR Commander as they used the deponent’s knowledge of the English
language to translate the questions that were asked from the missing
person’s family members, and the answers that were given. She remembers
that Gerry gave the GNR Commander several photographs of the missing
person. These were postcard-type photographs, taking their size and
shape into account. They were actually photographs of the size and shape
of a postcard, and they seemed to be all similar to her.
She also realised that from the very first moment on, both Gerry and the
rest of the group members insisted in stating that Madeleine had been
abducted, all of them using the word “abducted” [original in English]
instead of missing, and they all showed great interest in informing the
press about the situation.

The deponent further recalls that she entered the room where Madeleine
had been sleeping. She now remembers that the door was closed. The
inside of the room was dark. The shutters were down, and light entered
only through its holes. The windows were closed and the curtains
slightly open. Gerry, who accompanied the deponent during this visit,
with the GNR officers also present, said that it had been him who had
closed the window because the babies were still sleeping inside, which
the deponent could verify as true. Gerry mentioned that when he noticed
that Madeleine was missing, he had found the window and shutters open,
and the curtains fluttering.

The deponent recalls that the cots that were used by the babies were
placed in the middle of the room and aligned, and therefore she found it
strange that someone could have taken Madeleine from the bed where she
was sleeping up to the window, because there was no space to get
through. The deponent opened the bedroom’s wardrobe to check if
eventually Madeleine was hiding inside. Then they all left the room, and
someone closed its door again. The deponent remained in the living room
for a while, with the GNR officers, Gerry and the other group members
that were there in a frenzy, going in and out and speaking on their
mobile phones. She noticed that none of the group members, including the
child’s mother and father, were busy looking for her. The mother was
sitting on the master bedroom’s bed, the father accompanied the deponent
and the GNR officers and the other group members walked in and out and
spoke on the phone, apparently concerned about informing the press about
the event.

She thought that the child’s mother was downbeat with the situation, the
father showed his concern and also asked both for the press to be
alerted and for dogs to be brought in for the search. Concerning the
others, she can only recall that Fiona and her husband, Payne, were
hysterical about the situation. At a given moment, right after the PJ’s
elements arrived, the child’s parents removed the twins from the cots
where they still slept, and took them into the apartment on the first
floor. At Kate’s request, the deponent removed the soft toys and a
blanket from the cots, and also took them to the first floor. The
babies’ cots were left only with the mattresses.

The deponent also wishes to mention that at around 3 a.m. Madeleine’s
parents asked for the presence of a priest on location. They didn’t
explain the reason why they wanted a priest, but the deponent found the
fact strange as there were no indications that the little girl was dead,
and that’s the circumstance under which usually the presence of a
priest is requested.

At a given moment, the deponent translated the deposition from one of
the ladies that belonged to the group of English people, namely one that
she indicates as being a brunette. This lady told the GNR officers, and
the deponent translated, that she had seen a man crossing the road,
possibly carrying a child. The deponent found that situation strange
because she was convinced that when she saw this man, the lady was
positioned in a spot that has no viewing angle to the location where she
had seen the man. She doesn’t know exactly where the lady was
positioned when she saw the man passing by, but she knows that she
indicated that she saw him passing on the street that lies in front of
the window to the bedroom where Madeleine was, walking into the
direction of the street that leads to the Baptista supermarket.

When questioned about the clothes that the English group members wore
that night, she mentions that she only remembers that Fiona wore a green
blouse, Gerry wore a dark coloured shirt, and Fiona’s husband wore
light-coloured trousers, she thinks cream-coloured.

And she stated nothing further.

Hi the End is Nigh......what about this bit, so much for the curtains blowing and shutter jemmied.

The deponent recalls that the cots that were used by the babies were

Interesting that 'Gerry said he closed the shutters'. His fingerprints were not found on the window, Kate's were. I understand that with roller shutters there is a side cord to open/close them, we have them here in France. Did the forensic police dust the shutter cord for fingerprints? If they did and no fingerprints were recognised, perhaps Gerry was wearing gloves! ;-)

I always love the part of the statement where straight away Gerry is requesting sniffer dogs be bought into to assist the search, so he thoroughly believed in their efforts until of course Eddie and Keela dropped them in it.

Regards the bit aboout Tanner saying she'd seen an abductor, Kates book says:

I didn’t yet know that at around 9.15pm Jane had seen a man on Rua Dr Agostinho da Silva carrying a child who appeared to be asleep. When I’d discovered that Madeleine was missing she had been in her apartment three doors along. Hearing the commotion, she had come out and discovered what was going on. Taking Fiona to one side, she told her how, after leaving the restaurant to make her first check on her children, and having passed Gerry and Jes talking on Rua Dr Gentil Martins, she had seen this man crossing the junction with Rua Dr Agostinho da Silva, ten or fifteen feet in front of her, walking from left to right. Obviously, at the time she had thought little of it: as far as any of us knew, Madeleine was asleep in her bed, and, having just seen Gerry, Jane was well aware that he had been in our apartment only a few minutes before. Quite naturally, she’d assumed the man was a father with his child, perhaps on their way home from a crèche. As soon as she heard about Madeleine’s disappearance, everything fell into place and she felt sick. She immediately reported this sighting to the police. Gerry was informed but, given the condition I was in, he did not share this development with me until the morning.

The time of the morning she was told will need to be ironed out.

Fiona and David were hysterical and David had beige trousers too?? Never knew he had a pair.

Hi Jean Luc, the only print they found was one on the window and that was Kates, and the shutters were not jemmied.

I thinkl it was in Amaral"s reconstruction where he called in an expert who said the shutter is very heavy and would have made a noise if it was jemmied and rolled up. when you read all this you have to wonder why they weren"t charged with negligence in PDL.

When you read all this you have to wonder why a reconstruction was not called immediately , were the Police negligent, or were they "advised" by
Socrates to do nothing. It all stinks to high heaven.

I am totally amazed that there is a significant hardcore of the public who cannot, or refuse to, get a whiff of the odour of obfuscation, lies, deceit, self-preservation, delusion etc.

Quite a few interesting things in this statement but the one I noticed straight away was that Gerry said it was he who had shut the window & shutters. 2 points on this.

1) Kate said they didn't touch CC etc as they were aware of forensic evidence being spoiled
2) It was Kate's not Gerry's fingerprints on the window

Wierd Weather, in the last 15 minutes we have had rain, thunder, lightning and now hailstones.!!!!!!!

The more I read this Statement the more I think the Police or Judiciary were very afraid of upsetting the McCanns and their entourage, but I think Amaral
should have cordoned off the Apartment area so no one could enter and gone ahead with the recon while the Mccanns and OC Staff were still there.

So it must be true beyond any doubt, and the boooook is the new indisputable "bible"

HOW did JT KNOW, was aware, that GM had been IN his apartment a few minutes before???????????
The first sighting by JT of GM and JW was when she stepped onto the path outside the Ocean Club and looked LEFT, up the hill, to see them.
How did she KNOW/WAS AWARE GM had already been in and was now OUT of his apartment?
For all she knew, and how could she have known otherwise, JW could have met GM when GM was on his way TO the apartment and they had been chatting outside the apartment until she saw them.
She didn't speak to them yet KNOWS that GM has already been IN the apartment and has met JW on his way back to the OC!.
JT dosen't SEE GM exit the apartment and dosen't KNOW how long he has been talking to JW.
Yet strangely JT and KM know that JT was aware GM had already done his check before meeting JW on his way BACK to OC!
Physic or what?
So HOW or WHEN did she, JT, become AWARE that GM had DONE his check?

And the best bit of this little 'saga' is that, all along, GM was on the OTHER side of the road, and JW was standing outside the gate to 5A on her side of the road shouting across the road to GM about child checking!
She has to be AWARE that the only way for her to pass them, chatting to each other on opposite sides of the road, is to walk BETWEEN them....................... yet neither JW or GM SEE her!
HOW'D she do that?

What stood out for me was the fact that Gerry handed the postcard photos to an officer. There was a lot of talk on the forums when these photos were printed and where. No searching but printing.......

I think Kate got it wrong, Gerry crossed over the road to talk to JW but apparently neither men saw her walking up the road.

Apparently one of the OC Staff had a printer according to Gerry because the OC said their printer did not print that particular size photo.

When has she ever got it right?
She's calling JW an out and out LIAR, but JW has under threat of prosecution, stated THREE times he spoke to GM outside the gate of 5A.
And JW even drew an unhelpful sketch map of where he ACTUALLY was standing talking to GM.
What i don't get is that JW has never threatened to sue the McCanns.
WHY NOT?
THEY (McS) have both said, in print (her booook) and interviews,(Oprah Winfrey) he (JW) couldn't have been where he said he was (outside gate 5A) as GM had CROSSED the road to talk with him

I do remember reading that although Jez wilkins had only met Gerry on that holiday, Gerry phoned him several times , maybe to clarify the time and
which side of the road they were on. In the McCann video of the reconstrutction, Jane tanner walks on the side of the road where the gate is.

Hi maebee, why didn"t she tell Gerrry and Kate straight away? Do they really expect us to believe that as soon as Gerry left the apartment, some guy
jemmied the shutters, crept into the children"s bedroom after climbing over the window without waking Madeleine who was sleeping in the bed nearest
the window, picked her up in his arms, climbed through the window again and Jane saw him walking across the road.......they must think we are idiots
to believe such rubbish but it makes me even more mad that they were not charged while in Portugal.

Well, they are going to Portugal in February - I assume they would not be immune from being detained if circumstances dictate? Perhaps a combination of existing evidence, new findings from the review and matters aired in the Civil Case?

I'm confused....

a) I thought Jane said Bundleman was walking across the top of the road (ie from the carpark side of 5a across the road and then onwards, as if past RM's house etc), not downwards, past the Ocean club reception and towards the supermarket??

b) If Bundleman was walking towards the supermarket, surely he'd be walking towards Jane (and Gerry and Jez)? so why is Silvia saying she can't think how Jane could have seen him?

Or have I got this all wrong?

I thought the same as you.... could be a written badly though, that road past the entrance to the OC and tapas would lead to the Baptista

So, apparently Gerry is saying that Kate did not even bother to shut the window or the shutters before running out of the apartment to the Tapas Bar to inform the world of the immaculate abduction.

If, as Gerry says, he is the one who shut the window, then why are Kate's the only prints that were found on the window? The only possible answer can be that she opened the window!
