Personally, I don't believe that he conducted either of these checks.

From Matthews' rogatory

" So I approached the room but I didn't actually go in because you could see the twins in the cots and one of the, you could see the twins in the cots because they're in with, sort of the cots were in the middle of the room with sort of a gap of about sort of maybe a foot between the two, the cots had sort of got that fabric end and sort of a mesh side, so you could see the sides and you could see them breathing and there were two there and it was all completely quiet. And the other things you could see in the room, there was a, there was another bed at the back underneath the window at the far side and you could see the end of the bed, another bed here. And because I was looking for, well people say, well why didn't you go in the room, why didn't you check on Madeleine"

How could he have seen the twins "breathing" without seeing Madeleine in her bed as her she was closest to the door?

http://www.mccannpjfiles.co.uk/P1/01_VOLUME_Ia_Page_15.jpg

Also if you look the brown cot doesn't have mesh ends so he couldn't have seen a toddler "breathing" through it.

And how come he barely enters the room and can see the bed at the back of the room when Kate went to do her check - in one of her stories she says - she stared at Maddies bed for ages trying to work out if she was in it or not?

Now according to Kate the door was only opened a little not to let too much light in which might wake the Children and she couldn"t decide whether the
blankets was madeleine. Gerry goes into the room stands at the side of the sleeping Madeleine's bed gazing down at her and marvels how lucky he was
to have such a beautiful Daughter.

No wonder they wouldn"t take a lie detector test........the Machine would blow up.!!!!

Hi matthew.....Kate"s part in the Documentary ended up on the cutting room floor because it couldn"t be tied in to the other statements. Shame, because theAmerican Actress playing her looked very much like her.

Hi panda...amaral seen what this reconstuction was...when you just have the mcanns version of events,i dont think a kate lewk alike would of been of any use...

Present and former Polícia Judiciária (PJ) inspectors are indignant about the recording of the television documentary that Gerry and Kate McCann – the parents of Madeleine, who disappeared from an apartment in Praia da Luz, almost two years ago – filmed in the Algarve, during the weekend. And they recall that the couple and its friends refused to participate in the reconstruction that the PJ wanted to carry out in 2007.

"We're looking at a clear process of whitewashing of the situation", former coordinator of the PJ's investigations Gonçalo Amaral told 'Público' yesterday, further mentioning that "the theatre play" that was carried out in Praia da Luz "is not even complete, because one of the main characters is missing, doctor David Payne".

The former senior PJ officer understands that David Payne should have been summoned by the McCanns, given the fact that it was he who, right after the child's disappearance was communicated - on the 3rd of May 2007 - prevented other persons, namely an employee of the English Social Services (who happened to be in the area) from adopting measures. "That's right. The doctor who used to bathe the children is missing, the doctor whom an English couple complained about, in England, on the 16th of May, over something that happened with an underage daughter of theirs, in Mallorca, in 2005", Gonçalo Amaral added

The former investigator further recalls that last weekend's action possesses no juridical value whatsoever, and regretted that when Madeleine went missing, "there was no courage to counter the political pressures that led to the archiving of the process" and that prevented "the execution of a reconstruction that might even have led to conclusions beyond the hypothesis of a mere accident as being the little girl's cause of death". For Gonçalo Amaral, the little girl's parents, together with David Payne, remain the main suspects – "I remember well that he [Gerry McCann] said, in May 2007, that in two years, we'll all be back here [in Praia da Luz]. And in fact, two years on, here he is…", he added.

The reading that Amaral makes from the McCann family's filming in the Algarve is practically the same that is made, individually, by the president of the PJ's Criminal Investigation Workers Union (ASFIC). Carlos Anjos said that ASFIC does not adopt an official position in this case because "the English are free to do what they want". Nevertheless, he understands that we're looking at "an image cleaning, through a reconstruction that is worth rigorously nothing".

"A reconstruction only has value when all the persons that intervened when the facts took place, are present, which is not the case. This is a theatre play and it doesn't match what happened, but rather what they [the McCann family] wish had happened", Carlos Anjos added.

The McCanns' presence in Praia da Luz has not been well accepted by the majority of the local population. After an immense wave of solidarity that appeared as soon as the disappearance of Madeleine became known, Gerry and Kate would be looked at with suspicion when they were made arguidos in the process.

Their popularity would suffer even further when they left the Algarve, headed for England, from where they would then, surrounded by a team of lawyers and advisors, impute responsibilities to the Portuguese authorities. Two years after the child's disappearance, business in Praia da Luz gets worse by the day.

At the resort where the couple stayed, 21 out of 48 employees have been dismissed, due to financial inviability.

Yesterday, as a kind of consolation, the English family's spokesman, Clarence Mitchell, lamented the "negative impact of the case on the local economy".

As we know the mccanns & tapas are so keen on libels,i find it strange that david payne has never challenged these claims that stem from the gaspar statement & the concerns of yvonne martin...

Very good point. Why would Kate have thought that Madeleine might be cowering? Not only is the script is poorly written, the crap actress is crap at ad-libbing.

Similar mistake was made with 'they've taken her!'

This was the Portugugese response to the mockumentary the Mcs made, the one where the famous whoosh clunk sound Kate made surfaced.

Interesting question from the Portugese though, why didn't David Payne take part? He was the last independant witness to see Maddie.

Scared someone else might unhelpfully recognise him?

Yes, why would someone describe their child as 'cowering.'? Hiding, maybe. Playing, maybe. But cowering?

I have just read on one of the threads that Karen Mathews was found cowering under a divan. Now she was scared for her life so yes she would be cowering, which means to crouch or shrink in fear.
So what would Madeleine be cowering from Kate?

Yes, the word "cowering" conjures up images I'd rather not have of what life may have been like for Madeleine.

By the way it was Shannon Matthews not her mother Karen who was cowering. I think that the only thing Karen would cower from is the prospect of doing an honest day's work!

sorry, I've just deleted my entire post, because I've realised I'm completely wrong.

Kate says the 'cowering ' bit AFTER she discovered the 'open window and shutters'.

it's at around 2.08

Sorry to have been banging on about this unecessarily.

Hi, just noted my booboo yes it was not Karen of course who cowered, it is said she wasn't the cowering sort, far from it.
And yes indeed Not Born Yesterday, I have the opinion that Madeleine had a very worrying life.
