Tragic Darcey's mum sues Victoria over failure to erect West Gate barriers

EXCLUSIVE: DARCEY Freeman's mother is suing VicRoads over her daughter's murder, claiming safety barriers on the West Gate Bridge could have saved her little girl's life.

Peta Barnes says the road authority continually ignored advice to install anti-jump fencing.

Darcey, 4, fell 50 metres after being tossed off the bridge by her father in 2009.

Two days short of the third anniversary of Darcey's death, Ms Barnes has begun Supreme Court action, claiming negligent death and nervous shock.

Details of her claim are being kept confidential, after an application to the court by Ms Barnes's lawyers.

The court caps personal injury payouts but it is believed claims like Ms Barnes's can amount to hundreds of thousands of dollars.

Ms Barnes cradled her dying daughter in hospital after agreeing to have life support switched off.

She has since suffered post-traumatic stress disorder, and supports her two sons who witnessed their sister's horrific death.

In a heartbreaking victim impact statement, Ms Barnes said time would not heal her wounds.

"Not a day goes by where I do not constantly think of Darcey, where I don't miss her and wish with all my heart that she was with me," she said. "I can feel her little hand holding mine."

Ms Barnes said she feels panic and fear over incidents in daily life that would not have affected her before.

"I have heightened anxiety in everyday situations and have to manage myself carefully to control this."

Barriers on the bridge were first recommended by a coroner in 2004, when there was an average of eight suicides from the bridge a year.

But the Government initially accepted VicRoads advice that $10 million was too high a price for barriers.

Immediately after Darcey's death the Government said it would fast-track a $20 million plan to erect suicide-prevention fences. Since they were installed, there has been an 85 per cent decline in bridge suicides.

Arthur Phillip Freeman, 38, is serving at least 32 years' jail for murdering Darcey after a jury rejected his defence of mental impairment.



The court heard Freeman had been driving Darcey to her first day at school. He told Ms Barnes by phone: "Say goodbye to your children."

He stopped in an emergency lane atop the bridge.

Witnesses reported seeing him carry her to the bridge railing and throwing her over.

He then drove away.



A VicRoads spokesman said a writ had not yet been served.

imo i agree with darcys mum if there had been saftey barriers etc on the bridge at the time little darcy would be alive today

It's obvious, looking at that bridge before the barriers that it would have been easy to stand on those nice steps created by the girders to jump or throw someone over.
