Liderava o Ministério Público quando o caso rebentou em 2004 e agora será o relator do processo de revisão de sentença de Leonor Cipriano, que ontem foi inquirida no âmbito da eventual repetição do julgamento.

O juiz-conselheiro Souto Moura, ex-procurador-geral da República, é o relator do recurso extraordinário de revisão de sentença no âmbito do qual o Supremo Tribunal de Justiça (STJ) está a apreciar a eventual repetição do julgamento de Leonor Cipriano, avançou ao DN o advogado Marcos Aragão Correia.

Souto Moura estava à frente do Ministério Público aquando do desaparecimento de Joana, em Setembro de 2004. Agora, passados cinco anos, volta a ter intervenção no caso. Uma circunstância que a defesa de Leonor Cipriano - que por diversas vezes teceu duras críticas à forma como o caso foi investigado pela Polícia Judiciária - não pretende valorizar.

"Confio no juiz-conselheiro Souto Moura. Já deu provas de não entrar em jogos políticos e é um exemplo de imparcialidade", diz Marcos Aragão Correia, acrescentando que as diligências ordenadas pelo STJ, no âmbito das quais se inclui a inquirição a Leonor Cipriano, ontem realizada no Tribunal de Execução de Penas de Évora, são "importantes" para esclarecer o caso.

A mãe de Joana terá sido ouvida durante mais de duas horas pela juíza Ana Catarina Ferreira, numa diligência a que compareceu sem a presença de defensor. Marcos Aragão Correia disse ao DN não ter participado na diligência para "salvaguardar" Leonor Cipriano da "grave calúnia de que esta poderia estar a ser condicionada pelo seu advogado".

A inquirição foi ordenada pela 5.ª Secção do STJ e terá incluído questões sobre a confissão escrita feita em Janeiro deste ano por Leonor Cipriano, no Estabelecimento Prisional de Odemira, onde se encontra detida, na qual responsabiliza o irmão pela morte de Joana.

Nessa declaração, Leonor diz ter concordado com a venda da menina a um casal que a levaria para o estrangeiro. Mas, segundo a sua versão, a "transacção" correu mal. O dinheiro não apareceu. E João terá acabado por agredir a menina, provocando-lhe a morte. "Depois de uma grande discussão, concordei em não dizer nada. Mais tarde, ele disse-me que tinha enterrado o corpo lá para cima nos montes da Figueira. Tive medo", acrescentou.

A esta confissão seguiu-se uma outra, em Maio, também por escrito, na qual João Cipriano terá confirmado a tentativa de venda da sobrinha. Com base nos dois documentos, Marcos Aragão Correia avançou com um recurso extraordinário.

Leonor e João Cipriano estão a cumprir uma pena de 16 anos e seis meses de prisão pelos crimes de homicídio e ocultação de cadáver, tendo sido condenados em Março de 2006. Durante a audiência remeteram-se ao silêncio. Mas o advogado de defesa diz que isso "em nada prejudica" a nova apreciação que o Supremo está a fazer do processo.

"É admissível a revisão da sentença quando surjam factos novos, que não tenham sido analisados no âmbito do processo, mesmo que, à data, já fossem do conhecimento dos arguidos", sustenta Marcos Aragão Correia, dizendo existirem "novos factos e meios de prova que suscitam graves dúvidas sobre a justiça da condenação da recorrente pelo crime de homicídio da filha, em termos que justificam a sua inocência e absolvição

Caso Joana: Leonor Cipriano novamente ouvida

A mãe da menina voltou ao tribunal de Évora para ser novamente ouvida e decidir-se se vai ou não repetir-se o julgamento

Leonor Cipriano regressou, esta qurta-feira, ao Tribunal de Execução de Penas de Évora, numa diligência solicitada pela 5.ª secção do Supremo Tribunal de Justiça.

A mãe de Joana apresentou-se no tribunal sozinha sem a presença do advogado, Marcos Aragão Correia.

O interesse do tribunal focou-se na declaração por escrito assinada por Leonor, em Janeiro, onde negava qualquer responsabilidade pela morte da filha.

Nessa declaração Leonor Cipriano afirmava que teria sido convencida pelo irmão, João Cipriano, a entregar a filha a um casal estrangeiro a troco de dinheiro.

Esta quarta-feira, a mãe de Joana recordou à juíza o dia de 12 de Setembro de 2004.

A nova versão explica que a menina saiu de casa às 20h00 para se dirigir à pastelaria Célia, localizada na Figueira. Mas Joana não saiu sozinha. O tio, João Cipriano, saiu atrás dela.

O irmão acabou por regressar a casa cerca de uma hora e meia depois, mas já sem a menina. Não teria conseguido entregar a criança ao casal de desconhecidos, já que não tinham o valor do dinheiro combinado, e que se terá descontrolado:

«Disse-me que mandou os gajos embora e então a Joana começou a dizer que ia contar tudo. Seguiu-se uma estalada e depois outra e outra porque a menina protestava cada vez mais. Finalmente descontrolou-se e Joana acabou por morrer», afirmou Leonor.

No seguimento desta declaração o advogado de Leonor interpôs um recurso extraordinário para o supremo Tribunal de Justiça onde solicitou a repetição do julgamento.

O Supremo admitiu o recurso e ordenou várias diligências entre as quais novas inquirições a Leonor e João Cipriano.
