Six doctors have launched a legal action to demand that the inquest into weapons expert David Kelly's death is reopened.

They say there is not enough evidence to prove he committed suicide and are publishing a hard-hitting report which they claim proves the Government scientist did not kill himself as the Hutton Report decided.

Lord Hutton concluded he bled to death as a result of a cut to his wrist and an overdose of painkillers.

But Michael Powers QC, an expert in coroners' law, said the cut would not have caused him to bleed to death, and there was only a normal dose of co-proxamol in his body.

He said that for a coroner to reach a verdict of suicide there must be evidence "beyond reasonable doubt" that they intended to kill themselves.

Dr Powers added: "Suicide cannot be presumed, it has to be proven.

"From the evidence that we have as to the circumstances of his death, in particular the aspect of haemorrhage, we do not believe that there was sufficient evidence to prove beyond reasonable doubt that he killed himself."

He said there was not enough information to determine whether Dr Kelly was murdered or killed himself.

Dr Kelly was found dead at a beauty spot near his Oxfordshire home in 2003 after he was exposed as the source of a story that Tony Blair's Government "sexed-up" its dossier on Saddam Hussein's weapons of mass destruction to justify invading Iraq.

In one final phone conversation, he told a caller he would not be surprised "if my body was found in the woods".

There was a rush to get an answer as to what had happened and the inquest should not have been left to Lord Hutton, who is not a coroner, Dr Powers said.

The other five experts involved are trauma surgeon David Halpin, epidemiologist Andrew Rouse, surgeon Martin Birnstingl, radiologist Stephen Frost, and Chris Burns-Cox who specialises in internal general medicine.

They have instructed solicitors Leigh Day and Co, who are to approach the Attorney General Baroness Scotland to try to get the matter considered by the High Court.

Dr Kelly had some signs of heart disease which was not bad enough to have killed him, and it was never made public how much blood he had actually lost, Dr Powers said.

Although there was very little co-proxamol in his body, three packets of ten were found nearby with just one pill left.

An ulnar artery in Dr Kelly's left wrist had been cut, but this would not have caused him to bleed to death, Dr Powers said.

"Any doctor, any medical student will tell you that if you want to kill yourself by haemorrhage that is not the way to do it. Kelly was not silly," he added.

The inquest was suspended before it could begin by the then Lord Chancellor Lord Falconer, who used the Coroners Act to designate the Hutton Inquiry as "fulfilling the function of an inquest".

It was obviously clear that he was murdered and that he knew he would be. This country is corrupt and I doubt anything will change with a change of government.

There used to be a great video on you tube of an interview with an ex british cabinet member (Michael Meacher) where he practically admits that murder was sanctioned. The video is still there, but the sounds gone all wonkey, and the bits of the video go fuzzy in places. How convinient Dr Kelly Death - Legal move for new inquest 294124

Also some great testimony on the same video by two pathologists at Sheffield university who also claim that the death was not suicide.


It doesnt shock me that a government kill its citizens. If I where in power, I'd probably do the same in the interests of the greater good but Dr Kelly's death upsets me. This guy undoubtably risked his life at times for this country, the work he did was of real importance. He was murdered simply because he became an inconvinience to a bunch of second rate uneducated labour party spin doctors who where failing to conceal the truth.

When you think about it, its rather pathetic that the government was so afraid of the comments from one man. They spend billions a year on intelligence services, they had thousands of people who would have testified that the intelligence proved the presence of weapons of mass destruction, they spend hundreds of milions a year on spin doctors and media manipulation, they must have hundreds of slimy toads who'd stand before the press and argue their case, and yet the comments from one man, sent these scum into a blind panic, and days later a man is dead.

This happens because one man wants to play out his childhood fantasies of taking the country to war.

Does any legal eagle posting on this forum know whether an incoming government can revoke the previous government's D notices, DA notices, or whatever press gags are now called? The ban put on by Hutton... 70 years before any relevant Kelly papers, medical records/opinions etc can be seen, is appalling. Obviously it puts all the information beyond the reach of the Freedom of Information Act.

I think a similar prohibition was put on the papers surrounding the Dunblane case... Again, this was supposedly so as not to hurt the relatives of the children killed... but most people with three digit IQs and a moderate amount of knowledge understand the matter differently.

The hutton enquiry was a white wash and everyone knew it. The Chilcot enquiry is an even bigger waste of time and money and everyone knows it,does anyone really think bliars going to change any of his previous statements ?
The fact that governments/ministers authorise murder to protect their lies has never been better proven than in this case.The question is which 'government' authorised this and who knew about it.It may have been Bush bliar or one of the Iraqi's working on their own or in cohorts.More importantly now is the fact that brown and probably cameron know about it and have a 'pact' of silence.

Maybe its not all over yet ? -----I dont know if this private prosecution is still likely ?

It's the ESTABLISHMENT, they all look after each other !!!

Don't expect any of them to tell the truth. Ask Claire Short, she liked her Limo a bit to much to jump with COOK.

Thanks, Photon for the links to the DA notice site. There was not much on it, but I am glad I read what there was, and it did clear up a few misunderstandings I had. The Grauniad this morning has a short piece about the possibility of challenging the 70 year secrecy ruling and re-opening the inquest. It seems that most medics who have any detailed knowledge of the particulars of Kelly's 'suicide', evaluate it's likelihood of being just that somewhere between very unlikely to impossible.
