Goncalo Amaral, the former lead investigator in the case of Madeleine McCann, is fighting to overturn a temporary injunction on his book, which alleges Madeleine died in the family's holiday apartment and her parents faked her abduction.

The McCanns travelled to Lisbon earlier this year to hear the final legal arguments in the case and renew their appeal to find Madeleine, who disappeared from the resort of Praia da Luz in May 2007.

They said they were fighting the case to make sure people keep searching for their daughter.

"If people believe, unnecessarily, that she's dead without any evidence then we'll never find her," Mr McCann said.

His wife added: "The important thing to remember is that a child is still missing."

The couple also said they wanted the whole investigation into their daughter's disappearance to be reviewed by Portuguese and British police.

Mr Amaral's lawyers have described the case as an attack on freedom of speech and vowed to go to the European courts if he loses.

The former detective is being sued for around £1m by the McCanns in a separate libel case, and the couple have also launched criminal proceedings against a Portuguese TV channel.

TVI broadcast a documentary based on Mr Amaral's book prior to the temporary injunction, but the McCanns' lawyers believe the channel then broke the rules of the injunction by continuing to discuss the allegations against the couple.

The Mccanns, who are from Rothley in Leicestershire, will not be travelling to Portugal to hear the judge's decision.

The right to freedom of speech is recognized as a human right under Article 19 of the Universal Declaration of Human Rights and recognized in international human rights law in the International Covenant on Civil and Political Rights (ICCPR). The ICCPR recognizes the right to freedom of speech as "the right to hold opinions without interference. Everyone shall have the right to freedom of expression".[1][2] Furthermore freedom of speech is recognized in European, inter-American and African regional human rights law.

Portuguese court to rule on whether to suspend injunction against former detective's book claiming Madeleine is dead.

Kate and Gerry McCann will learn today whether the Portuguese former detective Gonçalo Amaral has successfully overturned a ban on his book which claims their daughter Madeleine is dead.

Amaral was the first head of the police investigation into Madeleine's disappearance from Praia da Luz in May 2007, shortly before her fourth birthday. In July 2008 he published a book, Maddie: The Truth of the Lie, which alleges that Madeleine died in her family's holiday flat and that her parents faked her abduction.

A judge granted the McCanns a temporary injunction in September last year halting further sale or publication of the book and a TV documentary Amaral made about the case.

Amaral launched an appeal against the ban at the main civil court in the Portuguese capital, Lisbon, last month, calling a series of witnesses to support his claims. After hearing closing arguments from lawyers last week, the court reserved judgment until today.

Amaral's lawyers argue that the material in the book is contained in the official Portuguese police files for the investigation, many of which were made public when the case was shelved in August 2008. The McCanns say their main motive for challenging the former policeman is the fear that people will stop looking for Madeleine if they think she is dead.

There will be a full trial at a later date on whether the injunction banning the book should be made permanent, said the couple's Portuguese lawyer, Isabel Duarte. Amaral has vowed to go to the European court of human rights if necessary.

The McCanns, both 41, from Rothley, Leicestershire, are due to respond to the court's ruling at a press conference in London tomorrow. They are also seeking €1.2m (£1m) in compensation for defamation in separate civil proceedings against Amaral in Portugal.

Although it is most closely associated with a military battle, the term is used by analogy in fields such as business, politics, law, literature, and sports to describe any similar struggle which is ruinous for the victor. For example, the theologian Reinhold Niebuhr, writing of the need for coercion in the cause of justice, warned that: "Moral reason must learn how to make a coercion its ally without running the risk of a Pyrrhic victory in which the ally exploits and negates the triumph."[4] Further, in Beauharnais v. Just what the bloody hell hold have those two got over everyone and everything. I can't believe that the judge has left the injunction in place. Everything in the book is in the files. He isn't saying anything which isn't available to anyone. Well, as far as my signature goes, I don't think that Sr Amaral will throw in the towel but I am seriously thinking of doing so. I can't honestly see that these two are ever going to have to answer for what they did ( in the least neglecting three very vulnerable children for the sake of a little adult pleasure). They certainly won't be answering for anything else because as Fred has said on another thread, they are a teflon couple. Nothing will ever stick to them. They have had protection from a high level from day one and it continues now. It will always continue because someone somewhere has a dark secret which must never see light of day. Until the whole sorry charade is PROPERLY investigated then the status quo will remain. Maddy is missing. Her "parents" are walking around cocking a snoot at all and sundry. Gerry with his arrogant nose in the air attitude, Kate with her poor little me act. Sorry folks but I think that this one is going to be consigned to the " we know what happened but haven't got a hope in hell of proving it and getting those bastards into court to anwer" bucket.

I hope that the Mccanns and their friends live long lives where they can reflect on what happened in PDL in 2007. I also hope that they never have a moments peace with their knowledge and that it eats away at them as I am sure it will. Maybe the dam will burst but I doubt it. It is all about saving their own sorry careers and backsides.

Sasha, I feel the same. But it is very similar to the OJ Simpson case. I can remember the same feeling when the original verdict was announced. And then the parents of Ron Goldman (one of the two people murdered) mounted a civil case. And won. Simpson never paid them a penny - but look where he is now.

It just crossed my mind a cartoonist from S. Francisco wrote a book with his own theory of the Zodiac case, implying that a certain individual was the Zodiac. Well, to my knowledge, the family never used an injuction to shut this cartoonist up. What this cartoonist did is the same Amaral's did.

I just typed what was said exactly on the Sky News Report Kitti, I thought the same as you.

This despicable pair seem to come up smelling of roses don't they.
This is not the end Mr Amaral will carry on I am sure, he can take this to the Human Right's Court.

Its been a long Road with so many twist's and turn's, but its not over till the fat Lady sing's.

That is what I understand. The book is not banned for good. If it were Amaral could not appeal!

Well without these court cases would a book written by a Portuguese detectives in bookshops on the continent be any more publicity than this. Not sure if it would be. It's still pretty annoying though that the pair have 'won' again.

That is what I understand. The book is not banned for good. If it were Amaral could not appeal!

That is Sky News for you though.
Martin Brunt on just a moment ago, and said there is a long way to go as yet, and mentioned Mr Amaral can take this to the Court of Human Right's.
Brunty also said another Court Case would be coming up later this Year where the McCann's are suing Mr Amaral.

Hi AA , so they ban the book then what,another pops up in its place and another and so on,what are these two going to do spend the rest of their lives going to court for injunctions,this will not shut people up or stop people asking questions and the more they put themselves on public view the more questions will be asked,are they content with spending the rest of their lives under this cloud .Something happened on or around the 3rd of May 2007 something which made a great many people uneasy these people are not going away .A child is still missing and someone knows where she is and this small victory for the McCanns will not stop the questions or remove the doubt.

Mr Amaral was supposed to be sueing the mccanns too...why do the mccanns get president over a portuguese citizen.

Lets hope murat gets some headway and its positive in its outcome...NOW THAT WOULD BE GOOD.
