Two 11-year-old boys have each been given a three-year supervision order for attempting to rape an eight-year-old girl.

They were aged 10 last October when the girl told her mother she had been assaulted in Hayes, west London.
The jury at the Old Bailey found the pair guilty of attempted rape but cleared them of rape.
The defence claimed the boys - one of whom was described as a model pupil by his teacher - were just being naughty or playing a game, but jurors rejected the argument.
Sentencing them, Mr Justice Saunders said: "I do not accept that what happened was a game but I do accept that you did not realise how serious what you were doing was."
He said to impose any sort of custodial sentence would be "counter-productive" and not in the boys' best interests.
The boys had been told in advance they would not be locked up.
When they entered the court they chatted to one another and looked around excitedly.
It may sound from all this that I am forgetting the little girl involved. I do not. Everyone will sympathise with her for what she has gone through.
Mr Justice Saunders
The judge told the boys: "The jury decided that you did something very wrong which if you had been older would have very serious consequences for you."
"Because you are so young, the court is mainly concerned with doing what is best for you with the aim of ensuring that you do not do anything like it again."
He said the case had already caused "immense disruption" to the boys' lives and those of their families, and "great unhappiness".
The judge and barristers dispensed with wigs and gowns, as they had done during the trial, and the boys were allowed to sit with their mothers and solicitors.
The judge said both boys would be ordered to sign the sex offenders' register for two and a half years.
He added: "It may sound from all this that I am forgetting the little girl involved. I do not.
"Everyone will sympathise with her for what she has gone through.
"Not only what happened to her as the victim of these offences, but also to have to give evidence about them.
"I hope that she will be given all the help that she undoubtedly deserves to get over her experiences."

I saw an article earlier that said some lawyers want the criminal age raised, because the boys were only 10 when they committed the offence. I totally disagree.

Personally i think that when kids are in court for cases like this the judges, lawyers etc wear all their robes just so the brats can see just how serious their crimes are and hopefully scare the crap out of them into behaving. Scare them enough as a kid so they wouldn't dream of doing a crime again.
I also think that we should be able to charge kids as adults when it comes to sex crimes and murder.
Saying they may not understand right from wrong may have applied in the 50' and 60's but these day they know the law and know exactly what they can get away with. They commit serious crimes under 10 and know they cannot be prosecuted and by the time they get to 10 they are often hardened criminals going on to commit more serious crimes.
In the states they charge 12 and 13 yr olds as adults and there is a case at the moment where a 13 yr old commited murder.
If we don't act now then these criminals and feral kids will breed more criminals.
The only way to reduce crime is lower the age of criminal responsibilty to 6 as they know right from wrong and ensure that they break the law they will get a long sentence. You commit an adult crime like rape or murder you serve adult length sentences and if that means 50 years jail well tough.

Being found guilty of attempted rape makes their crime less heinous to the 8 year old victim?
The defence claimed the boys - one of whom was described as a model pupil by his teacher - were just being naughty or playing a game, but jurors rejected the argument.
Would the defence have claimed the CRIME as a naughty game if his/her young daughter was a victim of a similar CRIME?

What about the interests of the community who see the power of the law being flouted by those who should enforce it? What message does their sentence send to rapists and potential rapists?

Why?

You should, Mr Justice Saunders, be mainly concerned with what they have done to their victim, that they have done it and got away with it

Why was such consideration given? This is a serious offence against a young child, they should be shown just how serious by havung the full panoply of court procedures used in their trial.

Then they will be allowed to go merrily on their way....

You are not wrong there Mr Justice Saunders. She, her family and the whole community have been short changed by your decision.
"Everyone will sympathise with her for what she has gone through.
"Not only what happened to her as the victim of these offences, but also to have to give evidence about them.
"I hope that she will be given all the help that she undoubtedly deserves to get over her experiences."
I would hope so too, at least the system ought to do something right in supporting the victim and her family.

Is this not the same case where the girl admitted in Court that she was NOT raped because she feared being told off by her mother? To be honest how do we know that the mother has not instilled those memories of what happened into her head? I am not saying the boys were right and yes a sexual assault did happen but if she did lie about them raping her then the charge surely should have been indecent assault and not attempted rape.

But yesterday, in an extraordinary twist, the girl said neither boy had raped her. She did however say one of the boys made her touch his penis as they played in a field.

An eight-year-old girl who told her mother that two 10-year-old boys had sexually assaulted her, yesterday said in court that she had lied about the incident because she had been "naughty" and was worried she would not get any sweets.
The girl, who cannot be named for legal reasons, had earlier alleged that the boys, who are among the youngest ever to be tried for rape in a British court, had pulled her pants down and exposed themselves before raping her.
But yesterday under cross-examination she said that she had voluntarily been playing with the boys, who also cannot be named, and had pulled down her own underwear.
Linda Strudwick, defending one of the boys, asked her: "Did you ever tell your mum it was not you but it was [the boys] who took your knickers down? You didn't want your mum to think you had been naughty?"
The girl, giving evidence from behind a screen, replied: "Yeah."
Chetna Patel, representing the other boy, asked whether he had raped her. The girl replied: "No."
The judge, Mr Justice Saunders, asked what the girl had been worried about and she replied: "No sweets if it [sic] found out I had been naughty."
The prosecution had earlier alleged that the boys took the girl to a secluded spot in Hayes, west London, to assault her last October.
Rosina Cottage, prosecuting, said: "Together they took her to different locations near where they lived in order to find a sufficiently secluded spot to assault her. The events leading to the alleged rapes all took place in and around a block of flats and they ended in a field."
Yesterday, jurors were given a virtual-reality tour of the area where the alleged attacks had taken place.
The girl gave instructions for where the camera should go. Speaking on a screen from an ante-room, she told a police operator to point to a bush, a lift in a block of flats, a stairwell and two bin sheds. At a second shed behind another building she pointed out a gap in the fence, leading to a field.
The girl gave most of her evidence via video link. Throughout the trial, she held her teddy bear, Mr Happy, on her lap. While giving evidence, she was seen clasping her hands together, running her hands through her hair and occasionally yawning. She would often reply that she could not remember the exact details of what had happened.
In a video interview, filmed the day after the alleged incident and played to the court, the girl told police officers: "They pulled my pants down. I didn't want to and then they put me into the lift and then they done it again."
The two boys watched proceedings in the well of the court, sitting between their mothers and solicitors. Neither the barristers nor the judge wore gowns or wigs because of the age of the defendants.
Due to the nature of the trial, several measures were taken to protect the integrity of those involved. After she had finished providing evidence, Mr Justice Saunders thanked the girl, noting that she appeared exhausted: "No one is suggesting you have done anything wrong. I am the judge. I know when people have done something wrong. You have not done anything wrong. Remember that."
The jury heard that when the child was taken to hospital with stomach pains, she did not have any injuries to her genitalia, but had a number of scratches and grazes.
The older boy denies assaulting the girl but, during an interview with police, admitted exposing himself and touching her in a sexual way. The boys, now 11 and 10, deny two charges of rape and two of attempted rape of a child under 13. The trial continues.
