What now
Things do seem to have stalled somewhat. We have heard no reports about the returned books. No reports about the case against Mr Amaral. Nothing about any cases in fact. The odd bit of spin leaking out re the progress of the review. And I don't know what to make of it all. Hopefully, things are progressing behind the scenes.

We Justice seekers tend to be so wrapped up in the here and now that it is easy to forget the wheels grind along slowly without the need to keep us fully informed at all times of every twist and turn!

I think there is a conspiracy to delay the McCann v Amaral Trial until the Review is ended. On the one hand ,if the McCanns win' the "Madeleine died in
5a" theory in the PJ's Final Report will have not been upheld by the Court. On the other hand, if Amaral wins the McCanns will have lost all credibility
for retaining the Fund.
In the meantime, if the Review does find evidence of negligence by the original PJ team, the McCanns will be proved correct in their claim, if the Review does not find any evidence to disprove the Final Report Amaral wins.

I thought perhaps they have been taken from the McCanns but if Amaral was asked that they be held somewhere to avoid the sale of them pending the results of the enquiry. I'm not sure exactly what the first step would be once the deadline had passed: In the general run of things, I suspect they'd get a degree of leeway before the Court actually commenced further action.

Hi mossman, actually it would be the Publisher who owns the books but you have to ask why they waited so long to ask for their return . I think probably
they were put in storage by Duarty the McCanns Lawyer, pending the result of the upcoming Trial.However, there were 7500 books apparently, even at E10 sales value per copy, that's E 7,500 so you have to ask why the Publisher waited so long and had to go to Court to get justice. did he claim
interest on E7500 and legal fees ??? I do wonder at the length of time it takes for the wheels of justice in Portugal to turn, especially with such a high
profile case.

Your'e quite right LOTV, a slip of the comma I guessed E10 because that would have been the lowest price at the time the books were sequestered. What I don't understand, (which is normal for the characters in this case) is why the Publisher did not go to Court earlier. For Duarte/
McCanns so say they were hanging on to them until the outcome of the Trial is known is "Ludicrous". No news yet on whether they have been returned,
you would think Amaral would enjoy the humiliation of the McCanns and Duarte. In fact Amaral has lost out as well.

On another forum, I queried the ownership of the books, mainly because I had read that the ownership of the books belonged to Goncalo Amaral and the publisher. I was told that whoever filed the complaint against Isabel Duarte and the McCanns regarding the return of the 7500, owned the books and the person who filed the complaint was Goncalo Amaral.
In my opinion I would think this is correct, because if the publisher owned the books, surely the publisher would be the one to file the complaint. I feel sure the Supreme Court Judge, who issued the order to Isbel Duarte, to return the books, would not accept Goncalo Amaral's complaint against Isabel Duarte and the McCanns.
At the end of the day, it doesn't matter who owns the books, what matters is if they still haven't been returned, Isabel Duarte and the McCanns don't have any fear of flouting the Court Order. The McCanns are still flying hither and thither, slagging off the Portuguese Judicial system in media interviews and not one interviewer, disputes what they are saying. It's no wonder they appear to think they are above the law, because they are treated as if they are above the law.
Isabel Duarte probably knows everything there is to know about the Portuguese law. She knows the consequences of ignoring a court order, yet she has ignored a court order that was issued to her. I can only presume that she was acting on the instructions of the McCanns, because they were named in the complaint that Goncalo Amaral filed in the court. She must have been confident, that she and the McCanns, would not face prosecution if the books were not returned. Otherwise she would have advised the McCanns, that it would be better to return the books.

I wonder if Goncalo Amaral, has tried to freeze the assets of the McCanns, it seems rather strange if he hasn't.

As far as I know, the Publisher owns the Books. It's like Kate's book, she gets a Royalty after the Advance is paid off and Transworld who paid for the printing, makes a profit from the Sale, pays for all transport to distribute to book Stores etc . I doubt very much that Amaral would be the owner, he could not afford the Printing and all other costs but would be entitled to a percentage of each book sold. I believe the Court ordered the E1.2 million
claimed by the Mccanns to be set aside but with the lifting of the injunction by the Apellate Court there was no reason that the 7,500 could not be
sold the following day.
There is much about all this that puzzles me, why did not the Publisher demand the return of the Books sooner, why did Amaral change Lawyers mid-
stream? why has it taken so long for the trial when the McCanns had no delay when requesting an injunction ?

Hi Panda, I wasn't aware the books could only be sold in certain countries. Where does it say this? As far as Im aware Amaral is now free to sell the book in any country. If he can find a publisher and outlets willing to sell it in the UK, he is legally free to do so.

Thanks for replying Panda, sorry my original post was actually worded quite badly, i was in a rush. When I say Amaral, I mean that "side" as opposed to him personally.
I have a feeling, nothing more, the silence surrounding these books and there whereabouts, at this particular time, could be important. It was all guns blazing a couple of weeks ago, now we hear nothing about them. I am just hopeful that perhaps the books are now being with-held on the request of SY so that they do not go into the open market and cause difficulty for the police if they wish to charge them with anything.
On another note and off topice but my god i walked into my sitting room today where my boys were watching the Liverpool Everton game and what two mugs were staring at me from the tv - the gruesome twosome. I thought I was hallucinating,but no, they they were side by side sitting pretty in Wembley. We cannot even enjoy a match now.

Well they will have the European Championships before the Olympics. Is the book published in Polish I wonder, it would be nice to take in some football whilst advertising the sequel to the book in Poland.
Gosh, they will have a busy summer, hopefully a trip to Portugal on the back of a ticket with a return date of 20 years time will also be part of the Agenda.
