Kate McCann faces former police chief in £1m libel trial over Madeleine's disappearance

Mrs McCann's attendance in court is understood to be against the advice of Scotland Yard detectives who are attempting to launch their own investigation in the Algarve to try to solve the six-year mystery.
The couple are suing disgraced detective Goncalo Amaral for £1 million over allegations he made about the fate of Madeleine, who disappeared from an apartment in Praia da Luz shortly before her fourth birthday in May, 2007.
It is feared that her presence in Portugal will provoke a media circus and further aggravate Portuguese authorities as the Scotland Yard team seek cooperation to carry out their own inquiries on Portuguese soil.
A source said: "Because of the sensitivity of the situation, police don't want the McCanns anywhere near the country because they fear it could turn into a media circus.
"The Met police are worried it will create a bigger platform for Mr Amaral and his supporters to spout more bile and could damage their own inquiries in the country.

Neither Mr nor Mrs McCann from Rothley, Leicestershire, are due to give evidence in the libel trial against Mr Amaral, who headed the initial investigation into their daughter's disappearance which led to the couple being named as suspects.
Instead, Dave Edgar, a private investigator hired by the family to search for Madeleine and Michael Wright, husband of Mrs McCann's cousin Anne-Marie, will tell the hearing how Mr Amaral's "poisonous lies" have nearly destroyed the family.
However, Mrs McCann made a last minute decision to attend the first day of the civil case and is expected to give a statement outside court.
A source close to the couple said yesterday: "She doesn't particularly want to see again the man who has heaped so much extra pain on her family. But her lawyers felt that one of Madeleine's parents, if not both, should be there in person. Kate agreed to go while Gerry is busy working and looking after the twins. She is not expected to be giving evidence but will be sitting in the court room." The McCanns, who are both 45, were finally cleared in July 2008, when the Portuguese police investigation was shelved for lack of evidence.
But the following month, Mr Amaral who was sacked from the investigation and has since left the police force, published a book accusing them of faking their daughter's abduction to cover up her death in the apartment.
In 2010, they won a court battle in Lisbon to ban sales of the book entitled "The truth of the Lie", a ruling that was overturned later that year.
Mr McCann, a heart specialist and Mrs McCann, a former GP, are now seeking damages for themselves and their twins, Sean and Amelie plus further damages for the harm caused to the search for Madeleine, who would now be ten years old.
In a 36-page writ, first lodged in June 2009, they describe Mr Amaral as a self obsessed, manipulative money-grabber and accuse him of libel and breaching their human rights.
In July Scotland Yard announced a full-scale investigation into the girl's disappearance after identifying 38 potential new suspects and said they had requested assistance from Portugal's Policia Judiciaria.
A team of 37 detectives has spent the last two years examining thousands of documents, witness statements and evidence reports as part of a government funded review of the case ordered by Prime Minister David Cameron.

Well I expect Kate McCann thinks she knows better than anyone. After all she was the one who thought it was perfectly safe to leave three under four's alone in a locked or unlocked apartment depending on which version you believe. So I'm sure everything will turn out just fine.

Morning MaryB.....I think Sccotland yard have got a b****y cheek interfering, they had 2 long years to investigate this case. !!!! I don't think the McCanns had a choice, they brought the charges so how can they be questioned by Amaral's Lawyer if they are not there.?? Looking at the Witnesses for the McCanns , none of the other Tapas Group are being called , I find that very odd. Michael Wright spent time in PDL with the McCanns but his testimony would not be worth a lot when you see the photos of the McCanns so traumatised by Amaral's Book and video that they are laughing, giving speeches , busy earning money for the Fund, always willing to face the Media etc.MaryB wrote:Well I expect Kate McCann thinks she knows better than anyone. This is not how a Police source would speak.
Now whilst I agree the Police may not want the McCanns, either or one of them, to be present at the trial, I doubt somehow they would use wording such as those used by this source.
The Police like to listen to both sides in an investigation and often people can trip themselves up, so a true and thorough Police investigation would be keen to hear anything Mr Amaral has to say, just to see if they can dissect it and use it against him.

When you look at the charges LJC how can the McCanns say they have been Libelled and Amaral's book hindered their search???
1. Since Amaral's Book and Video were published there have been numerous sightings around the World
2. The health of the Family suffered , including the twins. .......this would have to be proven by Medical Certificates and with Kate writing two books one could hardly say she was affected.
3. The Book was published in Portugese and maybe other non speaking languages so how can the McCanns claim the family was upset unless they paid for a translation and read the Book to the twins.
4. The Final Report states that one of the possibilities was that Madeleine died in the Apartment , the Report was published for anyone to see.
5. The McCanns employed their own ex Detectives for almost 2 years who found nothing , this after the case was closed . They also sold Holiday Packs to people going on holiday containing Posters to be stuck in convernient places in the Country they were visiting.
It has been said on sky that Madeleine will not be a Witness, she will be sitting in the Courtroom. I really can't understand why the Plaintiffs do not take the stand.

If this is a well rounded SY investigation, all sides have to be listened to and I also feel that Mr Amaral will not be persuaded to say more than he plans or less than he plans just because Kate McCann is glaring across at him from her courtroom seat; Mr Amaral is his own person and will do as he pleases.
Rather I feel its the case that if SY have requested that Kate/Gerry or both do not attend, its simply because there is nothing for them to do there, so why add to your stress? If Kate and Gerry's lawyer thinks they should attend although they are not required to speak, again the question has to be asked, why?
What this source has said, whoever the source is, is probably because the source is afraid of what Kate may say outside Court rather than what Mr Amaral may say and I feel if Mr Amaral brings something new out, some fresh information he has, I just think SY will be all ears.

Still waiting to see by whose standards he is "disgraced". That one has never been adequately explained.

The police work by hearing all the evidence available so l expect they're keeping a very close eye on what is said at the hearing.
The only people who talk about not wanting to create a media circus are the McCanns aren't they with the reconstruction request. Plus they don't want what Mr.Amaral's findings given to a wider audience.
Nah that's the McCanns speak!
Interesting that they are at such pains to not annoy SY, what are they frightened of??

Hi margaret, I think the whole scenario is going to cause chaos , Press from all over the World will be printing this and there will be three seperate days for the process to be analysed ........is Kate going to Court for the publicity this will get her? Is she doing it to show Gerry up? Will this be part of her latest Book? I really can't believe she decided of her own accord to return to Portugal after the last treatment they received outside the Courthouse. Who will sit beside her to give her an immediate translation?
