I'm not sure Amaral should make that comment when he is in the middle of a Libel Suit. The Smiths were interviewed by the Irish Police at the request of the PJ , but no action was taken by them. Also Kennedy interviewed them so his testimony could also be used. Mrs Smith declined to be interviewed by the Guarda, and I don't think Smith's testimony would be acceptable in a Court , his observation that when he saw Gerry boarding a Plane carrying his Son it reminded him that the man in PDL carried his child the same way.'..... hardly conclusive is it .

Martin Smith's statement is in the released files, in the public domain, it's not a secret and it cannot be hushed up. It's available to anyone who Googles for it. Why shouldn't Dr Amaral mention it?

Maybe in the files that were not released. And here's another thing. It was said at the libel trial that some files were not released due to some of the people involved having a history of sexual offences.

Jane Tanner, her companion, Russell O'Brien, Matthew Oldfield and his wife, Rachel – gave contradictory statements”. And the judicial person in charge exemplifies: "”Jane Tanner always said that she went out from the restaurant to see her oldest daughter. Fiona, David and Dianne guaranteed to the PJ that she never left the restaurant before the alarm was given by Kate. This information was corroborated by several workers of the Tapas Bar restaurant”. These witnesses also stated that Gerry McCann did not even go to check on the children, when he went away of the restaurant, and that he only stayed at the apartment of Praia da Luz entrance.

I have been following this case since May, 2007 and it was been widely believed in the early days that Jane Tanner had seen a man on a previous night taking his child back from the creche so she used this idea to give the abduction idea credence and to blame Robert Murat.
Many posters used to think that it was Gerry who was seen by Martin Smith and his family carrying a child as he wanted to give the abduction idea credence too initially but Jane Tanner later came up with her idea and they went along with that.
The idea was to be a premeditated faked abduction by Gerry who was hoping to be seen but not recognised. No one would carry a dead child around PDL so most posters used to predict that Gerry carried either Jane Tanner's daughter or his sedated daughter, Amelie. He then hurried back to the apartment with her and put her in bed hence the delay in phoning the GNR.
I have always believed in the earlier death theory due to the phone records which were studied in depth by a previous poster here so IMO Maddie was already dead and in a freezer somewhere perhaps in empty Apartment J? and later moved to the Renault Scenic - hence the cadaver was found there. Amaral stated that the body had been frozen.
There is suspicion that a substitute Maddie lookalike (hence the discrepancy in photos) also called Madalene (but spelled differently) was signed into the creche all week so Maddie never went there. It is predicted that Gerry forged her father's signature so it was all planned in advance. This has all been reported to the PJ since and now SY are looking into the phone records.

The unnamed lawyer, who claimed to represent one of the Tapas Nine, told the respected Spanish newspaper El Mundo: "My client feels obliged to keep silent about what he can do to help the investigation, and not because of the Portuguese secrecy laws.
"It's not that he is scared of the McCanns, but the economic and political lobby surrounding the couple is truly frightening to anybody.
"What my client wants is to reveal the whole truth, but he does not mean to accuse or blame anyone, as that is the job of the police.
"The only thing he wants is to help the police discover the truth about what happened before, during and after that dinner on May 3."

- If the the e-fit is based on the Irish family's testimony that, in the night of the facts, saw a man carrying a child walking towards the beach, that e-fit will have to be in someway similar to Gerry McCann, since it was that person [Martin Smith] that has identified him with a high degree of probability. Why was this published only now is something you will have to ask Scotland Yard. As to the "another suspect", no suspect was detained. It was someone who "bragged" about having seen Madeleine and it's alleged that he had paedophile material in his computer. Thus, his detention is not a direct result of any investigation related to the disappearance of the child.
Why was that e-fit only made now and which criteria are behind that arrest? Do you believe that it has any veracity and is it important for the investigation?
- I believe I have already answered partially to your question. If we are talking about the Irish family's testimony that I have referred to, then it has an enormous relevance to the investigation. We only hope that their initial statements aren't misrepresented and "rewritten".
BBC made a programme on the reconstitution of the events related to Maddie disappearance. How do you see the fact that the McCann couple and their friends have refused to do a reconstitution at the time of the [PJ] investigation?
- It's not a reconstitution. Or rather, it is not a reconstitution as foreseen in our Code of Criminal Procedure, which was rendered impossible due to the unavailability of the participants (suspects and friends). It should be recalled what the prosecutor of the Republic stated at the time of the archival of the process: with the non-participation in the reconstitution, the couple lost the possibility to prove their innocence. In fact that is what the reconstitution offers, the opportunity to enlighten and clarify any doubts, and it should be done by the participants, while alive.
In the investigation that you coordinated, were there suspects and identikits?
- The investigation had had three suspects. Some identikits were made.
Did you, as coordinator of the investigation, had at your disposal all the necessary means?
- The only problem that we had was lack of time. As you know, I was removed from the investigation after six months. Therefore, we lacked time.
In this type of investigation, what is the importance of the time factor?
- It is crucial. It's necessary to act quickly and in a timely manner. Initiate the investigation immediately and then have time to investigate all the leads and answer to all questions. That was what I didn't have.
