148 to 153—External diligence related to Flack sighting with pictures

In the context of following up this lead [PAGES 145-147], under the guise of this investigation, at 3pm, we made contact with various people living in the area surrounding the place where this lead starts, to check if the witness is mistaken or if the details come to agree with what he says in the context of Madeleine McCann's disappearance.

The object of this further action is the possible collection of new details which could help to clarify evidence gathered from the witness statement of a British citizen on holiday about 300 metres from the place from which the small child disappeared (more specifically Rua da Ramalhete, Lote 1, Apartment 7, Praia da Luz), who identified himself as Derek F., from Ilford, Essex, UK, [DOB and passport details given].

That individual reported a suspicious movement close to that area by an unknown male which, he is convinced, could be related to the matter at hand because it occurred so close to the location of that event and at a time very shortly before it.

In order to clarify this situation an interview has been booked for 6 May at 10h30 at the Policia Judiciaria station in Portimao.

It was possible to determine that the vehicle was rented on April 28th at Faro airport by a Polish citizen, named W.K., staying at Solimar in Burgau where he reserved the accommodation via the internet. We now attach a copy of the reservation email. The Polish citizen paid for the reservation with credit card no. 5185... . .... .... ... valid until May 2008.

The contract was drawn up by Nelson M., an employee of the agency. A photocopy of the hire agreement is attached. The vehicle was returned to the hire company on May 5th 2007 at Faro airport and has already been washed and hired out again according toinformation given to us by Luis F., an agency employee. Currently, the vehicle is on hire to Clere E. at Parc da Floresta no...in Budens, Vila do Bispo.

We have carried out investigations to find out where W.K. was staying. He was staying in apartment no.... Solimar building, Ficticia in Budens. That apartment is managed by the company ATB, situated on the Main Street, Marretas building, Burgau, Vila do Bispo, whose director, the person named Nuno F., we have contacted.

That apartment belongs to Peter and Margaret O., who live in Windsor Grove, Cardiff, Wales. Photocopies of documents showing complete identification for Peter and Margaret O. are attached as well as a copy of the rental documents. It is to be noted that after W.K.'s departure, theapartment has had no other lettings and has not been cleaned, and we have requested that it remain that way. In the context of the investigation into the disappearance of the little British girl, Madeleine McCann, in Praia da Luz, during the night of May 3rd 2007, it is of vital concern for theinvestigation that the relevant authorities make enquiries about the citizens of Polish nationality, of whom the known details are, W.K., holder of Polish driving licence no. 6307...and Anetta K., partner of W.K., to find out if they have criminal records. They arrived at Faro airport on April 28th 2007 on flight Al32744 from Berlin and they left Faro, today, on Air Berlin flight AB2745. We also request information about the final destination of these two passengers.

The reason for the request is that those people were observed in Sagres having an unusual interest in a child very similar physically to the missing girl. They had stayed in anapartment in Burgau, a few kilometres away from the place of the disappearance. W.K. holds credit card number 5185 .... .... ....

192 to 195—External diligence carried out at the Beach Bar in Burgau with CCTV images of Polish couple

In order to determine the comings and goings of the couple of Polish nationality, who spent their holiday in Burgau, we approached several business establishments and on the basis of the description which we have of the couple, the owner of the "Beach Bar" advised us that it could be two of his clients. He seemed to recall that the couple had lunch and dinner two or three times, without remembering the exact days, but it would have been at the beginning of the week. He knows that they are Polish because they spoke about football on the day of the Liverpool/Chelsea match, saying that Liverpool's goalkeeper was Polish. The match in question took place on May 1st 2007. They also discussed Portuguese and Brazilian classical music.

The couple know several performers from those countries. They asked the owner of the bar where they could buy music of this genre. The owner directed them to the FNAC shop at the Algarve shopping centre or to the Chiado commercial centre. They said they would probably go to Lisbon the same day. To the restaurateur, the couple seemed quite atypical of holiday-makers to that place. They paid in cash, the lady was often irritated and they dressed more formally than would expect for a summer holiday at a beach. The owner, however, did not perceive any abnormal behaviour from the couple.

The investigation determines that the couple effectively went to FNAC at the Chiado centre on May 2nd 2007 where they bought two comedy musicals CDs, paid for with credit card no. ... ... ... ..., the same one used to pay the Luzcar rent-a-car company for the hire of the vehicle, registration...AV-67. We seized the surveillance video and we attach photos from the FNAC surveillance system in which we can see the Polish couple in question.

According to the register it was he who was on duty during the hiring of the vehicle...AV - 67, a grey 2006 Renault Clio. He delivered the vehicle which, meanwhile, has been returned today at 6.45am as the register states. At that time of the morning no employee will have taken delivery of the car, but it was driven into a parking garage the doors to which only operate for cars registered with 'Luzcar', or other people who are registered with the garage.
He does not remember the client who hired this vehicle because he delivers 30 vehicles a day, but he states that the register contains all the useful information.

* The delivery place.
* Date and time.
* Client's name.
* Exact home address.
* Temporary address in Portugal.
* Nationality.
* Driving license.
* Credit card number.
* Private telephone number.

He does not remember anything else. After reading, he goes on and signs.

Following up information already filed with respect to "The Ocean Club" and Mr Lance. P whose parents occupy apartment 7 of Block 2 (Garden), who spoke of having seen an individual several times in tha area and described his physical appearance.
He confirmed several times that the man was thin, brown skinned, about 35 years old, about 1,70m tall, with dark short hair. While not having seen the clothing clearly, the man was not a "ragamuffin". He last saw the man about two weeks ago.
In Praia da Luz, the man was always seen near the pharmacy in Rua Helena do Nascimento Baptista, but he saw him at least twice and, from memory, between 11h00 and 12h00 on the main access road into Praia da Luz which leads to Rua Direita.
The man was always seen to be alone, and the witness ddoes not know if he was Portuguese or a foreigner. To him, the man's behaviour was always strange although he could not be specific as to why he felt that.
Trying to find the man officers walked the streets of the areas described by the witness, without success.
Mr. Lance P. drove to the DIC Portimao where he made a formal statement and helped create the "e-fit" no 19/2007, attached.

213 to 217—Messages between PJ and Interpol Lisbon regarding Polish couple

[THIS IS A SUMMARY OF THE KEY POINTS FROM INTERPOL COMMUNICATIONS]

From IP Germany:
1-Information was sent to Warsaw for them to trace and interview the Polish couple whose personal and travel details were communicated.

2-Information collected by the German authorities from Air Berlin indicated that Poles used this connection route because there were no direct flights to/from Portugal/Faro and no other carriers offered low prices. Flight manifests could not be obtained from the airline after-hours and the documents obtained were incomplete, but of the 82 reservations (either through Internet or direct with Air Berlin), data for 30 other people could be obtained from other travel agents. Air Berlin documents showed no suspicious reservations pertaining to children.

Using the "PAX-LIST" (passenger list), persons in seats around the KROKOWSKI couple were shown pictures of Madeleine and all stated that that couple was not accompanied by any child.

From IP Warsaw:
- At 07h10 this morning (6 May) the couple were interviewed in their home apartment, which was searched and the missing child was not found. After arriving in Berlin they left by train at 21h22 arriving home this morning at 06h45.

We went to the area where we attempted to locate the Millenium Restaurant, to verify it, that the same belonged to the tourist resort Ocean Club of Praia da Luz. In that place, we verified that to access it it is necessary to pass through the reception where they demanded our identification. The head of the restaurant, Luis Barros, contactable on mobile xxx, clarified that the group of whom the missing child and her parents were part, comprising eight adults and nine children, ate in that restaurant on the day they arrived, namely 28.04.2007, because the other restaurants of the resort were closed. They all ate as a group, parents and children. He referred also that that group came with a half-board scheme, i.e. the right to breakfast and to dinner. In relation to dinner they only ate there on that day, although they took breakfast every day in that place accompanied by the children. He pointed out that, while the space is open to the general public for dinner, it is used almost exclusively by clients of the "resort". Having been shown the photo of the Polish couple, he did not recognise them. We also contacted the receptionist, Monica Marques, mobile number xxx, who told us that besides herself her colleague Elisa, mobile number xxx, and intermittently Luisa Coutinho, mobile number xxx, worked there. Having been shown the photograph of the Polish individuals, Monica Marques said that she had never seen those people.

Today, following on work previously performed, we went to the Dolphin restaurant, Rua da Calheta, 14-A, in Praia da Luz, where we contacted one of the owners, A.J.V.Marais, South African, to whom was shown the "e-fit" constructed from information obtained from a witness in this case who recalled seeing someone similar telephoning from the public phone booth in front of the restaurant.

As the residence of the owner was above the restaurant, the "e-fit" was also shown to his wife, L.J.Marais, who immediately said she recognised it as corresponding to an individual she saw 3/4 times telephoning in the booth and once walking in the street near the restaurant.

Asked, she said he was always dressed in white trousers, a little dirty, and a dark winter coat. He was always on foot and alone when she saw him.

Asked further, she said she saw him during the past week, not recalling on which days, but guarantees not having seen him since the date of the events at hand [under investigation].

They were given phone numbers with which to contact this Police force should they see the man again.

The number in the phone booth was 282-789-210.

In the surrounding area, specifically Rua Helena do Nascimento Batista, another booth was located, it having the number 282 789 111.

There being nothing more of interest for the case this work ended.

Processo Vol II pages 448 to 451—Five External diligences carried out on 2007.05.07

Officers: M.Pinho, C,Gomes and J.Carvalho, Inspectors

To confirm or otherwise information given to this Police force regarding the whereabouts of the girl Madeleine Beth McCann or the suspects, the following work was carried out as ordered:

1) Júlio Manuel Madeira Campos de Carvalho
--- In Rua 25 de Abril, ..., Praia da Luz, Mr. J.M.M.C de Carvalho was approached, it having been said that he could have approached the employees of the care centre in the Ocean Club, that that approach could have been done in the street and when he passed them in a white Renault Express.
--- Informally, he explained not recalling having meddled [interfered] with the care workers, but admitted that he could have made "a pass at [chatted up] English girls".
--- On the night of the events he was at home with his brother and nephew. At 22h00, through his girlfriend, he learned of the disappearance of the young girl and joined the general people in the searches.
--- He had nothing else of interest to the investigation.

2) Visibility of 5A
--- Verifying the field of view [line of sight] of the Ocean Club from the Luz Tur building next to the Baptista supermarket, I found the visibility of the girl's apartment to be much reduced [obscured] because of the large and medium-sized palm trees in the resort's swimming pool area.
--- Walking all the building floors I verified that the visibility of the ground-floor is zero [null], by which I came to know who lived on the fifth through the ninth floors [of Luz Tur],information that, informally, I collected through the building assistant [supervisor] Mrs. M.M do N.A.Silva, of 501-X, and, I determined that the apartments and people with clear view were only:
a) Apartment 808-AP, a couple of about 60 years. Irish Republic nationals, who live there. They frequently spend time in Portugal, some time only the lady. The apartment has been occupied for about six weeks by the lady on her own.
b) Apartment 606-AF, Portuguese couple of about 27 years old, both teachers. He teaches at Bispo School and she lectures in the north of the country. They have leved inthe building for 4 years.
c) Apartment 504-AR, Portuguese couple with two children; a boy of 3 and a girl of 9 years. The lady, about 35 years old, works as a cleaner at Hotel Bela Vista in Praiada luz. The man has been working in Spain for 2 years and comes home occasionally [once in a while]. They have lived in the building for 9 years.
d) Of the remaining apartments they are not occupied and were not occupied on the night of the events, according to the Luz residents who were stopped [questioned].
--- It is therefore concluded that from that building, if by some chance the movements of the parents and child were observed and noted ["cased"], it was not done from that building.

3) Richard Andrew Gorril
--- A phone message told that in house no. 4 on Rua da Lajes lives an Englishman, with a short beard, 50 or more years old, single and with limited social contact. The person was approached and invited to identify himself. He was identified, through his passport ..., as being R.A.Gorril, born in 1945 in Peterborough, England.
--- He invited us into his home and walked us through it, advancing that in England, in similar cases, the people, voluntarily, placed themselves totally as the disposal of the authorities. He explained that he enjoyed to live alone. He reads, watches television and communicates with friends by mail [e-mail]. He has been at home during recent days except for Saturday, 5 May, when he went to the Lagos market where he bought fish, fruit and vegetables.
--- As for the events he knows nothing of interest to the investigation.

4) Svitlana Babyena
--- Information received told that the lady owner of the cafe "Ala do Castelo" situated next to the Lagos Hospital saw a person, on Saturday morning, 5 May, pulling a young girl who looked like Madeleine Beth McCann.
--- The lady was approached and identified herself as being S.Babayena, a foreign resident since 2006, then, informally, she explained that on the Saturday or Sunday past, at 09h00, next to the "Lago da Igreja" [church square] adjacent to the Lagos Hospital, she saw a man of about 35 years old, about 180cm tall, short blonde hair, thin, who pulled by the hand a young girls who looked like the missing girl. The girl appeared calm and did not seem to be 'contrary' [put out; perturbed]. She does not recall what the child was wearing. She did not see where they went and had never seen [before] those people who seemed to her to have been foreigners.
--- Shown the "e-fits" from the file she stated that the man was very different.

5) Derek Flack shown photos/images
--- The witness Derek F., who had told us he saw a person next to the place of the events - apparently watching, was approached.
--- He was shown the pictures from the file. He identified no-one, lamenting the quality of the images.
--- It is the conviction of the undersigned that the witness craved [had a strong desire] to identify someone in those facial images.

The work done provided no valid result with respect to the whereabouts of the girl.

Regarding possible suspects also none were indicated.

Service Information document dated 11 May 2007 from Inspector Pedro Varanda relating to an informal conversation with Robert Murat

As you will know, Sir, on this day at 11h30, there appeared before the undersigned and (lady) Inspector Patrícia Duarte, a British citizen called Diane Webster, holder of UK passport XXXXXXX, in order to hear her witness statement.

In the course of an informal approach that preceeded that work, it was determined that she was not conversant in Portuguese, written or spoken, and the service of an English-speaking interpreter was therefore called for.

In this function appeared a British citizen, Robert J.Q.E. Murat (duly identified in the files from previous work), official resident of Casa Liliana, Rua Ramalhete, Praia da Luz, Lagos.

The work [the DW interview] being concluded, and during an informal conversation that the undersigned began with that interpreter (as would be characteristic in this type of situation), Robert Murat displayed an unusual curiosity about the investigation that was developing around the disappearance of the minor Madeleine McCann that occurred on 3 May 2007.

As an example, it will be proper to point out that he has insistently and repeatedly questioned me about the identity of possible suspects, about the strategy outlined by the lead coordinator of the investigation and the work that might possibly have been considered for the coming days.

Before [faced with] such an attitude, that was so unusual and absolutely inappropriate that I immediately became highly suspicious, I always countered [ducked the questions], insistently requesting that person to be aware of the contractual duties pertaining to the role which he has assumed in this investigation, pointing out that it was presently the inquiry phase, and, naturally, covered by judicial secrecy.

It behoves me further to state that that suspicion became even more consolidated, following the fact that I became aware that Robert Murat would covertly attempt to catch glimpses of various procedural pieces [items being prepared for the case file] that make up the present inquiry, to the point that I followed my own consultation [hunch], in order to conduct the Diane Webster interview.

Finally, and in the sense of reiterating the suspicious attitude shown by Robert Murat, I venture still to state that, beyond having manifested an enormous knowledge about the dynamics inherent in the functioning of the "Ocean Club Garden" (in which the events under investigation had taken place) and of the routines followed by the McCann family and their companions during their respective stays in in Praia da Luz, he has tried persistently to influence the conduct of the present investigation, suggesting various analyses the agreement with which [i.e. had they agreed to follow those suggested lines of inquiry] could be intended to impute the consummation of the present illegal act [the missing child] to foreign third parties [i.e. to put the blame on, or to attribute the blame to, outside foreigners].

The above being exposed [laid bare] - and without intending to place any competence on the above individual, nor the slightest imputation that that [my suspicions] was what he wanted to be [actually intended to do] - I have to bring the above incidents to your attention, in order for you to determine what may be appropriate.

Date: 2007/05/04 Location: Praia da Luz
Entity that determined the activity: superiorly determined
Funcionario [employee] that executed it: Miguel P*** and Duarte F****, Inspector

Description and outcome of the investigation:
-------- On this date, we went to the Tapas restaurant, owned by the Ocean Club, located in Praia da Luz (Lagos), where we spoke with various employees of the restaurant, who were on duty there last night. ----------
-------- The subject of conversation was the disappearance of little Madeline MCCAN, especially the behavior of the elements of the group that dined at that restaurant yesterday, which was partly made up of the parents of the missing child, as well as if [whether or not] they had seen an individual suspect, with a blonde "rastas" [hairstyle] in camouflage pants. ----------

-------- JERONIMO TOMAS RODRIGUES SALCEDAS (Phone No "91 768 ####) - bartender:
- He saw the missing Madelaine, for the last time, yesterday at 16.45h next to the restaurant;
- He did not notice if from the group of British citizens (in number 8 or 9) that yesterday dined in restaurant (which was partly made up of the parents of the missing [child]), someone left [absented themself] during such dinner;
- He saw a walkie talkie on top of the table of the group, [like] those that are used to monitor noises of children, from a distance;
- He did not see a person of blonde "rastas", while he was working last night. ----------

------- SVETLANA STARIKOVA VITORINO (Russian citizen, with the telephone No "96635 ####) - kitchen assistant:
- Said that, yesterday, one individual, purportedly the father of the missing, left the dinner table where a group of friends (in number 8 or 9), for about 30 minutes. After having returned, a woman whom she believed to be his wife, also left the table, there having passed a few moments, all the guests left the table in question, except one elderly lady, who told her [Svetlana's] colleagues that that child had disappeared.
- During the time that she was working yesterday (between 14:30 and 23:00) she did not see any individual with blonde "rastas".

-------- MIGUEL SALCEDAS COELHO (BI No 1426####, telephone 91920####) - cook
- He did not know the missing or her parents, he knew only that they were part of a group of British citizens who usually dined there;
- As he works in the kitchen, rarely did he go to the tables, so he saw nothing;
- He did not see any person with blonde "rastas", while he was working (14.30 and 23.00) ----------

--------- JOAQUIM JOSE MOREIRA BATISTA (residing at Rua Ilha Terceira, no. 15, Lagos, Telephone No 91 277 ####) - table employee [waiter].
- Of the group of 8/9 British citizens who dined at the restaurant last night, as usual, of which the parents of missing were part (he didn't know them) he noticed that two individuals left the table, of the male gender.
- The first to leave was about 40/45 years old (tall, skinny, white complexion, with large [a full head of] hair of color gray) and the period of his absence was about 15 minutes, being that they had to [re-]heat his food, which had cooled;
- The second to leave (about 40/45 years of age, having the physical characteristics of the first, but having less bulky hair) did so for about 30 minutes, and that shortly after he returned, all left the table, except for an elderly person, who told him that a child had disappeared, the daughter of a member of the group, due to which he thought that the second person to leave could have been the father of the child;
- Of the times in which this group had dined in that bar it is [was] often [for] someone from the group to go to check at the apartments the state of the children (their offspring) who were sleeping there.
- He did not see any person with blonde "rastas", while he was working (16h00 and 00.00). ----------

-------- JOELSON FABIO SOARES SANTOS LÚCIO (telephone No 96948#### - was contacted in another restaurant of the [Mark Warner] group, situated in the same locality) - pantry boy
- As he works in the pantry, he never goes to the area where are the tables, so he saw nothing;
- He didn't know the missing or her parents;
- He did not see any individual with blonde "Rastas", in the period in which he remained in service (15:30 and 23:30. ----------

--------- RICARDO ALEXANDRE DA LUZ OLIVEIRA (as he was on his day off, he was contacted by telephone No 91 397####) - table employee.
- Of the group of 8/9 British citizens who dined at that restaurant yesterday, like they usually did, which was partly made up of the parents of the missing (he did not know them) he noticed that absent from the table, for about 15 minutes, [was] a man (tall, little more than thirty years of age, normal physical stature, white complexion and hair color light brown);
- It was usual [for] someone of that group, to leave to go to the apartments to check the children (children of the group members) who slept there;
- At the table, he always noticed [saw] the existence [presence] of an intercom;
- He did not see any person with blonde "rastas", while he was working (16h000 and 00h30).----------

------- As for the kitchen employee, MARIA MANUELA ANTONIO JOSE, given that she was not in service yesterday [neither] during the dinner [nor] when the disappearance of the child occurred, she was not interviewed. ---------

------ In the main reception (open 24h) of the Ocean Club, the signatory [undersigned] was able to observe a person with long hair, curly, blonde in color, with camouflage shorts and green sweat-shirt, which fit the description of the suspect of the "Rastas", it being that I questioned the receptionist about him, who said that this individual and his wife are guests in the hotel and he has been tireless, since yesterday, in search of the missing girl. Attached are photocopies of their passports as well as the hotel registration form. ----------
