DNA tests confirm remains are Caylee Anthony

ORLANDO, Fla. -- Pieces of a tiny skeleton found in swampy woods can tell authorities one thing: Missing three-year-old Caylee Anthony was killed. What they can't help explain, authorities said Friday, is how or when she died.


Forensics teams join police to search the area where a utility worker found a child's skeletal remains

Authorities said at a news conference that DNA tests conducted on remains found by a utility worker last week less than a kilometre from where the child lived matched Caylee's genetic profile. But the only clue they give about her death is that her bones didn't suffer trauma, said Orange County medical examiner Dr. Jan Garavaglia.

"Bottom line is, folks, no child should have to go through this," said Orange County Sheriff Kevin Beary.

The discovery of the child's remains came after months of searches, twists and turns in the investigation. Caylee's mother, Casey Anthony, 22, was indicted in October on first-degree murder and other charges, even though no body was found. She has insisted that she left the girl with a babysitter in June, but she didn't report her missing until July.

A search team said they did not check the wooded area sooner because it was submerged in water from the summer's heavy rains. But the utility worker who made the tip, Roy Kronk, said he had contacted the Orange County Sheriff's office in August to report that he had seen "something suspicious, a bag, in the same area."

The sheriff's office said he first called on Aug. 11 to report the bag. A deputy responded but didn't find anything and was unable to locate him. Kronk called a crime hotline the following day and the information was passed on to the sheriff's office criminal investigation division. On Aug. 13, he called the sheriff's office a third time. He met a deputy, but authorities cleared the area as a place of interest in the search a short time later.

Beary said his department was investigating its response.

"If we missed a window of opportunity, we don't know," he said. "I'm not throwing anybody under the bus because we don't know."

It took authorities several days to analyze the remains since being found last Thursday, and some are still undergoing tests. Some of the bones were as small as a pebble and had been scattered, and the fragments were hard to find by excavators who searched on their hands and knees, authorities said.

Garavaglia -- the star of cable TV's "Dr G: Medical Examiner -- said authorities concluded Caylee was killed through DNA tests and "circumstantial evidence." But she said she was certain this a homicide and not an accidental death -- and didn't expect further testing to reveal a specific cause.

"I wouldn't have issued the report if I wasn't sure," she said.

A jail chaplain told the girl's mother that the remains were her daughter at the Orange County jail just before the news conference began. Her lawyer, Jose Baez, was with her at the jail shortly after.



"This is her private moment," Baez said. "This is her life she's trying to battle through right now."

The case captivated the Orlando community where the little girl's family lived, and Caylee has been a staple on national news as her grandparents pleaded for tips, promising that the girl was still alive.

Volunteers and investigators mounted several search through the summer and fall, looking at wooded areas near Orlando International Airport, local parks and even the grounds where the bones were found.

Caylee's grandmother first called authorities in July to say she hadn't seen the girl, whose third birthday passed shortly after her disappearance, for a month. Her daughter's car smelled like death, she said.

Police immediately interviewed Anthony and soon said everything she told them about her daughter's whereabouts was false. The babysitter was nonexistent and the apartment where Anthony said she had last seen Caylee had been empty for months. Anthony also lied about where she worked, they said.

Other troubling details emerged: Photos surfaced of Anthony partying after her daughter went missing. Friends said she was a habitual liar, but also a good mother.




Last month, the Orange County State Attorney turned over almost 800 pages of documents showing someone used the Anthonys' home computer to do Internet searches for terms like "neck breaking" and "household weapons."

In mid-March, someone searched Google and Wikipedia for peroxide, shovels, acetone, alcohol and chloroform. Traces of chloroform, which is used to induce unconsciousness and a component of human decomposition, were found in the trunk of Casey Anthony's car during forensic testing, the documents say.

If convicted of first-degree murder, Anthony faces an automatic life sentence as prosecutors have announced they will not seek the death penalty. Her trial is scheduled for March.

Without a definite cause of death, a defence lawyer can suggest to a jury that labelling Caylee's death a homicide is only speculation, said A. Russell Smith, a Jacksonville lawyer and immediate past president of the Florida Association of Criminal Defense Lawyers.

"Juries are particularly conscientious in homicide cases because the penalties are so severe," Smith said. "So, to the extent that there are gaps in critical evidence, it makes the prosecutor's job much more difficult."

ORANGE COUNTY, Fla. (WOFL FOX 35, Orlando) -- Missing toddler Caylee Anthony’s remains have been found and identified and since the discovery the girl's grandparents have kept a low profile.


Their attorney, Brad Conway, has been acting as their mouth piece. He has also been helping plan a proper burial for the toddler, something he says has been tough.

"My job is not to trust anybody,” Conway said. “And we will make sure they're able to grieve in private. We want to make sure that people are there to bury this child with dignity and respect and not profit on it in any way," he added.

The plan is still to have both a public and private memorial. The private memorial will be very small - only family and close friends. The public memorial will be open to everyone. But, there will be some rules such as no back packs, no cell phones and no cameras.

Contrary to what been being reported, Conway said the Anthony's would like their daughter Casey, who is currently being held in the Orange County Jail charged with Caylee’s death, to be there for the private memorial.

"They want their family together,” Conway said. “They want their family together for this. I don't know if that's possible."

As for the remaining money left in the Help Find Caylee fund, Conway said there's not much left, maybe a few thousand dollars. The family will donate it to a group whose mission is to help find mission children.

"We want to make sure that money is given to an organization that's well documented,” Conway said. “And the majority of their money goes to finding missing children as opposed to overhead,” he added.

The Anthony's are hoping give Caylee a proper send off after her mother's defense team is done with the work they need to do on the remains.

Play based on Casey Anthony case opens in Australia

'Tot Mom' is directed by Oscar-winner Soderbergh

A play based on the arrest and court case involving Casey Anthony has opened in an Australian theater.

The production of Tot Mom, directed by Steven Soderbergh, opened Friday and will play until Feb. 7, according to the Sydney Theatre Company's Web site.

The play uses excerpts from transcripts of the Nancy Grace show on HLN, as well as court documents, audio segments and police reports to tell the story of the June 2008 disappearance of 2-year-old Caylee Marie Anthony.

The name of the play comes from Grace, who has often described Casey Anthony on her show as the "tot mom."

Casey Anthony, of Orange County, has been charged with first-degree murder in the girl's death and could face execution if convicted.

Reviews describe the play, which is the final production of the theater company's main stage season, as "chilling." Tickets are $30 to $75.

Actress Essie Davis, who was in Matrix Revolutions, portrays Grace.

Soderbergh is the Oscar-winning director of Erin Brockovich and Ocean's Eleven. He is donating his fees from the play to Alexandria, Va.-based National Center for Missing & Exploited Children.

Academy Award-winner Cate Blanchett and her husband, Andrew Upton, are the artistic directors of the nonprofit Sydney Theatre Company.

A judge ruled today that he will not block the State Attorney's Office from seeking the death penalty against the Orlando woman accused of killing her 2-year-old daughter in 2008.

Orange Circuit Judge Stan Strickland denied a motion by Anthony's defense team that asked the judge stop death penalty procedures against her.

Anthony's attorneys argued that the state's decision to seek the death penalty violated her constitutional rights. Strickland ruled that the state may continue and that the issue of whether Anthony should face the death penalty is an issue for a jury.

"While the quantum of evidence sufficient to seek the death penalty will virtually always be an issue, that matter is generally best left for the jury," Strickland wrote in a two-page ruling.

The denial is the latest of many by the judge in the case. Earlier this week, Strickland denied defense motions that the Orange County Jail stop videotaping Casey Anthony in jail. He also denied a motion to dismiss charges of check fraud.

Anthony, 23, is charged with first-degree murder in the case.

Her two-year-old daughter, Caylee Marie Anthony, disappeared in June of 2008. Her remains were found on Dec. 11, 2008 in woods less than a mile from her family's home in east Orange County.

Casey Anthony was in court yesterday for a hearing regarding the death
penalty motion. Here defense tried in vain to have the death penalty
removed from the case. Not only did the defense file the motion which
some felt was frivolous, but they also included a surprise witness to
testify on the defense’s behalf. The prosecution had not been aware
that this witness would testify.

The defense’s surprise witness was University of New Mexico Law School
Professor Elizabeth Rapaport. Though the prosecution objected to the
witness, Judge Perry overruled and allowed the testimony to continue.
Professor Rapaport discussed the correlation between gender and the
death penalty.

Judge Perry was very lenient with the defense and overruled several
objections from the prosecution. He listened as Professor Rapaport
detailed how the public views mothers who stray from traditional roles
as mothers. Women who don’t live up to society’s standards or gender
roles as women have a harder time during capital punishment trials.

The defense hoped the judge would see that the death penalty was
sexist or added to the case based upon Casey Anthony’s gender and the
way the public had viewed her after seeing numerous photos of her
partying after her daughter Caylee Anthony had disappeared.
The prosecution disagreed with the defense and so did Judge Perry.
The prosecution said that the idea that the death penalty had been added
to Casey’s case solely upon her gender was absurd.

Judge Perry stated, “The fact that the defense has not met their
burden in this case, the motion to preclude the death penalty for the
impermissible gender bias, it will be denied.”

And Casey was thinking of Caylee's constitutional civil rights when she did whatever she did to her little daughter? I say bring on the death penalty!

Missing girl's mom charged with child neglect and lying to investigators. Did the mother kill her daughter?

Casey Anthony, the mother of a missing 2-year-old Florida girl, was charged Tuesday with child neglect and lying to investigators. Her daughter was last seen in mid-June, and authorities said they'd found evidence of human decomposition in Anthony's yard and car.
Sheriff's deputies said Anthony's car smelled of decomposition, and a cadaver-trained German shepherd noted a smell of human remains in the car and her yard. They said they found a stain, dirt and what seemed to be Caylee's hair in Anthony's trunk. A search of the yard turned up no body.

"The risk of her flight if she is released on some low bond increases exponentially, especially now that she's heard this additional evidence and that she is their person of interest," said assistant st[url][/url]ate attorney Linda Drane-Burdick.

Deputies emphasized they were still looking for the girl - alive - and urged anyone with information to step forward.
Defense attorney Jose Baez requested bond around $10,000. He said Anthony's family can't pay a high bond and she has the right to freedom while facing lesser charges.

"This is not a capital case, and if it were they certainly would file it, if they had evidence to," Baez said. "There is circumstantial evidence of a possible homicide, I will give them that. But circumstantial evidence has not made them confident enough to charge her with any specific homicide or kidnapping, or any capital offense."

Anthony's parents became concerned after her car was towed from a check-cashing business where it had been parked for days. She and the child lived with her parents, and she told them she worked as an event planner at an area theme park.

Investigators say Anthony was unemployed, and a purported babysitter seems to never have existed. The mother and child hadn't been home in the month before investigators were notified that Caylee was missing. Investigators believe the girl's father is dead.

Anthony's mother, Cindy Anthony, acknowledged in court that her daughter had lied before, but said she was a caring mom. The registered nurse believes the girl is alive, and Casey Anthony lied to police because she was somehow threatened. Cindy Anthony said she would even sell her house to free her daughter.

"I know Casey as a person," she said. "I know what she is for a mother and I know there's only one or two reasons why Casey would be withholding something about Caylee. I believe that it's something that someone is holding over her and threatening her in some way."
Casey Anthony's face filled with tears at the hearing, watching her parents at the witness stand and again after Strickland set bail.
"Casey, we love you!" yelled Cindy Anthony as the courtroom cleared.
Her daughter nodded and sobbed before being led away in chains.

The mother of a missing girl was caught on camera partying in a nightclub as police tried to find her daughter.

Police say they fear Caylee has been murdered but they have not released details of any suspect.

In transcripts of a 911 call, Caylee's grandmother tells an operator she thought her own daughter's car had been used to transport a body.

"There's something wrong," Cindy Anthony told the dispatcher.

"I found my daughter's car today, and it smells like there's been a dead body in the damn car."

In three 911 calls, she said she wanted to press charges against her daughter Casey, 22, for "grand theft", then in a second call she said she had someone in her home who needed to be arrested in relation to a missing toddler.

Casey Anthony claims her babysitter took the child and she did not report the girl missing for a month because she thought she could find the pair.

The woman falsely named as missing tot Caylee Anthony's baby sitter — and kidnapper — said the child's mother has cost her a job, her family's privacy and life as she knew it.

Zenaida Gonzalez told FOX affiliate WOFL-TV in Orlando that her world was turned "upside down" after the little girl's mom, 22-year-old Casey Anthony, gave her name and other details about her life to police.

"I lost a lot. It changed my kids' life. I lost my job. ... I've had to hide out," Gonzalez told WOFL. "Why me? Why drag me into your mess? Why drag my family into your mess? She ruined my family. She ruined my life. Simple as that."

Gonzalez, a Kissimmee resident who has filed a defamation lawsuit against Anthony, said she had never even met the family or heard of them until she got the call from police that she was under investigation in Caylee's disappearance.

The child has been missing since mid-June. Anthony claims she left 2-year-old Caylee (whose third birthday came after her disappearance) with a baby sitter named Zenaida Gonzalez, who snatched her. After investigating those allegations, police say they don't believe the young mother's story.

Gonzalez thinks Anthony gathered information about her by going to the same apartment complex Gonzalez had visited to look at a vacant unit. Police have confirmed that theory.

"I looked at an apartment for 15 minutes and those 15 minutes changed my whole life," she said.

In addition to knowing her name and learning about her visit to the complex, detectives also had information about her two daughters and what kind of car she drives, Gonzalez told the station.

She said she was let go from her job as a direct result of her unwanted involvement in the case because her boss was "scared of the media."

She declined to elaborate on the type of company or its name, describing it only as "a place where people go a lot" and explaining that her employer feared the swarm of reporters was hurting business.

Gonzalez's interview and lawsuit have come after the release of about 600 additional pages of documents in the case, among them the transcripts of text messages, voicemails and depositions with Anthony, her family and her friends.

In one sexually charged instant message exchange, Anthony tells an apparent lover ("nyitaliano3") that she's "so sad," feels like she has "cabin fever" and craves freedom.

When he invites her to dinner, she tells him she'll have to bring her daughter, whom she refers to as "the little snot head."

She also talks about a nanny she refers to as "Zani," though most of her friends and acquaintances have told police they'd never heard her speak of a baby sitter or of Gonzalez.

Casey Anthony Case Headed to Grand Jury
According to sources close to the investigation, the Florida State Attorney's Office is planning on presenting its case against Casey Anthony to a grand jury on October 14. If that happens, it will then be up to the grand jury to determine if there is enough evidence to charge Anthony in the murder of her missing 2-year-old daughter, Caylee Anthony.

Meanwhile, investigators have released footage from surveillance cameras, which show Casey Anthony using stolen checks at several Orlando area stores, where she purchased groceries, clothing and lingerie. The footage also shows Anthony cashing a check at a Bank of America.

ID has obtained copies of newly released documents, which contain a complete list of the items Anthony purchased. We are currently editing those documents, to remove personal information and will be posting them soon.

In related news, Investigation Discovery is preparing to join Texas EquuSearch back in Orlando for another search for Caylee Anthony. Yesterday, a spokesperson for EquuSearch told ID that Tim Miller is headed to Orlando this weekend to check the status of the search areas. If the high waters have receded and the vegetation has started to die off, Tim will call in the rest of the team. Otherwise, they are looking to start the search during the first or second week of November.

Casey Anthony is now up to face First Degree Murder Charges over her daughter Caylee Anthony, despite no body


A grand jury returned charges of first-degree murder, aggravated child abuse, aggravated manslaughter and four counts of lying to investigators against Casey Anthony in the death of her daughter, Caylee, State Attorney Lawson Lamar said. The mother is being held without bond

I'm just wondering if its a Capital State that she is going to be charged for murder in ? and if so can you be executed for murder when there is no body ?

Don't get me wrong I don't think Casey is innocent of her daughters disappearance/possible death, I think she is in up to her neck in it.. As per my previous post Caylee Anthony and Casey Anthony

But like my views on the McCanns, I highly doubt it was a premeditated murder. It takes a very evil person to purposely kill their own child. But I believe that she possibly tried to drug her to keep her quiet whilst she partied, and the child possibly overdosed or fell (just like what I think happened with the McCanns)

My utmost wish is that both these people as in Casey Anthony and the McCanns come clean, tell the truth of what happened, tell the police where they put the children and beg for leniency in sentencing.

My biggest upset is that these dear sweet little children Madeleine and Caylee are lying buried in a hole somewhere, with no respect for their little lives and their souls unable to rest in peace. Its not fair to the grandparents and the rest of the families either.

Nothing good ever comes of secrets and lies.

Massive Search To Begin For Caylee
3-Year-Old Girl Last Seen In Mid-June

ORLANDO, Fla. -- In what may be the largest search in U.S. history, about 4,000 volunteers are expected to search for 3-year-old Caylee Anthony, who was last seen in mid-June.

Caylee's mother, Casey Anthony, remains jailed on first-degree murder charges in connection with her daughter's disappearance.

The Texas-based group Equusearch will conduct the Saturday search for Caylee, and the group has set up its headquarters on Lee Vista Boulevard and Shadow Ridge Drive near Orlando International Airport.

The group is preparing 350 team leaders Friday, who are being sent out in groups of two or three to different areas to determine what type of equipment and how many people they will need in their search.

Tim Miller and Mandy Albritton of Equusearch said the search is a huge undertaking.

"This is the biggest and largest search that Texas Equusearch has ever done," Mandy Albritton said.

"In the very best conditions -- if this little girl is out there -- she's skeletal remains, and it's going to be extremely easy to miss," Miller said.

California bounty hunter Leonard Padilla, who bailed out Anthony from jail months ago when she was only charged with child neglect, is also back in Orlando to help in the search.

"We'll basically brief (Equusearch) on what we had," said Padilla, who has analyzed pings to towers from Anthony's cell phone records.

"The woman lives her life 10 minutes at a time. It never, ever affects her adversely. Child's dead? OK. What do do? Oh, I've got to go (to) Blockbuster tonight," said Padilla, making note of the fact that Anthony was captured on surveillance video shortly after Caylee's disappearance.

Miller said Padilla's information coincides with where they planned to search.

Cindy Anthony, who believes her granddaughter is still alive, will not assist in the search.

"I talked with Cindy yesterday, and we hugged -- and we even had some tears come out -- but I don't believe that (Caylee's) alive," Miller said.

Miller said a meeting will be held Friday at 6 p.m. at the Taboo nightclub in Orlando for anyone who is interested in joining in the search, which is scheduled to take place Saturday at 8 a.m.

Casey's Mental Health
The mental health of Casey Anthony could be the key to determining her fate, according to a Local 6 News report.

Anthony is scheduled to go to trial in January.

Anthony has undergone two psychological evaluations, but the reports have been sealed by the judge who ordered the tests after Anthony's arrest in July.

Local 6 News investigative reporter Tony Pipitone interviewed Lake Mary psychiatrist Dr. Ryan Hall, who has not examined Anthony and could not comment to her specifically, but he has studied women who have killed and their motivations for the killings.

"You have to look at the motivation -- why they're doing -- why they think they have to (kill their own child)," Hall said.

Psychiatrists focus on five general reasons, Hall said.

Altruistic, which was explained as the person doing the child a favor.

Psychotic, when the killer is having hallucinations or delusions.

Accidental, which usually result from abuse.

Revenge, getting back at someone, usually a spouse or the child's parent.

Unwanted child.

Hall said that only in extreme cases can the killer be found not criminally responsible for the death.

"You have to have a severe mental illness, and two -- due to the severe mental illness -- you have to not realize what you were doing was wrong," Hall said.

Andrea Yates, the Texas mother who is in a psychiatric hospital after drowning her five children because she said she was battling Satan before calmly reporting the deaths to police, is an example of that type of person, Local 6 News reported.

Pipitone said the prosecution of Anthony thus far seems closer to that of Susan Smith, who let a car containing her two children roll into a lake, where they drowned. Smith blamed carjackers who never existed, and she's serving a life sentence in South Carolina.

"She was interested in an individual, (and) he said he didn't want to be with a single mother. She killed her two kids. There was concealment, it was planned out, she made false statements to police, she was trying to avoid detection (and) she knew what she'd done was wrong," Hall said.

Investigators believe Anthony is concealing the location of her daughter's body.

"No more lies. No more bull coming out of your mouth. We've been very respectful. We're taking our time and talking to you, but we're tired of all the lies. No more lies. What happened to Caylee?" Orange County sheriff's Detective Yuri Melich said in a July interview at Universal, where Anthony had said she worked.

"I don't know," Anthony said.

"You do know," Melich replied.

"I don't know," Anthony repeated.

"What happened to Caylee?" Melich asked.

"I don't know where she is. That's the God's honest truth," Anthony said.

If Anthony were delusional, she would really believe that she worked at Universal and left Caylee with an imaginary baby sitter, Pipitone said. The state claims that Anthony is lying.

Psychiatrists, like Hall, routinely determine whether someone is delusional or simply deceptive.

"You have to look at what the motivation is there. Is it that they don't want to admit they're really unemployed? Do they have to let people think they're greater than they are? So there could be personality factors, (a) need for narcissism, needs to seem greater than they are. Or they could be trying to hide embarrassment or shame," Hall said.

If Anthony has no severe mental illness, there's no way she can avoid prison, if convicted, Local 6 News reported.

"People found insane go to the state mental hospital, but that's reserved for truly psychotic people. Casey just doesn't seem to fit that bill," Pipitone said. "She's not been convicted of anything, but clearly she has issues that could lead to the death penalty being taken off the table or mitigate against a death sentence if she ever were convicted."

New Documents Released

More than 500 pages of documents pertaining to the Anthony case were released Thursday by the state attorney's office.

The documents include never-before released interviews of Anthony's parents, George and Cindy Anthony.

In an interview about retrieving Casey Anthony's car from an impound lot after it was found abandoned at an Orange County Amscot, George Anthony said the smell in the car was terrible.

"I believe that there's something dead back there, and I hate to say the word 'human,'" said George Anthony, who told detectives he knew something was wrong and was nervous to open the trunk. "I think I whispered out to myself, 'Please don't let this be my Caylee.'"

George Anthony said he also saw a basketball-sized stain on the carpet of the trunk, Arm & Hammer laundry detergent and a plastic garbage bag contaning a pizza box and maggots.
George Anthony said in the interview that the smell was so bad that he had trouble breathing as he drove the car home. He said when he pulled into the garage, his wife came out and said, "Jesus Christ, what died? It was the pizza, right?"

In a separate interview, Cindy told detectives that she was concerned someone would take the car.

"We parked it in the garage, opened everything up, took the battery out of it just in case someone came home to try to get the car. We took the battery out of it. (You) never know," Cindy Anthony said.

It was later revealed that there was never any pizza in the trunk, only the empty box, Local 6 News reported.

George Anthony also admitted to detectives that Casey Anthony lived life on the edge, but said he was shocked to hear that his daughter was partying at Fusion, an Orlando nightclub, during the first month after Caylee's disappearance.

Also, in an interview with an Orange County sheriff's detective, George Anthony said his daughter had once told him that she was robbed at gunpoint while she was working at Sports Authority. George Anthony said he confronted the manager of the store about the incident only to be told that Casey Anthony never worked there.

Casey Connection To Apartment

An interview also released on Thursday shows that Casey Anthony had a connection to the Sawgrass Apartments, where she said she left Caylee with a baby sitter named Zenaida Gonzalez before never seeing her daughter again.

Dante Salati, a friend who Casey Anthony had known since high school, lived at Sawgrass for three years. His apartment was located next to the building where Casey Anthony said she left Caylee.

Salati said Casey Anthony's last visit to his apartment was January 2007, and he had never seen Caylee at the complex.

A detective asked Salati, "Do you think if Casey would come in there to drop her child off at an apartment 500 feet away on a regular basis -- do you think you would have had some idea that was going on?"

"Yes," Salati replied.

Death Penalty Argument

Attorneys for Anthony on Wednesday urged state prosecutors not to seek the death penalty in the high-profile case, using baby photos of their client to help their cause, Local 6 News reported.

Local 6 News obtained the baby photos of Anthony that will be used by her attorneys in an effort to sway the state from pursuing the death penalty.

The photographs show Anthony as a baby, playing with her brother, Lee, and surrounded by family members.

An experienced defense attorney was recently retained on Anthony's behalf, and he's hoping the photos and his 30-page argument will convince prosecutors.

"In this case, no one knows how death might have happened, if at all," stated the document, which was also obtained by Local 6 News. "If death did occur, the death was almost certainly a tragic accident."

Anthony's defense team also raises the possibility that Caylee may have been poisoned by chloroform, saying, "Death may have occurred while the child was sedated or from an unwitting overdose of a sedative."

Anthony's attorneys are also trying to show prosecutors that their client is an unlikely candidate for the death penalty because of her age and lack of a criminal record. Attorneys said the evidence suggests Anthony was a good, loving mother but also a troubled woman who may be suffering from depression or other mental conditions, Local 6 News reported.

The defense admits that Anthony "spent money she does not have, wrote bad checks, had multiple unstable relationships and participated in risky behavior."

The request did not mention the baby sitter with whom Anthony said she left Caylee at an apartment complex before never seeing her again. But the argument is not a case strategy, Local 6 News reported, rather only an attempt to get the death penalty option off the table.

Cindy Anthony Statement

Anthony family spokesman Larry Garrison released a statement on Thursday from Cindy Anthony, a day after it was reported that her daughter's attorneys are seeking to avoid the death penalty in her Casey Anthony's case.

"I feel that a good attorney will plan for the worse case scenario and hope for the best.

"I know that Casey's attorneys know that she is innocent, but they cannot ignore how the media has already spun the facts and convicted her. Casey has been severely attacked by the media since she was first arrested, and anyone would be a fool to ignore that. All of the negative spin has done her an injustice.

"Just look at what it has done for poor Caylee. The media already has given up on looking for this child, when there is simply no credible or concrete evidence to prove that she is dead. The defense and the family will never give up on looking for Caylee.

"We continue to believe she is alive, and so should everyone else who has a conscience. I would ask anyone to ask themselves just how quick would they stop looking for someone that they loved," the statement said.
