You seem to have missed this sentence in Claudia's post above.

"The Publisher is the one which has to demand the return of the books because they belonged to them."

Still doesn't alter the fact that they haven't been returned.

Exactly, the McCanns and Isabel Duarte, are in contempt of court. They have disobeyed the Supreme Court Judge, not the publisher of Goncalo Amaral's book and not Goncalo Amaral.

If Goncalo Amaral doesn't own the book, why did he make a public statement saying he had denounced the McCanns and Isabel Duarte in a letter to the DIAP? Why did he make a public statement saying it is up to the authorities to take action against the McCanns and Isabel Duarte? Then tell Claudia 79 that it is up to the publishers to demand the return of the book.

Its all very strange and now the McCanns have taken out another case against Goncalo Amaral, which will be heard in February 2012, they have the perfect excuse to hang on to his books.

All parts can inform the proper authorities that the books have not been returned. However, only the Publisher has the right to legally fight for the books through the legal channels because the books belong to them.
As for the libel trial, it is not new. It has been started ages ago. The dates have been now finally set.

You are still missing the point. The McCanns and Isabel Duarte are in contempt of court. Contempt of court is wilful disobedience of a court order and Isabel Duarte and the McCanns could find themselves in prison for up to 5yrs, for disobeying the Supreme Judge, when he ordered them to return the books.

Anyone who has an interest in this book may have a right to legally fight for the return of the book, but the Supreme Judge must deal with the contempt of court issue. If he doesn't, then once again the McCanns are being let off the hook for committing an offence. They have already been let off the hook for committing a gross offence which lead to Madeleine's disappearance.

Ok. You're absolutely right. GA knows nothing about this.

I note a hint of sarcasm in your post, you know fine well that Goncalo Amaral knows about the contempt of court issue. I haven't come on here to be sarcastic, I just want to express my views.

And I am telling you that not being a legal expert, I've asked GA himself about this. So no sarcasm at all. Just telling you where it came from. I have no idea if you know how the Portuguese legal system works. But if you do/did, then you would understand what I meant when I said nothing will be done if there isn't an active approach to getting the books returned. At least until the libel trial has an outcome and all the appeals are exhausted.
