The law is not fair, it is just a contest where the side who can use the rules to their best advantage wins. Being rich enough to just out price the opponent is a very common tactic that is used. That is what people like Kate and Gerry pay lawyers for, to plan and to utilise the rules to their best advantage. It is not about being nice, it is about winning and it can be a very dirty fight.

That has often been my point, when did we ever hear Gerry was selling that big house or remortgaging it to fund looking for Madeleine. It has always been about fund raising from everyone else to pay for his antics. His attitude has been clear, I want to milk everyone for every penny I can get, to pay my mortgage and buy me a nice new car etc. No way am I dipping hand into pocket. I am so profligate with money I had to get pensioners, those on Income Support etc who were mug enough to hand over their State Benefits to pay my mortgage for me because there is no way I had any savings to pay it myself. Maddie is my property, she is a very sellable piece of property and all profits must come to me. How many times did we hear The Pink Ludicrous One shouting that. ONly thing is, he does not shout it any more, even that thick twut realised that is seriously enough to pi%% the public off and make them see what money grabbers they are. So instead of going on about all funds should just go to them, no one else is entitled to profit from Maddie, they go one better and start suing any bugger that looks like they may be trying to do that. Remember how cross they were the Madeleine Foundation is nothing to do with us and not part of the offical collection for finding Maddie. Official??? I could think of better words.

I doubt Carter Ruck's latest jaunt against the MF was funded even by the Fund. This was very different to the action against the Express. Carter Ruck would not have agreed to fund it because clearly they would not be in the position of thinking we can get our costs paid from these two. It was simply a case of terrorising them into shutting up. As such, Carter Ruck would have wanted paying for that work. Given Brian Kennedy also got a mention as apparently being libelled by the MF I would be pretty certain he funded it all.

It is a pity, and it certainly adds to the injustice, but the upside is it provides a very convinient and very large stick to beat him with. Both Mitchell and McVey are on record of stating that public donations would not be used for legal fees.

Year one accounts quite clearly showed they deliberately misled the public. I suspect the year two accounts will shed even more light on their reprehensible behaviour.

and Gerry was very clear at the time in saying that he thought the donations could be used to fund lawyers' fees and he did not see the public would have a problem with that. Talk about distorted thinking. Just a few days later McVey goes on record as saying that he is wrong about that, you can just imagine what Gerry had to say to her and why she beat a hasty retreat from something that she could clearly perceive would take her down with them. There was another went at the same time. How wise!

O Tribunal Cível de Lisboa, que esta semana ordenou o arresto dos direitos de autor do livro de Gonçalo Amaral sobre o desaparecimento de Madeleine McCann, bem como do documentário que se lhe seguiu, considera que a sociedade unipessoal criada pelo antigo coordenador da PJ poderá permitir receber e fazer desaparecer os proventos que lhe são pessoalmente destinados pela venda dos livros e vídeos. Por isso, na sequência do pedido de indemnização da família McCann, decidiu através de um procedimento cautelar, arrestar também a quota de Amaral na empresa, um terço do seu vencimento como gerente e até o Jaguar que o ex-polícia conduz - mas que pertence à firma.
O carro, com uma cilindrada de 2700cc e um preço a rondar os 70 mil euros novo, foi comprado em Maio e registado em nome da sociedade Gonçalo Amaral Unipessoal Lda., com um capital social de 5000 euros. A empresa, criada em Novembro do ano passado, oferece consultoria, estudos e análise na área da investigação criminal e é especializada na divulgação, promoção e comunicação de trabalhos técnicos.
As notificações para as editoras que publicaram o livro "Maddie - A verdade da mentira" seguiram no início da semana para vários países da Europa: Itália, Holanda, Dinamarca, Alemanha, Espanha e França. A editora Guerra & Paz, (que publicou o livro em Portugal), a Presslivre (proprietária do "Correio da Manhã" onde Amaral tem uma crónica semanal), a Valentim de Carvalho e a TVI foram também notificadas do arresto dos direitos de autor que são devidos ao antigo coordenador da PJ até haver uma decisão final no processo em curso.
Contactado pelo Expresso, Gonçalo Amaral escusou-se a fazer qualquer comentário sobre a decisão do Tribunal Cível, remetendo a sua posição para um comunicado de imprensa divulgado na quarta-feira. Nesse documento, o homem que investigou o desaparecimento de Madeleine McCann receia "ficar impossibilitado de defender as suas razões em tribunal" e admite enfrentar "constrangimentos relativos à sua própria defesa".
Kate e Gerry McCann, que foram constituídos arguidos no decurso da investigação, e os três filhos menores, Sean e Amelie e Madeleine, são os requerentes do processo em curso no tribunal cível. Exigem ao antigo inspector da PJ uma indemnização de 1,2 milhões de euros por difamação, devido a afirmações "contínuas e grosseiras" sobre a investigação do caso de 2007.
No entanto, de acordo com a avaliação feita pelo tribunal, a situação patrimonial de Gonçalo Amaral não oferece garantias suficientes para o pagamento em caso de condenação. A casa de Olhão - que comprou em conjunto com a mulher, em 2002, com um empréstimo do BIC, mas que está registado apenas no nome dela - foi arrestada em 2005 devido a uma dívida de cerca de 130 mil euros.
Um ano depois, a Fazenda Nacional registou uma penhora sobre a casa como garantia de pagamento de 16900 euros. Por fim, há dois anos, foi o BES (ao qual o BIC pertence agora) a avançar com uma acção executiva contra o casal para cobrança de mais de 300 mil euros - nova penhora.
O livro "Maddie - A verdade da Mentira" foi lançado em Julho de 2008 e nos dois meses seguintes, até final de Setembro, teve 12 edições, ou seja, 120 mil exemplares. No entanto, em Setembro, também por decisão do tribunal, tinha já sido proibida sua a venda.
Gonçalo Amaral aposentou-se da Polícia Judiciária em Junho do ano passado, depois de 26 anos de serviço. Na altura, afirmou que saía para ter "plenitude de liberdade de expressão", depois de ter sido afastado, meses antes, da investigação ao desaparecimento da criança inglesa devido a declarações feitas à comunicação social. Actualmente, Amaral recebe uma pensão por reforma antecipada de 2039 euros. O inquérito sobre o caso foi arquivado em Junho de 2008, sem que fossem apuradas quaisquer responsabilidades dos pais da menina inglesa de três anos que desapareceu a três de Maio de 2007, na Praia da Luz.

Can we nail them for fraud ?

Do think that Gonalco Amaral will come out of this OK. He will have his time in court and have the opportunity to say what he wants to...in court! The McCanns are trying their best to break him, but they certainly won't do that. They are the ones who are digging the hole and then fall into it.

My understanding is that Goncalo is saying unless he gets state help to fund his defence of the case against him by the McScams he will not be able to afford the legal fees. Dealing with a case like this is not really possible unless you have lawyers working for you and he just cannot afford them. I think that was how they planned it, get an injunction to seise his assets and then he will not be able to carry on, fait accompli. Vicious, nasty, tactics but all within the law. If he does not defend the case against him, he loses anyway. That is the way lawyers work for their clients, get the result by the fastest cheapest method.

I think the better hope is that the McCanns will find themselves arrested before it comes to that.

I'm with you on a lot of this - but arrested for what? They appear to be bankrolled to the hilt. They're avoiding everything

Hiya Photon, For being involved in the disappearance of their daughter, fraud, perverting the course of justice.

I know that is a lot to hope for, but I have faith in the police, even if, sometimes, it takes them years to get sufficient evidence.

There are so many indicators of late to suggest the McCanns position becomes yet more precarious, including them re-focussing back on Portugal having once ran away from there. Back home is what they really fear.

I just have a faith in justice and sometimes that is the way it works out. Goncalo just needs a break because their case against him is not one he can win. But they do not deserve to win it either.

I go with all of that Viv - but things aren't looking good (IMHO). Sometimes it just appears as though justice just doesn't happen. They squirm out of it..................... There seem to be so many dodgy backers in this case.

do you really think or know such nasty, vicious tactics are within the law?
To let humans gag because of money and to prevent them from their rights?
I thought this law is only in GB.

I just can't understand why there isn't a rich backer somewhere willing to help Amaral out. I know if I were wealthy I would be only too happy to back him financially. He mentioned somewhere that he had masons approaching him and agreeing with his views and yet he is being left stranded, his only hope is legal aid. He wants so much to face the Mccanns in court yet is being denied this right. Even if it is 'only' for the sake of justice, someone somewhere surely will be willing to help him. I can't believe that only the Mccanns have wealthy benefactors and if so, why?
