They have just realised that they might not get anything, so suddenly the money is not the motivating factor. Aye. Right.

They're just changing tack because they have realised how unpopular their actions are in Portugal and that elsewhere there don't seem to be many people shouting "give'em the cash!"

It is just a pity the spineless UK journos don't have the same bottle as Amaral, the tragedy of 3 year old Madeleine would have been addressed long ago.

I dont really think Amaral will settle for any kind of deal. If he makes a deal then that'll be admitting they are correct and he is wrong.

I think the McCann's are now squirming because they saw the list of witnesses Amaral is calling!

Imho the fact alone that humans who lost their child have to fight against the former chief investigator who handeled teir childs case speaks volumes to me, really!

I suppose you have to consider 2 scenario's, either GA is genuinely concerned with justice (which I 100% believe that he is) or that he's a disgraced cop out to make a fast buck.

If its the former, then I really dont think any amount of money is going to change the situation. If in the unlikely event its the latter, then unfortunately for the McCann's backers, the price is going to be high for a whole bunch of reasons. Following the success of his first book he's probably pretty bullish about the prospect of achieving greater sales, of both books, so any offer will need to compensate for loss of earnings. A bribe of 100K is significant when your working a 9-5 job struggling to make ends meet, but its not so significant when you have 1.4 million in euro sitting in the bank, and even less if the second book is showing signs of strong sales. Any offer of an out of court settlement signals a weakness, actually, it signals desperation, and an unscrupulous oppenent is always going to exploit that.

The problem that the McCann's face of course is that even if GA settles out of court, there are other interested parties waiting in line to exploit that weakness. If GA is paid off, who'll be the next in line ?, this story is only just beginning, and the media know when the time is right that there'll be serious money to be made from this story

I will bet my bottom dollar that Sr Amaral will never ever accept any money or anything to get off the case. He won't stop until it's all over and the truth is finally told.

I read months ago that the amounts awarded by Portuguese courts bear no relation to the amounts awarded in Britain, hence the libel tourism, so perhaps they have been advised they'll only get a token few euros if it does go ahead

I've always believed that stage 1 of the strategy was to get a temporary injunction in Portugal, Stage 2, a permanant injunction against the book through a Portugese court, and stage 3, a libel hearing in the UK, purely because its easier to win there, and the payouts are larger, and if stage 2 is successful it helps crystalise the argument that the book was libelous.

money will not im sure buy amaral, truth has a price beyond mere money. i know i couldnt be bought to hide truth. jimo. so its not about money for the McCs, grovelling front page apologies without the 500K should havebeen enough then. IMO they ruined their "good name and reputations" when it was learnt that on several occassions at night they left 3 children under 4, alone allegedly with an unlocked door whilst they went jollying with friends. Their reputations were not worth a light from then. imo

Oh dear! It's all unravelling like the proverbial ball of string, or perhaps a better analogy would be, cracks are starting to appear in the dam. Of course they tried to ruin Dr. Amaral with their injunction which included freezing his assets so that he couldn't afford to fight the case; no use denying that now. Did they really believe their lawyers when they told them this is how you get your hands on all those lovely Euros that Mr. Amaral has made from the book?
Suddenly a statement from McCann says that the purpose of the legal action is only to defend their reputations and not make money. Unfortunately for McCann, he couldn't resist taking a swipe at Amaral by including the bit about Amaral being in debt anyway. This was a direct statement which cannot be denied and it is pure defamation. Of course that's only of theoretical value because if they lose the battle to stop the book the consequences will be far worse. The next stage would be for the book to appear in the UK and that would effectively mean that their super injunction or whatever they're using to gag the UK media would no longer be enforceable. IMO they haven't a hope in hell of buying Dr. Amaral off either. Well, plenty of time for them to ponder over the coming holiday. I wish them a very merry Christmas.

Padres de Maddie escriben una carta abierta a Gonçalo Amaral

Al considerar que las noticias que han sido publicadas durante los últimos días sobre los procesos civiles que nos enfrentan a Gonçalo Amaral contienen tergiversaciones de la verdad o interpretaciones de la ley vigente en Portugal contrarios a los derechos fundamentales previstos en la Constitución, entendemos que debemos clarificar las siguientes cuestiones:

1. Libertad de expresión y el derecho al respeto y buen nombre

La libertad de expresión es un derecho fundamental previsto en la Constitución de la República Portuguesa. Aunque también lo son, independientemente de la nacionalidad, el derecho al trato justo y al acceso al derecho y los tribunales, a la integridad moral, al buen nombre y reputación, la prohibición del carácter perpetuo de las penas y la presunción de inocencia hasta dictada sentencia penal en un juzgado. También lo es el derecho de resistencia a agresiones ilegítimas. Como lo es el, sobretodo, el derecho a la vida. (Inciso: Madeleine Beth McCann tenía derecho a: La protección y salvaguarda de sus padres. A que sus padres y amigos no mintieran en las declaraciones dadas oficialmente a la policía. A que sus padres solicitaran la reapertura de la investigación. A que sus padres y amigos volvieran a Portugal para participar en la reconstitución de los hechos. A que sus padres pusieran todos los medios a su alcance para contratar “a los mejores detectives” para buscarla).

Las restricciones a todos estos derechos, dice la Constitución, solo podrán existir, para salvaguardar derechos fundamentales. (Inciso: Como lo es la Libertad de Expresión, Información y Opinión)

Preguntamos, entonces, a cualquier ciudadano que nos lea, si entiende que nosotros, que no estamos acusados de ningún delito, y que fuimos exculpados por un despacho que concluye que, de la investigación coordinada en su momento crucial por Gonçalo Amaral, “no se consiguió ningún elemento probatorio que permita a un hombre medio, a la luz de los criterios de la lógica, de la normalidad y de las reglas generales de experiencia, formular ninguna conclusión lúcida, sensata, seria y honesta sobre las circunstancias en que se produjo la retirada de la niña del apartamento, ni enunciar, siquiera, un pronóstico consistente”, ¿tenemos o no el derecho a ser dejados en paz, a ver preservada nuestra vida, nuestro nombre y, sobre todo, la búsqueda para encontrar a nuestra hija, cuyo derecho a la vida, al amparo de la Constitución portuguesa, es inviolable? (Inciso: Srs. McCann, ¿es esto lo mejor que pueden hacer para aclarar “las tergiversaciones” del Sr. Amaral? Quizás deberíamos preguntarles a los perros Gerry…)

A tenor de este despacho, responsabilidad de dos magistrados, donde el libro del Dr. Amaral es objetivamente condenado, incluso antes de ser publicado, ¿podemos decir que las conclusiones de este libro son lógicas, normales, lúcidas, sensatas, serias u honestas? ¿Deben ser protegidas por la ley y por los tribunales? (Inciso: ¿objetivamente condenado? Sra. Duarte, estoy segura que lo puede hacer mejor).

¿Aportó el libro, alguna ventaja o impulso a la investigación sobre la desaparición de nuestra hija? ¿O solo enriqueció al autor, editores, asesores, comentaristas y a quien le dio voz? (Inciso: ¿Aportaron algo a la investigación Método 3, Oakley International y más recientemente Dave Edgar & Company? ¿Aportó algo a la investigación las 100.000 libras presuntamente pagadas por traducir el sumario?)

Estamos seguros de que no será difícil comprender la dimensión de nuestra herida abierta. Pedimos que cada uno se ponga en nuestro caso. (Inciso: Eso es imposible. Seguramente ninguno de nosotros hubiese dejado solos a sus hijos para irnos de cena con los amigos, ninguno de nosotros hubiese mentido a la policía, todos nosotros hubiésemos vuelto a Portugal para colaborar en una reconstitución oficial de los hechos)

Por eso tenemos el derecho de oponernos a las agresiones a las que ininterrumpidamente hemos sido sujetos, ante los tribunales, cuyas decisiones son tomadas soberana y libremente.

Lo que venga después, sea a nuestro favor o en nuestra contra, no es censura o beneficio indebido, será apenas el resultado de la ponderación libre de las normas democráticas y de derechos fundamentales a las que tanto nosotros como el autor del libro estamos sujetos.

2. La decisión cautelar

La decisión cautelar de aprehensión del libro tiene ya dos sellos judiciales y puede y debe ser divulgada, ya que interesa a todos los ciudadanos que, en nombre de la libertad de expresión, corren el riesgo de llegar a ser públicamente acusados de por vida, después de haber sido exonerados por los tribunales. (Inciso: Hace unos párrafos fuisteis “exonerados” por un despacho. Repito, no habéis sido exonerados de nada. Sois sospechosos oficiales de la desaparición de vuestra hija. La policía, a quienes pusisteis personalmente todas las trabas posibles para llevar a cabo la investigación, hecho demostrado a través de vuestras propias mentiras e incoherencias, no consiguió reunir, de momento, pruebas suficientes para avanzar con una acusación formal). No vendemos esa decisión en ninguna parte, al contrario del autor del libro, por lo menos hasta la suspensión del mismo, al igual que nuestras conversaciones con los periodistas, sean formales o informales, no suceden a cambio de compensaciones económicas, contrariamente también a Gonçalo Amaral que, en cuanto puede, lo hace o intenta hacerlo. (Inciso: Tergiversación, los McCann no cobran, el dinero es ingresado en “el fondo”. Por otra parte ¿pueden demostrar que el Sr. Amaral ha cobrado por las entrevistas concedidas?).

3. Asfixia económica

Gonçalo Amaral, a finales de septiembre de 2009, cuando solicitó al Estado que asumiera, a través de los impuestos de los portugueses, el pago de sus costas procesales en todas las iniciativas llevadas a cabo por nosotros contra él, declaró que no poseía bienes inmuebles ni sociedades y que solo su esposa poseía un automóvil.

Aunque la verdad es que, en ese momento, al igual que ahora, era propietario de una vivienda desde hace siete años y había constituido una sociedad unipersonal hace casi un año, además de haber comprado, según dice por 40.000 euros, el ya célebre Jaguar, que registró a nombre de esta sociedad, creada con el capital social de 5.000 euros.

Esa vivienda estaba embargada, desde 2005, por António de Sousa Amaral, se cree que es un familiar suyo, estando además embargada dos veces, tanto por Hacienda, en 2006, por deudas de impuestos diversos, como por el Banco Espírito Santo, que instauró contra él la ejecución diligenciada con el nº 969/07 por la Sala 3ª del Tribunal Judicial de Olhão, por falta de pago del préstamo.

El último registro de los gravámenes sobre su vivienda data de 19 de mayo de 2008, precisamente un año antes de la compra del Jaguar. Todos estos registros son públicos y pueden ser consultados en los Registros de la Propiedad, Comercial y de Tráfico. (Inciso: ¿Podrían presentarnos ustedes unas cuentas “detalladas” del fondo creado para la búsqueda? ¿No pagó ese fondo dos plazos de vuestra hipoteca? ¿No está pagando ese fondo a bufetes de abogados, empresas de imagen y portavoces? ¿Han presentado ustedes una demanda contra el detective que, presuntamente, estafó al fondo 500.000 libras, ya que este hecho bien podría haber “entorpecido la búsqueda”? ¿Podrían explicarme, por favor, en qué benefició todo este gasto, que representa más del 80% del total donado, a la búsqueda privada? Gracias.)

La falta de pago a los acreedores no resulta, pues, de nuestra actividad judicial, que, hasta ahora, no vio embargado, en su beneficio, ningún bien que, antes, no estuviera ya comprometido, ni ninguna cuantía de la que Gonçalo Amaral fuese beneficiario. El fisco, su familia y la banca se encargaron de eso antes. (Inciso: Todo esto tendrán la oportunidad de demostrarlo en el tribunal. No solo eso, también tendrán que demostrar que Gonçalo Amaral solo escribió el libro “planteando una teoría imposible” para lucrarse como pretenden hacer ver aquí. El respeto al honor y buen nombre, también protege al Sr. Amaral).

4. Costas judiciales

Gonçalo Amaral dice que las costas a pagar por la acción civil, donde se pide su condenación al pago de una indemnización, ascienden a casi 30.000 euros y que antes tiene que pagarlos y solo después puede contestar la acción.

Desde luego, al considerar este montante, está asumiendo que perderá la acción, ya que solo en ese caso es cuando tendría que pagar la tasa judicial exigible. Por otra parte, no solo ha contestado ya, sino que no ha pagado nada, por haber solicitado apoyo al Estado, como ya se dijo. Si tuviera que pagar, pagaría, para poder contestar ese proceso, apenas un importe máximo de 2.040 euros o, mínimo, de 1.530 euros, dependiendo solo de cómo su abogado lo comunique al tribunal. 5. ¿Por qué es de máxima relevancia responder a las sucesivas provocaciones que Gonçalo Amaral profiere públicamente?

Independientemente de todas las cuestiones que puedan ser levantadas en cuanto a la mala conducción de la investigación, cuando Gonçalo Amaral era responsable de ella, hay una niña inocente desaparecida. (Inciso: Estoy segura que podrán demostrar en el tribunal que existió una “mala conducción” de la investigación “imputable” al Sr. Amaral y no a las mentiras de los McCann y sus amigos).

Es por ella que estamos empeñados en reponer el frágil equilibrio que nos permita tener condiciones para encontrarla, abriendo, con gran esfuerzo y mucho coste, el camino al descubrimiento de nuevos indicios para reencontrarnos con nuestra hija. (Inciso: ¿nuevos indicios? Y ¿cuáles son los indicios existentes?).

Nuestra hija sigue desaparecida y necesita la ayuda de todos.

Nosotros y sus hermanos, Sean y Amelie, sentimos mucho su falta, mucho más de lo que la palabras pueden describir.

Se aproxima el tiempo de la Familia y nosotros vamos a pasar otra Navidad sin nuestra Madeleine. They will be quite happy to have a cut of the money, I am sure if it avoids going to court. And they are hoping GA's financial position means that he will be happy with that also.

After all, they have not had to defend themselves in court so far, have they? Everyone else has just rolled over.

Since Dr. Amaral has been working to get the McCanns into some kind of court I should have thought that having almost achieved his objective, avoiding going to court would be the last thing he has in mind. Perhaps we should also be aware that feeling is running very high in Portugal not least because this has become a matter concerning the constitution and the principle of freedom of expression that it is supposed to protect. IMO it's gone too far for McCanns to stop things now however much it might suit them; this is a fight to the finish.

I also see it as them being in a room filled with Jack in the Boxes whch tell the truth when they pop up... they might manage to nail some of the lids down but they will never know which one will pop up next.
