There is a telegraph article in September 2007 saying the law changed. The media and various interested parties have the right to access the files. So I would guess Amaral sharing with the media would not be an actual crime. The McCann lawyer is getting up in years and maybe she didn't realize the law had changed.

I think there are some good points made here, Gerry complained in 2007 (I think he has certainly made comments but do not know exact dates) about the contents of the file being leaked but at the same time, on his own admission, he was constantly briefing the press and in September 2007 hired Mitchell with that specific purpose in mind. Mitchell was also involved very early on and at the same time they employed Control Risks Group almost immediately with publically donated money and then Justice McGuinness also.
It is vindictive and nasty and will clearly do nothing at all to get Madeleine back. The only thing that could get her back is if they placed her somewhere safe and they tell us where she is. Failing that, with paeodphiles, advertised her? But they tell us there is absolutely no evidence she has come to any harm? Given they were quite properly investigated for MURDER KIDNAPPING CHILD TRAFFICKING and given the PJ obviously know that Goncalo was using this confidential information for his book and have not taken any action to date, where is the sense of proportion from the McCanns? I do think that what he did was wrong, but is wrongs pale into complete insignificance compared with perhaps selling your own child and I am sorry but that is what they have been doing from day one. They wanted book and film deals out of it, but the police case against them prevented them doing most of that, they are clearly quite furious that Goncal manage do to do a book and "just get away with it". Maybe it is about time the McCanns just woke up and smelt the coffee and realised just how serious their own position is and that there is no way they can media manipulate their way out of everyone knowing that.

Kate and Gerry McCann are already embroiled in legal action against Mr Amaral in an attempt to ban his book which claims their daughter is dead.
Now the couple intend to accuse him formally of passing on information about the police investigation into Madeleine’s disappearance before the case was closed – a criminal offence in Portugal.
The McCanns’ Portuguese lawyer, Isabel Duarte, alleged that Mr Amaral broke the law by sending a draft of his book to his publishers several months before the judicial secrecy period in the case was lifted in July 2008.
She said: “It seems that Goncalo Amaral passed information in the case files before the secrecy was lifted.”
The lawyer also alleged that the ex-policeman released facts about the investigation that were not in the case files.
It will be for the Portuguese public prosecutor to decide whether the former detective has a case to answer.

Mr Amaral was the first head of the Portuguese police investigation into Madeleine’s disappearance from Praia da Luz on May 3, 2007, shortly before her fourth birthday.
A judge granted the McCanns a temporary injunction in September last year banning further sale or publication of his book and a TV documentary he made about the case.
Mr Amaral’s lawyers argue that the material in the book is contained in the official Portuguese police files for the investigation, many of which were made public in August 2008.
The McCanns say their main motive for challenging the former policeman is the fear that people will stop looking for their daughter if they think she is dead.

I take this latest move to smear Dr. Amaral extremely seriously just as I took all the previous attempts which were either thrown out of court or are the subject of an appeal after a courtroom farce. The reason why it is being done is simply to be able to cast aspersions on Dr Amaral's name whenever it is mentioned; hence the one about him misusing legal aid and giving false information concerning his assets etc is already dead therefore a new one had to be invented to take its place. The teaming up of that obnoxious woman from the Sun newspaper with the BBC to 'invent' the smear about Amaral's use of the English F-word shows us clearly the type of scum we are dealing with here. I am confident that Dr. Amaral will continue to present himself as the quiet and reasonable man dedicated to searching for the truth that he undoubtedly is. With every new attempt to smear him he gains in stature.

Debbie I am afraid she can have it both ways, false statements and handing over confidential details of the police files whilst still subject to secrecy of justice are CRIMINAL OFFENCES. On top of the civil action already commenced for defamation. The legal aid is not mentioned in this article, but that may be fraud, not sure we do not have the details.

Me too famous. Don't think violation of secrecy is a big offence anyway. Remember a journalist interviewed on Panorama said it was quite usual for details to be provided to the media in spite of this law. Of course the McCanns claimed they stuck to it rigidly, but then they used it as an excuse not to answer any searching questions!!

They surely know they are very likely going to lose this case and it's so blatantly obvious that they are now desperately trying to muddy the waters where Amaral is concerned, in any straw clutching and ridiculous way they can.

It's looking bloody good for Amaral. The McCanns are just repeating a mantra,"There is no evidence to suggest Madeleine is dead" that is all they say, they backed the wrong horse when they took on Amaral.

I think the McCanns really like the doggy/death theory being run and run, it is a marvellous money earner for them.
They deliberately blocked TVI from running their own Channel 4 documentary even though it clearly casts them in a favourable light. Do you think when they did that they had one eye on the money, what this has always been about. They are not just suing Goncalo Amaral but the publisher and TV company also. That way they make sure they get their cash.
Same cynical plot with the Daily Express, firstly one sits back and waits for at least 12 months for lots of erm "libel" to have been done to them, that puts the damages bill up. They wait until there is so much of this doggy story being repeated they just cannot fail. They have lawyers and they know doggies cannot give evidence of any death in court. They know there is no other evidence. The nice man from the press complaints commission said to Gerry, now look Gerry I can intervene and stop the Daily Express, I can do this privately with the minimum of fuss to protect you, Kate and your reputations. What did Gerry say, no don't you dare, we want to sue them! Now if you think about these two examples very carefully maybe you will spot a game plan going on. They do not give a toss about the doggy stories, they love them, they want them oft repeated, they do not want the stories countered or stopped, that would stop the cash tills ringing.
As for am I joking? Well Goncalo Amaral is saying that if the court make a permanent injunction he will fight it through the courts and go all the way to the European Court of Human Rights. Now does it sound like he thinks he is going to win? I believe the Judge will do what British Police want her to do, shut both the McCanns and Goncalo Amaral up.

I think you support Goncalo for what you see are all the best reasons, but he has made himself anti establishment. Do you seriously think a Judge will be able to approve of that?
He said he would prove Madeleine died in the apartment on no more than the dogs findings which is not proof of that at all, as we have heard. How is that searching for the truth?
He could have written a book based upon all the other evidence that led the police to know from day one, the McCanns were involved in her disappearance. Why did he need to insist she is dead, he could have done the McCanns far more harm and himself far less harm!
