“Trial has already caused more damage than the book”
18 JANUARY 2010 | POSTED BY ASTRO

by Carlos Rodrigues Lima

“Three days of court hearings have been enough to cause more damage to the McCann couple’s cause all over the world, than my book during the 14 months that it was in the shops.” This is how Gonçalo Amaral – a former Polícia Judiciária inspector – answers Kate McCann’s latest statements about the development of the trial about the injunction that the couple placed against the book “The Truth of the Lie”.

In the latest update on the “findmadeleine.com” website, Kate McCann considered that “Mr Amaral's book and DVD contains some information from the PJ files but there is a lot in the files which is not in Mr Amaral's book. Hence it is highly selective and therefore biased. Mr Amaral's book contains his opinions rather than fact.” Nonetheless, for the former PJinspector, who led the investigation into Madeleine’s disappearance, in May 2008 [sic], “a book about a criminal process, just like a police report, a dispatch from the Public Ministry or a sentence from a judge, is always a selective exercise, a summary of the process, without being biased because of that”.

Adding: “I wasn’t biased, and the witnesses from the Polícia Judiciária that testified in court weren’t biased.”

In one of the most recent sessions of the trial that opposes Gonçalo Amaral to the McCann couple, members of the PJ that were connected to the investigation, and prosecutor Magalhães e Menezes, from the judicial circle of Portimão, admitted to the possibility that the child is dead – which is to say, stances that meet the thesis that Gonçalo Amaral defended in the book “The Truth of the Lie”, whose sales have been suspended by an order from Lisbon’s Civil Court.

One of the investigation’s most striking episodes were the two English dogs that detected the cadaver and blood odour. “We realise that the behaviour of the dogs was the turning point in the investigation for the PJ”, says Kate McCann, refusing, however, the notion that the diligence may be used as evidence: “To suggestor [sic] use the dogs´ reactions as evidence is simply wrong and abusive”, one can read on the website.

Gonçalo Amaral replies: “Other indications that are part of the process and of my book were excluded from Kate’s analysis. She has the right to evaluate the window’s indications and the dogs’ work in her own way. But the PJ also has the right to evaluate them, and to evaluate them within the set of produced evidence.”

Concerning the present ongoing lawsuit, the former inspector synthesises it in the following way: “Columnist Manuel António Pina wrote that the McCanns’ arguments could be used to burn the entire press on a daily basis. In a democracy, arguments are not burned, they are opposed.”

Yes of course it has been more damaging than the book because the papers can now print things which they couldn't before. Not many people even knew about the book, but everyone sees the papers. They can dress it up as "slurs" if they like but the ideas are out there now and The McCanns have noone to blame but themselves.

It is also right that they are trying to stop people thinking and deciding for themselves but noone has ever been able to do that.

Yes, it all comes back to the issue of rebuttal versus attempted suppression. People do not like facts to be kept from them by the use of fancy lawyers and massive libel actions, they want to be able to decide for themselves. Rebuttal of accusations is therefore preferable unless of course it is impossible to rebut them. It became very obvious during the Lisbon hearings that masses of negative information had been suppressed by the McCanns using their expensive libel lawyers over the last two and a half years and a completely different picture emerged to the one the British public have been fed by the McCanns, their PR machine and the media. IMO the damage to the McCanns is terminal but they will be the last people on earth to understand that.

Of course the trial has caused more damage to the McCanns' cause than the book. What was once known as the theory of a single "disgraced" cop, is now known to be shared by many experts in the field. It is the McCanns' greed and yearning for revenge against their accuser, Mr Amaral, which has led to the outing of more damning information than the general public has been made aware. Of course even more damaging to the McCanns' cause than even the trial, is the McCanns themselves.

Does anyone think that possibly this trial is exactly what Amaral wanted? He has many years of experience dealing with people like the Mccanns and is probably very good at profiling. Could he have known that Gerry could not resist suing him if he published his book? I have long been a believer that Gerry is a sociopath, but this bit in particular is especially true of Gerry (taken from http://www.youmeworks.com/sociopaths.html):

WHAT DO THEY (SOCIOPATHS) WANT?

This is an interesting question. Of course most of our purposes are strongly influenced by our connections and affections with others. Our relationships with others, and our love for them, give us most of the meaning in life. So if a sociopath doesn't have these things, what is left? What kind of purposes do they have?

The answer is chilling: They want to win. Take away love and relationships and all you have left is winning the game, whatever the game is. If they are in business, it is becoming rich and defeating competitors. If it is sibling rivalry, it is defeating the sibling. If it is a contest, the goal is to dominate. If a sociopath is the envious sort, winning would be making the other lose, or fail, or be frustrated or embarrassed.

A sociopath's goal is to win. And he is willing to do anything at all to win.

Has Amaral deliberately led Gerry into a game of cat and mouse that he knew Gerry would not be able to resist? Maybe for Gerry it isn't all about the money, but simply about winning!

For Gerry IMO it is all about control. He cannot stand other people having their own opinions that he cannot control. And like all control freaks and bullies, he stamps his feet and throws tantrums when he can't get his own way. Unfortunately for him, he's met his match now.

Even as an anti l am gobsmacked the McCanns bought this action, all they've done is bring Mr.Amarals words to a wider audience. I'm convinced Mr.Amaral will win yet know the McScams always manage to pull a miracle out of the hat......

I can only put their pursuit of this case down to their arrogance at continuing to get away with their 'abduction' charade and their grasping greed which of course will be their downfall.

All things considered, everything is beginning to unravel for them. And if the Murat vs. Tanner case is true then that will be the cherry on the icing “Trial has already caused more damage than the book” 25346

Like any crime where there is not enough evidence to nail the perpetrator sometimes you have to play the fool and poke the beast to see what happens.
The police know what happened but possibly the who/why so you have to give the perpetrator free reign so to speak. You occasionally give them a poke and watch the reaction and that will point you in the right direction.
Murderers who aren't caught instantly may play the innocent and even go so far as to help with searches and public appeals for help ( how many times have we seen that and thought something is wrong and behold that person is the killer)
Most of the time the killer will also revisit the scene of crime or the dumping site to make sure that nothing has been disturbed by animals or mother nature and possibly even to gloat and "get off" on reliving the crime.
My own feeling is that at some point Madeleine was dumped somewhere along their jogging route.
How many times did they jog that route before Madeleine died and how many times after?
we know kate jogged along the beach but now she is jogging up the hill.
Why?
Could it be that they are surreptiously keeping an eye on the site of Madeleines corpse? How better to disguise a check than to do it in plain view of the cops and media, who would suspect anything? After all it's not blatant and has become a routine. Every day the same route no one would pay it any attention. It would be harder to cover up if they suddenly started visiting some strange remote place for no apparant reason.
The church and their jogging route both became the norm and a perfect chance to check on the body.Did not people complain of a bad smell in the church? was that when they had to move her? to many questions and complaints and people would start poking around looking for the source of the smell and they are screwed.
It allowed them also to say goodbye prior to the final dump. where she is now i don't know but it would have to be somewhere accessible by car. When did they alone use the car? Were there times that only kate gerry or a trusted accomplice used that car? does anyone remember when they were in that car and there was no smell andd then the next time they were in that vehicle it stank to high heaven?
If so that would put us in the ball park for the moving of her corpse. On those days where did the car go and who were the passengers?
Once you smell death you cannot mistake it for any other smell ever. I know i have smelled it on many occasion both that of the newly dead and those who have been dead a while. those who died a bloodless death and those who were shall we say messy. Once smelled never forgotten, it cannot ever be mistaken for Dirty diapers or rotting meat though the latter does come close.
Their friends who complained about the smell i think suspected it but for whatever reason decided to keeep quiet instead choosing to believe the explanation because the other is just to unbelievable and callous to believe.
Imagine if your brother and his wife killed a family member and after a few days had to move the body in their car?
You are in that vehicle with your brother and the rumor going round is that your brother and his wife were involved. You smell a smell and he passes it off as dirty diapers and rotting meat from a leaky meat package. Inside you suspect the truth, you have seen their behavior and evasiveness but he keeps reassuring you it is fine he will clean the car when he gets home. Deep inside you know or suspect the truth what do you do? do you protect your brother at all costs to stop his family being broken up? after all what is done is done and cannot be changed. do you tell the cops your suspicions? do you tell your brother you smelt that smell and you know what it is? do you tell him he needs to go to the cops and confess to bring an end to the uncertainty and if he does things will go easier?
Only you and he know what discussion went on and the answer. You have decided for now to say nothing but inside it is eating away at you. You know what happened, you know when and possibly why. You know both have tempers after all you have been on the receiving end many a time and now you are worried about the safety of the remaining kids. do you break that promise you made? do you tear apart a family upsetting yout mom and dad? You promised that their kids would be well looked after and would stay with the family. or, do you make an anonymous call to the police and tell them what you know and suspect? You have an idea where the body is or at least was when you were in the car that day althiugh it may well have been moved since then.
It is a decision no person should ever have to be forced to make. Family or justice for a little girl?
I know what i would do. i would then do my damndest to make sure the children were well looked after within the family and that whatever happened i would still love him as a brother.
I think the family need to sit down with both kate and gerry and say look we know you did it, it may have been an accident and in your panic you did what you did but now is the time to bring it to an end. This will never go away until the day madeleine is found and given a dignified burial. We will stand by you and we will look after your children till you are free.
Better it ends now whilst the children are still young rather than years down the line when they will fully understand what you did.Years down the line they may not be as forgiving so do it for your children so they can move on and live lives without the fear of wondering if what happened to Madeleine will happen to them.
We know it will be a hard decision to make but we also know that once you take that first step you will feel so much better for it so much relief. Never having to worry about the knock on the door, no more wondering if the people watching your are cops. The fund can be used to do so much good even though it was conceived to conceal a crime.Let there at least be some good that comes out of this and no matter what we will always love you and be there for you when you come out.

I believe that the McCanns knew very well that the ideas in Amaral's book would be terminal to their credibility, which is why they were forced to try to prevent its publication in the UK. Perhaps they thought Amaral would back down or that the press wouldn't be allowed to report the proceedings. It's certainly backfired spectacularly, although if the injunction IS upheld we can expect more spin implying that the book is inaccuarate and libellous...
