For live tweets on the Madeleine McCann case from the Portuguese courtroom today

On these fundaments, they conclude by requesting the determination of the following measures:

a) The prohibition of sale and the order to seize, for destruction, the books and the videos that are still left at shops or any other deposits or warehouses;

b) The prohibition to execute new editions of the book or the video, or of other books and/or videos, that defend the same already criticised thesis, and that are destined to be sold or divulged by any means, in Portugal;

c) The prohibition to cede the editing rights or the author rights on the contents of the book or the video, or of any other books and videos on the same subject, for publication in any part of the world;

d) The prohibition to cite, to analyse or to comment, verbally or in writing, on parts of the book or of the video that defend the thesis of death of the third Applicant or of the concealment of her body, by the two first Applicants;

e) The prohibition to reproduce any comment, opinion or interview, where said thesis is defended or can be inferred;

f) The prohibition to publish statements, photographs, or any other documents that are allegedly connected to said book and video or said thesis.

So from what i can see it looks like you can't discuss the book or dvd either so does that mean that all the publicity regarding the book , dvd and their contents are in fact a breach of the injunction and we can now expect the mccanns to sue every paper,tv and radio station for actually mentioning the book or the thesis contained within which is that Madeleine is dead?

This is going to backfire on them big time not only are they trying to ban the book and dvd they are also trying to get a super injunction banning any mention of the existence of the dvd and book or the theory within.
Since the book and dvd are based on the contents of the police files can we expect the mccanns to ban the police files? ensuring that the contents never see the light of day pretty much like Madeleine in fact. Can we expect some point in the future a statement that Madeleine never existed and as such she did not disappear from PDL after her and her siblings were not left home alone in an unlocked apartment every night whilst mom dad and their friends didn't get drunk.
They did not create a fund and raid it for their own lavish lifestyle, that in fact the whole world was mislead by a corrupt copper out to make a name for himself?
Ridiculous? Yes but i think this is an all or nothing case, they are throwing everything they have to try and stop the unstoppable, the genie is out of the bottle and no amount of threats etc can or will get it back in.
All they have succeeded in doing is showing just how avaricious and selfish they really are.

Moral and physical integrity or lack of it from her parents led to this case in the first place.

thanks kitti and vengeful angel for explaining the legalities, so not only can they not discuss the thesis in the book/dvd but also can't comment about it in any way at all?

The injunction is on certain parties and as far as I know does not extend outside those people or portugal so I think bloggers are safe in that respect

Are they in fact able to bring a a criminal prosecution ?

Is it not the state that prosecutes criminals - surely they can only lodge a complaint with the court that the terms of the injunction were broken.

There aint none, but it doesnt matter, cos their being protected at all costs.

I once posted that in hopeful anticipation but was told in Portugal it wasnt possible, there is clearly some unfinished police business. Still we can but hope for a miracle?

See Kitti - I told you that they're trying to find out who bought the newspaper with the dvd so they can sue them for believing it and ceasing to search - over 10000 people to sue potentially

Good point - it's the POLICE that raise criminal prosecutions! Or are the PJ going to prosecute themselves, now?
