An Alby translation to clean up/replace google

Again, there were several omissions from, and errors in, the original Portuguese. I corrected those that I found. Also, much of the Portuguese statement is written with a convoluted 'future+past' verb construct that attributes an 'uncertainty' to the words, whereas I have translated much of it in a non-literal manner to make it read more definitively. Hence, the reader must understand that neither the Portuguese nor my translation necessarily constitute the exact words spoken by Oldfield.
If you read MO's Rogatory Letter testimony you will get a sense of the difficulty the Portuguese interpreter faced when listening to this man.

No que respeita ao casal McCANN (composto por GERALD McCANN e KATE HEALY), o depoente esclarece que os terá conhecido tão somente há cerca de quatro anos a esta parte, por ocasião do casamento de DAVID e FIONA PAYNE, o qual terá tido lugar no verão de 2003, em Itália.
In respect of the McCanns (Gerald and Kate), the deponent clarifies that he has known them only for about four years, since the wedding of David and Fiona Payne which took place in the summer of 2003 in Italy.

Não obstante, refere ter conhecimento de que os McCANN já se relacionariam com os dois restantes casais há alguns anos há aquela parte, a ponto de terem efectuado anteriormente algumas viagens de férias, juntamente com o casal PAYNE.
However, he relates knowing that the McCanns already knew the other couples for some years and they had been on holiday previously with them, together with the Paynes.

Refere que, em razão da relação de amizade para com os dois primeiros casais, terá efectuado uma viagem de férias a Grécia, a qual terá perdurado por um período de uma semana, à imagem do que haviam previsto para a sua actual estadia em Portugal.
He relates that, due to his friendship with the other two couples he had been on holiday in Greece for a week, and they had expected the trip to Portugal to have been similar to that week.

Indagado, esclareceu que, à imagem do que acontecera na presente ocasião, todos os casais ter-se-ão feito acompanhar pelos respectivos descendentes.
Asked, he clarifies that, the similarity between this and the previous occasion was that all couples were accompanied by their offspring.

Porque perguntado, refere que o casal McCANN não terá participado na viagem à qual acaba de se reportar, efectuada no ano passado à Grécia, alegando desconhecer se nessa altura se terá colocado a possibilidade de os mesmos integrarem o grupo de excursionistas.
Because it was asked, he relates that the McCanns had not participated in the above trip to Greece alleging to not know if, at that time, they were asked to join the group of excursionists.

In this way, it will have been this last individual [DP] who chose Portugal as the tourist destination, adding that, considering the expected climatic conditionsand the time period of the holiday, Mark Warner would be the only operator available to them with a final destination of Praia da Luz.

Nessa altura, DAVID terá contactado a operadora turística "MARK WARNER", a fim de proceder à compra dos pacotes turísticos e à reserva das respectivas viagens.
At that time DP will have contacted the tourist operator Mark Warner with the intention to purchase tourist packages and to reserve the respective journeys.

Indagado, refere que o DAVID terá assumido pessoalmente o pagamento das despesas relacionadas com a reserva dos pacotes das restantes famílias, as quais lograriam restituir-lhe posteriormente os montantes correspondentes a cada uma delas.
Prompted he relates that David will have personally assumed payment of the costs of the packets of the other families, each of which amounts would be repaid to him afterwards.

Deste modo, refere terem chegado a Portugal no pretérito dia 28 de Maio, acrescentando que todos teriam alojamento reservado no "OCEAN CLUB GARDEN" até dia 05 de Maio - data para a qual teriam aprazado o regresso a Inglaterra.
In this way he relates they arrived in Portugal on 28 May adding that all would have lodging reserved in the Ocean Club Garden until 5 May – the date on which they would have returned to England.

Prompted about the motives which contributed to choose the operator Mark Warner he explains that it is usual for this operator to work with tourist complexes that possess some requisites demanded by his familyand the others who make up the group, namely: sports activities with instructors (especially tennis and water sports), childrens' activities, and restaurants within the resort enclosure in a way that they can be accessed without the need for any kind of transportation.

Pressed to define “baby listening” service he clarifies that that service can be summed up as a watching, by doing 'rounds' of the outside of an apartment in the course of which someone checks for noise coming from the location where children are sleepingand, if noise is heard, to alert the respective parents of that situation.

Ainda assim, deseja esclarecer que, aquando da realização das supra citadas reservas, a operadora supra mencionada tê-los-á informado da inexistência de serviço de "baby listening" no "OCEAN CLUB GARDEN".
Furthermore, he wishes to make clear that while making the aforementioned reservations the operator had told them that a “baby listening” service was not in place in the Ocean Club Garden.

Tal facto terá deixado alguns dos casais - e em particular o ora depoente - relutantes em relação a possibilidade de viajarem para Portugal, em razão de todos os casais possuírem filhos menores.
That fact had made some of the couples – and himself in particular – reluctant to come to Portugal because all the families have minor children.

No que a este particular diz respeito, deseja nesta altura acrescentar que, em conversa com DAVID PAYNE, que terá ocorrido em data que não recorda com precisão, mas que reporta aos pretéritos dias 07 ou 08 do corrente mês, este último ter-lhe-á confidenciado que, nessa altura, KATE HEALY ter-se-ia manifestado particularmente relutante quanto à vinda a Portugal, porquanto lhe teria acercado um mau pressentimento, relacionado com as crianças que acompanhavam o grupo e com a inexistência do supra mencionado "baby-listening".
As far as he [MO] is concerned, he wishes at this time to add that, in conversation with DP on a date he does not recall with certainty but likely to have been on 7 or 8 May, he [DP] confided in him that that, at that time, KH had been particularly reluctant about coming to Portugal because she had had a bad feeling [presentiment] about the children of the group and the non-existence of the “baby sitting” service.

Nevertheless, he relates that, they had discussed this problem resolving to make the trip since the operator had assured them accommodation sufficiently close together that, collectively, they had managed to assure the checking and supervision of their respective progeny.

About the inherent conditions of the travel plan subscribed to by the couples, he clarifies that they had acquired “half-board” packets – i.e., inclusive of flight, transfers, lodging, breakfast and dinner.

Nesse sentido, refere que todos os membros do grupo ingeriam as refeições mencionadas no parágrafo que antecede em restaurantes do grupo "OCEAN CLUB", nos seguintes termos: o pequeno-almoço teria lugar no restaurante "MLLENIUM", que se situa ligeiramente afastado do bloco residencial no qual se encontravam alojados (perto da "rua principal, a caminho de lagos, a cerca de 10 minutos a pé"), ao passo que o jantar teria lugar no restaurante "TAPAS", sito junto a piscina do mesmo bloco residencial.
In that sense he relates that all members of the group would eat meals in OC restaurants as follows: breakfast would be at the Millenium, situated slightly away from the residential block where they were lodged (close to the “main street, the lakes road, about 10 minutes on foot”), while dinner would be at the Tapas restaurant, situated next to the swimming pools of their residential block.

The sole exception to this rule would be by the McCanns who would eat breakfast in their apartment, he considering that that was done due to the fact that they had three small children and the distance between [their flat] and the Millenium. Nevertheless he wished to point out that, on the night of 28 May the group had dined at Millenium as the Tapas was closed.

À parte deste episódio, refere que, nos restantes dias, terão jantado sempre no "TAPAS".
Aside from this he relates that on all other days they dined always at Tapas.

No que diz respeito ao almoço, refere que os casais costumavam ingeri-lo em grupo num dos apartamentos dos quatro casais, acrescentando que o faziam normalmente no apartamento do DAVID e da FIONA PAYNE, por este ser o de maiores dimensaes.
With respect to lunch, he relates that the couples usually ate it as a group in one of the four apartments, adding that the Payne's apartment was commonly used due to its larger size.

Instado acerca das reservas/marcações de jantar efectuadas no Restaurante "TAPAS", refere que a primeira vez que procederam à sua reserva foi no Domingo, desconhecendo contudo quem a terá feito. Perguntado se teria sido o RUSSEL a efectuar a referida reserva, a testemunha admite isso como possível, reiterando no entanto desconhecer com precisão quem a teria feito.
Prompted about the dinner reservations/bookings at Tapas, he relates that the first time thay made a reservation was on Sunday, not knowing who had made it. Asked if it could have been ROB the deponent admitted that that was possible, reiterating to not know for sure who had made it.

Relativamente aos restantes dias, esclarece que, na segunda-feira, a sua esposa empreenderia tal reserva, acrescentando ainda que esta o teria feito para a totalidade dos restantes dias, à excepção de sexta-feira, dia 04 de Maio, na medida em que nessa noite iria realizar-se um jantar adstrito ao Clube de Ténis.
relating to the other days, he clarifies that on Monday morning his wife undertook such reservation, adding still that it would have been for all the remaining days except for Friday, 4 May, as there was to have been a Tennis Club dinner that night.

Esclarece que a referida reserva foi feita para nove pessoas, e para as 20H30.
He clarifies that the above reservation was made for nine people for 20h30.

Instado a identificar os apartamentos nos quais haviam ficado instalados os quatro casais, o depoente referiria que o casal McCANN teria ficado no apartamento 5 A, o depoente, esposa e filha, de nome GRACE, no 5 B, o casal O'BRIEN (RUSSEL e JANE) no 5 D, e o casal PAYNE no 5 H.
Prompted to identify the apartment in which the four couples had been lodged, the deponent said that the McCanns were in apartment 5A; he, his wife and daughter in 5B; the O'Brien's in 5D; and the Payne's in 5H.

Quanto a sua disposição relativa no edifício residencial Bloco G, refere que os três primeiros ficariam situados no rés-do-chão, ao passo que o último ficaria no primeiro andar; acrescenta que o apartamento dos McCANN situar-se-ia a extrema esquerda de quem acede àquele bloco pela entrada principal, e paredes meias com o seu próprio apartamento; o apartamento dos O'BRIEN ficaria situado em frente à entrada principal, por detrás da escadaria através da qual se acede aos pisos superiores; e, finalmente, o apartamento dos PAYNE ficaria no piso superior, imediatamente acima do apartamento dos O'BRIEN.
While the above all related to residential Block G, he says that the first three are situated on the ground floor, the last being on the first floor; he adds that the McCann flat was at the extreme left when accessing the block from the main entrance, and immediately adjacent to his flat; the O'B was in front of the main entrance behind the stairway used to go to the upper floors, and, lastly, the Payne flat was immediately above that of the O'Briens.

Asked about criteria for the distribution of couples between the flats as described in the preceding paragraph, he relates that Mark Warner had taken charge of the allotment of couples and flats.

For this reason, he does not know the nature of that criteria, all the more since, similar to the others, he only found out which flat he had been allotted when he arrived at the resort – the time at which they were each given the keys to their corresponding flats, one key per couple (that being a metal key, not an access card).

No seu caso particular, refere que se terá dedicado prioritariamente à prática de desportos náuticos (tais como a VELA) e ainda, à prática de Ténis.
In his particular case, he gave priority to water sports (such as sailing) and, then, tennis.

Relativamente aos restantes, refere que se dedicavam de igualmente a prática de vários desportos salientando que os McCANN nunca se haviam disposto à prática de desportos náuticos.
As for the rest, they also did various sports, pointing out that the McCanns never did any water sports.

A este propósito, refere que, em data que não recorda com precisão, mas que reporta a um dia da semana passada, no decurso do qual teria chovido na Praia da Luz (julgando tratar-se do pretérito dia 02 de Maio, véspera do desaparecimento de MADELEINE McCANN) ter-se-ia disposto a efectuar, durante cerca de 40 minutos, um percurso de corrida pelas ruas que circundam o empreendimento no qual estariam instalados, juntamente com a mãe de MADELEINE, KATE HEALY.
By the way, he relates that, on a date he does not recall for sure but on one day in the past week during which it rained in PdL (thinking it was 2 May, the day before the disappearance) he went on a 40-minute run on the streets around the resort together with KM.

Indagado sobre se alguma vez se teria ausentado da Praia da Luz, responderia negativamente, referindo que, tal como os restantes companheiros de grupo, não se teria disposto fazê-lo porquanto não teria meio de transporte à disposição que lhe permitisse encetar quaisquer deslocações.
Asked about any time he was away from PdL he responded in the negative, stating that, the same as all others in the group, he had not done so because he had no means of transport to facilitate any such movement.

Por conseguinte, e a pergunta feita, refere que nenhum dos casais possuía viatura automóvel alugada.
Consequently, and the question asked, he relates that none of the couples possessed a hired motor car.

- terá acordado cerca das 06H30 e as 07H00, indo tomar o pequeno-almoço ao Restaurante "Milénio" pelas 08H00. Terá tomado o pequeno-almoço com a sua mulher e filha. Não recorda quem se lhes terá juntado. Sabe que o GERALD, a KATE e os respectivos filhos não tomaram lá o pequeno-almoço, na medida em que sempre tomaram esta refeição no seu apartamento. Relativamente aos restantes elementos do grupo, não consegue lembrar quem esteve no Restaurante "Milénio" naquela manhã. Tem a certeza de que não foi acompanhado por todo o grupo, uma vez que não se fazia acompanhar sempre pelas mesmas pessoas, aquando desta refeição- julgando que apenas estaria presente o DAVID ou o RUSSEL e os respectivos filhos.
Acrescenta que, à medida em que os dias foram passando, eram cada vez menos os elementos do grupo que lá iam tomar o pequeno almoço, optando por tomá-lo nos respectivos apartamentos, em razão da distância que medeia aquele restaurante e o bloco residencial no qual se encontra instalado.
Prompted to outline what had happened on 3 May, the deponent the following:
- he woke up about 06h30/07h00 going to take breakfast at Millennium at 08h00 with his wife and daughter. He does not recall who [else] was with them. He knows that GM, KM and their children did not breakfast there because they always did that in their apartment.
Regarding the other group members he cannot remember who was in the Millennium that morning. He is sure that he was not accompanied by the whole group given that they were not always accompanied by the same people during this meal – thinking that only DP or ROB would have been there with their respective children.
Adding that as each day passed there were fewer group members who went there for breakfast, opting to have it in their apartments, due to the distance of the restaurant from their residences.

Após tomar o pequeno-almoço, dirigiu-se apeado para a Praia, onde terá chegado cerca das 09H30, a fim de praticar Vela. Sabe que nessa manhã também lá estavam o DAVID e a FIONA, não recordando contudo se para ali se teria deslocado na companhia de quaisquer destes indivíduos, ou se estes já lá se encontravam aquando da sua chegada. Esteve a praticar vela até cerca das 11H00. Por esse motivo terá chegado tarde à aula de ténis que tinha agendada no empreendimento turístico para as 11H00. Que terá tido a aula juntamente com a sua mulher.
After breakfast he walked to the beach, arriving about 09h30 to go sailing. He knows that on that morning DP and FP were also there, not recalling if he went there with either of those individulas or if they were already there when he arrived. He was sailing until about 11h00 due to which he was late for the tennis class he had booked for that time, together with his wife.

Cerca das 12H10 foi, na companhia da sua mulher, buscar a sua filha ao kids-clubs.
About 12h10 he went with his wife to pick up his daughter from kids club.

Seguidamente dirigiram-se os três para o apartamento do casal PAYNE, a fim de ali almoçarem. Esclarece que almoçou ali com o casal PAYNE e respectivos filhos e sogra, com o RUSSEL e a JANE. Não recorda se lá estariam a KATE e o GERALD.
Subsequently the three of them went to the Payne apartment for lunch. He clarifies that he lunched there with the Paynes, their children and mother-in-law, and with ROB and JT. He does not recall if KM and GM were there.

Posteriormente, em momento que situa entre as 13H30 e as 14H00, o depoente e a sua família foram para o seu apartamento, tendo colocado a filha de ambos a dormir, posto o que ali lograriam permanecer até cerca das 14H15/14H30 - altura na qual decidiu ir procurar o RUSSEL, razão pela qual se teria dirigido ao respectivo apartamento, a fim de o chamar para irem ambos praticar vela.
Later, sometime between 13h30 and 14h00, he and his family went to their apartment to put their daughter down for a sleep, remaining there until about 14h15/14h30 – the time at which he decided to go to find ROB, he also having returned to his own flat, to call him for them both to go sailing.

- Após a prática do referido desporto (ou seja, em momento que situa entre as 15:30 horas e as 15:45 horas), foram ambos para a Praia, onde lograriam encontrar-se com os restantes elementos do grupo (incluindo as respectivas crianças), logrando permanecer ali até cerca das 17H00. Esclarece que o GERALD, a KATE e os respectivos filhos não estavam na praia.
After their sport (sometime between 15h30 and 15h45) they both went to the beach where they met up with the rest of the group, including children, staying there until about 17h00. He clarifies that GM, KM and their children were not at the beach.

Após saírem da praia, deslocaram-se para um restaurante sito na praia, no qual lograriam jantar as crianças, enquanto os adultos se limitaram a beber umas bebidas.
Leaving the beach they went to the beach restaurant where they fed the children while the adults limited themselves to a few drinks.

Cerca das 18H10, o depoente, o RUSSEL e o DAVID, foram a uma partida social de ténis, que teria lugar no empreendimento supra indicado, reservada aos elementos do sexo masculino, na qual lograriam permanecer até cerca das 19H00. Esclarece que quando chegaram à referida reunião, o GERALD já se encontrava na referida partida social, sendo que a KATE e respectivas crianças se encontravam a observar aquela partida, juntando-se-lhes posteriormente as restantes mulheres e crianças do grupo.
About 18h00 he, ROB and DP went to a social men's tennis match, held in the above resort area, where they remained until about 19h00. He clarifies that when they arrived at that meeting GM was already there, with KM and her children watching the match, the rest of the women and children joining them [KM and children] later.

Às 19H00 o depoente, o RUSSEL e o DAVID terminaram a referida partida, tendo-se seguidamente dirigido para os respectivos apartamentos, nos quais já se encontravam os restantes membros do grupo.
At 19h00 he, ROB and DP had finished the match, having then gone to their respective apartments in which they found other members of the group.

O depoente referiu ter permanecido no seu apartamento até as 19H45, altura na qual, juntamente com a sua mulher, ter-se-á dirigido para o Restaurante "TAPAS", onde já se encontravam o GERALD, a KATE e, segundo lhe foi dito posteriormente, a JANE. Depois de si, cerca das 20H50, terá chegado àquele Restaurante o RUSSELL.
The deponent said he stayed in his apartment until 19h45 at which time, together with his wife, he went to the Tapas restaurant where GM and KM were already and, from what was said afterwards, Jane. Later, about 20h50, ROB arrived.

O depoente acrescenta que, como o DAVID, a FIONA e a DIANE ainda não estavam presentes – e em função de ter vislumbrado do restaurante as luzes do respectivo apartamento - resolveu ir ter com eles, esclarecendo que não chegou efectivamente ao referido apartamento, na medida em que o casal já seguia em direcção ao restaurante. Esclarece que os encontrou nas imediações do bloco habitacional, junto à esquina mais próxima da porta da entrada principal do apartamento ocupado pelos McCANN.
The deponent added that DP, FP and DW were still not present – and as he could see their apartment lights burning – he resolved to go to them, clarifying that he did not reach that apartment as those people were already on their way to the restaurant. He clarifies [further] that he met them near the living quarters, at the corner next to the main door of the McCann apartment.

Aproveitando o facto de se encontrar próximo do bloco residencial, acrescenta que, por auto.iniciativa, terá ido fazer uma "verificação auditiva" junto do quarto da MADELEINE e dos gémeos, ao que julga, pelas 21:05 horas. Que se limitou a aproximar-se junto a janela do quarto, na parte exterior do apartamento, para verificar se as crianças estavam a chorar ou acordadas. Benefiting from meeting them next to the residences, he adds that, on his own initiative, he made a “listening check” at the bedroom window of MBM and the twins at 21h05. That he limited himself to approach the bedroom window on the outside of the apartment to check if the children were crying or awake.
He adds to have not heard any noise nor perceived anything out of the ordinary. He went on to do the same check at the bedroom windows of his daughter and ROB's daughters.
