THIRD PAGE BATISTA
She made already statements concerning this process several times and remembers what she stated earlier, repeating here what the content of previous statements.
She is here because, with the passage of time since Madeleine disappeared she has remembered a few details on the testified facts that she believes may be somehow of interest to the investigation.
As she said earlier she was alerted about the disappearance of Madeleine between 22.30 and 23:00. She was at home and was informed of the event via a telephone call.
She drove immediately to the Ocean Club where she arrived a few minutes before elements of the GNR popped in.
After she arrived she went immediately to the apartment A5 where she found several people inside the apartment and outside of it. She entered in the flat but soon left without having spoken with anyone, because she was informed that elements of the GNR were in the principal reception. She went there to meet them.
When she came close to the elements of the GNR she found that behind her was
Gerry, Madeleine's father, accompanied by another man whose identity she doesn't remember. Then Gerry kneeled down, hit the floor with both hands, positioning himself as if he were a praying Arab, and screamed twice of anger, what he said being impossible to understand. Then Gerry stand up and accompanied her (the witness) and the other man in the car of the GNR to the apartment A5.
She entered the apartment and asked for the passports of all elements of the family, and also photographs of the missing girl. She went with Gerry to the GNR car to hand over the requested documents. She mentions she did this, as well
as other tasks, at the request of the GNR Commandant, because she could translate their questions and the missing girl's family's answers.
She remembers Gerry gave the Commandant of several photographs of the missing girl. They were postcard-like pictures, taking into account their size and shape and seemed all the same to her.
She understood also that since the very beginning either Gerry or the others insisted on stating that Madeleine had been snatched, all using the word "abducted" instead of missing, and all showing much interest in informing the press of the situation.
She also recalls entering in the room where Madeleine should be sleeping and remembers now that the door was closed. The room was dark. The blinds were down, some light entering through their holes. The windows were closed and the curtains slightly open. Gerry, who followed her and the elements of the GNR, said he did close the window because of the babies sleeping in the room, a fact she confirms.
Gerry said that when he discovered the disappearance of Madeleine he noticed that the window and the blinds were open and the curtains fluttering.
She recalls that the beds which were in the middle of the room and used by the babies
were aligned and therefore found it strange that someone had taken Madeleine from the bed where she would be sleeping and had gone to the window because there was no space to pass.
She opened the wardrobes of that room in order to confirm that Madeleine wasn't eventually hiding there.
Then everyone left the room and someone shut the door. She remained for some time in the living room, near the GNR elements, Gerry and other elements of the group
who got in and out and spoke on their cellular phones.
She observed that none of the elements of the group including the father and mother
of the child was concerned with looking for her.
The mother was sitting on the bed of her room, the father was with her (the witness) and the elements of the GNR, and other elements of the group got in and out
and spoke on the phone, anxious, in her opinion, to tell the press what happened.
She thought that the child's mother was devastated, the father was worried and
also asked to notify the press and to get dogs to search.
About the others she only remembers that Fiona and her husband, Payne, were hysterical with the situation.
At a certain time, after the arrival of the PJ elements, the parents removed the twins
from the beds in which they were still sleeping and took them to the first floor flat.
At the request of Kate she (the witness) to remove their puppets drink and a blanket that she took to the first floor flat. Only the mattresses remained.
She wanted to mention that around 3h00 Madeleine's parents asked for a priest to be present. They didn't explain why they wanted a priest but she (the witness) was amazed, because there were no indications that the little girl was dead and only in these circumstances is usually asked the presence of a priest.
At some point she translated the statement of one of the ladies who belonged to the group and that she describes as a brunette one. This lady said to the GNR elements, and she (the witness) translated, that she had seen a man on the road who might have carried a child.
This situation surprised her because she (the witness) was convinced that when the lady saw the man, the lady was in a place from where she had no angle of vision for the place where she saw the man. She doesn't know exactly what was the position of the lady when she saw the man, but she knows that the lady said she saw the man in the street in front of the Madeleine's bedroom window, walking in the direction of the street that then leads to the Baptista supermarket.
Asked about the way the members of the group were dressed up in that night, she only remembers that Fiona was wearing a green blouse, that Geny was wearing a dark shirt
and the husband of Fiona wearing clear pants, beige she thins.

I'm surprised with so many hits that no one has pointed out the other important points.

1. Gerry says he was the one who closed the window and drew the Curtains because it was cold.

Question:- Why didn't Kate think of doing this before she rushed down to the Restaurant?

Question: If it was cold, why did this not waken one of the Twins.?

Question: If Gerry gave the Police "a few photographs" together with Madeleine.s Passport,
where did they come from, were they the ones printed by the Staff Member he
and David Payne visited to ask for use of her Printer.? all this done before the
Police arrived at 11pm , instead of searching for Madeleine.

And don't forget the quality photographic paper these posters were printed on which 'could not be bought' in PDL & the PJ could never find the answer to where they got this high quality paper from....especially at 10pm at night in a state of panic of confusion

And the printer itself taking a holiday of its own to France and was never found despite knowing who had the printer (the boyfriend)

i read the printer went back to france with its owner but was then subsequently stolen. cannot say for certain where i read this so may be a forum myth, maybe somebody else can confirm.

I read the Printer was owned by a Female OC Staff Member , could it have been Pennington. Whoever it was, if we assume the photos were downloaded
from Gerry's Camera and must have been the poolside one and the Tennis court one , can anyone remember the Photo used on the first Posters ?

Also, would Kate run out leaving the window open and curtains blowing ?

Amy Tierney was the person who got the printer but i think it was her boyfriends and he took it back to France.

None of the other couples went back to their apartments to mind their children either. They all went around to 5a, or to the reception area etc. Surely they would have split up - one minding their children, the other helping and searching ? Truly bizzare.

whose idea was it to phone sky News? Madeleine had been missing less than 2 hours and could have turned up alive and well later having left the
Apartment and got lost. What could sky news or any other reporter do anyway, so late at night and in another Country.?

The poolside one didn't appear until after Gerry's return from Rothley. The tennins one fist appeared in Pat Perkin's e-mail campaign so not sure where it came from. One thing for certain, both these photos cannot have been from that holiday as the girls in them look very different and of different ages. Also I thought the photos were said to have been down-loaded from Kate's camera.

So why is it so important that the twins were in cots, and not on a bed? What has made him change his story so spectacularly, surely if you discovered your child missing you'd remember precisely where you'd left the other two?

So why is it so important that the twins were in cots, and not on a bed? What has made him change his story so spectacularly, surely if you discovered your child missing you'd remember precisely where you'd left the other two?

I think that statement in the Vanity Fair interview is very significant. The twins were together on one bed? The bed under the window? And the other bed had not been slept in. This could be quite important I think.

It means that any phantom "abductor" entering or leaving by the window, would have had to have literally stepped on the twins. So safe to rule out the window as a means of exit or entry, whether the shutters were jemmied or not.

all of the photos of the beds in 5a are strange. madeleines bed looks hardly slept in, the twins cots look as if they were just being set up. BUT the bed by the window looks as if it was slept in and also the bed in the main bedroom is very messy. i don't mean the clothes etc thrown on top, but the covers and pillows are not made up, ready for bed. so the neat, unused looking beds are those which should have been in use immediately prior to the disappearance and those not in use are the messy looking ones.

were the beds made every day does anybody know ?

I'm now just wondering - was this the bed Kate says she slept in on the 2nd of May? That was a Wednesday, the day the cleaner would come. So I don't see her bothering to make the bed under the window. Am I wrong about the quiz night? Or was that the 1st?

Still can't see the significance of her sharing the children's room that night, unless she wants to explain the rumpled bed. Dear, dear, all these red herrings.

I think that is the bed that Kate was supposed to have slept in, but I think that's another of those red herrings.

as other tasks, at the request of the GNR Commandant, because she could translate their questions and the missing girl's family's answers.
She remembers Gerry gave the Commandant of several photographs of the missing girl. They were postcard-like pictures, taking into account their size and shape and seemed all the same to her.
She understood also that since the very beginning either Gerry or the others insisted on stating that Madeleine had been snatched, all using the word "abducted" instead of missing, and all showing much interest in informing the press of the situation.
She also recalls entering in the room where Madeleine should be sleeping and remembers now that the door was closed. The room was dark. The blinds were down, some light entering through their holes. The windows were closed and the curtains slightly open. Gerry, who followed her and the elements of the GNR, said he did close the window because of the babies sleeping in the room, a fact she confirms.
Gerry said that when he discovered the disappearance of Madeleine he noticed that the window and the blinds were open and the curtains fluttering.
She recalls that the beds which were in the middle of the room and used by the babies
were aligned and therefore found it strange that someone had taken Madeleine from the bed where she would be sleeping and had gone to the window because there was no space to pass.
She opened the wardrobes of that room in order to confirm that Madeleine wasn't eventually hiding there.
Then everyone left the room and someone shut the door. She remained for some time in the living room, near the GNR elements, Gerry and other elements of the group
who got in and out and spoke on their cellular phones.
She observed that none of the elements of the group including the father and mother
of the child was concerned with looking for her.
The mother was sitting on the bed of her room, the father was with her (the witness) and the elements of the GNR, and other elements of the group got in and out
and spoke on the phone, anxious, in her opinion, to tell the press what happened.
She thought that the child's mother was devastated, the father was worried and
also asked to notify the press and to get dogs to search.
About the others she only remembers that Fiona and her husband, Payne, were hysterical with the situation.
At a certain time, after the arrival of the PJ elements, the parents removed the twins
from the beds in which they were still sleeping and took them to the first floor flat.
At the request of Kate she (the witness) to remove their puppets drink and a blanket that she took to the first floor flat. Only the mattresses remained.
She wanted to mention that around 3h00 Madeleine's parents asked for a priest to be present. They didn't explain why they wanted a priest but she (the witness) was amazed, because there were no indications that the little girl was dead and only in these circumstances is usually asked the presence of a priest.
At some point she translated the statement of one of the ladies who belonged to the group and that she describes as a brunette one. This lady said to the GNR elements, and she (the witness) translated, that she had seen a man on the road who might have carried a child.
This situation surprised her because she (the witness) was convinced that when the lady saw the man, the lady was in a place from where she had no angle of vision for the place where she saw the man. She doesn't know exactly what was the position of the lady when she saw the man, but she knows that the lady said she saw the man in the street in front of the Madeleine's bedroom window, walking in the direction of the street that then leads to the Baptista supermarket.
Asked about the way the members of the group were dressed up in that night, she only remembers that Fiona was wearing a green blouse, that Geny was wearing a dark shirt
and the husband of Fiona wearing clear pants, beige she thins.

Sorry to quote this whole post - I've bolded two bits: re the passports and the photographs.
There are photographs PJ I presume of these passports on the table - although there are only four - so either the GNR/PJ took only Maddie's passport or the photograph was taken before Silvia Batista took them to the police and the fifth passport was elsewhere. Just a niggle. Passports ready on the table, not a safe place?

She doesn't state at what time the photographs were handed over. It sounds - like the passports as if it was early in the proceedings. Although allegedly ROB took a USB key to reception to print the first poster with handwritten message (this was printed on the OC copier) and then used the USB key to print the high quality photographs - 30 - 40 of them according to the girl who printed them.

I'm just thinking this all happened rather later in the evening? Past midnight?
It also seems that Batista had nothing to do with clearing the apartment because of contamination.

what strikes me about that photograph with the handwritten note is "age 3". in my experience there is a big difference between a child at aged 3 and at aged 4. if it were me in that situation i would have described my child as 4 years old. there was not six months in the difference, just a matter of days before her 4th birthday.
a child of 3 can easily be imagined as small, in a buggy, not overly talkative. at 4 a buggy would be usually out of the question and as we have been told madeleine was a great communicator.

The poolside one didn't appear until after Gerry's return from Rothley. The tennins one fist appeared in Pat Perkin's e-mail campaign so not sure where it came from. One thing for certain, both these photos cannot have been from that holiday as the girls in them look very different and of different ages. Also I thought the photos were said to have been down-loaded from Kate's camera.

Yes, it's really weird isn't it?? And the first poster... no height, no weight, no eyes/hair color, age 3 instead of 4... It's VERY strange.. Who would want to use an old picture for a missing child, it makes no sense..

Hi maive......Your child goes missing between 9.15pm and 10pm , yet instead of immediately searching the surrounding area ,what do you do?
Why you immediately find someone with a Printer, not easy at that time of night , ask her to print some photos of Madeleine to show to the Police but
you don't use those same photos for a Poster urging the public to look for your Daughter.??????
