She comes to the process as a witness.

Being of English nationality and not dominating the Portuguese language, she is assisted by the interpreter Filipa da Silva.

She has been in Portugal since the 15th March, the date upon which she began work at the tourist resort called the Ocean Club in P da L, Lagos where she works as supervisor of the infant educators at the resort in accordance with her work contract previously signed in London.

With relation to the facts being investigated she says that in the execution of her duties at the resort she had several contacts with the girl called Madeleine McCann, although she says these were formal and short, referring to the fact that the girl belonged to the Mini Club group of children and clarifies that that definition is given to the group of children aged between three and five years old.

When questioned, she says that this group of children belonging to the Mini Club are supervised by her colleague Amy Tierney, who in turn coordinates a group of nannies called Catriona Baker and Emma Wilding, employees who were on duty for that group in the week in question, from 29th April to 4th May 2007.

The witness also clarifies that the Mini Club is sub-divided into two groups of children and that Madeleine was under the responsibility of Catriona Baker.

The Mini Club began at 09.00, making a break for lunch between 12.30 and 14.30 when the afternoon session would begin, lasting until 17.30. She adds that from 19.30 the resort crèche offers a complementary “dinner” service which ended at 23.30, which had an additional cost, the parents could also request another babysitting service that did not have defined hours but that would be agreed upon between the parents and the witness.

It is mentioned by the witness that during the period of time that the children were at the crèche they would be busy with different activities that could take place inside the installations of the resort, but which could also take place outside the resort, mainly on the beach, accompanied by employees from the tourist complex.

Accordingly, the witness states that on a date she cannot remember, but that it had been last week, Madeleine participated in a boat trip organised by the crèche together with other children from the Mini Club, accompanied by the employees (nannies) mentioned above and by the respective aquatic sports instructor whose name she cannot remember.

When asked, the witness states that Madeleine McCann was accompanied by her parents, Kate and Gerald McCann and that they were staying in apartment G5 A of the tourist resort.

On 3rd May at about 22.20 she was informed by her colleague Amy Tierney that Madeleine had disappeared, a fact which led to the initiation of the “Missing Child” procedure which consists of dividing various areas of the resort up between different employees in order to proceed in the search for the missing child.

Accordingly, she explains that at about 22.25 this procedure was begun with the resort being divided into three separate areas, the northern zone, the central zone (the rest of the resort area) and all the paths and roads that made up the resort and ended in P da L. For this purpose the witness mobilised and initiated the procedure with 5 employees from the resort who, in turn, were helped by different individuals (other employees, tourists, residents) during the search.

Later, she is not sure at what time, the local police arrived at the resort, took stock of the incident and began the respective measures for this type of situation.

When questioned, the witness says that the searches undertaken by employees from the OC finished at about 04.00 on the morning of 4th May with negative results.

When questioned, the witness says that when she was informed about Madeleine’s disappearance she was alone at home and left immediately to initiate the procedure described above.

When questioned, the witness says that as she did not have direct contact with Madeleine as she was merely the supervisor of the infant educators of the crèche, she does not know about the child’s habits or those of her parents and that no strange situation concerning the girl was communicated to her during the time she was working in Portugal.

When questioned the witness says that she has no knowledge of any type of situation that she finds suspicious or that could have anything to do with the disappearance, either directly or indirectly.

• Knew the McCann family since 29th of April as they would drop off their toddlers—Sean and Amelie—in the Toddler Club;
--- From 29 April until 3 May she was with those children every day.
• She also knew Madeleine as she would frequently come talk to her brother and sister when picked up by her parents;

--- From what she was able to observe, Madeleine was an active and sociable child and that when with her siblings [at collection time] she was excited and happy to see them.
--- She states that during her work, either at the care centres or at the outside places where she took the children to play, she never noticed, in the time she has been here Portugal, anyone in particular acting suspiciously or watching the children.
--- She states that she never heard any comments about such things from her colleagues.
--- Notwithstanding her and her colleagues being English, in the time she has been in Portugal she has met Portuguese people, and no-one has ever asked questions about her work, about the children she cares for or the McCann family in particular.
--- She states that since the disappearance of Madeleine she has seen or heard nothing that could explain what was behind it [the cause of it].

She comes to the process as a witness.

As she does not understand Portuguese and is of English nationality she is assisted by the interpreter Robert Murat who accompanies her during the questioning.

When asked, the witness confirms that she has been in Portugal since the 18th March 2007 having come to Portugal to work in this tourist resort.

She confirms that she works as head of the Baby Club and Mini Club, the former being for children aged up to eleven months and the latter for children aged between three and five.

She confirms that Madeleine is known by her as frequenting the Mini Club, as she was aged almost four.

When questioned about Madeleine’s behaviour, the witness says that she is a shy girl but very intelligent for her age, she tended to play with older children, the witness describes her attitude and behaviour as perfectly normal.

The witness confirms that she also knows Madeleine’s parents as they would go to fetch her from the club, but she adds that it was normally Madeleine’s father who did this.

When questioned, the witness states that she has not noted anything abnormal in the relation between the child and the parents.

The hours of the club are from 09.00 to 12.30 and from 14.30 to 17.30, the club is closed on Sundays on that day it only offers the dinner service.

When questioned, she says that if the guests wish so they can request services from the “Staff” who would look after the children from 19.30 to 23.30, however Madeleine’s parents never did this although the service is free.

She confirms that, on the night of the disappearance she was on duty and immediately went to the bedroom to see if the girl was hiding. She saw that the shutter was raised and that the window was partially open. It was then that she began to look in the wardrobes to see if the girl was hiding.

The first idea that occurred to her was that the girl could have left by her own means, however after checking that the window was open and the shutter raised she asked the parents whether Madeleine’s shoes were there, to which they replied that they were, these facts led her to think that Madeleine could have been taken by someone.

However there was a bed against the window, which could have enabled the girl to climb up onto it and then up to the window, the witness thinks it would not be possible as she would not be able to open the shutters and even if she had done so she would have fallen outside as the window is too high for a child of that age to be able to descend without falling.

In reply to the question asked, she said that the back door (porta das traseiras) that leads to the parking area was closed, but she doesn’t know whether the front door (porta da frente) was locked as when she arrived both the parents and a female friend of theirs whose name she does not know, were there and that is why the door was open.

After having searched the apartment and verified that the girl was not there, the outside searches were begun.

The witness confirms that the girl’s father went to the reception to call the police as soon as her disappearance was noticed and that twenty minutes had passed. The GNR took 30 – 35 minutes to arrive.

She says that at no moment did she notice anyone behaving strangely as concerns the children or anything that appeared at all suspicious to her.

She adds that the staff looking after the children were eleven employees, who worked in shifts regarding the hours from 19.30 to 23.30.

The witness remembers that upon entering the bedroom at the time of the disappearance, she saw that the bed that the two babies were sleeping (reparou que a cama que os dois bebés encontravam-se a dormir) and she saw that the bedclothes of the bed near the window were rumpled as if someone had been sitting there, that the bedclothes of Madeleine’s bed had been pushed back and that on top of the bed was a small child’s blanket and a cuddly toy.

She states that the distance between the apartment and the restaurant where Madeleine’s parents were was 30 seconds by foot away but that there was no visual contact with the back window of the bedroom where Madeleine was. From the restaurant just the front window of the apartment could be seen.

The witness does not remember any element that could be useful to the investigation.

• Although he has seen many pictures of Madeleine, he cannot say for sure if he saw her or her siblings in person;
• Remembers that the group travelling with Madeleine’s parents totaled nine adults;
• His recollection is that the group arrived on the 28th of April (Saturday), the same day in which the “Tapas” restaurant does not serve dinner and closes at 19H00;
• He believes that the group first ate at the Tapas restaurant on Sunday (29/04/2007) and cannot remember if they had lunch or drinks;
• Of the entire group, Madeleine’s father emerged as the greatest talker, sympathetic;
• They would arrive for dinner at 20H30 or 21H00 since these were only the reserved hours one could make at the reception;
• When questioned, he noted that it was normal for diners to stay in the restaurant until approximately 23H30/24H00;
• The group showed themselves happy with the food;
• He also noticed that some members of the group would leave at certain times and later noted that it was to check-on the children although he believed that this checking was in a proper Luz Ocean Club facility (such as the crèche).
• He was at work the night Madeleine went missing;
• At roughly 22H20/22H30 he verified that only one person remained of the group--the older one—joking with her that “they had left her alone”. The woman in question told him that all had gone to the apartment to look for a missing child. Minutes later. Looking very troubled, was Gerry, looking for his daughter everywhere, and focusing on the immediate poolside areas. Shortly after, many people were looking for Madeleine;
• The witness said that Madeleine’s mother screamed desperately for her daughter;
• The chef from the Millenium restaurant was called to help in the search and together with other Warner staff, the searched until 05H00. He remembers that around 50 or 60 people helped in the searches looking everywhere in the club, around the area, in the proper Luz village, the beach area, among others;

• She could not respond to the question of Madeleine’s behaviour as she had no direct contact with the child;
• She confirms that she knows Madeleine’s parents, as they were the ones who came to pick up the twins in the club. She never spoke to them;

• She noted nothing out the ordinary or nobody out of character;
• Adds that the staff dedicated to children is 11 in total, and work in turns during the 19H30 to 22H30 shift;
• Affirms that the distance from the restaurant to the McCann apartment was about 2 minutes by foot, and that there was no visual contact to the patio doors and to where Madeleine was staying. From the restaurant, one can only see the front window of the apartment.

• Works daily from 16H00 to 24H00, with the exception of Saturdays, where he begins at 11H30 and leaves at 18H00;
• The nationality of the clients who frequent the restaurant are mostly foreign nationals (mostly from the U.K.) and who stay in the Ocean Club;
• Was aware of picture of the missing child and the group of British tourists that accompanied her but was unaware of their names;
• About a week before the disappearance, the same group would dine almost exclusively at the Tapas restaurant;
• During the times he saw the group dining in the restaurant, he never saw any children with them;
• He does not remember having seen Madeleine “face to face”, and knows her from the photograph circulating at the time of her disappearance;
• It was normal for the men of the dining group, to get up and leave the restaurant and return minutes later. The witness is not aware of where the men were going to but that they would be gone for about 15 minutes;
• The witness can speak clearly to these events because many times he had to bring back the entre/dinner plate of said client(s), until they returned to the table;
• Remembers that on the night of Thursday, the 03rd of May, 2007, Madeleine’s parents dined at the Tapas restaurant, together with the normal group of people. He believes that they arrived between the hours of 20H00 and 21H00;
• He remembers that it was around nine people and remembers having taken the orders of the group;
• Later, between 22H00 and 22H30, he was in the kitchen, and was alerted, by a colleague, to the fact that a guest entered the restaurant screaming, and at this point, the entire group left in a panic;
• His colleague proceeded to tell him that the (screaming) individual indicated that a child had gone missing;
• A few minutes later, the witness noticed that there was a lot of agitation, with many people looking for the child;
• The information that followed was that the missing child, a girl, was the daughter of one of the British couples, referred to above;
• At this point, the witness states that there was no suspicious activity, that he was aware of, around the Ocean Club immediate areas;
• No one asked the witness about the habits of the group or about other groups in particular, or the children of said groups;
• Also states that on Thursday, the day Madeleine disappeared, as he arrived at work, he did not notice the presence of anyone who looked strange/out of place or of a suspicious nature;
• Witness states that towards the end of the day, the immediate restaurant area, is a quiet area with nor many people about;
• The witness notes that with regards the disappearance of Madeleine, there is nothing else he can add or comment on that would clarify the motive of the disappearance.

• He serves the tables of said restaurant and from 16H00 to 18H00 snacks are served with dinner from 19H00 to 22H00;
• It is not usual to have people who are not guests of the resort, but this sometimes does happen;
• During his hours of work he does not recall having seen anyone who was not a guest of the resort taking refreshments in the Tapas bar;
• In order to enter the restaurant it is necessary to present a guest card in the restaurant reception. It is only this year that the restaurant has been open to the outside public—and he does not remember anyone from the outside having been served;
• Madeleine’s parents would dine every day in the restaurant—a group of nine people;
• He never noticed the children accompanying the adults during dinner;
• The members of the group would usually eat around 20H00 to 21H00 and only when all of them arrived would they begin to eat;
• It was usual, during these dinners, for one or two persons to get up and leave for around 15 minutes and on various occasions he saw a walkie talkie (likely the Payne baby monitor) on the table. He assumed that they would leave to go check on the children in their respective rooms;
• On the 3rd May, the witness arrived at work his normal time at 16H00 and for the first time saw Madeleine’s parents at dinner time which was around 20H45;
• He does not remember if the McCanns arrived together and whether they were the first ones to arrive at the table;
• It was one of his colleagues that served the table; he does not remember if it he served Madeleine’s parents at all;
• He remembers that on the 3rd of May one of the guests who was at the table left for ten minutes, as he was about to serve their starter, and was told to hold it for a few minutes—but it was 15 minutes before this guest returned, around 21H45;
• He does not remember having seen Madeleine’s parents leave the table but it is possible that someone may have left and the witness did not see them;
• Dinner finished at around 21H45 and some minutes passed where the witness looked towards the table but saw no one—his colleague told him that all the guests of that table left rapidly and abruptly. He remembers having heard shouts in the direction of the McCann apartment;
• He did not notice anything out of the ordinary in the restaurant or any strange behaviour of guests;
• When he heard the shouts coming from the direction of the McCann apartment was when he realized that Madeleine had gone missing;
• The table where Madeleine’s parents sat did not have a clear view of the apartment but only to the patio door and the time in which this was happening there is no light in that location, made worse by the fact that around the restaurant there is an opaque plastic covering;
• He was not aware of suspicious people around.

• Works between 16H00 to 24H00 and was on holidays from 02/05 and 03/05;
• Also did not work on 01/05 due to illness;
• After speaking with his colleagues, he learnt that Madeleine was related to a group of people who would dine in the restaurant in which he works—Tapas—at a big table;
• Does not know if this group took refreshments ate lunch in the restaurant. He does not remember the children having been at the restaurant with the children;
• The only person he actually remembers is that of an adult male, tall, with his bangs combed back;
• He cannot say with absolute certainty but believes that on this group’s table was a monitor normally used for listening to children;
• As already stated, he returned to work on Friday, 04/05, at 16H00, and noticed the confusion in the search for Madeleine and the desperation of the family;
• States that the locale in which the group sat, it is difficult to see the apartment from where Madeleine disappeared;
• In reality, there are physical obstacles like a plastic transparent panel which works as a blind; walls and vegetation;
• From that vantage point, it may be possible to see a light on in the (McCann) apartment but little more than that;
• Is aware of some break-ins that have occurred in the complex, as has occurred in other clubs, principally in the lower-level apartments;
• Is not aware of any important fact which could help locate the child;

• She was worked at The “Ocean Club” resort for six years as a cook in the Millenium restaurant;
• Relative to the facts of the investigation, on May 04, 2007, at around 06H50, she received a ride from her work colleague Alice, who informed her that a female child who was staying with her family in an Ocean Club apartment had disappeared the night prior;
• She states that she never saw the child in question, nor did she ever see her siblings or parents, except when various pictures of the family began showing on newspapers and television and in many spots around Lagos;
• It is normal for her not to have had any contact with the McCanns due to her line of work and only saw the parents of the missing child and Madeleine’s sibling after the disappearance;
• Confirms that on the day of the disappearance, May 03, 2007, she worked in the restaurant from the hours of 07H00 to 15H00 which were her usual hours of work from Tuesday through Saturday.
• After work she went home where she stayed until 17H00 leaving only for thirty minutes to go shopping. She returned home, where she stayed until 06H50 the next day (04 May 2007) in the company of her family (husband, two sons, and two brothers), which coincided with the hour she received the ride from her colleague;
• The witness is not aware of any information that would be considered suspicious or that could help further direct the investigation.

• States that the majority of those who visit the bar are foreign nationals, most of which are British citizens;
• Stated that he only learnt of the disappearance on the 04 of May 2007, at around 12H00, after a telephone call with his girlfriend (as he was off on Thursday);
• Notes that he did see a picture of Madeleine on television, newspapers and posters and does not remember having seen Madeleine nor her parents in person near the “Top Bar” where he works;
• For this reason, he does not believe that they frequented that locale;
• States that since he has been working at the bar, he has never been asked by anyone regarding the tourist habits or about their children of said complex. He also is not aware of any person or people who circulated the complex with strange attitudes/appearances;
• The witness does not have the slightest idea as to reasons for the disappearance, and unfortunately, has no further information that would help the police.

• Her hours of work are from 07H00 to 12H00, Tuesday through Saturday;
• Clarifies that she only attends breakfast clients, with the exception of Wednesdays, when the restaurant hosts a “BBQ night”, and where she works from 18H00 to 22H00, receiving dinner guests;
• Notes that in her line of work, she knows almost all of the “Ocean Club” guests and that almost all of them frequent the Millenium restaurant since it is the only establishment that serves breakfast;
• Knows the McCann family, made up of the parents, a daughter (missing Madeleine) and the twins;
• The witness received the McCanns for breakfast on Tuesday, Wednesday, and Thursday, and is unaware if they ate there on Sunday or Monday since the witness was off work those days;
• Clarifies that breakfast is served between 08H00 and 10H00 and that the McCanns usually arrived between 08H00 and 09H00;
• Affirms that the McCanns appeared to her a normal family, where all elements of said family had a good relationship between each other. That Madeleine appeared to be very tied to her father, as she was also close to him.
• As part of her function, she needs to get involved with the children and noticed that Madeleine appeared very timid, and did not answer the witness. She also clarifies that her last sighting of the clients in the Millenium was at the entrance of said establishment as she did not look towards the tables or the buffet zone;
• That she became aware of Madeleine’s disappearance on Friday morning (04/05/2007) from a friend named Alice. Alice recounted the story to her when she cam to pick her up and drive her to work;
• The complex zone is calm and the while the witness is aware of a few small break-ins, the whole situation left her very surprised;
• Does not have any information regarding the motivation for Madeleine’s disappearance.

• Specifies, meanwhile, that his place of work is frequented principally by individuals who are guests, the majority of which are British nationals;
• But it is possible for non-guests to enter the restaurant but that these individuals are restricted to an area (restaurant and bar) and are not admitted to adjacent areas (such as the garden, pool, and tennis courts);
• The aforementioned areas can only be used by guests of the “Ocean Club”—services for that establishment can be accessed from 08H00 to 01H00;
• For reasons of security, all those entering the restaurant are registered
• And must show their card (that shows their name(s), apartment number, check-in and out date) to gain entry;
• In regards to the Thursday in question, since it was his day off, he was not around the tourist resort;
• On the morning of the disappearance, he was around the area of Luz, taking care of personal matters and returned home around 11H30/12H00;
• He spend the afternoon of may 3, 2007, at home and again left around 17H30 to go for dinner to a restaurant “O Marujo” with his mother in Praia da Luz;
• Following dinner, he used public transport to get to Lagos;
• He only found out about the disappearance on Friday morning, when he showed up for work;
• Specifies that he cannot add anything more since he was in the are when the disappearance occurred and did not witness any strange movements/suspicious behaviour in the previous months;
• Relative to the McCann family, he can add nothing related to the case but only can state that they frequented that commercial establishment in the morning (at breakfast time);
• He cannot guaranty with certainty but believes that they were clients at that time;
• For the time following work (after 15H00), he can refer to nothing.

• Questioned on the relationship the McCanns had with their children, she is unaware and did not pay attention to such;
• Affirms that at no time did she witness the presence of anyone out of the ordinary, or with the children, or anything that appeared strange or suspect;
• Became aware of the investigation from her boyfriend, Nelson Rodrigues, who works as a barman in the Ocean Club, and who telephoned her around 23H00/23H30, on the 3rd of may, 2007, telling her that we would be home late as a child had gone missing and they were looking for her;
• Her boyfriend arrived home at 04H00 the following morning (04 May 2007);
• Apart from this moment, she became aware of the facts through the media;
• Has no other elements to offer that may be useful to the investigation.

• Is the proprietor of Refugio, a restaurant situated in Burgau, for about one year;
• The witness states that on May 1, 2007, day off, at around 16H00, a couple appeared motivated by adverts in a lock of apartments in “Sol e Mar” in Burgau, in order to reserve a dinner table. The couple reserved the table closest to the door for 19H15;
• At that time the couple appeared and occupied said table;
• Almost immediately, the women began to photograph the interior of the restaurant without asking for permission. This situation captured the attention of the witness because his clients, tend to be of a ‘posher class’ and are more discreet in their conduct. This couple’s clothing was of a vulgar fashion;
• The women proceeded to photograph everything, people and objects for around 10 minutes. When she stopped photographing, the witness brought her a menu. They began to speak English, regarding fishes and as she could not identity—the tamboril (a fish)—she asked the witness if he knew the name in German. He responded no, that he did not. At the next table, there sat a German couple who gave the woman the name of the tamboril fish in German;
• From that sequence of events, the witness presumes that the client was not German, asked her nationally, to which she replied, Polish;
• Meanwhile, the client ordered an entrée and drinks (half a bottle of red wine of Monte Velho) and a bottle of water without gas;
• Witness adds that while he served the drinks, the woman took many pictures of the witness, without asking his permission. The witness, bothered by the situation, in an ironic form, told her that in order to continue taking pictures, she would have to pay after which she stopped;
• This woman took her pictures with a digital camera, or small dimensions, but he did not catch the brand or characteristics;
• He served her entrée: Mexilhao a Provencal and “Alabote with caper sauce” to the male who devoured the entrees within 5 minutes. The woman took a bit longer and did not eat everything. They did not have desert and did not have coffee;
• The individual asked for the bill and paid cash. After and hurriedly, the couple left the restaurant without saying goodbye to parts unknown;
• He noticed that they left on foot. They did not go by car as if they had the care would have been parked well away from the restaurant;
• He describes the woman as Caucasian, around 32/33 years of age, blonde and in a pony-tail with clips. He believed it was not combed often. She also had dark eyes and was of normal height. She had a slim face and was around 170 cm tall and slim. She was wearing a printed beige dress and a bordeaux coloured jacket. She also wore trousers but he did not record the details. He did not look to her shoes;
• The male, also Caucasian, was around 35 years, about 180cm in height, dark hair combed to the back, slim face, dark eyes, rectangular glasses with transparent lenses in black frame. He was wearing a black shirt and a black jacket. His trousers were also black. He does not remember other details of his clothing;
• He had the sense that the couple were people with money and of culture;
• Confronted with a photograph in the file, the witness identified the two people who could be found behind the individual, as the couple who ate in his restaurant ton May 01, 2007;
• States that the couple did not return to the restaurant after that time and he did not see them again;
• States that the couple did not comment on their visit to Portugal. States that they only spoke of fish. Nothing more. During drinks, he saw the couple speaking to other clients;
• States that the individual, when he reserved, did so in the book and the witness offered to make a page for authorities.

• Has worked in his current role for seven years, and in total has worked for the complex for 18 years;
• His duties consist of the management of reservations and control of contractual transactions with private individuals and with travel agencies;
• He is also responsible for the management and supervision of the reception;
• The witness affirms that, as is normal practice, he received the manifest with the McCann reservations through the Mark Warner agency, who is represented by Mr. John Hill;
• This manifest consisted is normally composed of specifics for each booking, and as is regular, a ground-floor apartment in order that the family may have easier access with small children;
• Adds that this family, arranged to stay from the 28th of April until the 5th of May 2007 with half-pension, which means breakfast and dinner were inclusive. For dinner, the guests may opt for two restaurants—the Tapas or Millenium even though the food is identical at both. The selection of which is a matter of distance to the apartment;
• In this case, it is rational to choose the “Tapas” as it is around 100 meters from their [McCann] apartment as opposed to the “Millenium” which is about 600 meters from said place;
• From the restaurant, it is possible to see part of the apartment front, which includes the lounge of the McCann apartment. The room where the children slept, is completely out of the vision of anyone who may be in the “Tapas” bar;
• Therefore, the best solution would be to leave the children in the parent’s bedroom or in the lounge area, where it would have been easier to facilitate the watching of the locale in question from where the parents dined;
• A “baby sitting” service, also available, runs from 19H30 to 23H30 and the witness affirms that such service are free to guests;
• He does not understand why the McCanns did not request this service, as it is free of charge;
• Prior to the disappearance, he had no contact of any type with the family and only knew them as one of hundreds of other guests who frequent the complex;
• In regards to the disappearance, on the 3rd of May, 2007, he remembers that around 22H00/22H15, he received a telephone call from the receptionist—Helder, who informed him that John Hill wanted to speak to him urgently in regards to a child who had gone missing and that the G.N.R. who had already been contacted, had yet to arrive. He added that he had already called them various times and was told that they would arrive as soon as possible as they were taking care of a robbery in Odiaxere. The receptionist asked whether he could contact the P.S.P., but he told him no, as this area was covered by the G.N.R.;
• Given the circumstances, the witness immediately left to the complex to assess the situation;
• He reached the locale, 15 minutes later, went directly to the reception, where the G.N.R. had already arrived and were collecting a deposition from Gerry McCann;
• The witness then went to the apartment, where he found a number of people, and noticed that there was no sign of attempted robbery or of forced entry;
• States that he heard in the area that the mother had not left the blinds open and would always shut the blinds when she left the apartment. He did not notice anything abnormal in relation to the residence or the immediate area;
• The witness affirms that the complex does not have any type of security, or CCTV;
• Affirms that at no time did he notice something or someone out of the ordinary/suspicious, concerning the children;
• The witness was asked a copy of the booking/room list outlining all the elements/reservations made by the guests and the family in question which is available immediately following this statement;
• Witness affirms that he nothing else to record that could help the investigation.

• Since the age of 18 has worked in the tourist complex known as the Ocean Club, situated at 44 Rua Direita, Praia da Luz, Luz, Lagos, as an accountant. The locale of his work is in the offices of the reception in the aforementioned complex;
• Relative to the investigative facts, the witness notes that on May 03, 2007, (Thursday), at around 23H00, finding himself at home, in the urbanisation Ramalhete, Casa H, Praia da Luz, Luz, Lagos, situated close to ht e complex area already mentioned, he noticed “much movement and traffic out of the ordinary,” outside (frequent passing-by or vehicles and individuals) for the hour in question. For this reason, he went to lookout his window. He came across a work colleague—Joao Carlos Batista (maintenance chief of the complex) who told him what had happened. Joao told him that a child had disappeared. Said child was lodged at the tourist complex;
• He assumed that the child would appear momentarily and returned inside his home where he stayed until 08H00 the following day (04 May 2007);
• On that following day (04 May 2007), at around 08H00, the witness’ supervisor (Robin Crossland) went to his home, asking him to compose a document in Portuguese relating to the missing female child from her apartment so that it could be distributed to the immediate areas;
• It was at this moment when the witness understood the gravity of the situation, having been informed that the missing child had not been found since 22H00 the following day (03 May 2007). This child was female, her name was Madeleine, she was three years of age, of British nationality, and was lodged, together with her parents and siblings, in an apartment block 5 (water side gardens) in the Ocean Club establishment;
• The witness upon arriving at work immediately began working on the aforementioned document translated into the English language and was handed over by Robin Crossland;
• The witness did not know the minor in question or the rest of her family or group and only saw Madeleine and her family after the disappearance in media outlets;
• The witness clarifies that on the day of the disappearance, he carried on with his normal routine, and that around 09H30 reached his office, having lunch at around 13H00 and 14H30, returned after that, and stayed there until 18H00;
• Prior, he went to Portimao in his car, where he met his mother for an appointment/consult with the Alvor Hospital. He returned alone around 21H30, after having dined in Alvor and stayed at home until the next day;
• Relative to the facts of the investigation, the present witness only knew of the events from what he heard from media outlets and from conversations with his colleagues;
• He has nothing else to add than that which has been stated referring to the fact, as already recorded, said child accompanied her parents on holidays, together with her siblings;
• He is not aware of any suspicious activity, directly or indirectly related that could help the investigation.

• The robbery was carried out when the guests had left for dinner shortly after having checked-in and left their baggage in the room;

• She states that she was never told of any suspects or whether and of those that committed the crime had been identified;
• Is not aware of an strange/suspicious individuals in the interior or exterior of the complex during her entire service to the resort. She adds that she has never been questioned about the type of guests that frequent the resort, but that only some friends have asked her if there was work to be had in the cleaning sector of said establishment;
• On the 3rd of May, 2007, she came to work as normal, at 09H30, left at 13H00, having gone to lunch at home in Lagos and returned at 14H30;
• In this period, she does not remember having seen any individual or vehicle that caught her attention;
• At round 18H30, she left work and went home and again did not see anything out of the ordinary or suspicious in the interior or exterior of the establishment;
• She became aware of the facts the next day, Friday, via a colleague of hers.

She is responsible for the apartments with the exterior areas, pools and communal areas (gardens and others) being the responsibility of other departments;
. In this form, and for a better understanding of the organisation of the tourist complex, whose structure has already been explained;
. The deponent further clarifies that practically all the apartments of the tourist complex and privately owned, and the Ocean Club just manages them. For this reason, the complex works with various travel agencies which contact them to rent apartments with certain features/options made b the clients;
. Concerning the McCann family, she remembers that after reading the booking list for check-ins for the 27th, this family had contracted with the Mark Warner travel agency. This agency informed that tourist complex that for that family they needed a type T2 apartment, as they were a family of 5, not specifying the number of children nor their ages;
. She further adds that the respective travel agency contacted and activated the “CHILD CARE” service. This service is composed of employees of British nationality, who are installed for their length of service in the tourist complex. On the eve of check-in, this service is directed by the administration of the Ocean Club with and end to collecting the key to the respective apartment. Given that this service is related to the travel agency, it is they who give the keys to the guests, and not the “Ocean Club.” This service is who was responsible for the placement of children’s beds in the rooms. The deponent further states that her responsibility is the hygiene of the apartments, not touching the children’s beds, as it is the CHILD CARE service which effects the changing of bed linens of these same beds;
. On these terms, aided by the list which she was given as to the program of cleaning mentioned previously, she remembers that the McCann family, arrived to the apartment on the 28th of April with their check-out date booked for May 05;
. During the stay, as with any other client, the cleaning is carried out on Mondays, Wednesdays and Fridays. The collection of rubbish is carried out on Tuesdays and Thursdays with Saturdays being the day were a deeper cleaning is carried out. Referring to block 5 where the McCann family lodged, the person responsible for cleaning there is employee Mara Julia Serafim Da Silva; also being an aid to the preparation of the apartment before check-in for new guests. Before the McCann check-in, Maria Julia had aided Dina Maria Does Reis Rocha as she was more available;
. Before the preparation of the apartment, she was totally unaware that children were booked for that apartment. Only by coincidence, precisely at the moment in which the employees were preparing said apartment, the CHILD CARE elements proceeded to place the children’s beds (cots). It was only at this moment when her department took notice that children would be staying there;

. With the aim of explaining her routine, she states that employees arrived at 10H00 and the deponent takes from a safe in the laundry room, the keys to the apartments where they are scheduled to clean that day, and hands them to the respective employees. At the end of the work-day, shortly after 18H00, they reunite in the laundry-room in order to hand over their respective keys;
. There is a preference to clean those apartments with children guests in the morning, with the rest being reserved for the afternoon;
. She refers that along with her and the clients, the Ocean Club reception and the maintenance department have the apartment keys, with the function of the department to fix various things that the apartment may need;
. States that the entire department finishes work at 18H00, but at that time of the facts were not to be found in the immediate areas. She further adds that during the previous days, she did not notice anything relevant which called her attention, nor any one strange. She also states that the proper characteristics of the Tourist Complex make her constantly come across various people, who are related to, or not related to, the complex, without any control of access;
. In ending, questioned, she refers to her department, which is made up of 28 employees whose names are listed in this act which the deponent has handed over, duly initialled. Of these, 19 are actual staff, with the rest being contracted employees (proceeded by the numbers 88, 86, 87, 89, 71, 92, 100, 60 and 90) only for the periods of major influx (the duration of contract could vary between 7 and 8 months) despite which they have maintained a professional relationship for many years, with the exception of employees proceeded with the numbers 88, 89 and 60 who have gained a contract for the first time, this year with the complex;

. Questioned, responded that he became aware of the child’s disappearance on Friday, May 04, in the morning, through communication with his work colleagues, after arriving at his office;
. States that until the date of the disappearance of the minor he had never seen an image of said minor or of her family, parents and brothers, who he only came to recognise with the various disclosures made by social communication organs;
. For this reason believes that he never came across them [McCanns] in the resort, since their arrival, or if he did, he did not pay attention;
. States that in the role of his functions it is not customary to establish contact with the tourists lodged in the resort;
. Questioned as to whether in past times he noted or was aware through communication with colleagues of the resort that a strange person/persons
Were seen around the resort, or asked strange questions about the tourists and children who accompanied them or about the proper installations of the resort, the deponent states that only an employee named Bernardino Silva, told him on Friday, the 04 of May, that the day prior, the date the child went missing, that he saw a strange individual around the resort;
. The deponent does not remember any details of what that employee told him but knows that the same employee was already questioned by the Judicial Police regarding these facts;
. Asking, the deponent states that of all the employees that work in the resort and whom he knows, he had no knowledge that any one of them has criminal or social problems.
. The deponent is not aware of situations where the employees of the resort have brought strange people into the aforementioned place;
. States that only since March of this year, more than 50 new employees were admitted, and does not have any idea regarding these new people;
. Regarding other strange situations that could have happened in the resort, like for example, robberies in the interior of apartments, the deponent states that there have occurred some but that he does not know of any recent situation;

. That she works at the Ocean Club since 03/03/1996, having exercised this time in the function of receptionist—for around one year and a half, Reception Manager—for around three years and since this year to the present date, Director of Maintenance Services;

That the function of Director of Maintenance and Services she is responsible , in the area of services the hiring of people, and in the area of maintenance is responsible for the admission of employees and for the good functioning of all the machinery that composes the Ocean Club, principally, in the apartments, pools, gardens, fending, etc;
. As concerns the admission of employees, this is done in the traditional way, or is, when the need for an employee is determined in an area, the situation is commented on between the various people responsible and the rest of employees;
. Generally, it is an existing employee or other who indicates that they know of someone, in the majority of cases, resident in Lagos;
. In whatever the case, there is always a labour contract made with the employee, for a minimum of six months, and a file exists of said employee which contains identification details of said person and information regarding previous professional practices;
. An exception is made when a business in contracted to carry out a service and whose business is responsible for the employees, those being in the meanwhile accompanied by that who is responsible for works and maintenance, Mister Joao Carlos Silva Batista;
. She is aware of that which occurred in the Ocean Club resort and is aware of the disappearance of the child, around 22H30 on the 03 of May, 2007, following a telephone call from her Administrator George Robin Crossland;
. She immediately went to the Ocean Club resort, and already there were the GNR, and a search was immediately carried out throughout the resort with e search being carried out by many residents and employees of the Ocean Club;
. That on the date 03/05/07, her workday began at 09H30, having entered in the Ocean Club, through the Club Zone, having walked around the pool area and prior to that the other pools;
. At around 13H00, she went to lunch in Lagos, together with her husband, Mister Joao Carlos Silva Batista, and returned around 14H30;
. That around 18H00 she left the Ocean Club resort, having returned to the same, as a result of the circumstances already described, at around 23H00;
. That during the day 03/05/07 she did not detect nothing abnormal or different on this day;
. That she also was not told of any abnormal situation which happened;
. That after the happenings and in conversation with the rest of the employees and Ocean Club management, nothing was related to her or commented upon regarding the situation that was abnormal, namely the presence of strange people in the resort;

. relative to the investigative facts the witness clarifies that on May 04, 2007 (Friday), at around 09H20, he was already at his work location, and was informed by his colleagues that during the previous night (03 May 2007), at approximately 21H30, a child of the feminine sex, three years of age, of British nationality, who has lodged with her parents and siblings in an apartment “water side garden”, block 5, apartment A in the Ocean Club report, had gone missing from the interior of the same;
. Questions, the deponent states that he did not know the missing child not the rest of the family of the same, and only saw Madeleine (her name he got from his colleagues) and her parents and siblings, after the disappearance, in media outlets, who divulged the situation;

. She further adds that the zone of the establishment whet block 6 is located, is close to the public passage zone, where various people pass daily, residents of local houses, and the path to the beach;

At the time, she believed that a robbery had taken place in the said place, and left for the laundry room of the establishment where there are lockers which hold the necessary equipment needed to carry out her daily work. At this point, she was asked to accompany en element of the GNR to the apartments in block 6, with the aim to seeing the interior and verifying if the minor could be found there;

. That in the sequence of his functions he circulates the resort, without restrictions, knowing it reasonably well;
. Questioned, states that he is aware of the missing English child whose name is Madeleine, a situation which he became aware of on Friday, the 04 of May, after the notices were released in the media;
. States that on the day of the disappearance of this child he worked at the resort until about 15H30;
. Questioned, the deponent states that in the scope of his functions and the day before the disappearance of the child, he only came into contact with the mother of the same, whose name he does not know;
. This happened on Tuesday, the first of May, in the sequence of a service that he had to carry out in the apartment where this family was staying, also known as Block G5, Letter A;
. This serviced was carried out between 10H00 and 11H00, together with his colleague who is named Mario, and consisted of the repair of a blind in the room of the parents of the minor;
. In this sequence, the deponent and his colleague also taught the mother of the child how to operate the washing machine;
. The woman in question was alone in the apartment;
. The only places of the apartment where the deponent and his colleague entered was the kitchen and the parent’s bedroom;
. The deponent states that short of that service does not know of any other work carried out in the apartment since the arrival of that family in the resort and the disappearance of the girl;
. Questioned, the deponent states that days before the disappearance of the little girl, no one spoke to him strangely about the tourists, the children which accompanied them or other facilities of the resort. He also did not hear conversations of this nature with other persons;
. Regarding the presence of people or persons which presented with a strange conduct near the resort, in the past with special attention to the disappearance of the child, the deponent states that he noted nothing abnormal;
. States that only about four months ago he noticed the presence of three gypsies close to a resort warehouse, situated close to the Millenium Restaurant, who were taking existing firewood from there;
. The deponent knows that in that resort zone, as it is a zone of warehouse and also little traffic, it is frequented by individuals of gypsy origin looking for scrap;
. Various robberies have already occurred in this zone and the deponent is of the conviction that the authors of these crimes are individuals of gypsy ethnicity whose identification he does now know;

. That she comes to the process as a witness;
. States that she does not know the Portuguese language and is accompanied by interpreter, Robert James Queriol Murat, translator;
. That she has been in Portugal since the 21st of March, the date in which she began work, of this year, in the establishment known as the Ocean Club, situated in Praia da Luz, in Lagos (Algarve) where she works as an infant educator in the aforementioned establishment, conforming to a work contract previously signed in London. Clarifies that, last year, she began her work in this establishment where she has worked from July to October. The deponent further clarifies that in the period between 21 May 2007 and 07 May 2007, she worked with children between the ages of 6 and 10, known as the ‘Junior’ group, which is made up of 7 children of both sexes;
. States that her hour of work is very flexible, rotating and coincides with the weekly plan of the children’s activities. Because she is asked, she clarifies that she had formal training in England, for two years, in order to exercise her child educator functions;
. The deponent further clarifies that the Junior group does not find itself subdivided from the other groups, in that, at this moment, there are not enough children that permit it;
. relative to the facts of the investigation the witness clarifies that in her daily schedule mentioned she only, on one occasion, had contact with Madeleine McCann, for about 30 minutes—who was treated as Maddie—in that she had to substitute for her colleague, who, at that time, was responsible for the group whose name is Emma, as she had to go to the Tapas to take care of the refreshments of Madeleine’s group. For this, the deponent had the charge of accompanying that group towards the beach until the MiniClub where they stayed for a few minutes, and from where they left for the restaurant, mentioned above, in order to have dinner. She clarifies that when Madeleine ate her food, her parents were close and accompanied her;
. Questioned, she states that Madeleine McCann related to the group of children “MiniClub” who are supervised by a colleague of hers, whose name is Amy, and who coordinates her workers, for who she only knows first names, Cat and Emma, employees who worked with the group during the week in question, from 29 April to 04 May, 2007;
. Questioned, she states that the minor in questions appeared to her a calm child, happy, but quiet. States that Maddie was a very pretty child, notwithstanding, she did not stick out for this fact. However, she furthers that the same child, from what she saw, was a child who did stick out, precisely as she was calmer and shier that the others;
. Questioned, she furthers that she had no contact with [Maddie’s] parents;
. That on the 03 of May, 200, at around 22h30, after having left the apartment where she is living, close to the establishment mentioned, together with two more colleagues, also residents there, whose name are Leanne and Sarah, she found her colleague Amy. That during their discussion she was informed that Madeleine McCann had disappeared and that they were looking for her. For this reason, together with her colleagues, they also began searching for Madeleine McCann;
. That during the search she carried out, together with her colleagues (employees of the Ocean Club) others were also participating from the establishment ion question;
. Subsequently, she cannot precisely state the hours but indicates that at around midnight, she noticed that the locale also consisted of local authorities who were taking notice of the occurrence and initiating respective measures for this type of situation;
. Questioned, the deponent states that the searches made by elements of the Ocean Club terminated around 04H00 on the following day, 04 May, 2007, to negative results. That morning, close to 08H30, the began searching anew in the complex, and the deponent was with a group who looked for the child in a part of the tourist complex;
. Questioned, the deponent states that she did not have direct contact with the minor at issue, Madeleine McCann, and is not aware of her habits or that of her parents, nor was she told about any strange situation regarding the child or f another period of time in which she worked in Portugal;
. It was about one week ago, on a date for which she cannot be precise, while she was accompanied by her friend Leanne, and going in the direction of her residence, on a street located close to the building where she lives, when they were cornered by an individual who passed by them, very slowly, at the wheel of a vehicle of make and model she did not know but the time but it did not seem recent. At passing, the individual invited them for a beer, to which they quickly declined. She adds that she did not pay the individual much attention, so that he would not continue to bother them, but this fact only allowed her to retain his physical characteristics—he had short, black hair. Urged, she states if she was confronted by this person or his photograph, she would not be capable of identifying him. That she did not observe any other characteristics signs of the individual like the vehicle that he drove. A few days later, in conversation with her colleagues, Leanne, Cai and Rhiannon she was told that an individual in a white commercial vehicle, had cornered them. That in none of these situations was it possible for Leanne to capture the license plate of the commercial vehicle mentioned above. Questioned, she states that she saw never saw the above referenced individual again;
. Questioned, the deponent states that beyond this situation, on another occasion, an event caught her attention. An individual of the male sex, in Praia da Luz, next to a café, whose name she does not know, was playing a guitar until the day of the facts, now under investigation. on the night Maddie disappeared and while she was involved with a group searching, mentioned prior, they encountered a vehicle, whose make and model she does not know, of while colour, commercial, parked on top of a hill, where, she cannot identify. At this point, some of the group elements banged on the window of the vehicle and the back doors and saw the person who habitually played the guitar on the beach. He was covered with blankets, reading a book and drinking a beer, with the help of a flashlight. Questioned, they did were not able to observe in detail the interior of the vehicle. She add that the individual was asked whether he had seen a minor of about four years of age and the same responded, jocularly, that on that night, no one knocked on the doors of his vehicle;
. For the reason she was asked, she state that she never spoke to anyone who were not her colleagues, regarding the children with whom she worked;
. Adds that she has no knowledge of any type of situation which she finds strange and/or another which could be directly or indirectly related to the disappearance of Madeleine McCann;

. That she comes to the process as a witness.
. Questioned, states that, it has been about 22 months since she had been employed by the resort the Ocean Club on Praia da Luz;
. Specifies that, since the beginning, , she exercises her functions of cleaning supervisor, and that her specific competencies relate to the coordination of the laundry room services, like, for example, the coordination and supervising of the work carried out by the different cleaners;
. More specifically, her work-day begins at 09H30 until 18H00, every day of the week, with interruptions from 13H00 to 14H30 for lunch. During the week she has, the witness notes, the right to a day and half of free-time when there is less work. For this fact, there is no certain day on which she is ‘off work’;
. Because she was questioned, she clarifies that, as a rule, she begins her work activities in the laundry room, located next to the Tapas restaurant, where she arrives around 09H30. However, by request of the cleaning supervisory staff, it is sometimes necessary to go to apartment blocks in order to provide missing materials (products and clothing);
. States that the keys to the apartments are kept in special safes and are given to the staff during the morning in order to carry out their cleaning duties;
. But states that each cleaning worker is assigned a block of apartments and are responsible for the cleaning therein;
. Those same people are aware of the rules in carrying out their duties alone;
. Because she is asked, she responds that during the lunch period, she leaves for her home and knows that the majority of cleaners, in that time frame, are installed in the laundry room.
. After the days work, they return the apartment keys to the manager responsible who, as she already mentioned, after confirming that they are all there, deposit them in the security safe;
. In the installations of the laundry room there is only one copy of each key, corresponding to each apartment, and that they are likely deposited with the reception;
. As regards the specific facts of the investigations, she states that she has nothing further relevant to add;
. This, she confirms because in carrying out her professional functions, she did not come across the McCann couple or their children. She states she never saw them;
. Because she is asked, she responds that the apartment occupied by the family was assigned to cleaner Maria Julia, who never mentioned anything strange in that interior, or any situations that were not normal or unpalatable;
. She mentions that in the days preceding the disappearance of Madeleine se did not notice and individuals or strange movements in the tourist resort, nor did she hear and commentaries to this fact;

. That she comes to the process as a witness, manifested by her intention to make declarations in order to clarify the facts of the present investigation;
. The question made, she informs that she has been employed as a cleaner for 13 months in the Ocean Club. Together, and in the same department, she works with her daughters, Fatima Maria and Dora Isabel;
. Regarding her functions, she clarifies that she is the person responsible for cleaning block 5, and more specifically, apartments A, B,C, D, H, I, K,L, M and P, and can conclusively affirm that when the minor disappeared, only the apartments A, B, D, G, H and K were occupied. She states also that she is the only employee who cleans these apartments. In the preparation of Apartment A, that one in which the McCann family stayed, was prepared by the deponent with the help of her friend Dina, the previous Saturday, the 28th;
- She remembers that when she was preparing the apartment, she only received indication that it would be occupied by 5 people, not knowing children would be part of this. At that precise moment when Dina was helping her prepare the apartment,, elements of the Mark Warner business entered and proceeded immediately to place two children’s cots. It was only at this moment when she became aware that children would be staying there;
. The question made, she says that a third party placing the cots in the room is normal. Moreover, she says that only when apartments are reserved through the Mark Warner agency, it is they who are responsible for the placement of beds. On the other hand, when other travel agencies book the vacation, children’s beds are taken care of by the Ocean Club;
. In regards to her duties directly related to the apartment, she states that the last time she entered there was on the Wednesday, the day before the facts, more precisely on the 02 of May, where she carried out cleaning. Questioned, says that contrary to what has been established, on Thursday, the 03rd, she was doing something else, and did not have the opportunity to pick up the rubbish bags;
. She remembers that when she entered the apartment (A), on Wednesday, that inside she came across the parents. After being allowed to enter, she carried out her work, as they had already left. While she was there, she did not come across any child, supposing that they were in the crèche;
. During the time she carried out her work, she remembers having seen, given the scenario presented, that the couple slept in the room opposite the entrance way, where she came across a children’s cot. This room gives access to an exterior garden which is called the ground floor, and to a veranda. In the room closest to the door of the apartment, there was a bed pushed to the wall (where she assumed the missing child slept) and a second cot. All these beds were ‘messy’ and this told her that they had been used. She states further that in the room closest to the door, was another bed, which was not used;
. On the Friday following, the day after the disappearance of the child, she states that due to the police activity, she did not clean Apartment A;
. Questioned, states that on the days preceding the facts, she only entered the apartments to carry out her duties, and did not come across any element/object or strange fact that called her attention and which could be directly related to the disappearance;
. In the same vein, she states that she did not notice any element/person who presented with a strange comportment;
. Ending, she states that her hours of work begin at 10H00, terminating at 18H00, when she returns to Lagos, where she resides;

. That she comes to the process as a witness;
. Due to the fact that the witness is of English nationality and does not command the Portuguese language, the present statement is taken in the presence of Robert James Queriol Eveleigh Murat, a translator.
. The question made, the present deponent affirms that she has been in Portugal since the 21st of March, of the current year, 2007, having arrived in order to work in the tourist establishment;
. She affirms that she exercises her functions of nanny in the Baby and Mini Club , with her primary function to those children until 11 months, and the second, to children between 3 and 5 years of age, and in the toddlers 1, for children between 12 months and one year and in Toddlers 2, for children with the ages of 2 to 3 and also the Junior Club (6 to 9) and Indyes (14 to 1);
. She affirms that she saw Madeleine McCann once when she arrived during the week, but that she did not know, as the deponent was working only with the Toddler group;
. She did recognise the family, as she was responsible for the twins, children of the couple and siblings of Madeleine McCann;
. Questioned, the deponent states that she did not notice anything abnormal in relationship between the children and the parents, when they came to pick up the twins, they seemed happy to see them;
. Refers that the hours of the club us from 09H00 to 12H30 and from 14H30 to 17H30 and is closed on Sundays, functioning only during the dinner hour;
. The question made, she affirms that guests can request “Staff" services where children are watched between 19H30 and 23H30. Madeleine’s McCann’s parents never requested this service even though it was free;
. She affirms that at around 22H45, a group of people entered the bar, looking for the child, and that is when she became aware that she had disappeared. It was at this point when she also began searching;
. Further adds that there is a procedure to follow in the case a child goes missing, but that she did not follow this procedures, and simply organised themselves into groups and began looking for the child leaving from the Tapas restaurant;
. The question made, she affirms being unaware of who called or what moment the G.N.R. was called and does not remember what time the GNR arrived at the location;
. Affirms that at no time did she notice the presence of anyone with a out of normal comportment, concerning the children, or anything else that appeared to her suspicious;
. She adds that the staff dedicated to the children total 15, and who work in turns between the hours of 19H30 and 23H30;
. Affirms that the distance between the apartment and the restaurant where Madeleine McCann’s parents ate was about 3 minutes by foot, but does not know which room Madeleine was in, if it was at the back or front of the apartments. From the restaurant one can only see the front (patio) window of the apartments;

. That he comes to the process as a witness;
. Works in the Luz Ocean Club (LOC) for approximately three years and four months, always in the club maintenance service;
. This is his first job;
. Before this she completed the 9th year of school;
. Makes roughly 500 euros per month, and lunches in club with food that he brings from home;
. Has a fixed work schedule that comprises the hours of 09H00 to 18H00, with a break between 13H00 and 14H00 for lunch;
. Normally, he does not leave the establishment, having coffee with his work colleagues in the adult pool bar;
. His day-to-day work activities are placed next to the principal reception, the locale known as Palm Bay;
. When there, a receptionist records the service requests and it is his duty to set out to the domicile in question, along with the request, t carry out the work in question, which could mean pipe-repair, electrical, small repairs in painting, amongst others;
. The witness does not have a zone of work defined, and is sent to wherever it is necessary;
. Questioned, he states that he does not know the parents of little Madeleine, the little girl who disappeared, and who were lodged in Block 5, in apartment A;
. He also does not know any of the other elements who accompanied the group lodged at the apartment in question;
. He also does not know a date in which these people arrived to the club;
. Regarding this, he states that he did not effectuate any service in the apartment that they occupied, but knows that Luis and Mario, his colleagues, were sent there regarding a request to repair a blind and to give explanation as to how to run the washing machine. He assumes that the family of Madeleine was already there;
. After seeing a photograph of little Madeleine, he affirms that he never once saw that child;
. On the day of the disappearance of the child, that next morning (04/05/07) at around 01H23, he received a telephone call from the LOC reservations sector which he did not answer. He knows this because the number appeared on his mobile;
. When the telephone rang, he was sleeping and when looked at the ‘display’ of the mobile it looked as though what was recorded as the name ‘Relvas’, instead of ‘Reservations’, and thought it was a friend of his who often call shim at odd hours, already inebriated;
. It was around 08H20/08H30 of this same day when they called again—this time it was Nuno, his colleague, asking the witness to pay particular attention for a missing child—a 3 year old missing since yesterday, dressed in pyjamas, on his way to the LOC;
. On his way to work, he did not see observe anything that would help located the child;
. He went from Burgau to Luz, in his car, accompanied by this girlfriend who was also informed;
. Questioned, states that he did not notice, at any moment, someone with an unusual comportment, who could in some form, be related to the missing child;
. If any situation comes to light, he is perfectly aware of the procedure he needs to take, which is, the communication with the authorities, which he would carry out without reservation;

. Questioned, informs that he is a functionary of the Ocean Club since July of the year, 2005, with the duties of reception assistant manager. Clarifies that his post centres in the principal reception, open 24 hours per day, of the Ocean Club situated in the zone designated as the Palm Bay;
. Questioned as to his work hours, he clarifies that they are not normal, and are flexible, depending on the rest of the employees. In relating to days off, he says that he can never have a day off on Thursdays, nor on Saturdays, for these are the days for check-in and check-out of clients. Specifically, on the past 03 May, 207, day of the disappearance of the minor, he remembers that he finished around 16H00. For this reason, he affirms that he only learnt of what had happened the next morning when he arrived at work at 08H00;
. Remembers that at the time of the happenings, this being between 21H00 and 23:00 this past Thursday, he was accompanied by his girlfriend ***. Together with a friend of British nationality named *****, they decided to meet and go to Alvor;
. For this reason, when the disappearance occurred, he did not find himself in Praia da Luz;
. During the days which preceded the facts, he states that he did not notice any elements/individual/facts that called his attention;
. Clarifies that to carry out his duties, he is always in the reception, where he can leave for brief moments at certain opportunities;
. The question made, he says that habitually all the check-ins are made at the aforementioned reception desk. The other receptions are only for issues that limit themselves to the control of access of areas, pools and other similar equipment. This way, the clients are obligated to pass through the reception, without exception of the clients booked through the Mark Warner agency. This tourist operator, on the journey from the airport to the tourist complex, effects the collection of all identification and other from the tourists, and that subsequently, these elements are given to a functionary of the Ocean Club reception. In this way, the clients of Mark Warner do need to check-in directly with the resort reception. Only one individual is sufficient to effect the exit of an apartment, without the need for all users of the apartment to confirm their identity and exit. When he speaks of check-out, he states that this refers to the communication of departure of the apartment and not individual exit, with certification of the respective individuals (occupants);
. When they leave, all clients, including Mark Warner guests, must effect their exit in the principal reception;
. Reiterates what was said, referring that never noticed any suspicious element

. States that before she arrived in Portugal, she already knew some Portuguese people, but that they never questioned her regarding the functioning of the LOC or regarding her functions;
. States that since her arrival or in England no one has questioned her regarding the workings of the LOC and much less about the Mini Club or about Madeleine, a situations she only came to learn about after the facts;
. Questioned, states that she also does not know Madeleine’s parents, and the twins did not frequent the Baby Club given their age;
. Questioned, states that there are parents who leave their respective children all day, every day of their holidays in the respective clubs and that this is normal inside the British culture;
. Questioned, states that she has no knowledge of any unfamiliar individual or any familiar individual demonstrating interest in the children or in their exterior activities or of anyone of the same who took photographs of the children;

. He works in the Ocean Club since 15/03/06 exercising his functions as a multi-purpose operator, but more specifically, in the area of maintenance;
. That his functions are exercised in all types of maintenance necessary for the smooth function of living quarters and apartments, namely, repairs of damaged materials, small repairs, etc;
. That prior to this, he worked as a Table Chef in a pension, in Fortaleza do Beliche, situated in Cabo de Sao Vicente, Sagres, where he worked for 13 years, until the time of its closing;
. That in finding himself unemployed, he applied to work at the Ocean Club, and at other locations;
. That after a bit, he was called to work in the Ocean Club to begin functions as a multi-purpose operator;
. That at the time, he signed a contract for a one year term, and it was renewed;
. That in his functions, he effects maintenance necessary for the entire resort of the Ocean Club, and that his charges are directed by the chief maintenance person. Mr. Nuno Conceicao, or in his absence, his work is written in service notes;
. That in the virtue of his functions, he has access to all the living quarters and apartments of the Ocean Club resort, with the exception of the private apartments, that although they are locate din said resort, the maintenance therein is carried out by the proprietors;
. That he begins his functions at 09H00, reuniting with the rest of his colleagues in the maintenance garage, and at that time service requests are distributed by the maintenance supervisor, or in his absence are passed between his colleagues;
. That his work day begins at 09H00 until 13H00 and from 14H00 to 18H00;
. That the keys to the living quarters and apartments are under the responsibility of the Ocean Club, and are found guarded in the interior of a safe which is in the Maintenance Garage, whose opening code is known by all maintenance workers;
. That the keys are only taken from the safe when it is necessary to carry out a service, existing in this instance a service request, which is registered in the name of the maintenance worker and indicates the time spent and which is handed over to the Director of Maintenance Services, Mrs. Silvia;
. That he has knowledge of the situation which occurred at the Ocean Club, referring to the disappearance of a child, having been informed via telephone by his supervisor at 18H00 on the 04/05/07;
. That after finding out what had happened, he arrived at work at 09H00, and was informed by the Maintenance chief to go to the block of apartments in the Ocean Garden, to collect with other resort workers, and to hand out pamphlets referring to the missing child;
. That the pamphlets were distributed all over the resort located in Luz, Lagos;
. That afterwards, some of them went to search next to the pools and field locales in the hope of finding the child;
. That after this he went to lunch and from time to time exercised service functions, having left for Lagos in order to collect material for the repair of a living quarter and toward the end of the afternoon went to paint a room number 26 – COT Garden, having terminated his work at 18H00;

. That in the day the child’s disappearance occurred, on 03/05/07, he arrived at work at 09H00, having realised some service requests, but does not remember the locales and refers to the fact that these are noted on the requests;
. In the afternoon, of this day, he was varnishing a room door, number 26 – COT Garden;
. Her terminated work at 18H20, and left the Ocean Club resort, heading for Burgau, in the company of a colleague, Tiago, and after that went home;
. That on 03/05/07 he did not see any situation that seemed abnormal or out of the ordinary, and the same was not commented to him by other colleagues;
. That he is a unaware of any detail or information regarding the disappearance of the child, nor does he have any information that could help in locating her nor does he know anyone would could turn over such information;

Concerning the issue of the process said;
. The deponent affirms that he exercises his functions as receptionist in the establishment, for about eight years;
. In that which concerns the facts that are now being investigated, the current witness affirms that, as is normal, they received the family of Madeleine McCann, with importance to note that their stay was made b intermediary of the Mark Warner agency, who is represented by John Hill;
. States that this business has as its policy to cater to all needs of the clients, which means that there is practically no contact between the clients and the reception;
. Further adds that this family, like all the Mark Warner clients, are placed into a half-pension regime—breakfast and dinner. For diner, the clients can opt for two restaurants, the Tapas of the Millennium, with the first being ‘service a la carte’ and the second ‘buffet’ with the clients choosing not just for food, but for questions of proximity in relation to their living quarters. However, the current witness states that the guests have informed him that the Tapas restaurant is of better quality but is much more difficult to arrange a reservation as it has fewer places;
. In this case, the rationale choice for a family to dine is the Tapas, since it is 40 metres in distance from the apartment, as opposed to the Millennium which is around 200 metres from the same;
. The current deponent does not know the room location where the three children slept, however, at being informed that they stayed in the side opposite the apartment, the deponent affirms that this division is completely outside the direct line of sight from the Tapas restaurant;
. Because the solution most acceptable would have been to leave the children with a ‘baby sitter’ or take them to a small children’s playground that exists in front of the restaurant ‘Tapas’ where one could easily watch the area from where they were sitting;
. In regards to the question of an available service of ‘Baby Sitting’, between 19H30 and 23H30, he affirms that he knows of the existence of this service and that it is free;
. Questioned, the current deponent responds that he does not understand why Madeleine McCanns’s parent never used this service, given that it was free;
. The question made affirms that before the disappearance of the child, he had no type of contact with this family and that only as clients as is the case with hundreds of others who frequent the establishment;
. That she has been in Portugal since the 21st of March, 2007, the date on which she began work in the tourist resort known as the Ocean Club, situated in the locality of Luz, in Lagos (Algarve), where she works as an infant educator in the aforementioned establishment, according to the contract previously celebrated in London with the business known as Markwarner which acquires educators for the mentioned establishment;
. The deponent further clarifies that in the period between the 29th of April and the 04th of May, 2007, she worked together with the group of children lodged in the aforementioned establishment, who are two years of age, known as Toddlers2;
. The deponent further clarifies that Toddlers2 is divided in divided in three sub-groups of children, and that each group is headed by a different worker with the deponent being one of these sub-groups;
. Relative to the facts of the investigation clarifies that in the discourse of her work in the mentioned establishment, she came into contact on some occasions with a child known as Madeleine McCann, clarifying that the contact was formal and of short duration, and in relation to the fact that the child’s siblings were in the deponent’s group. But refers that it was her colleague Shinead, who took care of the twins that week;
. Questioned, states that Madeleine McCann was in the MiniClub group and that that group is composed of children between the ages of three to five years of age;
. States that her in the crèche of the tourist resort is supervised by her colleague Lyndsay, and the mentioned group of children in the MiniClub, are at times supervised by a colleague of hers, Amy, who is a coordinator of a nanny group including Cat and Emma. Both were employees who were working in said group the week in question, from 29th of April to 04th of May, 2007;
. Questioned, the deponent clarifies that Madeleine McCann was accompanied by her parents, who were staying in an apartment in the resort mentioned above, together with her twin siblings (a boy and a girl) of two years of age;
. That on the May 03, 2007, at around 22H45, she was in the bar known as ‘Mirage’ together with her colleagues, whose names are Emma, Shinead, Najoua Hayley and Stacy, which is situated close to the perimeter of the aforementioned resort. After returning from the bathroom, she was informed by her colleague Hayley that a child, of about 3 years of age, and whom was staying at the Ocean Club, had disappeared;
. The deponent immediately, together with her colleagues, went to the area of a restaurant (Milenium) in the establishment in question near to the bar they were at and began searching for the missing child;
. That during the search, she realised, together with her colleagues of the Ocean Club, others (tourists/owners) were also participating in the search;
. Not knowing the precise time, she noticed that authorities had arrived, and were taking measures for this type of situations;
. Questioned, the deponent states that the searches carried out by elements of the Ocean Club terminated at around 04H00 the next day, 04 May, 2007, to negative results;
. That during the searches that were carried out, she was told that the missing child was named Madeleine McCann;
. Questioned, the deponent states that she did not have direct contact with the minor at issue, Madeleine McCann, and did not know her habits, and that of her parents, and that no strange situation about the child was reported to her or at any other time during her time in Portugal;

She stayed at her residence until around 21H30 together with her colleagues Shinead and Emma, from where they left and headed to the aforementioned bar, the Mirage, also with Nathan, who joined them, and who had previously been on another floor, in the home of one of their friends;

. The bar is open exclusively for resort clients, and that the entrance to such is controlled by a client card;
. Questioned, states that she does now know the parents nor Madeleine as they did not frequent the adult pool bar;

The deponent clarifies that on the day of the disappearance of Madeleine (03 May 2007) she was with her boyfriend in her residence, situated in Lagos, furthering that the same, whose name is Nuno Conceicao, is also a worker of the Ocean Club, and works in various maintenance functions in the establishment. But refers that, for this reason, her boyfriend is in permanent service, or that when he is ‘off’ he could be contacted in the case of a maintenance service that needs to be attended in an apartment or in other areas of the resort in question. In this way she explains that on the day of (03.05.07) at around 20h30, her boyfriend was called regarding a problem with a lock in an apartment situated in the north zone of the establishment, close to the Millennium restaurant. He left to go there in his vehicle, together with the witness.
. That after her boyfriend concluded the service in question, which occurred about 21H00, they left to the reception in the establishment with the intent of her boyfriend collecting a service note;
. The deponent, together with her boyfriend, had left in a Peugeot vehicle, model 106, grey in colour, and passed various arteries of the establishment in question, and also having passed the place adjacent to the pool and area of the Tapas restaurant, passing by the residence where Madeleine was staying with her respective family, as she was later informed of the location;

The deponent states that when she passed by the roads in question, which are in the resort itself, and principally those which she later learnt were close to the apartment where Madeleine stayed and went missing from, close to the Tapas, which she traveled at about 21H00, (03 May, 2007) she affirms that she saw no vehicle, person or other situation that she considered suspect that could be directly or indirectly related to the facts of the current investigation in the present questioning;

. That in year prior the aforementioned enterprise was sold to a British company called “Mark Warner”, but the deponent continued to exercise his functions as manager;
. Relative to the establishment in question, the deponent clarifies that the same offers free child-care services to families who are guests;
. The deponent states that he does not know the exact details regarding the child-care service, but clarifies that the same functions during the day, from morning to late afternoon, and there also is a free service offered that will watch children during dinner and where the parents can leave their children with infant educators and go to pick them after they have eaten;
. That at around 22h15 of 03 May 2007, he was alone in his residence, situated in Lagos, and was contacted by John Hill, Mark Warner manager who works in the Ocean Club establishment and who informed him that a child, a minor, of the feminine sex, who was staying with her family in that resort, had disappeared and that he was going to initiate the “procedure for missing child” (sic);
. The deponent left toward the local where he arrived at 22H25 and there found John Hill and other functionaries, Silvia Batista, Joao Batista, the former who is employee manager and the latter maintenance;
. That when he arrived at the Ocean Club, he went to the entry of the pool and the restaurant (Tapas) areas of said establishment, having there come across various individuals in the local, all of which were participating in the search for the lost child, and was made up of guests and other people;
. That at around 22H50, local elements of the GNR arrived and took charge of the occurrence, and began to manage and lead the search operations of the child missing in the area;
. That until the GNR arrived at the local it was John Hill who determined what to do;
. The deponent affirms that he stayed next to the entrance of the pool and aforementioned restaurant, where he came across numerous persons, not having, at any point in time, entered in the residence where the missing child and her family had stayed;
. That he stayed there until 04H00 until the next day 04 May 2007 , where he returned to his home;

Concerning the issue of the process said;
. Is a functionary of the Ocean Club establishment since the 13th of January of the current year (2007), and is employed as executive chef of the kitchen. He clarifies that along with being responsible for the five (5) kitchens (one of whom is the Tapas) of the Ocean Club, his post essentially centres on the principal kitchen next to a reception, close to the restaurant MIRAGE. His work takes him occasionally to the other kitchens;
. He records that the past Thursday, 3rd of May, he left the central kitchen with the objective of going to the Tapas restaurant in order to determine that everything was functioning smoothly;
. When he arrived there, by vehicle, at around 21:10, he remembers that next to the Tapas reception, he saw a vehicle, dark blue in colour, with Portuguese license plates. Although he cannot be definite, he believes it was a Fiesta or Focus. The deponent furthers that is was not a small car, and for this reason it could very well have been a Focus and not a Fiesta. He tells that he does not remember any sticker indicating that it was a rental car. Inside the vehicle he saw no one.
. After parking his vehicle, he entered through the reception of that restaurant, in the left hand direction, toward the side opposite the pool, and passed by the esplanade. He remembers having seen in that esplanade, one table, occupied by three couples, without children, and all of them adults. On the esplanade, he encountered no one else.
. A few minutes later, when it was around 21H20, he heard some clamour, which made him leave toward the restaurant, a few meters away, and was then informed that a child had disappeared. Given the importance of this, believed that he should be in the surroundings. At that moment, he did not leave the area of the restaurant, and did not have the opportunity to check if the vehicle mentioned before was situated in the same location;
. Later, at around 21:40, he left the restaurant passing through the same esplanade where moments before, he had seen the same table occupied by the three couples, empty, who had left in the meanwhile various items, principally clothing. He was told by his colleagues that the child who had disappeared was a child of one of those couples;
. When he left, he noticed that the dark blue vehicle was no longer in its location (previously noted) and does not know of the existence or any connection between the presence of that vehicle and the disappearance of the child;

Because he is asked, George James states that her has been in Portugal for about seven years and that before this lived with his ex-companion, ******, in Praia da Luz.

That he separated from his companion in December of 2006, date upon which he began to reside in his actual address, and where he lives alone, and is not involved in any relationship.

That he has no children, and that the person with which he maintains his closest relationship, is still his ex-companion who resides in what used to be their home .

Clarifies that he worked in the garden centre in Almadena (PlantScape), Lagos, according to what he remembers, between the years 2000 and 2002.

From this point, he was self-emplyed, exercising his functions as gardener in various residences, principally in Praia da Luz.

In relation to the Ocean Club, he does work for this tourist complex as a gardener, receiving
monthly an official invoice. He has worked there for about two years.

He does not care for all the gardens of the Ocean Club, but only for the gardens in block 4 and only the green zone which is found near the exterior or the zone close to the street. He does not look after for the pool-side gardens.

Equally he cleans the steps of this block, and cleans the windows in the stair area. He does not work inside the apartments.

Having been asked, states that he knows the apartment from where Madeleine went missing, but that he never entered that apartment.

He works for the Ocean Club, every week on Wednesdays and always on this day, and that he has never gone to the Ocean Club other than on this day with the exception of the last day of the month when he heads to the principal reception of the OC, which is opened 24 hours and is situated on Rua Direita in Praia da Luz.

That he normally works in the Ocean Club, from 14H00, for about 01H30 to 02H00, and leaves there about 15H30, 16H00.

He goes to work using his ex-companion’s car, which is a Citroen C15, white in colour, and for which he does not remember the license plate.

He always parks in the area of block 4, and when it is possible, he parks next to the apartment from where the girl went missing, for no particular reason other than habit.

States that the last time he was in the Ocean Club was on Wednesday, before the child went missing or on the 02/05/07.

States that on Thursday, the 3rd of May, 2007, he was working in a garden in, Praia da Luz, for private clients, until 12H00 and after that ate some sandwiches and had a drink next to the ocean. He made the food himself.

On this day around 14H00, he went to another garden situated in Praia da Luz. He left there around 16H00.

After this he headed to Espiche, to the Rainbow (Arco Íris) Bar, and left there around 19H00.

After this he went home to take a shower and had dinner. He left again to return to the Rainbow Bar around 21H30 and stayed there until about 23H30.

At the bar he contacted a British individual whose name is ***** who he knows has a mobile-home and was parked in the Espiche camping site and who left on Monday, 7/05/2007.

States that he is known in the bar.

When asked, he does not remember having seen any strange situation. He does not know anyone from the family of the missing girl and has never seen them.

- As the deponent does not speak Portuguese, he will helped by the interpreter Sra. Lídia N. Employee of the PJ.

With regard to the facts of the investigation. Statements show that he knew of these facts by means of a phone call from Lindsay, head of the child care service, who told him about a female child staying at the resort who had disappeared. This phone call was made to the deponent’s mobile phone at about 22.28 on 03-05-2007. About 5 minutes later the deponent presented himself at the resort, because Lindsay had told him that she had initiated the procedure for missing children used by the company and the child had not been found. Upon arriving at the scene he saw about 100 people, employees, guests and residents searching the grounds, the beach and adjoining areas calling out the child’s name.

Initially the deponent thought that the child had got lost or disorientated, but as the searches did not produce any results he became increasingly worried.

The deponent went to the main reception to see if the authorities had been alerted, and fifteen minutes later went to the apartment being used by the McCanns, where he saw that both members of the couple were in a panic and were shouting that the child had been taken. The deponent thinks that the GNR arrived at the scene at about 22.45, however in a conversation several weeks later, he heard someone say, he doesn’t remember whom, that they had arrived at about 23.30, but as he was so busy he declared that he had no notion of the passage of time.

- Together with Lindsay the deponent occupied himself with orienting the search operations, in the sense of trying to determine that the same area was not searched more than once, given that the search area was quite extensive.

He has been employed by the Ocean Club since March 2006 and has no knowledge of any untoward situation involving Ocean Club users or in the village itself, other than some damage and minor thefts.


- When questioned he stated that the search operations that he organised finished at about 04.30. Elements from the PJ and GNR reinforcements with sniffer dogs were still at the scene.

- He wishes to add that he does not know of any motive that could have been the cause of the Madeleine’s disappearance.

- On the night of the disappearance he always saw the McCanns together in the apartment they were occupying at the time, with the exception of an episode when Gerry went to the main 24 hour reception
- , with the purpose of speaking to a GNR officer, he is not sure at what time this occurred, but it was certainly before 24.00.

Given that she does not speak Portuguese, Silvia Batista acted as interpreter.

When questioned and shown the photographs referred to in the previous statements, depicting the English girl, on “Kodak Xtra Life “ paper, 10 x 15, she said they were printed on her printer, also of Kodak brand.

When on the night of 3rd May, at about 24.00, she was at her desk at the Tapas bar, inside the resort, when at a certain time, one of the friends of the McCann couple, Russell, asked for a memory card reader, in order to print photographs of Madeleine. Immediately the deponent replied that she did not have a memory card reader, but that she had a printer with this hardware, which could read from memory cards.


She went to her room and returned to the Tapas with the printer where she printed out 20 to 30 photographs of the girl, using her own paper, in 10x15 format mentioned previously. The memory card containing the photos belonged to the McCann couple, and came from their camera.

She thinks that all of this took place at about 24.00 on 3rd May 2007. She presumes that she handed all of the photos to Russell, who distributed some to those present, the rest would be for the police authorities.

As regards her printer, she says that it is no longer in her possession as it is now with her boyfriend in France, she says, after consultation, and in accordance with her previous statements, that is was a “Kodak”, model Easy Share G60, of thermal ink transfer, with continuous tonality.

In annex, is documentation about the printer, describing its technical characteristics, which she recognises as being identical to her printer.

I am the above referenced person who lives at the address previously given to this police. I am a Portuguese national and I am fluent in Portuguese and Spanish. I have lived in the U.K. with my parents since 10 year of age. Since leaving school, I have been employed in various roles but have never identified myself with any of them.

I still have various family in Portugal and in the beginning of 2007, I was in the U.K. and unemployed. I was contacted via email by my cousin Miguel COLLEO (I am not certain how his name is pronounced) and he informed me that he was working in the Algarve in Portugal as a barman/waiter in the Ocean Club resort in Praia da Luz, Portugal. I always liked the idea of working abroad and asked him if he could find me work. He responded and told me that he had found a position for me in this same area in which he worked.

I travelled from Bristol to Faro, Portugal, on the 26th of March of 2007. From Faro I travelled directly to Praia da Luz and lodged in an apartment rented with Miguel. Initially, his girlfriend also lived with us but before the end of April 2007, she returned to South Africa. The apartment was located close to the beach but I do not remember the address.

I began working as a functionary at the Ocean Club on the 4th of April 2007 and my charge was to serve the bar and the Tapas Bar tables. My hours were 16h00 to 24H00, five days per week and the two days off were rotated weekly. The other employees of the Tapas Bar on my schedule were Ricardo, Ze and Tiago—all of them Portuguese and with little knowledge of the English language. As a result of this, I was frequently called to attend British clients.

I remember being at work in the Tapas the night of the disappearance. I also remember the group of adults that holidayed with Madeleine, including the parents as they were frequent Tapas Bar dinner guests.

I would normally see them during the day if I went to the complex for a swim, or when they were going to get their children for lunch in the zone next to the Tapas. Nothing in their behavior called my attention. They dined in the restaurant every night from Sunday until Thursday when Madeleine disappeared. The table was booked then for 19H30 to 20H00. It was nine adults in total, four couples and an older woman who was also with them. I always found them educated, good clients. They appeared to get along well amongst each other and each time I served the table they would comment on the food. It was a happy group who would often laugh during dinner. There was a man who particularly stood out from the rest of the group as she spoke a lot and told many jokes. At this time, I did not know who he was, but later found out it was Madeleine McCann’s father. Frequently, when I served the table I noticed that one or two elements of the group had left the restaurant. I could not imagine where they had gone to. After seeing the news stories, I figured that they had gone to check on their children. On some occasions, I also saw some infant monitors on the same table but never related this to the facts.

In relation to alcohol consumption, it never appeared to me to be excessive. The wine was included in the dinner at Tapas and the functionaries were very generous in this respect. The permission was approximately one bottler per person . According to what I remember, and relative to the consumption of alcohol, there were seven bottles between the nine adults. I believe that on the first or second night they dined in the Tapas, they drank a bit more, perhaps eight or nine bottles of wine. I believe that they were also offered liquor this night, as they had been such good clients. The behavior of the table did not change the night in questions. If anything, the group jested more than usual but no one appeared drunk.

Generally, they left the Tapas at 23h30/midnight, at times together and at other times in small groups. On the night in which they drank more than usual, they left a bit later, perhaps towards 00h30-01h00. I remember this detail because I was supposed to finish work at 00H00 and I wanted to go home. They always left on good terms and always wished the staff good night.

On the night Madeleine disappeared, everything appeared normal. I remember that when I took notice of the disappearance, I had been in the restaurant speaking with my two colleagues—Ze and Ricardo who were on break. I returned to the restaurant and noticed that the table of nine was empty with the exception of the older woman. I went over to the table and joked with her: “They’ve left you alone?” She responded more of less with these words: “No, they went to see if the little girl was there.” I responded that I hoped they would find her somewhere in the apartment. At saying this, I saw the man. Who I knew later to be Madeleine’s father, running to the pool and to the children’s play area in the Tapas zone as if looking for someone. It immediately hit me that after talking to the older woman, that the little girl had not been found. I offered to alert the workers at the Milenium Restaurant and the man agreed. He then left again running to continue searching. I believe that this was between 21H30 and 22H00 but do not remember with certainty.

I went to find Ze and Ricardo to give them the news and to get their help in searching for the missing girl. I saw the head of the Milenium Restaurant in the Tapas and asked him to telephone the restaurant.

I ran out of the Tapas and noticed that some of the childcare works of the Mark Warner had begun to arrive. At the point I left the Tapas I heard a scream from a woman I did not know. I do not know who screamed, but I had never heard a similar cry. I cannot even describe it but thought it had come from the child’s mother. I went to the reception with one of the child care workers whose name I do not remember. One of the employees looked to be organizing the searches and told us the name of the child. We were sent to the beach zone and looked in all the alleys and called out the name of the child but did not find her. Later, we returned to the Tapas where we found John, the Manager of Mark Warner. There were many people now, perhaps 40 including the Mark Warner personnel. We were divided into groups and Ewan and Rob (both employed by Mark Warner), my cousin, Miguel, and I went in a Mark Warner vehicle to search a beach zone which included a construction site. Again, we did not see any signs of the child and after a telephone we returned to the Tapas.

At this point more people were at the location, including residents of Praia da Luz. A man named Matt who owned a club in the locale, seemed to now be the operational front. A big part of our group was sent to the beach; we formed a sort of human extension cord in our searches. We finally returned to the Tapas around 04H00. We were sent home at the time.

I do not know when the police were called but the first time I saw them was around 23h00-23h00 that night.

Since Madeleine’s disappearance, I have seen her picture many times in the media, but I cannot honestly affirm that I remember seeing her in person before the disappearance from the Ocean Club. There were many children and I never paid much attention to any of them.

I stayed in Praia da Luz working in the Tapas until the end of July 2007, at which time I returned to the U.K.

That he comes to the process as a witness and states:
• That he is a functionary of the Ocean Club for about eight years and exercises his functions in the maintenance area. He is responsible for fulfilling maintenance requests on all the buildings related to the resort.
• That he works daily from 09H00 to 18H00, with weekly breaks on Wednesday and Thursday. Besides his routine hours, he also may be called at any time to carry out maintenance/repairs.
• That the majority of people who stay at the resort are foreigners, mainly English.
• Questioned, he states that, last Thursday, he was off duty but was called by the reception and went to the resort around 020H30 to open a door that had problems. After completing the work for which he was called, which took him about 15 minutes, he left for his residence, and was again contacted, at around 22H15 to ask him if there were torch/flash lights that could be used to help look for a child that had gone missing. The deponent responded that there weren’t any and was not called again that night.
• When he arrived the next morning, around 07H10, he encountered many people and GNR/police close to block 5 along with some foreigners, who, at the time, he associated with the disappearance of the child he had heard about the night before. He headed toward his place of work and that morning carried out his functions which included the cleaning of the pools next to the Tapas restaurant. He did not notice anything out of the ordinary.
• During the day he learnt more via his colleagues of the story of the missing child.
• Questioned, he states that he never came across a circumstance that made him pay particular attention to this family, not with the children or before the disappearance.
• Questioned, he states that he does not remember having seen Madeleine’s face before her photograph was released in the media and which he helped distribute to the apartments after her disappearance.
• He states that the break-ins to the apartments are common, especially
for burglary purposes, and that some are the result of clients leaving their doors open.
• Questioned, he states that according to what he remembers, he did not observe any abnormal movements by any individual that would indicate s/he was preparing to commit a criminal act.

He is an employee of the Ocean Club and works in the bar of the Millenium Restaurant. He worked there in 2006 but only from March to November and subsequently returned to work there on 26th March (2007). He works fixed hours from 16.00 to 24.00. He has one day a week off which is Tuesday. He has heard about the disappearance of an English girl who was staying in the apartments near to the Tapas bar.

He only works in the Millenium Restaurant and as this English family arrived on a Saturday, a day when the Tapas Bar does not serve dinner, they dined at the Millenium.It was a large group composed of 17 persons, 8 adults and nine children or vice versa.

He has seen photographs of little Madeleine but he cannot identify her within the group of children she was with. The dinner went normally and he thinks that they arrived very early for dinner. He does not think that this group returned to the Millenium restaurant except for breakfast during the morning shift and that he knows from colleagues that the group appeared daily.

When asked whether he had ever observed any strange behaviour by anyone who was observing the children in the club with particular interest or whether he has any comment or question, he says no.

He heard about the child’s disappearance on Thursday night. Shortly after he heard the news, a Mark Warner tennis instructor arrived at the Millenium and they went to search for the child together by the swimming pool and tennis courts. As they did not find Madeleine he phoned Luis de Barros, the head waiter who was on his day off to inform him. The latter arrived shortly afterwards and together they searched until about 05.00 AM.

He is perfectly aware of his duty to inform the authorities in the case of noticing any element that could lead to finding Madeleine.

. That in the beginning of her work day, she is given cleaning duties by Mrs. Marina Castela, who verifies the presence of the employees and distributes the keys for the respective areas of work;
. That during the week, from Monday to Friday, she carries out cleaning in the Ocean Club resort – Waterside Village, situated close to the beach zone, but more concretely, in Blocks No. 21, 22, and 24;
. That this cleaning is done only by the deponent, and only on Mondays, Wednesdays and Fridays;
. That on Thursdays and Saturdays and upon the check-out of clients and the eventual check-in of new ones, and for this reason, the cleaning of vacated apartments is done. In this situation, she cleans the blocks already mentioned or, when there is no cleaning to do in that area, she goes to help other colleagues in the cleaning of the apartments and living areas;
. That this distribution or personnel is decided by her supervisor;

. That, as is her habit, she went to the Waterside Village, having carried out the cleaning of the rooms and apartments, corresponding to blocks number 21, 22 and 24, and that nothing out of the ordinary or different was noticed or detected;
. States that meanwhile she only possesses keys to those living quarters for three blocks. She has the idea that in block 21 she carried out cleaning in six quarters; in block 22 three quarters and in block 21, two cleanings;
. For the rest of the apartments, she does not possess any keys, nor does she carry out any cleaning in them, as these are private property, even though they are situated in the Ocean Club resort;
. That on the day of the child’s disappearance, she began work at 10H00, having cleaned in Block 21 – Waterside Village until 13H00, having then gone to eat lunch at home

• When questioned about the missing child, Joao responded that he saw the child and her respective family around the club but did not see them in the restaurant as breakfast was served in the Millenium. He knows from his colleagues that they used to go there regularly for lunch almost every day;
• Stated that the restaurant is by reservation only and for this reason, it is not normal to see other people during the day but at night, the restaurant is open to the public. He further knows that in the last two weeks they did not serve dinners or attend bar clients who were not staying in the complex;
• On the other hand, the space between the restaurant and the apartment is an open space that could have been frequented by anyone. Adding that from the restaurant table where the group sat it is difficult to see out due to a window covering. This would have made it difficult to see their apartment windows;
• Relative to the facts of the investigation, he cannot add anything material. His friend telephoned him to keep him updated on the facts and he was involved with the searches that continued until this night (of questioning);
• States that he did not see a person or situation out of normal character in the days before the disappearance but is aware of some break-ins in the residences of the resort, especially in the summer.

Place of work: Luz Ocean Club

She has worked at the Ocean Club for approximately eleven years. She is a permanent employee of the Club and works all year round. She has a day and a half off a week. She has fixed working hours from 10.00 AM to 18.00 with a break for lunch from 13.30 to 18.00 and remains at the club during this time or goes to attend to personal matters near to the Club. She has a fixed day off on Tuesdays and had a day off on May 1st (national holiday) as well Sunday afternoon 29th April.

When asked how her work was organised in the club, specifically in the cleaning areas where she worked, she said there are norms pre-defining the areas where each employee worked, with the aim of delivering an efficient service. This principle does not imply that in times of work overload for any colleague, that they could not help out even in areas that were not allocated to them. She knows because she has heard that the missing English girl was staying in block 5 apartment A, which is referred to as 5ª out of habit. This apartment is situated in a zone that was not allocated to her, but to a colleague, in this case her mother María Julía Silva.

She knows that the little girl disappeared on the night of 3rd May and is sure that she only heard about this on the following morning when she arrived at work, as it was the only subject being talked about.

She had the opportunity to observe the photos of Madeleine that were being circulated everywhere and has no hesitation in confirming that she saw the child before her disappearance in the company of her siblings and mother and father, although in the latter case she only observed him from a distance.

She states that this took place on Sunday 29th April, just before she finished her morning work shift (13.30) as she had the afternoon off that day. At about 13.15 she went to help her mother, who was cleaning apartment I of the same block (5) situated on the first floor. She clearly remembers seeing the girl accompanied by her siblings and mother leave their apartment (5 A) and walk to the stairs leading to the floor above. She was very close to them at a distance of about 1 metre, observing their movements for a few moments because she was charmed by them. Madeleine led the way with a plate (perhaps plastic) in her hand bearing a piece of bread. As regards the clothes she was wearing she only remembers a skirt but cannot recall its description. She noted, because she thought them nice, the type of shoes she was wearing, tennis shoes, light in colour she thinks, which had little lights along the soles, which lit up each time she stepped on the ground. Her siblings followed behind her, wearing the same king of shoes and each holding a piece of bread in their hands, their mother followed behind them without holding their hands. She seems to remember that the mother was also carrying a plate. Moments afterwards, perhaps the time it took to close the apartment door, the father came out and also headed to the apartment upstairs. When asked, she does not remember whether the father pulled the door closed or locked it with a key.

After she chatted to her mother about there being many children in the apartments, she had the idea that the family in 5H were friends of Madeleine’s family who were staying in 5 A.

She never cleaned any of these apartments referred to as they were allocated to her mother. Her mother never mentioned anything strange to her, either before or after the girl’s disappearance that could be related to the disappearance. The only comment she remembered concerned the clutter in the apartments, mainly clothing which was left all around the place. She thinks that her mother cleaned the apartments in that block on Monday and Wednesday (02-05).

When asked if she observed anything in the apartments where she cleaned that indicated a person particularly interested in children, such as objects, photos, videos or anything else, she replies no. She has no knowledge of any fact that could contribute to discover Madeleine’s whereabouts and pledges to contact the authorities if anything should happen.

She has worked at the Ocean Club for six years with the function of cleaner in the rooms and apartments of Waterside Village and for the last 4 years her function is laundry worker. Her working hours are from 09.30 to 13.00 and from 14.30 to 18.00. The laundry, her place of work, is situated in the Ocean Club Gardens.

That as laundry worker her functions are to wash, dry all the linen from the rooms and apartments (sheets, towels and clothes from some of the clients) and from the Ocean Club restaurants (towels). All the laundry work takes place in the laundry where she works with three colleagues.

That she knows about the situation that occurred in the Ocean Club since 04/05/2007 at 09.30 as she was informed by a colleague from the laundry that a child had disappeared.

That she does not know the circumstances in which the girl disappeared only having heard about it in the press and from colleagues.

That she remembers that on Saturday 05/05/2007 having washed clothing belonging to the missing girl’s family and she checked that it was children’s and adult’s clothing. This service was carried out by her colleague Silvia Cravinho. That on the next day Sunday it was her colleague Bernadete Calado who went to deliver the clothing directly to the missing girl’s apartment.


That before that no clothing from the missing girl’s family had been washed and after that date there was no other washing of clothes from the family.

That she never had any contact with the family or with the missing girl as she never leaves the laundry except to have lunch.

That she did not notice anything strange on 03/05/2007. She did not notice anything strange on the days preceding this date and does not have any information about the disappearance.

She has been a receptionist at the Garden for 1 year, but has worked there previously.

The OC Garden reception has less functions than the main reception and deals with subjects relating to activities (Pool, Tennis) etc and excursions.

She points out that the family in question came via Mark Warner and this company takes care of all relations with clients and there is practically no contact between the clients and reception.

She adds that this family (McCann), like all MW clients had half-board, that is breakfast and dinner. For dinner the guests could choose between two restaurants, the Tapas and the Millenium, the first being à la carte and the second a buffet service, clients make their choice not only because of the food but because of the proximity of the restaurant to their accommodation. She says that the guests told her that the Tapas was of better quality but that it was difficult to reserve there as a MW guest as the MW daily quota was of only 20.

In this concrete case the reasonable option was the Tapas as the distance was only 40 metres from the accommodation as opposed to 200 m from the Millenium.

She remembers that on Sunday 29th April one of the elements of the group arrived with the child Madeleine McCann, she does not know his name and can only say that he was male and tall and thin and that he approached her to request a booking for the whole group, for the whole week and always at 20.30.

When questioned, she confirms that the man was not the father of the girl but one of the members of the group whom was often seen in his company.

The man justified his request by saying that the group had many small children whom they would leave alone when they went to dine. She said that at intervals some two parents would go to the apartments to see if everything was OK.

The deponent made some comments about the request, saying that the Tapas received many requests and that MW only had a quota of 20 per day, but upon the insistence of the guest she managed to make the bookings requested.

She confirms that it was possible to see the apartment from the restaurant, including the window of the sitting room.

She does not know in which bedroom the children were sleeping but upon being informed that it was on the opposite side of the apartment she confirmed that it would be completely out of sight from anyone at the restaurant.

That the most viable solution would be to leave the children with a baby sitter, which is the procedure normally adopted by clients.

Regarding the question as to the availability of the baby sitting service between 19.30 and 23.30, she confirms that the service exists and that it is free of charge.


When questioned, she says that she does not understand, as the service is free, why the parents of Madeleine McCann did not use it.

When asked she says that the contact with this family was normal, like with other clients and describes them as “nice”.

With regard to the date of the disappearance she says that she worked from 09.00 to 19.00 and only returned at 08.00 on 4th May.

It was on this day at 08.30 when she arrived that she was informed about the disappearance by colleagues.

She only knows what third parties have told her and from what she has seen in the press.

She never saw anything strange. During this interview she provided a book with the reservations for the Tapas restaurant.

She has worked at the OC for 3 years. Her work includes everything to with laundering clothes at the establishment from receiving, washing, drying, ironing, folding and leaving it for collection in various sectors such as the apartments and restaurants and the personal clothes of guests who request this service.

She works from 09.30 to 18.00 with a day and a half off each week. She had the afternoon off on 3rd May as well as the whole day off on 6th May and the morning of 7th May.

She arrived at work on 4th May and learned about the disappearance of the girl staying at the OC. She did not know the girl or her family or the group of friends they were on holiday with. Neither does she know which apartment they occupied, but she knows because that the person responsible for cleaning the apartment would be Julia because they talked about it amongst themselves. She has seen photos of Madeleine but does not remember having seen her before. Her daily tasks do not permit contact with the guests.

After the girl’s disappearance, she is not sure but believes it was last Saturday, 5th May she received a bag of clothes from MW employees and was told expressly that these were clothes from Madeleine’s family. It included adult clothes (men’s and women’s clothing as well as children’s clothing of different sizes, making it logical to presume that it included the girl’s clothes given that her younger siblings are twins.

When asked whether she remembers which items of clothing she received that could belong to Madeleine, she says a pink coloured skirt with two layers, one of them having a checked pattern. She remembers that there was nothing abnormal about this piece of clothing or the others, such as blood stains, tears or any other kind of damage.


She has nothing to say about the disappearance, did not see anything strange.

Work Location: Ocean Club

That he comes to the process as a witness. He has worked at the Ocean Club (OC) resort for about two months exercising his function as Tapas Supervisor (restaurant, bar and pool) in the Ocean Club Garden.

That prior to this, he worked at the Hotel Suites Alba Resort and Spa in Albandeira beach, Carvoeiro, in the restaurant area for about one year.

As a supervisor, his functions include all the operational workings of the space known as the Tapas. His normal hours are defined by need although he does have a set work schedule.

That his work location is comprised of the restaurant, pool and bar of the Ocean Club Garden, dominated by the Tapas.

That he became aware of the situation that occurred at the OC with respect to the disappearance of a child when he arrived at the Tapas around 22H00/22H30. He was immediately informed at arriving by work colleagues.

That after finding out what happened he immediately proceeded to join some searches next to the pool and the apartment zone around the resort. He stayed in the OC until around 01H30 when he left with his girlfriend.

That he knows the family of the missing child as they were clients of the Tapas restaurant which they began frequenting the 2nd day of their arrival to the OC.

From the very beginning, a request was made to the restaurant workers to reserve a table for 20H30 until the end of the week. The request was made for a specific table given the number in the group—nine people. This group would dine daily and always arrive around 20H30. They would leave the restaurant around 00H30.

That the table they occupied is next to the Tapas bar since that table was the biggest.

This group (who would dine at the time previously mentioned) was always made up of nine adults, constituted by eight couples (I think this is an error in the document, it says ‘oito casais’ or eight couples and should probably read four couples or quarto casais) and an older woman. He believed that this older woman was the grandmother of the missing child. He never saw any children accompanying the nine people.

When the table was reserved, nothing was mentioned about checking on the children and the only concern was in accommodating the entire group.

That the table this group occupied was always reserved for 20H30, and where the family of the missing child, in regards to dinner, has their routine defined.

That effectively he did know the missing child’s family due to the circumstances previously mentioned, but had not entered their [prior] residence. He goes daily to the family’s apartment in order to bring them lunch.

That every day around 13H00, he heads to no. 4-G (where the family of the missing child is staying) and to no. 4-1 (where 10 people are lodged) to deliver lunch. He repeats this routine at 20H00 to take them dinner.

That the payment for alcohol, not included in the vacation package, was paid by (service) card. This payment was made by random members of the group of nine.

According to what he remembers, the missing child’s family frequented the Tapas pool where they would take their children. They would stay in the children’s play area in the period between 16H45 and 17H30, at the time when babysitters would take care of the children. The babysitters are employees of Mark Warner.

That he never noticed any walkie talkies or other sound devices on top of the table occupied by the group. He only noticed that occasionally one of the nine present would get up from the table and leave for a few minutes. He did not know where they went.

The nine individuals, including the family of the missing child, were included in the half pension regime. They had the right to dinner (a menu that included starter, main course, desert and drinks as listed). All aperitifs, and after dinner drinks were paid separately using the credit card.

That generally, it was always the same people that dined in the Tapas and who were registered for dinner. A list of all the people who dined at the Tapas from the arrival of the missing child’s family to 2007.05.04 has been handed over to the investigation.

That on 2007.05.03 he began work around 09H30 and finished around 17H30, when he left the resort and returned again at 22H30, as already described previously.

That on the 3rd of May, 2007, he did not notice any abnormal situation or anything out of the ordinary, nor has any comment been made to him to this effect.

That for days prior to the disappearance of the child he did not detect any suspicious situation or details that he could now offer the investigation.

And nothing more was said.
