Sniffer dog evidence can't be discarded: HC
MUMBAI: A sniffer dog's evidence in a criminal case cannot be discarded, the Bombay high court has held while convicting a man of raping and murdering a five-year-old girl in 2007.
A division bench of Justice Ranjana Desai and Justice Vijaya Kapse Tahilramani noted that the evidence of a tracking or sniffer dog provides further proof of the crime, in addition to circumstantial evidence.
"Judicial notice must be taken of the fact that the training skills and special qualities found in police dogs are now being recognized universally as being of such a high calibre that in cases such as detection of explosive drugs, they are found superior and more effective than the most sophisticated instruments," said the judges, adding, "In this background, one needs to take cognizance that for tracking down a criminal, special faculties, qualities and skills of the dog are aspects of which note must be taken."
The court said that it would not be possible to brush aside the evidence of a tracking dog. "We are not placing complete and implicit reliance with regard to the identification of accused only on the dog tracking evidence. We have accepted this last head of evidence, in addition to the earlier evidence, in so far as it completely supports the same."
Kolhapur resident Ravindra Kamble (23) was accused of raping and murdering a five-year-old girl from his village on October 24, 2007. The girl's decomposed body was found in a field a few days later. The police called in the dog squad. The dog sniffed the vest found near the body and led the investigators first to the victim's house and then to Kamble's house, said additional public prosecutor Mankunwar Deshmukh.
During the trial, four witnesses testified that they had seen the victim with Kamble. A trial court sentenced Kamble to death. In the high court, Kamble's lawyers claimed that the prosecution's case was built entirely on the evidence of the sniffer dog. Deshmukh, however, pointed to other circumstantial evidence against Kamble.
The high court held Kamble guilty of the rape and murder, but said that the cases was not a "rarest of rare" that invited the death penalty. The court reduced Kamble's sentence to a life term for murder and awarded him 10 years for the rape. Kamble will serve the jail terms one after another, and not simultaneously, said the judges.

Quite right, malena - the dogs don't lie, they have no reason to lie, unlike humans. And evidence of the abilities of sniffer dogs of all kinds seems to be coming thick and fast these days, everything from helping in search and rescue, in murder and other criminal cases, detecting cancer or high/low blood sugar (in diabetics), etc. Anyone sneering at these amazing animals' abilities only makes a fool of themselves, they don't make a fool of the animal or those who train them. The whole McCann clan seem to have a remarkable ignorance of the whole subject of sniffer dogs, if we go by Auntie Phil's 'Lassie' remark or Gerry's 'Ask the dogs, Sandra' jibe. Funny, that.

Watch this video from 2.00 onwards. This is the story of a woman who disappeared from her small island home. Her dog kept being taken back to the island and he kept swimming to the mainland, to the property of the man who had actually killed her and led the searchers to her shallow grave. This was not a trained sniffer dog.

there is a programme on sky3, dog patrol, and it has all sorts of sniffer dogs
one found a stash of cannabis inside a playstation dance mat and this was so well done that they had actually undone the edges of the mat, put the hash inside, then restitched the mat, the repair was practically invisible to the naked eye
another dog found cocaine in a box of felix pouches that were still "factory sealed"
some dogs are trained to sniff out money and can even tell if an envelope has had cash in it, although the cash is no longer there
and in nicaragua there is even a breed of dog with two noses that they use for sniffing out drugs and they are twice as effective!
for 15 euro a month i sponsor three trained rats, two sniff out landmines and one sniffs out tb in urine samples
i consider it 15 euro well spent!

It was the dog who set off the resolving of the crime in the end. Amazing story but so sad seeing the husband of the murdered woman. He didn't say much but you could see real grief and loss in his eyes.

Wonder what kind of sniffer dog it was in the Indian case ? Interesting that in the McCann case, BOTH dogs alerted in the same areas. The reactions of Eddie and Keela in the flat and the McCanns' hire car, are the most compelling pieces of 'evidence' in this case.

I agree - but it's like everything else which is put to them - they have to dispute, deny and discredit - even sniffer dogs - everything. Whether this is standard reaction in their defence or they have been told to do this by whoever is protecting them - I don't know. It happens too much for it to be just coincidence. Just like they control what questions are asked and when it goes adrift from the agreed ones - they ignore the question and start waffling about something entirely different. They can't answer truthfully - it probably gives them the jitters because denying the evidence of the dogs is so wholly incongruous that it makes them look ridiculous. Didn't Gerry react very strangely when he was shown them at his interview. He knows the dogs have incriminated him/them/whoever.
