McCanns ask for extrajudicial settlement

They were the ones who took him to court for defamation and asked to suspend judgement to negotiate. On the eve of the trial of Gonçalo Amaral, against whom they filed a complaint, the McCanns asked to negotiate.

It's not often the one that accuses that asks to negotiate but in this case it was so. tvmais found that, on the eve of Gonçalo Amaral's trial, the McCann couple lawyers proposed a meeting in order to reach an extrajudicial settlement[out of cour]).

In court, Madeleine McCann's parents demanded from Gonçalo Amaral (see box*) a compensation of 1,2 million euro for alleged defamation. Now it's them who proposes an extrajudicial settlement .

The Blacksmith Thread covers a number of current "goings-on", so one dedicated to Amaral's compo is a good idea.

It's a ploy by the McCanns to gain another 6 months during which time they can get the Bennett case done and dusted and reap the PR rewards in the UK media. It's the UK media which takes priority for the McCanns - always has.

I am wondering how the newspapers who settled with the McCanns feel right now?

One man, with right on his side has taken on the Mccanns and called their bluff.

Will the newspapers decide they want their pound of flesh anytime soon?

you have a good point there -- i think the tide is turning -- but i do think the press will hold off until -- there is a statement or something re this review -- or opening of the case -and go from there

I can't imagine how Clarence can spin this even to the friendly U.K. press.

being the everso helpful hobnob wot i am, i sent the daily express an email pointing out their front page oopsie and also the gruesomes seeking an out of court agreement that Goncalo Amaral would decide was acceptable to him.
Since the express paid out a not unconsiderable sum to the gruesomes and the 7 dwarves i helpfully suggested they speak to their attornies in regard to suing to get their monies back since they printed the articles based on the reports in the files which are now publicly available and which corroborate the conclusions of madelein dying in te apartment ( accidental homicide allowed) and the parents and chums covered up said death and filed a false police report.

Since these facts are true and the gruesomes have cancelld their libel case ( there is no libel) then the express is entitled to sue for return of monies they paid out under threat of being sued for a libel which doesn't exist.
I also Let Pat Brown know as she was/is suing them regarding them getting Amazon to take her book of their lists as they claimed libel.

I think the case against Tony Bennet will also die a death since he too has used the facts in the police files and their conclusions to form his own opinion as to what happened, an opinion gerry says everyone is allowed to have.

This then leads me to wonder how they will pay all their legal fees since the fund cannot be used for such ( a disaster according to gerry)
Will they call upon their backers such as branson, kennedy etc to pay up? are they covered by no win no fee ( does carter0ruck use this in the hopes of getting more business coming their way from libel cases) will their family sell their houses to cover their not inconsiderable bills?
Who was pro bono?

Is this why the funds are so non transparent and were filed so late?
Hiding away of money?

Will the gruesomes spin this and claim having to pay damages, costs etc will empty the fund, hinder the non search since last march and leave the twins destitute?

Will the 7 dwarves who will also likely face libel charges now sue the gruesomes for the return o the money they donated to the fund ( how sweet) so they can pay damages and costs to Goncalo and also pay it back to the express as well.

It's going to ge real expensive real fast and i forsee lawsuits flying between the gruesomes and their lawyers and also between the 7 dwarves and the gruesomes and lawyers.

A card has been taken away from the house of cards and all that is left to do is sit back with popcorn and scorecards as we watch it collapse.

I wonder if the 7 dwarves will decide when faced with the collapse of the libel trial that they need to be talking to their lawyers real fast to see what their options are and if there is any chance of a deal.

It is every man for themselves.

I've just read Mercedes blog which states:
"The defendants are Gonçalo Amaral, former coordinator of the PJ and author of the book "The Truth of the Lie", the publishers Guerra & Paz, who published it, Valentim de Carvalho, who produced a documentary based on the book and TVI, which issued it".

Presumably this means that the McCanns will not just be negotiating with Goncalo Amaral but also with Guerra e Paz, Valentim de Carvalho and TV1. If this is the case he is not alone.

Will Healy & McCann have to appear in prison person - to account for the Entrapment, perhaps?

I don't think they are obliged to attend in person - but the tempter himself will be there.
Perhaps he will reveal who put him up to it - or then again he might take the rap and say that it was his idea all along.

I think I'm right in saying that the McCanns have no legal obligation to turn up for this hearing but, if a full libel trial was to follow, they would then be compelled to give evidence under oath.

I think also that Slugman Mike Gunnill is the one who will need to appear this time to explain his actions.

Very curious logic (Or absence of).

Vexatious litigation is to be deplored and it is clear from past Judgements that this Case is based on vanity, not upon a realistic prospect of success.
