Lisbon Libel Trial McCanns v Amaral

Come on fred! I have agreed with you before now. :-) This is such a mad case we all go round in circles.

My initial reaction to the headline was to run for the sick bucket but on reflection the Express is giving people the opportunity to know what's happening.

I look forward to reading the story in full tomorrow.

The mother of missing Madeleine McCann is expected to attend a Portuguese court for the start of the family's libel action against a former local police chief.

Kate McCann will be accompanied by her mother Susan Healy for the first hearing of the case against Goncalo Amaral who published a book making allegations about the three-year-old's disappearance.

The McCanns have strongly denied the accusations and say the former detective's claims have damaged the hunt for Madeleine and exacerbated the anguish suffered by her relatives.

Their lawyer Isabel Duarte is expected to set out the case - on behalf of Mrs McCann, her husband Gerry and their twins Sean and Amelie, now eight - at Lisbon's civil court.

Mrs McCann, who is travelling to Portugal for the hearing, could have been called as a witness but is not expected to give evidence.

Instead, a number of relatives will appear in the witness box. They will give evidence relating to the "damage" caused by Mr Amaral's book which, they claim, poisoned public opinion in Portugal against the family and allegedly deterred people from hunting for Madeleine.

The family stands to gain around £1 million in damages if their legal action succeeds.

Spokesman Clarence Mitchell said: "Kate and Gerry McCann remain very confident that they will win the case.

"They have a strong case against Mr Amaral. The matter is now in the hands of their lawyer as it goes through court."

A number of relatives ! Presumably there to say how Kate has suffered etc etc, obviously going for the sympathy vote.

Ye gods, are they going to let Motor Mouth Philomena out of her cage?

A good few months ago, I read that Goncalo Amaral was hoping to put the McCanns in the witness box. Did anyone else read this?

the headline implies that poor Kate is being pursued into court to add to her 'suffering' when it is herself and hubby who have initiated this vexacious case....

Well, if it's an ordeal, there's an easy way out. They can instruct their lawyer to drop the case, they can go back home and start looking for the daughter they lost. But there's no money involved in that so...

I see that in this article, Mr Amaral is once again described as a 'disgraced detective'.

Mr A Source makes another appearance and states that: "The Met police are worried it (media circus surrounding Mccanns' presence) will create a bigger platform for Mr Amaral and his supporters to spout more bile and could damage their own inquiries in the country."

And yet, quote:
However, Mrs McCann made a last minute decision to attend the first day of the civil case and is expected to give a statement outside court.

So, according to Mr Source, she's gone against police advice and is therefore knowingly creating the circus which may damage the Met inquiries.
There are not enough expletives in the world for me to use to describe the sheer hypocrisy and chicanery of these creatures.

Martin Brunt has tweeted that Mr. Amaral is expected to ask the judge to hold the hearing in private. He doesn't indicate his "source" however. Can't help but wonder if the source was Clarence Mitchell in the event that it is the McCanns who actually would like the proceedings to be in private. It is the McCanns who have plenty to hide.

Do 'witnesses' swear on oath in Portugal?
Can GA use new 'information' given freely by McCanns, in bewks or tv interviews, since the filing of case, as new evidence?

Agreed. Amaral has nothing to hide. The McCanns, on the other hand, don't want their stellar repuatations tarnished any further. Amaral may be able to provide evidence that has not yet been released from the files in order to defend his position. (One can only hope!) I am amazed at how Amaral has for the most part kept quiet since Madeleine's disappearance, while the McCanns and the UK media continue to bash him, the PJ, and all of Portugal. Perhaps he was waiting for the right time to bring the unreleased evidence to light?

Thankfully it's far less venomous than the disgraceful article in The Telegraph.

I wonder if the placing of the advert at the top (Tesco mum of the year awards) was done deliberately?  

As for the McCanns' description of Snr Amaral as a "self-obsessed, manipulative money-grabber" this must be the most classic example ever of the pot calling the kettle black.

Maybe he should have put all the profit in a private limited company.
