Decision: parole request was denied

The Court of Execution of Sentences considers that João Cipriano does not assume the responsibility for the crime, plays the victim and shows no empathy for the victim.

The Court of Execution of Sentences in Lisbon rejected the application for parole of João Cipriano, currently fulfilling 16 years and eight months in prison for killing his 8-year-old niece, Joana Cipriano, who disappeared in September 12, 2004 from the locality of Figueira, in Portimão.

The girl's body was never found, but João and his sister Leonor - the mother of the child - ended up being convicted by the Court of Portimão, after a jury trial, for first degree murder [aggravated] and concealment of the cadaver of the child.

In late September 2013, Joana's uncle had fulfilled half of the sentence. However, the court concluded that some presuppositions did not met the parole's criteria: João does not assume the responsibility for the practice of criminal acts, externalizes feelings of self-victimization, does not show empathy for the victim, has a criminal record and has four disciplinary sanctions while a prisoner. João Cipriano is serving time in the jail of Carregueira, in Sintra.

According to the ruling, "it would be incomprehensible for the Society and counterproductive for someone who is responsible for the practice of a serious crime, as the one for which the inmate was convicted, to benefit of parole once the middle of the sentence was reached".

Joana was likely killed after seeing the mother and the uncle in an incestuous act. Her body was dismembered and fed to pigs. In 2009 Leonor blamed her brother for the crime. He had already done the same to her.
