McCann way to Lisbon
The lawyer defending Gonçalo Amaral in the interim it has withdrawn the book "True Lies" of the market is in quarantine after being diagnosed with the flu one of the employees of the office. Speaking to the RTP, Gonçalo Amaral broke his silence to which they sent from the injunction that forbade him to defend in public the idea that Madeleine McCann is dead.
Perhaps someone could translate the text correctly?
That would be kind.

Well at least they have a cure now. Oinkment.
And to confess - having read the judgement I was entirely wrong, tomorrows event is the appeal against the injunction and not the libel action - I apologise unreservendly to those with whom I argued the toss - you were right and I was wrong. Sorry.

Maddie Showdown
showdown
1m libel case ... Kate and Gerry McCann
By ANTONELLA LAZZERI
Published: Today
MISSING Maddie McCann's parents face a dramatic court showdown today with the former Portuguese cop who claims they lied about her disappearance.
Kate and Gerry McCann flew to Portugal yesterday for the start of a 1million libel action against Goncalo Amaral who insists in a now-banned book Maddie is dead.
A friend of the McCanns said: "This is not about the money. It is to put an end to Amaral saying these things.
"Enough is enough. He has made money out of Madeleine and has affected the search for her.
"If people think Madeleine is dead they won't be looking for her."
Amaral, 54, led the initial investigation into Maddie's disappearance aged three from Praia da Luz, Portugal, in May 2007.
But he was sacked after publicly criticising the British police's involvement.
Since then he has made a fortune from his book claiming Maddie died in an accident or from an overdose of sedatives in the McCanns' holiday apartment.
He accused her parents of disposing of her body and making up the abduction story.
The McCanns, both 41, from Rothley, Leics, later won an injunction banning Amaral's book, The Truth Of The Lie, from sale.
But he plans to publish a new book called The English Gag tomorrow.

Re: Amaral V McCann trial
South Africa's manhunt expert, who has travelled to Portugal to trace missing Madeleine McCann, says that the possibility that she is still alive "is very slim".
And in a heartbreaking development her parents have accepted that she is probably dead, their official spokesperson admitted for the first time on Wednesday.
Clarence Mitchell, speaking for the family, said: "Kate and Gerry are realistic enough to know that there is a probability she is dead, but they have not given up hope that she is still alive and is being looked after somewhere."
It has also emerged that Danie Krugel, the former policeman whose special invention has been used to try to track missing people, visited Portugal in an attempt to find Madeleine. Madeleine, who is now four years old, disappeared while she slept in the room of a hotel complex in Praia da Luz with her younger twins on May 3. Their parents were dining at a restaurant nearby.

As Mrs McCann succinctly put it just hours before being named as a suspect: "The police don't want a murder in Portugal and all the publicity about them not having paedophile laws here, so they're blaming us."
So why did she mention murder when the PJ were at the time working on the assumption she was abducted. Surely had she known or suspected madeleine was alive then she would have said - As Mrs McCann succinctly put it just hours before being named as a suspect: "The police don't want an ABDUCTION in Portugal and all the publicity about them not having paedophile laws here, so they're blaming us."
You would only use the word murder if you knew the person was dead!
And why the word MURDER? had it been an accident then she would have said a death or suspicious death in portugal but she used the word murder which is very telling.
We know she is atrociously bad at stringing comprehensible sentences togeather without ums ers tuts and sighs so it looks like she opened mouth before engaging brain.
This would lead me to think that she knows Madeleine is dead and she knows how. Now whether it was pre meditated or not i couldn't tell you but murder is usually indicative of premeditation or that the person equates the fact they killed someone even in the heat of temper as murder.
I think that Madeleine was killed when someone lost their temper. A hard push or shove, a slap or punch when in a rage and the deed is done. You have a dead child with signs of assault such as bruising, bleeding which cannot be explained as accidental.
attempts to clean up the blood got most of it but you can never clear it all, tile grout is absorbent and luminol will show where blood was spilled even after clean up. the curtains also showed blood traces so depending on the blood pattern it could indicate what happened.
was blood absorbed at the bottom where it came in contact with a bloodied corpse? was their blood spray comensurate with striking a body?
Did they check the ceiling for any blood spatters such as when a fist or weapon is swung back to strike again and blood flies off the end.
It will be very hard for them to say Goncalo has affected the search because he believes she is dead and that has caused folk to stop donating and giving information when by their own admission they have said the same thing including hiring a body finder. Why do that if you truly believe your daughter is alive unless you know or suspect she is dead which is what Amaral has said.
Statistics would also indicate that unless a missing child is found within a certain time limit then the likelihood will be that the child is dead ( the exception being if the abduction is by a person known to the child such as an estranged parent)
Their early interviews say a lot more than they think which is probably why we now have to hear the whine of their pink spokespoodle rather than the whine of kate and gerry. neither of them can be trusted not to open mouth and insert foot and even the dumbest member of the public winces when you see them painfully mangle their way through simple sentences.

Re: Amaral V McCann trial
I got cranky when i read the daily express version of kate and gerry sue Amaral in particular the comment claiming that They have been cleared of any wrongdoing and claim the book has harmed the search for Madeleine because Mr Amaral said he believed she was dead. and The McCanns were later cleared of any involvement
So i have fired off an email to the express' editor and also the press complaints commission citing article 1
Accuracy
i) The Press must take care not to publish inaccurate, misleading or distorted information, including pictures.
ii) A significant inaccuracy, misleading statement or distortion once recognised must be corrected, promptly and with due prominence, and - where appropriate - an apology published.
iii) The Press, whilst free to be partisan, must distinguish clearly between comment, conjecture and fact.
iv) A publication must report fairly and accurately the outcome of an action for defamation to which it has been a party, unless an agreed settlement states otherwise, or an agreed statement is published.
I have pointed out that saying they have been cleared of any wrongdoing or involvement is misleading and distorted information since to be cleared they would have had to have been arrested, charged, tried and found not guilty in a court of law which clearly is not the case.
I pointed out that what they had actually had done was have their arguido status lifted which is completely different.
I informed them what the difference was between being an arguido and a witness was and also what protection was gained by being arguido.
I also pointed out that kate refused to answer 48 questions so either she chose to be made arguido or it was placed on her for her own legal protection. Should either be recalled back to Portugal or arrested and questioned again and one or both refuse to answer questions then they will automatically become arguidos again with the protection it entails such as having a lawyer present, refusing to answer questions and being able to lie, whereas as a witness they have to answer all questions and tell the truth otherwise it is a criminal offence.
I will let you know what happens

Re: Amaral V McCann trial
If Amaral is very clever he could easily throw this couple off balance and show them up for what they are, In My Opnion, people who know exactly what happened to Madeleine. They most certainly know that she will not be turning up any time soon or in the future.

Gonçalo Amaral's lawyer is in quarantine and has already notified the court. The McCanns arrived in Portugal yesterday.
Gonçalo Amaral's lawyer is in quarantine at home, after learning that an employee of his office has influenza A. António Cabrita has requested the postponement of the trial of the book "The Truth About The Lie."
The first session of the trial process against the book by the former coordinator of the Judicial Police, is scheduled for 9:30 pm today, at the 7th Circuit Court Civil Court of Lisbon, in the Courthouse. The prevention of Gonçalo Amaral's lawyer can dictate the postponement of the trial, which would be likely to occur around the 21st.
The quarantine state of António Cabrita was known at the end of yesterday afternoon, a time when Kate and Gerry McCann were already on the plane to Lisbon. The couple, who arrived at the Portela Airport shortly after 23:00, were still unaware of the possible postponement of the session.
Confirmation will only be given today by the judge who will judge the case. It will be the judge's decision whether to postpone, or not, the start of the hearing and set a new date. Anyway, the seven witnesses called by Gonçalo Amaral and called for today's session are to appear in the Courthouse. The prosecutor of Portimão, Magalhães e Menezes, who signed the order to close the investigation into the disappearance of Madeleine, Luis Neves, Director of the National Counter-Terrorism who helped coordinate investigations and Guilhermino Encarnação, the former director of the PJ of Faro, are some of the witnesses for Amaral.
The trial process also involves the publishers Guerra e Paz, who edited the book "The Truth About The Lie", a media company that produced a video and a TV channel that aired a documentary.
The evaluation is based on the application for interim relief brought on by the McCanns in May on behalf of their three children, Sean, Amelie and Madeleine, in order to withdraw the book of Gonçalo Amaral and the documentary based on the same work. And to stop the sale of copyright abroad by publishers Guerra e Paz and also prohibit the former policeman from continuing to speak publicly about his thesis of the case.
"I came for the trial tomorrow. We're here to ensure that freedom of speech does not allow the truth to be distorted. And [Gonçalo Amaral] distorted the truth. We're not here because of him. The law will produce justice," said Gerry McCann on arrival at Lisbon airport.

Amaral witnesses named

Influenza A slow response of Gonçalo Amaral injunction to the McCanns
You can not perform the examination of witnesses indicated by Gonçalo Amaral in response to the injunction filed by the McCanns and for the prohibition of sale of the book "Maddie - The truth of the lie."
The lawyer for former coordinator of the case received medical indications this afternoon to stay home quarantine and treated with Tamiflu since its secretary is infected with the H1N1 virus.
António Cabrita was preparing to go to Lisbon, where mid-afternoon a phone call warned of a problem: your desktop is infected with influenza A.
As a precaution, the lawyer Gonçalo Amaral will have to be quarantined and treated with Tamiflu. The case was exposed immediately, a request the judge of the 7th civil court of Lisbon. This is because, for this Friday morning, is scheduled examination of six witnesses listed by the defense of the former research coornador the Maddie case, under the defense to the injunction filed by the McCanns, to ban the sale of the book.
Witnesses pointed out by Amaral include Magalhães e Menezes, the public prosecutor of Portimão, responsible for the Maddie case, Tavares de Almeida, Ricardo Paiva Guilhermino the Incarnation and Bob Snow, inspectors from the Judicial related case, Joseph Davis, the liaison officer the British police and criminologist Moita Flores.
If the judge rejects the request of the lawyer, the session may be postponed to December 21.
Apart from this setback, Kate and Gerry McCann have decided to return to Portugal for the start of the hearing. The couple will even have intentions to visit Praia da Luz, it appears that during the end-to-week.

So it is all a hoax.

I must be very stupid.
Really.
If he is fit (but is he?) he could wear a breathing protection and disinfect his hands thoroughly before the court-date.
No risk for others then.

McCanns In Portugal For Battle With Ex-Cop

Gerry and Kate McCann have flown into Lisbon in determined mood and ready for a court battle with the ex-police chief who believes their missing daughter Madeleine is dead.
The McCanns believe ex-officer Goncalo Amaral is distorting the truth
They will ask a judge for a permanent ban on sales of Goncalo Amaral's book The Truth Of The Lie, in which he challenges their version of Madeleine's disappearance.
Mr McCann, 41, told Sky News: "We're here to make sure that freedom of speech doesn't allow the truth to be distorted.
"We believe the book has damaged the search for Madeleine.
"If people read it and believe she is dead then they will not keep looking for her and may not come forward with information they may have."
The couple will also ask the judge for around a million pounds in damages which they will use to pay for their own continuing hunt for their daughter.
Madeleine was nearly four when she vanished without trace from the family's rented holiday apartment in Praia da Luz on the Algarve coast in May, 2007.
She had been left with her twin siblings in bed while her parents dined nearby with friends.
The McCanns are sure she was abducted and believe she is still alive.
Mr Amaral was a senior officer in the investigation but was removed from it before it was abandoned after 15 months.
In his book he asserts that Madeleine died in the apartment and her death was covered up.
The McCanns won a temporary injunction in September when thousands of unsold copies of the book were handed over to their lawyers.
Mr Amaral will fight their action, claiming he has the right of freedom of speech.
He is also planning to launch a second book in which he will claim he has been gagged by the McCanns.
The court case is expected to conclude next week.
