Re: Amaral V McCann trial
I have a knowledge gap.
The world believes seems to be important.
That is how I see it.
Did Amaral ever state that Madeleine is dead?
Or did he only did state it is highly likely that she is dead (like in the official files)?
Any idea?
Dr. Amarals book would not have prevented any person to call the police in case she/he would have seen Madeleine!
The McCanns logic is a little bit strange imo.

Re: Amaral V McCann trial
http://joana-morais.blogspot.com/2009/12/influenza-delays-goncalo-amaral.html
The hearing of witnesses that were requested by Gonçalo Amaral in his opposition to the injunction made by the McCanns, which determines the prohibition to sell the book "Maddie, The Truth of the Lie" may be postponed.
The lawyer of the former coordinator of the case, António Cabrita, received this afternoon medical indications to stay at home in quarantine because his secretary is infected with the H1N1 virus.
António Cabrita immediately informed the judge at the civil court of Lisbon. On Friday morning two of the seven witnesses that have been requested by Gonçalo Amaral are scheduled to be heard within the opposition to the McCann's injunction.
The seven witnesses called by Gonçalo Amaral's defense are: Magalhães e Meneses, the Public Ministry prosecutor who held the Maddie Case Dossier; PJ chief Inspector Tavares de Almeida; PJ Inspector and McCann family liaison officer Ricardo Paiva, National-Joint Director of PJ in Faro Guilhermino Encarnação; PJ's Heavy Crime Unit Director Luís Neves, Former Judiciary Police Inspector and Criminologist Francisco Moita Flores and Scotland Yard Inspector José Freitas.
This witnesses will testify to the fact that the thesis that is presented by Gonçalo Amaral in his book is nothing more and nothing less than the facts pertaining to the investigation.
If the judge accepts the defense lawyer's request, the session may be postponed to December 21st.
Contrary to what the McCanns Spin Man suggested it is now apparent that the McCanns will visit Praia da Luz in the Algarve over the weekend (or maybe tomorrow in the afternoon in an attempt to boycott Gonçalo Amaral's new book launch).

Good Morning Kazlux,
So the sapo article is a joke, right? I read recently on a Forum that Cabrita is not charging Amaral for his
services, do you know anything about it? BTW, I sent you a pm a few days ago, did you receive it?

Good morning Beattie,
no joke I'm afraid, the lawyer (Cabrita) has asked for a postponement of the hearing and it will probably be granted, so the hearing will take place on december 21st, most likely.
Yes I also have heard that Cabrita does not charge Amaral for his services in the case (but still there are legal costs to be paid, for example 5000 euros for filing the appeal) and no, I have not received your PM - last one was from nov. 22, please resend?

That"s a choker, the McCanns are apparently already in Portugal, they were filmed at the Airport.
If this decision was made yesterday, surely the McCanns should have been told so they could cancel their flight

Thanks Ann_Chovey, will turn the Telly on, Sky repeats all their News every 5 minutes so I"m bound to see it.
Maybe they weren"t told in time to change their flights so their journey is in vain and that"s why Gerry is p***ed off, yet more Fund Money wasted. I do wonder though how opportune this delay is for Cabrita to amass
more evidence for his Client"s defense, or, if true that Amaral"s book is to be published today, they have time
to sell copies before another injunction is granted.!!!!!!!

Really.
If he is fit (but is he?) he could wear a breathing protection and disinfect his hands thoroughly before the court-date.
No risk for others then.
But?
Different countries have different rules about Swine Flu; it is possible that in Portugal anyone who has it or who has been into contact with a confirmed case has to remain in quarantine for a certain amount of time. It would be a sensible measure. I believe Spain has a similar policy.
So, if the case is postponed, the McCanns will have extra time to go and visit the "many friends" they insist they have in Praia da Luz. Perhaps they'll dine at the Tapas Restaurant? They won't have to worry about any child-minding arrangements this time...

Usual rubbish about them having been cleared of any wrong doing, disgraced cop etc, but at least this article has given the new book a lot of publicity.

PORTUGESE DETECTIVE SUED BY GERRY AND KATE MCCANN RELEASES NEW MADDIE BOOK
The McCanns are suing Goncalo Amaral after he implicated them in Madeleine's disappearance
Friday December 11,2009
By Nick Fagge
THE disgraced Portuguese policeman who claimed Kate and Gerry McCann were involved in the disappearance of their daughter Madeleine is to publish a second book about the case, it emerged yesterday.
Former detective Goncalo Amaral will release the book – called The English Gag – today as the McCanns go to court to sue him for libel for his first book, The Truth Of The Lie.
The launch, to be held at one of Portugal’s most respected bookshops, will take place just hours after the couple embark on a court room battle with Amaral.
The McCanns are seeking up to £1million damages over his claims that they were involved in their daughter’s death.
They have been cleared of any wrongdoing and claim the book has harmed the search for Madeleine because Mr Amaral said he believed she was dead.
Kate and Gerry McCann dramatically returned to Portugal yesterday to face him across the courtroom in a bid to stop him peddling lies.
Last night their spokesman, Clarence Mitchell, said: “It’s regrettable that Mr Amaral chooses to do this on the same day as the trial opening.
“Most people would expect him to concentrate on the trial rather than launching any new book and the court will take its own view of his activities.”
Madeleine was nearly four when she vanished from the McCanns holiday apartment in Praia da Luz, Algarve, in May 2007.
Mr Amaral led the investigation and was instrumental in making the couple, from Rothley, Leicestershire, official suspects in their daughter’s disappearance.
But he was taken off the case after he criticised British detectives who had been brought in.
The McCanns were later cleared of any involvement. In his best-selling first book about the case, he claimed Madeleine was dead and questioned the McCanns’ account that she was abducted while they were eating with friends.
The couple’s lawyers were granted an injunction banning further sale or publication of the book in September following a year-long campaign.
The court order also banned Mr Amaral from repeating his claims about Madeleine or her parents. But in court today the detective, who resigned after he was found guilty of professional misconduct in relation to a separate child abduction case, intends to deny vigorously the McCanns claims of defamation.
Mr Amaral, who enjoys widespread sympathy in Portugal, has said he will call high profile witnesses including British police officers.
The 54-year-old former detective said he decided to write a second book after he was faced with censorship about the case.
His second book will be launched at the prestigious Lisbon bookshop Ler Devagar at 6.30pm local time.
In it, Mr Amaral defends the publication of his original book and claims he was gagged by the British establishment.
Portuguese detectives have claimed their investigation into Madeleine’s disappearance was seriously hampered by the publicity campaign run by the McCanns and their supporters.
Senior police officers have claimed they were unable to carry out their inquiries properly because the couple were protected by a network of powerful people that included millionaires, celebrities and politicians.

Re: Amaral V McCann trial
"We are here to ensure that freedom of speech does not allow the truth to be distorted" Says Gerry, quote OP. Gerry knows the truth then, does he? I thought he was not present when Madeleine "vanished".
Think this is more to do with compensation, than searching, or rather re-opening the police enquiry.
We all had "swine flu" , about the same as ordinary flu. UK not closing schools yet, and the flu alert is admitted to be
less severe. Avoid the jab (flucase.com)

Re: Amaral V McCann trial
The McCanns would no doubt have have sued if they had contracted the flu through attending court. I'm quite sure they will be putting down their unnecessary air fares as additional expenses so as not to deplete Madeleine's search fund even further. In reality the Portuguese judiciary should find them residence in the deepest, coldest, dampest cells until the hearing resumes. (IMO that is).

I wonder if the mccanns knew about the witnesses as most off them had something to do with the case and have the same thesis as mr amaral, if they didnt, it will give them time to change tactics, wont it.
