There were several possible charges that could have been brought against the McCanns’: kidnapping and selling a child were among them.

He said that Kate and Gerry’s report that they had been checking on their daughter every half an hour was inaccurate. He claimed that although the parents had been checking on Madeleine, it was not as often as every 30 minutes. – Well we all knew that , thanks Mrs Fenn ;)

Police intercepted text messages sent by the McCanns’ because they were suspicious of the parents’ role in Madeleine’s disappearance.*

A report signed by Chief Inspector Tavares De Almeida said that Madeleine died in the flat in Praia da Luz, the witness adds.

The British police told the Portuguese officers what the capabilities of the sniffer dogs being used in the investigation were.

One of the dogs used to search the apartment in Praia da Luz identified blood and another identified the smell of a human body – a “dead” human body, no person has ever been known to die in 5a…

The dogs detected the traces inside the dining room of the holiday flat and in the car the McCanns’ were using. – he forgot to mention Kate’s trousers and t-shirt, oh and a small childs red t-shirt

The animals also found a scent on a piece of cloth in a flat rented by the McCanns’ after they left the apartment where Madeleine vanished. – i think here he is refering to cuddle cat

A report by the British police stated that one of the sniffer dogs was in a nervous, excitable state, and wanted to get into the room. – and do his job

He tells the court that British police took an active part in the investigation.

British police kept information about the McCanns to themselves. – what like the Gaspers statements do you mean, the ones where they accuse Gerry McCann and David Payne of making pervy comments and gestures towards Madeleine? What else did they keep secret i wonder….Gordon, Blair care to comment??

Forensic lab technicians from Birmingham came to Portugal so it is strange concerns were raised about contamination. – isn’t it just

British authorities other than police hindered investigation by withholding information. – What the great British Gov…get away with ya. Mind you they did slap a D notice on the operation ore list hmmm.

When we asked UK for info on McCann’s we got a single side of a4.- bahahahahaha…was it blank?

At this point The McCann’s lawyer is getting quite worked up in her cross examination of de Almeida. – ooopsy

Then the McCann’s lawyer is rebuked for saying de Almeida was accused of torturing suspects – he was never charged. – double ooopsy

The court is adjourning for lunch. Back at 3pm – in other words the Judge calls time out and orders Ms Duarte to sit on the naughty step

Inspector Ricardo Paiva –

Insp Paiva says he was the family liaison officer for the case but was taken off at the McCanns request. – well they had all the support they needed, Brown made sure of that

Paiva is asked whether he ever got the impression from the McCanns’ they thought Maddie could be dead. He says yes. – Kate found this amusing and whispered in Gerry’s ear at this point. Ever the stoic Scot though, Gerry continued to look straight ahead preferring to ignore wifeys immaturity.

Paiva also says the McCanns’ were made suspects after the British sniffer dogs were brought in. – not them bloody dogs again

It was Scotland Yard who first thought it could be a murder case.

Amaral’s theories are based on the facts of the investigation – i can vouch for that having read the files myself

Amaral’s thesis has prevented other theories from being investigated. – Lets get the case re-opened then!

McCann’s never pointed me towards any evidence that Maddie was still alive – because they knew she was dead Gov!

we found the ‘merchandising’ operation with wristbands and so on very strange – yep and so did most of the populace, still GM said he thought his daughter’s eye was a good marketing ploy!

If she was being held somewhere publicity would be more likely to hasten her death – but it was a good marketing ploy for goodness sake man, they had a mortage to pay

The McCann’s’ lawyer is taking an aggressive tone as she cross-examines Mr. Paiva. – Careful you’ll be on the naughty step again….tut tut

The McCann’s’ lawyer makes the point that ‘evidence’ usually sightings – has suggested Madeleine is still alive. – bahahahahahaha, i’ve not forgotten Mr. Edgar’s performance when seeking info on the “Posh look a likey”

He says that the McCann’s are not responsible for generating any of this ‘evidence’ that their daughter is not dead. – Bahahahahahahaha

Another of the McCann’s’ lawyers moves to quiz the witness – literally. She gets out of her seat and walks right up to the video screen. She says that the McCann’s were always totally prepared to come back to Portugal to take part in a reconstruction of the disappearance. – bahahahahahaha

The senior lawyer for the McCann’s has approached them on the front bench of the public gallery for a quick huddled conversation. – tips from “sea bass” no doubt

I don"t think the McCanns have a hope in Hell of salvaging their Reputations, even if they win this case.

There has been an Earthquake in Haiti which has killed thousands but it is the McCanns who are front page
News. How will Clarence explain this away.

The McCanns are going to wish they had never taken on Amaral. They have opened a can of worms that will not go away and it is the best thing to happen as now there could be some cracks in their stories.

A source close to the McCanns from Rothley, Leics, said: "It may be traumatic for them to hear terrible things said about them and Madeleine but they want to be there for her sake."

Pity they weren"t there for her sake when Madeleine was crying for over an hour, yet Gerry and Kate still went

I think this has given the papers the chance they have been looking for. I remember when Gillian Taylforth sued for libel reading that it was a huge mistake because all of a sudden papers were free to print bad stories about her. If she had kept quiet, the story went, hardly anyone would have read the story she protested about and probably wouldn't have bothered with it even if it they had because it wasn't all that bad (something about she and her boyfriend indulging in some action in his car).

But because she got greedy, and saw the chance to get a lot of money, her name was dragged through the mud.

A salutary lesson there for two doctors....

The examining magistrate Jose Magalhaes e Menezes relied on a report by the then investigation officer, Tavares de Almeida, and claims that Madeleine McCann is dead since 2007, and died at the house of the parents.

The report is part of the evidence by the former Inspector Goncarlo Amaral.

Amaral's book "A verdade da mentira" (The truth about the lie) was banned in September 2009

Padres de Madeleine y ex inspector luso Amaral vuelven a los tribunales

Kate y Gerry Mc Cann retomaron el proceso interpuesto contra Amaral con el objetivo de retirar definitivamente del mercado el libro "Maddie, la verdad de la mentira" (2008), después de que un tribunal luso ordenara el pasado septiembre la retirada cautelar de la obra, donde se involucra a los progenitores en el caso.

El Palacio de Justicia Lisboa acogió hoy la primera sesión del juicio con la presencia del matrimonio británico y de Amaral, quien presentó su defensa a través de la comparecencia de varios testigos, quienes apoyaron las tesis del ex inspector luso.

Algunos antiguos oficiales implicados en el caso, entre ellos el Director Adjunto de la Policía Judiciaria (PJ), Luis Neves, confirmaron estar convencidos de que la niña falleció y que el matrimonio ocultó el cadáver.

No obstante, Amaral, en declaraciones a los periodistas después del juicio, mostró su desilusión con el testimonio del fiscal del Ministerio Público que cerró el caso en 2008, ya que declaró que la muerte de la pequeña nunca fue probada.

"Quizá hay falta de coraje político digamos así (...) Hay un proceso con decenas de indicios de hechos, de coincidencias, de diferencias de testimonios", argumentó Amaral, que dirigió parte de la investigación sobre la desaparición de la niña hasta que, presionado por sus críticas a los medios y las autoridades británicas, renunció y se jubiló anticipadamente.

Por su parte, la aboga de los Mc Cann, Isabel Duarte, desveló que los padres de Madeleine están "muy contentos" en cómo se ha desarrollado la primera jornada del juicio -que se prevé que dure hasta este jueves- y califica "Maddie, la verdad de la mentira" como un libro "lleno de interferencias y deducciones".

El litigio entre el matrimonio McCann y Goncalo Amaral también afecta al vídeo con el título homónimo del libro basado en un documental transmitido por el canal portugués de televisión TVI, que divulga la tesis del ex inspector sobre Madeleine.

Asimismo, los progenitores de la pequeña británica presentarán otra acusación contra Goncalo Amaral debido a declaraciones que consideran difamatorias y por las que solicitan 1,2 millones de euros de indemnización.

El proceso contra el antiguo policía portugués continuará mañana con la presencia de Gerry McCann, mientras que Kate, su mujer, se quedará en Lisboa acompañada de una amiga para comparecer en la audiencia del jueves.

Madeleine McCann estaba a punto de cumplir cuatro años cuando desapareció de un apartamento de playa en el Algarve (sur de Portugal) en mayo de 2007.

Los McCann, que declararon desde el principio que su hija había sido raptada, fueron considerados sospechosos formales en septiembre de 2007, pero fueron exculpados en julio de 2008 por falta de pruebas para sustentar la hipótesis de que la niña hubiese fallecido por muerte accidental.

For its part, the advocates of the Mc Cann, Isabel Duarte, revealed that Madeleine's parents are "very pleased" at how it has developed. The first day of the trial is expected to last until Thursday.

The Attorney General of Portugal closed the process, which could be reopened if new evidence came to regarded as consistent on the disappearance of the girl.

Meanwhile, Amaral launched last December a new book on the disappearance of Madeleine, entitled "The English gag. Story of a banned book" and that is about the prohibition of sale of his previous work.

Portuguese police convinced themselves Madeleine McCann's parents faked her abduction, despite having no evidence against them, a court was told yesterday.

Officers leading the investigation into the three-year-old's disappearance believed she died in a 'tragic accident' and that her parents hid her body, a senior detective admitted yesterday.

The dramatic confession was made during a tense legal battle in a Portuguese courtroom, played out in front of Kate and Gerry McCann.

After almost three years of leaks, slurs and innuendo, Inspector Tavares Almeida laid bare unsubstantiated police suspicions against the couple.

It was the first time any Portuguese police officer has spoken publicly about the decision to name the McCanns as arguidos, or official suspects.

Mr Almeida said the decision was taken after he filed a damning report to the Portuguese prosecutor in September 2007, four months after Madeleine's disappearance.

'The conclusion arrived at in the report was that Madeleine McCann died in the apartment and that the McCanns simulated the abduction,' he said.

'So they are suspects. It was a tragic accident in the apartment that night.'

Mr McCann shook his head in disbelief as Mr Almeida gave his evidence on behalf of his former senior officer, disgraced detective Goncalo Amaral.

He put his arm around his wife as they sat in the public gallery of the court. The couple, both 41, have accused Mr Amaral of libel after he wrote a book accusing them of covering up their daughter's death.

Yesterday's hearing was part of that £1million libel case.

Mr Almeida claimed that British police had also believed the McCanns were involved after Madeleine vanished from their holiday apartment in Praia da Luz.

'We all believe she is dead,' he declared defiantly. 'It was our conclusion as police professionals, both Portuguese and British police. The McCanns didn't kill her but they concealed the body.'

Madeleine vanished from a holiday apartment while her parents ate dinner with friends at a nearby restaurant on May 3, 2007. The McCanns led a worldwide campaign to find her, but there have been no confirmed sightings.

A second officer, Ricardo Paiva, said Portuguese police were suspicious of the couple's 'merchandising' operation in the months after Maddie disappeared. The Madeleine Fund they set up sold wristbands and T-shirts publicising the case and used the money to support the search.

Mr Paiva said they should have faced prosecution for leaving their children alone, saying: 'People have been arrested for far less - even in the UK.'

Former Portuguese detective Goncalo Amaral wrote a book accusing the McCanns of covering up their daugther's death

He admitted that Mr Amaral's conviction about the McCanns' involvement had stopped police from investigating other theories.

But the only evidence the Portuguese police could amass against the McCanns was the reaction of sniffer dogs sent into the couple's holiday apartment in Praia da Luz, which smelled 'the scent of death'.

The performance of the dogs has been called into question after they also reacted to remains at Haut de la Garenne orphanage in Jersey, which were later found to be animal bones. Mr and Mrs McCann, both doctors, were finally cleared when the police investigation was officially shelved because of a lack of evidence.

Mr Amaral, 49, was sacked from the investigation after launching an outspoken attack against British police.

Speaking after the hearing, McCann family spokesman Claudia Nogueira said the couple, of Rothley, Leicestershire, had been 'hurt' by the day's allegations.

She said: 'However, they know what really happened, so they're confident. They just want to find their daughter.'

The case continues.

Un nouvel épisode dans l’affaire de la jeune Britannique disparue en 2007 au Portugal s’est ouvert hier. Ses parents, Kate et Gerry MacCann, sont de retour à
Lisbonne pour un procès qui les oppose à l’ex-inspecteur-chef Gonçalo Amaral, auteur d’un livre qui les accuse.

Selon la thèse de l’homme qui a dirigé l’enquête pendant plusieurs mois, avant d’en être écarté pour avoir publiquement critiqué l’attitude de Scotland Yard, la fillette serait morte accidentellement dans l’appartement où la famille passait ses vacances. Ses parents, paniqués, auraient dissimulé son corps. Ils auraient ensuite fait croire à un kidnapping. C’est dans un livre publié en juillet 2008 que l’ex-policier a choisi de raconter sa version des faits. Maddie, l’enquête interdite, devenu un best-seller au Portugal, a été retiré des ventes en septembre dernier sur décision judiciaire.

Les époux McCann, qui se battent toujours pour tenter de retrouver leur fille, demandent aujourd’hui au tribunal de confirmer le référé interdisant ce livre. Ils réclament également 1,8 million de francs de dommages et intérêts à Gonçalo Amaral pour diffamation.

Intime conviction

Mai 2007, Madeleine McCann s’apprête à fêter ses 4 ans. Maddie, comme la surnomment ses parents, passe ses vacances avec sa famille à Praia da Luz, une station balnéaire du sud du Portugal. Le 3, vers midi, Kate et Gerry MacCann décident d’aller déjeuner, laissant la petite et ses deux frères jumeaux âgés de 2 ans dans la chambre. A leur retour, Maddie a disparu.

Gonçalo Amaral, alors responsable de l’enquête, relève une attitude étrange de la part des parents, un détachement inhabituel. Il accumule les indices, comme les traces de sang retrouvées dans l’appartement des McCann et dans leur voiture de location. Il se forge très vite une intime conviction.

En septembre de la même année, les époux McCann sont mis en examen, soupçonnés d’avoir accidentellement tué la fillette et d’avoir dissimulé son cadavre. Faute de preuves, le couple est blanchi. La justice portugaise classe l’affaire Madeleine McCann en juillet 2008.

Mis en examen

Depuis, le couple finance lui-même les recherches. Deux détectives ont même été engagés grâce à l’argent récolté sur Internet. Selon France Info, l’avocate portugaise des McCann, Isabel Duarte, craint que les allégations de Gonçalo Amaral n’affaiblissent la mobilisation de l’opinion publique pour retrouver Maddie. C’est essentiellement pour cette raison que les McCann auraient décidé de poursuivre le policier en diffamation. Le procès devrait se terminer demain. La fillette reste introuvable; le verdict est attendu en fin de semaine prochaine.
