Description and result of activity
In the follow-up of the investigation on this date at about 17.00, the presence of a white coloured vehicle was noted, a Ford Escort van with the number plate S677 YWP, in a car park near Av Gentil Martins, quite close to the OC Garden, where the disappearance of Madeleine McCann took place on 3rd May.
At that time, it was noted that the image of what had occurred in previous days, was that an individual had been seen inside the vehicle, in the driver’s seat, in such circumstances that would indicate that the individual was carrying out a kind of vigilance of the apartment where the McCann family was staying when the girl disappeared.
As a result, in response to the fact reported in one of the witness statements – by Derek Flack, who reported the presence of an individual at the site where the abovementioned vehicle was parked, on a date immediately before or coinciding with the occurrence currently being investigated, as well as the fact that the British authorities reported the presence of an individual of British origin, who was the owner of a vehicle with these characteristics – indicating that this should be investigated by the responsible authorities with the aim of finding out whether this was an act of vigilance by the individual in question.
In the follow-up to this event, the present inquiry began at 17.10 at a site in the immediate surroundings of Praia da Luz, called Cama da Vaca.
Within the sphere of establishing an act of vigilance by the individual, inquiries were made at the site in order to proceed to his identification, for which a residence was visited at the location mentioned in the previous paragraph, called Casa Prado da Primavera – Lot 3 – Cama da Vaca – Vilada Luz.
At that time, it was established that the individual in question was Barrington Godfrey Norton, identified by residence card nº******.
As a consequence, when asked to clarify the places where he had been present, he made himself available in a voluntary manner to accompany the police officers identified above to the PJ office in Portimao for formal questioning.

Description and result of activity
On this date at 23.50 we went to the Pacífico Bar, located in the Vilamoura Marina in the Marina Lusa complex.
There we personally contacted the owner of the bar, Aurélio Mendes Guerreiro, in order to find out in what circumstances two phone calls were made from the fixed telephone at the bar nº 289301562 to the mobile nº 447903108397 belonging to Kate Healy on 4th May 2007 at 00.47 and at 01.02.
Aurélio Guerreiro explained that both phone calls were made by him as he had been asked by an English lady who at the time of the events was in England, called Pat Perkins, who had been a client of his some years ago and used to spend her holidays in Vilamoura, asking him to help a British couple who were on holiday in P da L and whose daughter had gone missing.
According to what he said, Pat Perkins lives in Liverpool and is a friend of Kate Healy’s mother and was in Kate’s mother’s house when she phoned him to ask for help for the McCann couple. As it was not possible for him to go to P da L personally, he contacted the mobile number Pat Perkins had given him, saying it was the couple’s number and spoke in English with a man, whose identity he does not know and whom he told of his willingness to help in anything that was necessary in relation to the disappearance of the little girl, whom he later knew to be Madeleine McCann.
He added that a few days later, on 7th May, the same Pat Perkins sent him an email containing a request for help to find Madeleine and containing an annex with a photo of Madeleine for public distribution.
Joined in annex are photos of the bar and a copy of the email.

At the site it was observed that the building in question was an agency of the Remax – Imobilaria company and contact was made with an employee L*** M***** S*****.
According to LS, the suspect Richard (sic) Murat has worked in the agency for a period of almost one year, carrying out the functions of estate agent, having terminated his contract in the middle of January of the current year.

Examination of the photographs to determine the following:
1. Age of the photos, from the age of the paper and/or the ink used
2. In what kind of machine is the paper of the photos used (machine for rolled or cut paper).
3. How are the photographs cut, by guillotine or other.
4. If the sizes (of the photos) are standard.
5. If the developing or printing of the photos was done in Portugal or in another country.
Observations and tests carried out.
The examination was carried out in accordance with the current procedures of the Documents Area of this laboratory.
Observation of the document(s) using adequate technical means (stereoscopic magnifying glass, spectral video comparing equipment with different kinds of illumination and different wave compression) to search for the printing methods, analysis of the cut margins and other eventual details.
It was confirmed that these were reproductions produced on Kodak Xtra Life photographic paper, printed by pigment sublimation. It was also noted that the sets of the Kodak Xtra Life markings on the back of the photos are presented at the edges of the photos (see image on page 3). The size of the photos is 10,2 x 15,2 cm (4 by 6 inches) which is one of the standard sizes in photographic reproduction and the cut margins are continuous (see image on page 3).
Given the specific nature of the requirements and the type of document in question (photos printed by pigment sublimation on special Kodak paper) and the non- existence of analytical methods that enable the dating of this kind of document by means of the analysis of “inks” we also consulted that company’s representative in Portugal.
In this way, it was possible to ascertain that the type of paper that the photographs were reproduced on has been commercially available for almost two years, having replaced Kodak Picture Maker paper, both for use in photographic development booths as for domestic printers.
The machines installed in photographic development booths use rolled paper which is cut by the machine’s own guillotine, for the reproduction of photos. On the other hand, domestic photo printers use sheets of paper, which have margins that are cut by perforation in the case of most models of printers. Lastly, the positioning of the markings on the back of the photos, could indicate that these were printed on a series 47xx machine (in a booth) or using a G600 Dock printer (domestic use).
However, we were told by Kodak that any analysis for the concrete determination of the type of machine used in the printing of the photos, could only be done at their factory in Rochester, US.
Conclusions
Based upon the observations made it is only possible to include the following:
1. The paper used to print the photos in question has been commercially available for almost two years.
1.1. The format of the photos is of 10,2 x 15,2 cm (4 by 6 inches) which is a standard size for photographic reproductions.
1.2. With regard to the cut margins of the photos and the position of the markings on the back, it could be said that they were produced using a 47xx series machine (in a booth) or using a domestic type G200 Dock printer. However, only an analysis by Kodak, in the US, could eventually determine concretely the type of machine used to obtain these reproductions.

- No sentido de se determinar com precisão o percurso de um casal de indivíduos naturais da Polónia, e que estiveram a passar férias no Burgau, efectuamos várias diligências nomeadamente junto dos estabelecimento de restauração da Vila, nos supermercados, na Garrafeira Ribeiro, no Brizze Cafetaria, onde foi exibimos o fotograma recolhido junto da Loja FNAC do Centro Comercio Chiado, onde constam os dois indivíduos acima referenciados (a esquerda na foto), não sendo os mesmos reconhecidos em nenhum destes locais.
- Tentou-se efectuar diligências junto ao restaurante Refúgio, que não foi possível realizar por o mesmo estar encerrado para descanso.
- Contactado, o proprietário do Beach Bar, que já nos havia referido ter tido como clientes um casal de cidadãos polacos, conforme informação dos presentes signatários datada do dia 05/05/2007, o mesmo após vizualizar o fotograma acima mencionado, reconheceu imediatamente a senhora e o indivíduo com o cabelo mais comprido como tendo sido os
clientes a que se referira no dia anterior.
- Igualmente contactamos o proprietário da Papelaria Fernandes, Gilberto Fernandes, onde se pretendeu despistar a eventualidade do caso polaco tal adquirido várias letras com a palavra "casa", e outras letras sendo a ultima um "z", bem como fita cola para fixar essas letras, sendo que ao lhe ser exibido o fotograma em questão, imediatamente identificou a senhora e o indivíduo com o cabelo mais cumprido como sendo o casal polaco, afirmando de de forma peremptória não ter sido este casal que lhe adquiriu as tais letras.
- Perguntado como travou conhecimento com este casal esclareceu que no dia 1 de Maio estes estiveram nos seus estabelecimentos comerciais, a papelaria e lojas de artesanato, onde perguntaram o preço de várias peças acabando por nada adquirir.
- Ficou a saber que eram Polacos devido a conversa sobre o futebol nomeadamente em relação ao Liverpol e ao Chelsea, devido ao guarda-redes Dudec, que é polaco.
- Referiu que o casal estava vestido da mesma forma que é retratado no fotograma.
- In order to determine the exact trail of a couple from Poland, and who were on holiday in Burgau, we performed various tasks in particular with the catering establishment in the town, in the supermarkets, in the Garrafeira Ribeiro, in the Brizze Cafetaria, where we showed the photo from the Loja FNAC of the Chiado shopping mall, where [in which] the two above mentioned individuals are known to be (on the left of the picture), neither of them being recognised in any of those locations.
- The same was attempted at the Refúgio restaurant but it was closed for its official day of rest.
- Contacted, the owner of the Beach Bar, who had already referred to serving a Polish couple, as per the Information report from the undersigned officers dated 05.05.2007, after being shown the above photo immediately recognised the lady and the individual with longer hair as having been the customers to whom he had referred the day before.
- We also contacted the owner of the Papelaria Fernandes, Gilberto Ferandes, where if it was intended to throw off the trail the possibility of the Polish couple having obtained various letters with the word "casa" [home; house], and other letters ending in a "z", as well as sticky tape to affix [fix; fasten; secure; seal] those letters, it being that when he was shown the above picture he immediately identified the lady and the individual with the longer hair as being the Polish couple, affirming peremptorily that it had not been this couple who had obtained such letters from him.
- Asked how he met the couple he clarified that on 1 May they were in his shops, the paper shop and the gift shop, where they asked the price of various things [but] leaving without buying anything.
- He knew they were Polish due to talking about football, in particular Liverpool and Chelsea about the defender Dudec, who is Polish.
- He pointed out that the couple were dressed in the same way as they are portrayed in the photo.

- Igualmente contactamos o proprietário da Papelaria Fernandes, Gilberto Fernandes, onde se pretendeu despistar a eventualidade do caso polaco tal adquirido várias letras com a palavra "casa", e outras letras sendo a ultima um "z", bem como fita cola para fixar essas letras, sendo que ao lhe ser exibido o fotograma em questão, imediatamente identificou a senhora e o indivíduo com o cabelo mais cumprido como sendo o casal polaco, afirmando de de forma peremptória não ter sido este casal que lhe adquiriu as tais letras.
- Perguntado como travou conhecimento com este casal esclareceu que no dia 1 de Maio estes estiveram nos seus estabelecimentos comerciais, a papelaria e lojas de artesanato, onde perguntaram o preço de várias peças acabando por nada adquirir.
- Ficou a saber que eram Polacos devido a conversa sobre o futebol nomeadamente em relação ao Liverpol e ao Chelsea, devido ao guarda-redes Dudec, que é polaco.
- Referiu que o casal estava vestido da mesma forma que é retratado no fotograma.
- In order to determine the exact trail of a couple from Poland, and who were on holiday in Burgau, we performed various tasks in particular with the catering establishment in the town, in the supermarkets, in the Garrafeira Ribeiro, in the Brizze Cafetaria, where we showed the photo from the Loja FNAC of the Chiado shopping mall, where [in which] the two above mentioned individuals are known to be (on the left of the picture), neither of them being recognised in any of those locations.
- The same was attempted at the Refúgio restaurant but it was closed for its official day of rest.
- Contacted, the owner of the Beach Bar, who had already referred to serving a Polish couple, as per the Information report from the undersigned officers dated 05.05.2007, after being shown the above photo immediately recognised the lady and the individual with longer hair as having been the customers to whom he had referred the day before.
- We also contacted the owner of the Papelaria Fernandes, Gilberto Ferandes, where if it was intended to throw off the trail the possibility of the Polish couple having obtained various letters with the word "casa" [home; house], and other letters ending in a "z", as well as sticky tape to affix [fix; fasten; secure; seal] those letters, it being that when he was shown the above picture he immediately identified the lady and the individual with the longer hair as being the Polish couple, affirming peremptorily that it had not been this couple who had obtained such letters from him.
- Asked how he met the couple he clarified that on 1 May they were in his shops, the paper shop and the gift shop, where they asked the price of various things [but] leaving without buying anything.
- He knew they were Polish due to talking about football, in particular Liverpool and Chelsea about the defender Dudec, who is Polish.
- He pointed out that the couple were dressed in the same way as they are portrayed in the photo.

The inquiry was terminated, stating that this was absolutely not Madeleine McCann.
Afterwards and taking into account document 93/05 JAPM relating to child abuse, Mr C***** C***** R***** and English man was investigated, who had fled from justice to an unknown destination and that his mother and stepfather own a bar called the Plow (sic) and Arrow on the main road of Luz, some 150 metres from the site of the events and it was thought important to establish whether this individual had been present in the region on the date of the events.
The Man’s stepfather said that his wife was in England and that her son C***** R**** R**** since the facts that had led to him being included in the document had not returned to Portugal and stated that he was working in Iraq as a photographer.

On this date at about 14.30 we went to P da L where we personally contacted Engineer Pereira, already interviewed on page 1652, with the aim of being shown as exactly as possible the sites, where on 3rd May there were open trenches for the water, electricity and telephone networks, which were left open without any kind of supervision during the night of 3rd May.
Together with the works foreman, Sr Afonso, we were shown that on that specific date, two trenches were open, one located at Rua Helena do Nascimiento Batista (Photos 1 and 2 shown on the annexed map as Area 1) and another situated in Rua Direita (Photos 3 and 4, shown on the map as Area 2).
Using two pieces of red plastic tubing, the exact site of the areas where the open trenches were situated was indicated (see photos in annex).
Both men told us that the trenches were 1.20 m deep and 0.9m long and various plastic tubes of different sizes were placed within them for the water, electricity and telephone networks.
With relation to the type of soil that was on the trenches in question, we were told that was a rocky soil and that only using machinery would it be possible to carry out any kind of excavation.
But it was stated that after the opening of each trench a “regularisation” process is used at the base of the trench, clearing all the earth and rocks resulting from the digging and immediately the base of the trench is covered with pieces of rock or sand that act as support for the placing of the water pipes and the tubes inside which the electricity and phone cables pass.
We were told that on the morning of 4th May, when work resumed on the trenches, all the workers who were employed in opening the trenches, including the Engineer and the Foreman, already knew about the disappearance of an English girl from P da L, which is the reason that they carefully checked all the trenches that had been left open on the preceding night, in the eventuality that the girl could have fallen in by accident, however nothing was found.
They say that given the normal procedures followed in these kinds of works, it would be extremely difficult to bury or hide a human body, not only under the trenches in question without the grave being immediately detected by the workmen.

We went to the area where we attempted to locate the Millenium Restaurant, to verify it, that the same belonged to the tourist resort Ocean Club of Praia da Luz. In that place, we verified that to access it it is necessary to pass through the reception where they demanded our identification. The head of the restaurant, Luis Barros, contactable on mobile xxx, clarified that the group of whom the missing child and her parents were part, comprising eight adults and nine children, ate in that restaurant on the day they arrived, namely 28.04.2007, because the other restaurants of the resort were closed. They all ate as a group, parents and children. He referred also that that group came with a half-board scheme, i.e. the right to breakfast and to dinner. In relation to dinner they only ate there on that day, although they took breakfast every day in that place accompanied by the children. He pointed out that, while the space is open to the general public for dinner, it is used almost exclusively by clients of the "resort". Having been shown the photo of the Polish couple, he did not recognise them. We also contacted the receptionist, Monica Marques, mobile number xxx, who told us that besides herself her colleague Elisa, mobile number xxx, and intermittently Luisa Coutinho, mobile number xxx, worked there. Having been shown the photograph of the Polish individuals, Monica Marques said that she had never seen those people.

On this date we went to the Cepsa service station on the A22 in Lagoa with the purpose of gathering information related to the presence, at about 02.30 on the 04-05-2007 of an individual of Spanish nationality, or at least who expressed himself in Spanish, who had asked an employee about the way to Luz.
The employee in question was not present as he had worked the night shift but had referred to the fact that on the night of 3rd – 4th May at about 02.10 or 02.15 a Spanish speaking individual had asked about the way to Luz.
This individual was heading north (in the direction of Faro/Portimao) and the employee did not see the vehicle that the individual got out of. But he adds that the individual was male, aged about 35, 1.70m in height with short dark hair and wearing a blue shirt.
The service station has a camera vigilance system with digital support (CD ROM) and the system has an hours’s difference.
The employee said that the individual arrived when he was talking on the telephone.
In accordance with the information given by the employee, the images from the video tape correspond to 05-05-2007 at 03.00 (corresponding to 03-05-2007 at 02.00) and at 03.08 the employee is visible making a phone call.
The video did not show any individual, just a white merchandise vehicle with Portuguese number plates.
It was added that this was seen between 02.00 and 02.35 (03.00 – 03.35 on the recording).
It was stated that the external camera enables the visualisation of persons and vehicles in deficient quality given the conditions of where the camera is placed.
The owner of the service station was asked to keep the recordings relating to that period.
Nothing else was found of interest to the inquiry.

Inside the vehicle, he could only make out the presence of one person, as well as a dog in the front passenger's seat.

At the moment that said vehicle passed him, he observed that the driver was looking towards the back seat . Mr R***** affirms that he did not have, at that time, the opportunity to determine what was in the back of the car.

When questioned, he further noted that he recognised the identity of the driver, indicating that it was a female, of Brazilian nationality, 1,70 cm in height, 25/26 years of age, slim with lightly coloured skin. Due to minor arguments caused by the misuse of tools, involving mainly the woman’s companion identified as E***** S*****, the latter, also of Brazilian nationality, and Mr. R*****, effectively came to blows, and the services of the couple were concluded.

In effect, if the action had been planned, the author should have - bearing in mind the physical space - chosen the contrary direction as his escape route, where there was a parking area at a distance of 20 metres, which would have been a discreet way to enable him to leave the scene unnoticed.
Given this reasoning, it was judged appropriate to visit the scene, in order to see the geographical viability of the correct perception of the events, or at least the closest possible approximation regarding their truth.
It was immediately possible to note that the Casa Liliana house, situated in Rua da Ramalhete, P da L, Lagos, owned by Robert Murat, could also de designated as Casa Liliana, situated on Rua Agostinho Silva, or in other words, situated in the same road as Block 5, precisely in the direction taken by the suspicious individual, described in Jane Tanner’s witness account.

We asked them to show us all the printers and photocopiers existing at the OC, which were operational at the time of the disappearance of Madeleine McCann and that were used to print colour copies of Madeleine’s photo.
Silvia Baptista informed us that at the request of John Hill and his wife D****, hundreds of colour copies of a photo of Madeleine McCann were printed on 4th May 2007 with the aim of distributing them in Pda L and Lagos. For this purpose a colour photocopier, Toshiba, in the main OC reception was used as well as an HP laser printer, HP Color Laserjet 2840 located at a desk at the Ocean Country company, a colour laser printer Epsom Aculaser C1100 located on the desk of the administrative secretary and a colour laser printer HP Color Laserjet 1600 located on John Hill’s desk.
On his part, John Hill informed us that the printing of large quantities of Madeleine’s photo was carried out by himself with the help of his wife, at the request of Russell O’Brien, a member of the McCann’s group of friends, John Hill stated that the photograph the colour prints were made from a mobile data disk of the “memory stick” kind that Russell O’Brien gave him on the morning of 4th May.
They both stipulated that these were the only colour printers and photocopiers in existence at the Ocean Club and that there was no other place with the capacity for colour printing.

In the context of following up this lead [PAGES 145-147], under the guise of this investigation, at 3pm, we made contact with various people living in the area surrounding the place where this lead starts, to check if the witness is mistaken or if the details come to agree with what he says in the context of Madeleine McCann's disappearance.
The object of this further action is the possible collection of new details which could help to clarify evidence gathered from the witness statement of a British citizen on holiday about 300 metres from the place from which the small child disappeared (more specifically Rua da Ramalhete, Lote 1, Apartment 7, Praia da Luz), who identified himself as Derek F., from Ilford, Essex, UK, [DOB and passport details given].
That individual reported a suspicious movement close to that area by an unknown male which, he is convinced, could be related to the matter at hand because it occurred so close to the location of that event and at a time very shortly before it.
In order to clarify this situation an interview has been booked for 6 May at 10h30 at the Policia Judiciaria station in Portimao.

At the headquarters of the self-drive vehicle rental company, "Luzcar rent-a-car," we asked them to provide us with all the information concerning the vehicle bearing the registration number...AV - 67 for the period from 28/04/07 to the time of the present investigation. It was possible to determine that the vehicle was rented on April 28th at Faro airport by a Polish citizen, named W.K., staying at Solimar in Burgau where he reserved the accommodation via the internet. We now attach a copy of the reservation email. The Polish citizen paid for the reservation with credit card no. 5185... . .... .... ... valid until May 2008.
The contract was drawn up by Nelson M., an employee of the agency. A photocopy of the hire agreement is attached. The vehicle was returned to the hire company on May 5th 2007 at Faro airport and has already been washed and hired out again according to information given to us by Luis F., an agency employee. Currently, the vehicle is on hire to Clere E. at Parc da Floresta no...in Budens, Vila do Bispo.
We have carried out investigations to find out where W.K. was staying. He was staying in apartment no.... Solimar building, Ficticia in Budens. That apartment is managed by the company ATB, situated on the Main Street, Marretas building, Burgau, Vila do Bispo, whose director, the person named Nuno F., we have contacted.
That apartment belongs to Peter and Margaret O., who live in Windsor Grove, Cardiff, Wales. Photocopies of documents showing complete identification for Peter and Margaret O. are attached as well as a copy of the rental documents. It is to be noted that after W.K.'s departure, the apartment has had no other lettings and has not been cleaned, and we have requested that it remain that way. A key to the apartment has been given to us to carry out any further investigations deemed necessary.

This apartment belongs to P. and M. Ow., residents of Cardiff. The apartment was rented via the Internet.---------------------------------------------------
Attached is a copy consisting of identification details of the owners.---------------------------------
Also attached is a photocopy of two (2) documents related to Krokowski’s rental.----------------
We were informed that since Krokowski’s departure, no other occupants have stayed in the apartment and that the apartment has yet to be cleaned. A request that the apartment remains as is and not be cleaned or accessed by any person was made by this police force.---------------------
N*** F***** has given us the key to the above referenced Solimar apartment so that any and all necessary inquiries may be carried out.-------------------------
