Give us a clue, JFAK!

If it's supposed to be a key date in the forthcoming Case, I shouldn't hold your breath - these things are subject to further delays and postponements: Believe it when you see it

Court Acquits Accused Parties of Defaming Gonçalo Amaral

This Tuesday, Faro Court acquitted Aragão Correia, Leonor Cipriano’s lawyer – mother of the girl who disappeared from the Algarve in 2004 -, as well as professor António Pedro Dores, of having defamed, the ex PJ inspector Gonçalo Amaral.

Aragão Correia and the president of the Association Agaist Exclusion for Development (ACED), António Pedro Dores, were accused of having defamed the ex – inspector, who almost eight years ago investigated the disappearance of Joana, Leonor Cipriano’s daughter.

In the summing up, the judge stated that the necessary conditions had not been met in order to even consider the legal possibility of sentencing António Pedro Dores, president of ACED, who published the “Report On the Torture of Leonor Cipriano Perpetrated by the Policía Judiciaria”, the subject of the law suit brought by Gonçalo Amaral.

As regards Marcos Aragão Correia, the acquittal confirmed his compliance with the civil duty of denouncing acts of torture, an obligation of every citizen, and, on the other hand gave as proven that Leonor Cipriano’s lawyer was convinced that Gonçalo Amaral was even a participant in the acts of torture against Joana’s mother.

Upon learning of the acts committed against Leonor Cipriano – whose existence, already the subject of an independent judgement, was not questioned by the court – by means of a conservation with his client, Aragão Correia was convinced of the truthfulness of the version he heard, which, in the Court’s understanding, annulled the seriousness of its publication.

However, based upon the witness statements heard – including that of Leonor Cipriano -, the Court did not admit as proven that Gonçalo Amaral had been present at the acts of torture nor that he had coordinated the team which afflicted them.

Nevertheless, the judgement alleged that Aragão Correia knew that publicly attributing those acts to someone could constitute material “that was damaging to his honour and dignity”, however he did this in the conviction that Leonor had told him the truth.

In 2009, Gonçalo Amaral was sentenced to a one and a half year suspended sentence for making a false statement in the trial of the ex – PJ inspectors and officers, accused of torturing Joana’s mother.

The ex – inspector considers that the ACED report was “damaging to his honour and personal and professional considerations”, which is why he decided to bring a complaint for defamation against Aragão Correia and the president of the association.

The Public Ministry requested the acquittal of both men, alleging that this was not a case of defamation, as all evidence pointed to the existence of torture, in spite of the fact that it has never been proven exactly who was responsible.

Heard as a witness during the final sessions of the trial, Leonor described that the inspectors placed a bag over her head, beat her all over her body and hit her with a phone book and a hard cardboard object.

Allegedly, the acts of aggression took place after she had been forced to kneel on two glass ashtrays, which according to her, had been supplied by Gonçalo Amaral himself.

Leonor and the missing girl’s uncle, João Cipriano, were sentenced in November 2004 to 20 years and four months and to 19 years and two months imprisonment respectively, for the crimes of qualified homicide and hiding of a body.

Following an appeal, Leonor Cipriano’s sentence was reduced to 16 years and eight months.

Aragão Correia and president of the Association Against Exclusion for Development (ACED), Antonio Pedro Dores, were accused of defaming the former inspector, who investigated for nearly eight years the disappearance of Jane, daughter of Leonor Cipriano.

In its judgment, the judge said the conditions were not met to consider even the possibility of legal order António Pedro Dores, president of ACED, who spread the "Report on Torture Leonor Cipriano perpetrated by the Judicial Police," the object of the process raised by Gonçalo Amaral.

As for Marcos Aragão Correia, cemented his acquittal in the fulfillment of civic duty to denounce acts of torture that is required every citizen and, on the other hand, has proven that as the lawyer for Leonor Cipriano was convinced that Gonçalo Amaral was the same co-author of the acts of torture against the mother of Joan.

By having knowledge of the acts committed against Leonor Cipriano - whose existence, as an autonomous object of judgment, the court did not question - through a conversation with your client, Aragão Correia became convinced of the veracity of the version heard, which, in the opinion of the court annulled the severity of their publication.

However, based on the testimony he heard - including that of Leonor Cipriano - the court failed to establish that Gonçalo Amaral has witnessed acts of torture or even coordinate the team that practiced.

This last paragraph is worth noting.

Does this mean that it is good and bad news for Dr Amaral? Good news, because the court failed to establish that Dr Amaral witnessed torture, or coordinated a team that practiced torture. Bad news, because has lost the court case and he will have to pay all of the costs.

The decision in this case also shows how difficult it is to get a guilty decision for defamation.

Hi AnnaEsse

Regarding the good news, I am very pleased, I'm just sad that he failed to win the defamation part of the court case and in my opinion, the gruesome twosome and their followers, will use the failed defamation part of the case, as a stick to beat him with.

By the way I've rephrased part of a sentence, in the above post, that will show in another post. I did it because I misquoted, part of the link regarding the torture.

The McCanns will not be pleased, then. Their €1.2m is slipping away. They would be well advised to drop it now, before they have to pay any more court costs.

This I believe is overall a very good outcome
for GA. He has been cleared of any knowledge
or involvement in the torture of a suspect.
Furthermore, Correra, as a lawyer was justified
in highlighting the torture claims of his client
even though they were dismissed by the court.
Indirectly, as I read it, the ruling upholds the
rights of Correra to express his professional
views based on evidence supplied by his client.
This same right has been denied to GA to freely
express his professional views.
If I have read into this incorrectly I do apologise.

From Marcos
we were declared NON-GUILTY of all charges;
the torture of Leonor Cipriano perpetrated by the portuguese police is once again confirmed;
the serious and active involvement of Goncalo de Sousa Amaral in that torture is once again confirmed;
Goncalo de Sousa Amaral was condemn to pay all the court expenses;
since the Public Prosecutor also asked for the non-guilty verdict, no more appeals are possible.

Please divulge!

That is how I read it and as such it augurs well for a good decision for Dr Amaral in the case that the McCanns are bringing. If Correra has the right 'to express his professional
views based on evidence supplied by his client' then Amaral surely has the right to express his professional opinion based on the joint investigation carried out by Portuguese and British police.

Hi Iris

I hope the McCanns do drop their libel case. I know the McCanns wanted a huge amount of money, if they were successful in their libel case. However, I also read that the McCanns wanted part of Goncalo Amaral's pension and the house his former wife and children now live in. If this is true, the Missing People's charity should be informed.

I don't know how Kate McCann, can stand in front of a poster which shows a missing child or vulnerable person, when along with her husband, she is hoping to sling Dr Amaral's children, along with their mother, out of their home. Also every euro, that the McCanns want to take from Dr Amaral, is a euro that could be put towards feeding and clothing his children.
