SY believes the three planned the burglary and when faced with the little girl killed her and took her body.
Says who? I believe I may be right in saying that I have never heard SY state this: I think they are on record as considering it, along with other theories, but considering and believing are two different things. Of course they have to investigate everything they have intelligence for.
Malinka should have been investigated. I consider he's a bit dodgy, didn't he own lots of vehicles and a boat as well? And a criminal record. I'm sure someone here can confirm or otherwise if I am correct.
But what is also dodgy are his cars being set on fire. Not the first time I think. But he himself links it to the Madeleine case, someone trying to tarnish him over it.
I am not so sure, but am glad SY have investigated him, if only to rule him out.

He has worked as a driver at the OC since the 26th March of this year. His functions consist of driving the tourists from the reception to the apartments where they are staying. His working hours are from 11.00 to 16.00, except for Thursdays and Saturdays which are the days guests arrive and leave and when he starts and finishes work much earlier and later. He knows the resort well as he circulates throughout the whole resort.
When asked whether he knows about the disappearance he says that he heard about it on the day of the disappearance at about 23.00 because he was on his balcony and two men passed by and asked him whether he had seen a small girl who had gone missing from a restaurant. On the following day when he arrived at work he was told all the details. When asked, he replies that he does not think he saw or spoke to the girl or her family before the disappearance. He only knew who they were from the news.
Nobody made any comments to him about the guests or about children in the preceding days.
He did not see anyone suspicious or any unusual vehicles.
No more is said.

Sorry, didn't make myself clear. I know the PJ investigated him previously and ruled him out, but I am trying to say I am glad that SY have also investigated him. I realise he's been ruled out (and it seems by SY as well) but I was trying to say I felt it was the right decision for SY to look at him again and am glad they did. I was giving reasons for why I am glad SY have looked at him again. If he's well and truly ruled out, that's fine. However, I do still wonder about his burned out car and whether it was ever kept securely for further scrutiny. Not saying he's involved but if he owns lots of cars can he account for them all around the time?

that wasn't what I was thinking LJC I was thinking it was set to divert attention from other people. Bearing in mind that recently SY had apparently asked the PJ to get DNA by any means, which the PJ refused as being illegal, I wonder what if anything illegal was done to divert attention from the McCs years ago. of course there may be nothing .

Let's just say the McCann's have been questioned again by Scotland Yard, and investigated, maybe as part of this ongoing investigation would we know about it? Or would be done on the quiet?

I've just emailed Operation Grange, registering my disgust at their failure to investigate the McCanns.
At the end of my email, I stated out that I didn't expect a reply from them because I had previously emailed them and I had never had an acknowledgement from them, let alone a reply.
I've had some success, I've had an acknowledgement to my email. I'm not expecting a reply from one of the Operation Grange team, but I could receive a visit from one of our nice friendly local police officers, warning me to keep my opinions to myself.
At the end of my email, I stated out that I didn't expect a reply from them because I had previously emailed them and I had never had an acknowledgement from them, let alone a reply.

Below is what I've written in my email to Operation Grange, which by the way is not as long winded as my previous email. In my previous email, I included links.
To the Operation Grange team
As a British taxpayer, I feel free to tell you that I am absolutely disgusted with your style of investigation.
You know who should be brought to justice, because you have all the evidence in front of you, which is written in the PJ Files. If the penny hasn't yet dropped, I'll tell you who should be brought to justice, it is the McCanns.
The McCanns never searched for Madeleine, they never contacted or ensured that the G.N.R. were contacted, immediately Kate McCann raised the alarm that Madeleine had been 'abducted.' They contacted the British Government and anyone else they could think of, who would save their skins, whilst not caring about the skin of their daughter.
The McCanns lied to the G.N.R. and when the PJ began to investigate the case, the McCanns hindered them at every opportunity. Kate McCann refused to answer questions put to her about Madeleine's disappearance. When she was told that by refusing to answer, she was hindering the investigation, she flippantly answered, 'if that's what you think.'
You dissed your own dog handler, when you refuted the evidence that his little 'sniffer' dogs Eddie and Keela found in the McCanns apartment, which included cadaver scent, found on the clothing of Kate McCann and Madeleine.
You have more evidence that the McCanns should be the ones who are not just persons of interest, but suspects. Yet you've trotted over to PDL, armed with the names of people who you believe, could have played a part in Madeleine's disappearance.
I would like to know why the McCanns are so special, that they can commit an act that resulted in Madeleine's disappearance and are not being prosecuted for their act, which was at the best neglect and at the worse cruel. It's plainly obvious that you're looking for a 'patsy' or 'patsies' to take the rap, for something the McCanns should be taking the rap for.
If you succeed in your quest, I hope you never sleep easy in your beds again. You will have denied Madeleine the justice she deserves and when her siblings are older, they will not only suffer when they learn that their parents were responsible for whatever happened to Madeleine, they will suffer when they learn that a British police force, found someone other than their parents, to take the rap for Madeleine's disappearance.
I don't expect a reply to my email, you never replied to my last email. You didn't even have the courtesy to send me an acknowledgement. In fact I think you'll probably file my email, in the box labelled 'nutters'. Gerry McCann labelled those who dared speak out against them as 'nutters' and sad individuals.

I know I've made many grammatical mistakes in my email, which I wrote from my heart. However everything I have written in my email is the truth. I'll also stick my neck out and say that whoever reads my email, will agree with everything I have written, if he or she has any regard for the health and safety of children and is a copper who wants to uphold the letter of the law. Which is something sadly lacking in Scotland Yard.

At the request of Scotland Yard, and with the endorsement of the Portuguese Public Ministry, the suspects were formally constituted arguidos, yesterday, by the PJ inspectors of the Southern Directorate in Faro.
At least two arguidos didn't take lawyers with them, lawyers who were meanwhile appointed so the questionings could take place. Waiting for them was a list of over 250 questions. Most have agreed to answer them. The questions were made by the Judiciary Police officers in the presence of British detectives who could not intervene.
JN knows that the questionings were concluded in the early evening and that the arguidos aren't expected to return to the PJ Directorate. The last to come out, about 8:30pm, was Sergey Malinka, a Russian with Portuguese citizenship who had already been investigated in 2007 during the Portuguese investigation. At the time his computers were seized and his house was target of searches, however nothing relevant was found. He was a friend of Robert Murat, a former arguido in the Portuguese case.
The other arguidos are José da Silva, a former Ocean Club driver, Paulo Jorge Ribeiro, unemployed who suffers from schizophrenia, and Ricardo Jorge, who was at the time 16 years old. They are all residents in Praia da Luz, some live close by one of the sites where searches took place last month. It is Scotland Yard's belief that they planned a robbery to the apartment where the McCanns where staying for their holidays. That Madeleine woke up and was murdered, and her body was carried away, on the arms of one of the men, between those streets packed with tourists.
This is a theory that makes no sense whatsoever to the PJ. From today on, the 11 witnesses will begin to be questioned also at the request of the Scotland Yard.
Sniffer dogs to search cars
The English authorities brought sniffer dogs from the United Kingdom, in the eventuality that they are needed in the sequence of the police interrogations and constitution of arguidos, for example, to search the arguidos cars. The dogs are the same that have recently took part of the searches on the field in the Algarve. During the initial investigation, in 2007, two dogs of the same breed (Eddie and Keela) were used in the recovery of vestiges.
Arguidos - The facts that have lead the English to consider them suspects
Sergey Malinka, businessman, 30 years old
In 2007 he was thought to be a possible suspect and was target of house searches. Now, he is a suspect again because he threw away a sofa that was analysed by forensic experts where similar hairs to others that were found in the McCann's apartment were discovered. There is also a hearsay conversation that allegedly took place near Malinka's house vicinity about a body that needed to disappear. The English valued the fact that the Russian man's car was set on fire at the time and that someone wrote "Fala" [Speak] on the sidewalk.
José Silva, former driver, 38 years old
He used to work in the Ocean Club and is pinpointed by the English as being the person who would select the apartments to be burglarized at the tourist resort and would be the man in charge of monitoring the tourists movements. According to the Scotland Yard, he is compromised by phone calls that he made to other arguidos on the night of the disappearance and in his similitude to one e-fit that was made based on the description of an Irish family that were staying in Praia da Luz for their holidays. He would be, according to them, the famous man [Smithman] that was seen carrying a child on his arms.
Paulo Ribeiro, unemployed, 51 years old
He became a suspect to the English police because foreign tourists described his erratic behaviour and reported his presence near by the McCanns apartment before the disappearance. He suffers from a mental disorder and he was also denounced for his similarities with another e-fit based on other witnesses statements who identified him as being a beggar and also for being connected with another one of the arguidos [Ricardo Rodrigues] with whom he spoke on the phone in the day the crime took place.
Ricardo Rodrigues, unemployed, 23 years old
He was 16 years old at the time of the disappearance and the English connect him to the case because of mobile phone calls he did before and after that fateful event including a phone call to Paulo Ribeiro. Another one of the arguments alleged to incriminate him is the fact that he fits with a description made by witnesses who identified him as one of the two beggars [the other was Paulo Ribeiro] and of being a suspect of robberies in the area of Praia da Luz. He has also against him the fact that he also lives close by the other men that were constituted as arguidos at the request of the English police.

This is a theory that makes no sense whatsoever to the PJ. From today on, the 11 witnesses will begin to be questioned also at the request of the Scotland Yard.
Sniffer dogs to search cars
The English authorities brought sniffer dogs from the United Kingdom, in the eventuality that they are needed in the sequence of the police interrogations and constitution of arguidos, for example, to search the arguidos cars. The dogs are the same that have recently took part of the searches on the field in the Algarve. During the initial investigation, in 2007, two dogs of the same breed (Eddie and Keela) were used in the recovery of vestiges.
Arguidos - The facts that have lead the English to consider them suspects
Sergey Malinka, businessman, 30 years old
In 2007 he was thought to be a possible suspect and was target of house searches. Now, he is a suspect again because he threw away a sofa that was analysed by forensic experts where similar hairs to others that were found in the McCann's apartment were discovered. There is also a hearsay conversation that allegedly took place near Malinka's house vicinity about a body that needed to disappear. The English valued the fact that the Russian man's car was set on fire at the time and that someone wrote "Fala" [Speak] on the sidewalk.
José Silva, former driver, 38 years old
He used to work in the Ocean Club and is pinpointed by the English as being the person who would select the apartments to be burglarized at the tourist resort and would be the man in charge of monitoring the tourists movements. According to the Scotland Yard, he is compromised by phone calls that he made to other arguidos on the night of the disappearance and in his similitude to one e-fit that was made based on the description of an Irish family that were staying in Praia da Luz for their holidays. He would be, according to them, the famous man [Smithman] that was seen carrying a child on his arms.
Paulo Ribeiro, unemployed, 51 years old
He became a suspect to the English police because foreign tourists described his erratic behaviour and reported his presence near by the McCanns apartment before the disappearance. He suffers from a mental disorder and he was also denounced for his similarities with another e-fit based on other witnesses statements who identified him as being a beggar and also for being connected with another one of the arguidos [Ricardo Rodrigues] with whom he spoke on the phone in the day the crime took place.
Ricardo Rodrigues, unemployed, 23 years old
He was 16 years old at the time of the disappearance and the English connect him to the case because of mobile phone calls he did before and after that fateful event including a phone call to Paulo Ribeiro. Another one of the arguments alleged to incriminate him is the fact that he fits with a description made by witnesses who identified him as one of the two beggars [the other was Paulo Ribeiro] and of being a suspect of robberies in the area of Praia da Luz. He has also against him the fact that he also lives close by the other men that were constituted as arguidos at the request of the English police.

First impressions straight off the top of my head:
Four arguidos, four sitting ducks, if you will. One very young, one with mental heath issues.
One blast from the past with connections to Murat and one with an occupational proximity to the crime(s).
And yet seemingly not one chosen to be The Patsy despite aforementioned vulnerabilities and associations.

I'm sure the McCanns know where they were seven years ago too.
