MILAN, Italy (AP) -- The Italian appeals court that overturned Amanda Knox's murder conviction in the slaying of her British roommate gave the reasons for its ruling on Thursday: the evidence that had been used by a lower court against the American and her Italian boyfriend just didn't hold up. Those shortcomings included no murder weapon, faulty DNA, an inaccurate time for the killing, and insufficient proof that Knox and Raffaele Sollecito were even at the location where the crime occurred. So said the Perugia appellate court in its long-awaited reasoning behind its October ruling that reversed the lower court's convictions. British college student Meredith Kercher was found slain in a pool of blood on her bedroom floor in Perugia, Italy, on Nov. 2, 2007. Knox and Sollecito, who had just begun dating at the time of the murder, were arrested several days later, then convicted in what prosecutors' portrayed as a drug-fueled sexual assault. They were sentenced to 26 years and 25 years, respectively, in proceedings that made headlines around the world. On Thursday, the appellate cited among the other failed elements of the prosecutors' case DNA evidence, which was undermined during a re-examination in the appeals trial, and the failure to conclusively identify the murder weapon. The appellate court even contradicted the lower court's time of death, saying it happened at around 10:15 p.m., not after 11 p.m. The court said the "building blocks" used to construct the case had failed. The appeals court also said there was no proof of the prosecutors' claim that Knox and Sollecito had helped a third man, who was convicted separately, of sexually assault Kercher, nor was there evidence that the pair had simulated a burglary by throwing a rock through a window to remove suspicion from themselves, as prosecutors alleged. The appeals court said the lower court had arrived at a verdict "that was not corroborated by any objective element of evidence and in itself was not, in fact probable: the sudden choice of two young people, good and open to other people, to do evil for evil's sake, just like that, without another reason." "It is not, therefore, sufficient that the probability of the prosecutors' hypothesis is greater than the hypothesis of the defense, not even when they are notably greater in number, but it is necessary that every explanation that differs from the prosecutors' hypothesis is, according to the criteria of reasonability, not at all plausible," the court said. The only elements of the prosecutors case that were proven, the appeals court said, were the charge of slander against Knox, who was convicted of falsely accusing a bar owner of killing Kercher, and the fact that the Knox and Sollecito alibis did not match. That the alibis were out of synch "is very different" from the prosecutors' claim of false alibis, the court said. The proven elements combined, the court said, are not enough to support convictions against Knox and Sollecito. "The only elements that are sustained don't allow the belief, even when put together, that the guilt of Amanda Knox and Raffaele Sollecito for the crime of murder ... has been proven," the court said. After her conviction was thrown out, Knox, 24, returned immediately home to Seattle. She was credited with time served for the conviction of slander for accusing bar owner Diya "Patrick" Lumumba of carrying out the killing. Prosecutors contended a kitchen knife found at Sollecito's house was the weapon because it matched wounds on Kercher's body and carried traces of Kercher's DNA on the blade and Knox's on the handle. However, the court-ordered review discredited the DNA evidence, saying there were glaring errors in evidence-collecting and that below-standard testing and possible contamination raised doubts over the DNA traces on the blade and on Kercher's bra clasp. In addition, the defense cast doubt on the knife, questioning why Knox and Sollecito would return it to Sollecito's home if it had been used in the murder. They maintain the real weapon has yet to be found. A third defendant in the case, Rudy Hermann Guede of the Ivory Coast, was convicted in a separate trial of sexually assaulting and stabbing Kercher. His 16-year prison sentence - reduced on appeal from an initial 30 years - was upheld by Italy's highest court in 2010. The appeals court also expressed incredulity that the two would have cooperated in such a crime with Guede, with whom there is no proof of any relationship. What about the fingerprint off her boyfriend on the bra clasp.
What about the framing off the pub boss.
What about the lies and the admitting she was there in her original statement, her FIRST statement.
What about the drug taking on that night.
There WAS blood on the knife that matched Meredith which was found in the boyfriends apt.
What about the fake break in.....someone who entered the house must off had a key.
What about knox and her boyfriend buying cleaning fluid at the shop.
What about Knox and her boyfriend NOT Informing the police off a break in when they supposedly got to the house ....they phoned the boyfriends family member who worked for the police to report the break in...why do that when the local police were already there.
Knox is guilty but the justice system has done what we expected them to do...fail the victim and let's not forget ....what goes around comes around.

I think this small village was overwhelmed by the Press, the World attention on the case and contamination of the forensic evidence was enough for the
Jurors to reverse the original decision for life to get back to normal. It"s hard on the Kerchers I know .

Knox to make 4m dollars out off book about her time in prison.
She will also reveal something that has never been told about the case before....why didn't she reveal it when she was on trial..you ask.
The kerchers should get the book banned in the UK and seek damages from Knox .
She actually has to write the book as the parents owe a vast sum off money to lawyers who got her off and as someone on sky news reported this morning.....tasteless and leaves a bad taste in your mouth making money out off a murdered women and the book seems a celebration off AQUITAL and NOT innocence.

Amanda Knox's ex-boyfriend has acknowledged that the couple's bizarre behaviour after the murder of Meredith Kercher may have led police to believe they were responsible.
Raffaele Sollecito, who was convicted and later cleared of murdering the British student in Italy almost five years ago, has described the nightmare of the aftermath of her death in a new book.
Mr Sollecito maintains the pair's innocence but says that police found their behaviour "odd" in the days after the killing.
He also acknowledges they had no "real alibi the night of November 1 except each other".
Miss Kercher, a 21-year-old from Leeds University, was found semi-naked and with her throat cut in a house she shared with American student Amanda Knox in Perugia in November 2007.
Miss Knox and Mr Sollecito were convicted in 2009 of killing Miss Kercher, from Coulsdon, Surrey, but were freed last October after the verdicts were overturned due to a lack of evidence.
Mr Sollecito says "kissing" pictures may have fuelled police suspicions
Rudy Guede, a petty criminal and drug dealer from the Ivory Coast, was convicted of sexually assaulting and murdering the student and is serving a 16-year sentence.
In his book, Honour Bound, which is published on September 18, Mr Sollecito writes that he met Miss Knox at a classical music concert at the Universita per Stranieri, the University for Foreigners, on October 25, 2007 – a week before Miss Kercher's death.
He asked for her number, and she told him to come by the bar where she would be working later that night.
At the end of the shift, he writes, they took a walk, held hands and kissed. She accepted an invitation to come back to his apartment and spent the night.
Knox was overcome with emotion after she was eventually cleared.
He describes how the early days of his relationship with Miss Knox became a nightmare with the horror of Miss Kercher's death, the suspicion of their involvement and their tabloid portrayals as two suspects unrecognisable to themselves.
Miss Knox came to be dubbed as "Foxy Knoxy" and received the brunt of the attention as she shopped for underwear after the killing and turned cartwheels in front of investigators.
Mr Sollecito also criticises the police for their handling of the case, suggesting they reached for a far-fetched conspiracy instead of the simpler explanation that Guede had on his own committed a burglary gone wrong.

If Amanda Knox is innocent so are kate and Gerry McCann.
There is a long article written by a criminal profiler who goes through Everything that was said by Knox .....the statements plus other things and she is under no doubt that Knox is guilty off murder.
She doesn't think that Knox dealt the final blow but she was there and and she was part off it....she says she thinks as Knox didn't deal the fatal blow that Knox disassociated herself from blame in the murder.

I dont know what to make of this case.
To kill someone you need a motive and I don't see what motive Amanda Knox had.

I have long suspected a lethal cocktail of drink and drugs could have led to horseplay that lead to accidental death. I find it hard to accept there was a deliberate intention to harm meredith, and you need intent for a murder charge. Like Madeleine i doubt if we will ever know the truth about poor meredith's death.

The parallel to the Mccann case is very strong James, PDL/ a small Italian village, the Police in Italy contaminated some of the evidence, the McCanns had the Tapas Group in 5a before the Police or forensics arrived, contaminating any prints not theirs. Kerchers Family started a campaign and had US support and media attention, the McCanns had similar support.
If the case is reopened maybe some new evidence will be found. The Prosecutor is convinced they are guilty.

A motive .....Knox didn't like meredith at all.....meridith, the english rose, Knox.....well we all know what she was like.
Meredith had money stolen from her room and embarrassed Knox by accusing her.
Meredith didn't like knox bringing men home late at night, different men, and Knox left evidence lying around that she was having sex with them, she never cleaned up after her....knox's hygiene left a lot to be desired.
People liked Meredith, they didn't like Knox.
Someone who and a key to the apt let themselves in.....and that was Knox .
Knox was jealous off Meredith .....not a motive perhaps but along with other things.....

A board in Italy will be sitting today to see if Knox can stand trial for the death off Meredith...
Knox was acquitted ....after being found guilty off murder....on DNA evidence.....I.e. The knife ....that it was unreliable.
Knox was not acquitted as people think on other evidence, that was not heard at the appeal trial, it was just the DNA which was blood and degraded that was allowed to be heard and aquitted her.
I really HOPE but won't hold my breath that their will be a retrial...the money the new trial will cost will be a factor that that probably WON'T be a trial.
If there is, I hope Knox spends the next 20 years fighting and using her Ill gotten gains from the book, extradition to Italy.

Her sister said: "There are lots of questions without answers and that's why
we are looking for the truth.
"We miss Meredith terribly and nothing will bring her back. We hope that the
Supreme Court hearing will help to find some answers to what happened that night
in November 2007 when our lives changed forever.
"We still get messages of support from all over the world. Meredith will
never be forgotten but it's also important not to forget what happened, a
beautiful young girl, my little sister, taken away from us too early in a brutal
manner, with many aspects to still clarify.''
Amanda Knox and Raffaele Sollecito were
acquitted on appeal
Ms Knox, 25, and Mr Sollecito, 29, were initially found guilty of murder in
2009, with Ms Knox sentenced to 26 years in jail and Mr Sollecito handed a
25-year term.
But at their appeal in October 2011, defence lawyers and experts revealed how
evidence had been contaminated or poorly handled by forensic teams and that the
conviction should be considered unsafe.
They were immediately freed with Ms Knox returning to her home in Seattle
while Mr Sollecito went back to Bisceglie on the southern Italian coast near
Bari.
Today's hearing will be behind closed doors with neither of them in
attendance, and only their lawyers representing them.
A panel of judges will rule whether the Italian legal code was applied
correctly and fairly in both trials, and if they find grounds they can order a
retrial - as prosecutors in Perugia have demanded - or they can close the case
completely.
The case will be decided purely on paperwork and legal documents with no new
witnesses giving evidence. A decision is expected by late this evening.
Luciano Ghirga, Ms Knox's lawyer, said: "She is very anxious about the
hearing but she is waiting for it knowing full well that the outcome is very
important."
Meredith Kercher's mother, brother and
sister
Since returning to the US, she has maintained a low profile although she has
written a book about her four years in an Italian jail and is due to give an
interview to American TV station ABC next month ahead of its release.
Mr Sollecito has also written a book and has already given an interview on
Italian TV about the case where he said he and Ms Knox were no longer lovers but
were still in touch - he visited her earlier this year and they speak on Skype
regularly.
His father, Francesco, said: "He is working hard on his studies. He's working
on a project involving the movement of surgical instruments during operations.
He is calm and serene even if we are all in a state of apprehension.''
Miss Knox and Mr Sollecito have always insisted they are innocent of
murdering Miss Kercher, from Coulsdon, Surrey.
She had only been in Italy for two months before she was killed, having
arrived for a year-long course as part of her Leeds University degree.
Drifter Rudy Guede is serving 16 years for the murder having initially being
sentenced to 30 but this was later reduced on appeal.

Yes Kitti Italy's economy is not looking too good. Amanda Knox has just about run through the $ 4 million advance she received for her book, Waiting To Be Heard.
“I don’t know what I am going to do. The future is very unsure for me financially,” Knox told the Toronto Post.
Knox was convicted in 2009 of the murder two years earlier of her former exchange student housemate Meredith Kercher. The conviction was overturned in 2011 but an Italian court has now ruled she can be retried for the brutal crime.

Knox hasn’t been out buying fancy cars and yachts with her money from the memoir.
She paid her legal bills and reimbursed her parents for the $1.5 million in debt they ran up during four years of travel back and forth to Perugia, Italy so they could be by her side. She also went back to college, at the University of Washington, and she’s facing new legal bills for the retrial.
Her book has also exposed her to a string of possible lawsuits from Italian officials who claim she’s defamed them.
“People asked me if I would change the book and I said absolutely not. I am not going to change my story just because someone is threatening to sue me but I mean … it sucks. It sucks and it sucks,” she said.

The acquittal of accused murderer Amanda Knox was full of "deficiencies, contradictions and illogical" conclusions Italy's high court has ruled, ordering a fresh look at all the evidence to determine whether she did kill her flatmate Meredith Kercher.
In March, the Court of Cassation overturned Knox's acquittal in the 2007 murder of British student Ms Kercher and ordered a new trial. The court has now issued its written reasoning.
Ms Kercher's body was found in November 2007 in her bedroom of the house she shared with Knox in Perugia.
Knox, now 25, and her Italian ex-boyfriend, Raffaele Sollecito, 29, were initially convicted and sentenced to lengthy prison terms, but a Perugia appeals court acquitted them in 2011, criticising virtually the entire case mounted by prosecutors. The appellate court noted that the murder weapon was never found, said that DNA tests were faulty and that prosecutors provided no murder motive.
A man from Ivory Coast, Rudy Guede, was convicted of the mruder in a separate hearing and is serving a 16-year sentence.
In the 74-page Cassation ruling, the high court judges said they "had to recognize that he (Guede) was not the sole author" of the crime. The judges though said he was the "main protagonist."
They said the new appeal process would serve to "not only demonstrate the presence of the two suspects in the place of the crime, but to possibly outline the subjective position of Guede's accomplices." It said hypotheses ran from a simple case of forced sex involving Kercher "to a group erotic game that blew up and got out of control."
The high court faulted the Perugia appeals court for "multiple instances of deficiencies, contradictions and illogical" conclusions. The new court must conduct a full examination of evidence to resolve the ambiguities, it said.
Knox left Italy a free woman after her 2011 acquittal, after serving nearly four years of a 26-year prison sentence. Now a student in Seattle, she has called the reversal by the Cassation "painful" but said she was confident she would be exonerated. Italian law cannot compel her to return for the new trial and her lawyers have said she has no plans to do so.
