I have no information that would suggest what you say is correct. I remember something about the PJ not being prepared to fully investigate Payne because it would damage his character. But maybe Panda or Marky can elaborate on this. It would certainly be a reason why they would be loath to have any reference to these statements read out in open Court. But I don't think this libel action would be the place for this evidence to be aired/used.
