McCanns 'were suspected by police' www.thisislondon.co.uk
http://www.thisislondon.co.uk/standard/article-23793813-mccanns-were-suspected-by-police.do
Portuguese police believed Madeleine McCann died in her family's holiday flat and that her parents faked her abduction, a court has heard.
Kate and Gerry McCann faced former detective Goncalo Amaral across a courtroom as he tried to overturn a ban on his book that claims their daughter is dead.
One senior detective told the hearing in Lisbon that police made the McCanns "arguidos", or suspects, in the case after concluding Madeleine died accidentally and her parents covered up the death by inventing a kidnapping.
Chief Inspector Tavares de Almeida said he believed Madeleine died in her family's apartment in the Algarve resort of Praia da Luz on the day she went missing in May 2007.
He told the court the main evidence for this was the findings of British police sniffer dogs sent to Portugal to examine the flat.
The McCanns' lawyer, Isabel Duarte, challenged this claim, arguing that the sniffer dog results did not constitute proof and were not allowed as evidence in the case.
Mr Amaral is calling a series of senior Portuguese officials involved in the investigation into Madeleine's disappearance as witnesses to support his allegations.
His lawyers argue that the material in his book is contained in the official Portuguese police files for the case, many of which were made public in August 2008.
Jose Cunha de Magalhaes e Meneses, the local public prosecutor in the Madeleine investigation, gave evidence via video link. Asked whether he believed that the little girl was dead, he said it was "50-50".
Mr Amaral's lawyers are also seeking evidence from a British policeman, Metropolitan Police Detective Sergeant Jose De Freitas, who was seconded to Leicestershire Police to help with the British end of the investigation.

I'm eager to see what proof they will show that Maddie is alive? Because if they have nothing then it shouldnt be allowed as evidence either right?

Thanks Laffin, at last what was said in Court Today is filtering out into the Britsih Media, something I am sure the dastardly duo did not want, they will rue the Day they went ahead with this Libel Case.
Whatever the outcome they have lost.

vengefulangel wrote:"Mr Menezes said he thought the probability of Madeleine being alive was 50/50"
I was hopping mad when I read that, when I calmed down I got a different perspective on it. I am assuming that he had to say that because the Mccanns did not go ahead with the reconstruction, which would have cleared them of any involvement. Therefore the indications are that they know poor Maddie is deceased but cannot say to a court of law that there is 100% certainty until the mccanns do the reconstruction (which they havent yet done!!!!)
Incidentally does anyone know who said they were ok not to do the reconstruction...someone by the name of Prior? I dont remember hearing or reading anything along those lines before. How very pitiful that the mccanns never did a reconstruction, when we all know how great crimewatch is with its reconstructions and crime solving, because someone said "oh dont bother it probably wont help anyway!!!".

'Madeleine McCann stierf in vakantiewoning'

Claims that at least the original investigating judge in the case, Jose Magalhaes e Menezes. This would assist in a report signed by the then Superintendent of Police, the Almeide Tavares, British media reported Tuesday.
That was Tuesday in Lisbon during the first days of statements in the trial against the McCanns in Portugal detective Goncarlo Amaral. Amaral wrote the book "A verdade da mentira 'or' The truth about the lie", which he claims that the girl is dead and her parents have hidden her body somewhere.
Amaral led the investigation in October 2007 to the notorious case, which began on May 3, 2007 by the disappearance of the then 3-year-old girl. Amaral was removed from the case following his criticism of the British police in the media. The parents 'Maddie' demands 1.2 million euros damages and want the book definiteif is prohibited.

Hopefully there's a slim chance of that happening Alfie, perhaps the media are sensing that two and a half years of lies and cover up just might be coming to an end.Alfiefinn wrote:malena, only if there's a 99.99% chance that they'd settle out of court, I fancy.

Swearing outside to a reporter has zero value in this case. As long as it is not inside, he can swear whatever he wants, because it has no effect in the final result. Dozing off is also normal sometimes, in Courts. In this case, there's just one Judge, but in Criminal cases, with three judges, it wouldn't be the first time, that one of the side-judges start to doze off. It just means the session is being boring. From my personal interpretation, if Amaral dozed off, that's because nothing that was being said was making him nervous, which is (for now and apparently) a positive sign.

Re: What the papers say - Amaral V McCanns trial
I agree that I'm sure most BBC viewers would be far more interested to hear that Madeleine 'died in the flat' than to listen to the dull lunch box story. However, I suppose the Beeb's report on their webpage is impartial.
Not surprised Amaral lost his rag with O'Sullivan. The McCanns are trying to ruin him..

Yes, it's odd how the sightings all over the globe of Maddie by deluded nutters (IMO!) constitute evidence Maddie is alive and yet two highly trained and objective sniffer dogs detect substances they are trained to find and that is not evidence..

McCanns Brace For More Cover-Up Claims
10:53pm UK, Tuesday January 12, 2010
Jon di Paolo, in Lisbon
The parents of Madeleine McCann are preparing to face a second day in court listening to claims that they covered up their daughter's death.
During the three-day libel trial in Lisbon, Goncalo Amaral is trying to overturn a ban on a book he wrote following his time as a chief investigator into the child's disappearance.
In his book Maddie: The Truth Of The Lie, Mr Amaral claimed that Madeleine McCann died in her family's holiday flat on the night she vanished and questioned her parents' account that she was abducted.
The McCanns have always strenuously denied the allegations and say they will never give up searching for their daughter.
They believe she was snatched from their holiday apartment in the Algarve resort of Praia da Luz in May 2007.
The pair were declared "arguidos", or formal suspects, in October that year, but the status was lifted when the case was shelved the following summer.
They are seeking to have a ban on the book made permanent, fearing that telling people Madeleine is dead will stop them looking for her.
The couple, both 41 and from Rothley, Leicestershire, are also seeking £1m damages in a separate hearing.
On the first day of the trial, Mr Amaral's legal team called several of his former colleagues in the area of law enforcement to give evidence in support of his claim.
They contend that the allegations in the book match the facts of the investigation, highlighting the reaction of British sniffer dogs who were used to search the apartment.
One of the witnesses called was Tavares de Almeida, chief of police at the time of Madeleine's disappearance.
He said in his testimony that the animals detected traces of blood inside the dining room of the holiday flat and in the car the McCanns were using.

He added that they found a scent on a piece of cloth in a flat rented by the McCanns after they left the apartment where Madeleine vanished.
The McCanns' lawyer, Isabel Duarte, challenged the claim, arguing that the sniffer dog results did not constitute proof and were not allowed as evidence in the case.
At several points during the hearing she became very animated, leaving her chair to confront Mr Almeida and the video screen via which Jose Magalhaes e Menezes, the local public prosecutor in the Madeleine investigation, gave evidence.
The McCanns remained impassive throughout most of the hearing, only occasionally turning to each other or their interpreters for a few whispered words.
Mr Amaral, sitting next to his legal team only 15ft away, also showed little emotion, sitting looking straight ahead rather than at the McCanns' seats.
Former Madeleine case detective Goncalo Amaral
Goncalo Amaral
Mr Menezes said he thought it was 50/50 as to whether Madeleine was still alive.
Mr de Almeida and another witness, Ricardo Paiva, the police liaison officer initially detailed to look after the McCanns, both said that although British police on the ground gave maximum co-operation, other UK authorities appeared to hinder the investigation.
Mr de Almedia said Portuguese police requested background information about Mr and Mrs McCann and the friends on holiday with them at the time the little girl disappeared - only to be fobbed off with enough to cover a single sheet of A4 paper.
Mr Paiva said the enormous publicity generated by the appeal to find Madeleine, and the 'merchandising' of things such as wristbands, was what had made police start to feel suspicious of the McCanns.
The trial continues.
