Defence saying that Dewani can't be extradited under the Extradition Act while he is ill. She is referring to Second 91 which can only halt extradition until he's recovered not stop it all together.

I think they should get a second opinion, he is obviously fooling the doctor and my heart goes out to the parents of the wife he had murdered, they thought justice would be seen to be done.

You may be right. He apparently still hasn't started taking anti-depressants as part of his treatment because of his serotonin levels. Judge asked when he was last assessed by a reliable source. (interesting turn of phrase). The answer was July. Judge wants to know the qualifications of the psychiatrists at Fromeside who produced a court report on Dewani's health.

Lawyer for the South African authorities is challenging defence claims that it would be "unjust and oppressive" to extradite Dewani.

Dewani 'Needs A Year' Before Extradition

A businessman accused of arranging the honeymoon murder of his new bride needs up to a year to recover from stress and depression before he will be fit to be extradited, a court has heard.
Shrien Dewani's lawyer said he was still mentally unfit to be sent to South Africa where he is to stand trial for the contract killing of his wife, Anni.
Clare Montgomery QC said the case hung over Dewani "like the Sword of Damocles", but he was a suicide risk and not well enough to plead to charges of murder, robbery and obstructing justice.
She said he needed "a period of calm".
South African police said Dewani hired three local men to kill Anni, 28, during their honeymoon in Cape Town in November, 2010.
Dewani told detectives that their taxi was hijacked and he was thrown out unharmed before his wife was driven off. She was later found shot dead.
Last year, chief magistrate Howard Riddle approved Dewani's extradition and it was confirmed by the Home Secretary.
But in March the Appeal Court ruled that Mr Riddle should reconsider his decision with more examination of Dewani's mental health issues.
The Appeal Court said the extradition should go ahead "in the interests of justice", but only when Dewani was mentally fit.
The businessman, who runs a care home near Bristol, is currently detained compulsorily under the Mental Health Act. He denies all charges.
The latest hearing was adjourned until September 18, when the court expects to hear evidence from another psychiatrist who plans to assess Dewani next month.
Prosecutor Hugo Keith QC, on behalf of the South African government, said a psychiatrist who had already examined Dewani had said he no longer wanted to be involved in the case.
The chief magistrate said he wanted more evidence of Mr Dewani's likely speed of recovery before setting a new date for the extradition hearing.

What a disgrace AnnaEsse, this guy is pulling the wool over Judges eyes and once again our Judiciary are more concerned
for the criminal than justice. Why did'nt that woman QC demand another Psychiatrists report instead of reprieving Dewani
for another Year.?

My mistake NBY, your'e right, but how many months ago was he admitted to the Clinic ,an appeal made and he wasn't deported. ? Yet according to his Lawyer he is still too sick? We know it is a deliberate ploy but the QC is giving him the benefit of the doubt for another 6 weeks. even though the Phsychiatrist at the last hearing said he was fit to travel.
Don't Anni's family deserve justice and closure. ?

Thanks chrissie, yes the blogger has got it right. Is South Africa paying Court Fees, if so they need to employ a better
QC. There was a time when the British Justice system was considered fair and impartial , now this is no longer the case,
Judges adhere to the Human Rights Bill so much that it is time for the Government to withdraw from it when it comes to
extradition. How can a Judge decree that an illegal can stay in Britain because he had formed a bond with a Cat...take the cat with you I say.!!!!

That isn't Dewani in that above link, that is Anni Dewani's father.... Vinod Hindocha, poor man he is a broken man!!!

I think his family possibly pressured him into getting married, but there seems to be evidence that he is actually gay.

Lilyofthevalley, thank you - that would certainly explain the aged and haggard appearance but, unless I'm having a bad day, I can't see where it states that the photo is of his former father-in-law.

He was Gay or ac/dc, the Press showed a photo of his lover. I don't understand why he married Anni, she did not come from a wealthy Family. I remember reading that the newlyweds had an almightly row on their Wedding night according to
Anni's Sister. Maybe that was when Anni found out he was Gay and Dewani thought she would tell her family and his. I
think Dewani married her to have respectability .

That's why I think he married Anni for respectability, but Anni was no shrinking violet and prbably felt betrayed that her marriage was a sham. Didn't her Sister say Anni confided that Dewani wanted to wait until they were married before having sex?
