Re: Sky Live Day 3 - 14/01/10
Mr Santos: But up to now, none of the information published by the media has been strong enough to make the police re-open the case.

That would mean, if she's dead, the case will never be re-opened

He's telling us that all the "sightings" are totally bogus!!!

That would be right darling, but he needs a miracle!
Curious why you think that? Everything said has been well in his favour so far...?
ETA: You've probably explained above x
I don't think he'll win either. The McCanns will manage to convince everyone that it is not in Madeleine's 'best interests' to have a book available to the public like that.
If I was the judge, and I know I am not and do not understand Portuguese law, but anyway, I would put it very firmly, that serious criminal investigations into the disappearance of a little girl must be dealt with properly, they are not to be the subject of books and films whilst this little girl is still missing and that the reason she is making the order is for that reason, not because it offends Kate and Gerry McCann who she has heard evidence also courted the media and put her life at risk. I am afraid I would also add that as a former very senior police officer Goncalo really should have known better. We have heard evidence that clearly states the publicity was hampering the investigation. British Police have clearly stated a number of times that investigation continues.

but surely if they believe she is dead they still need to find out what happened to her and who caused it?

Mr Santos: Pirate copies of the documentary based on Mr Amaral's book were put on the
internet and a copyright complaint was made to police.

And as Gerry said (re. dogs indications) if such sightings aren't otherwise corroborated- that's not evidence, it's intelligence

So the only way the case would be re-opened would be for the body to be found. Sad, very sad.

That's not what he meant. What he wants to say is that if nothing new comes to the investigation, then it won't be reopened. It can be reopened with the child dead or alive, but new facts are needed, to be added to the files.

But if she's dead, and that can be proven - eg a body turns up - then that means a new case can be opened!

Re: Sky Live Day 3 - 14/01/10
I would add that I have always looked at this from two points of view. The moral one, where I like Goncalo and I like to see the Mccanns stopped and punished. But then there is the legal one, and on that one, he was wrong.

British Police would just arrest them, Almeida has just stated, the British Police could not charge them (purely on the basis of the dogs) , he was confirming their jurisdiction in this case - Offences Against the Person Act 1861.

The McCanns 'lawyer, Isabel Duarte, asks Mr Santos if he remembers the colour of the
first page of the police investigation file.

What a bizarre question - this surely must be leading somewhere.

Re: Sky Live Day 3 - 14/01/10
where is she heading to....
Judge isn't getting it either....
The judge is sitting slumped in her chair, her chin resting on one hand as she listens to the exchanges between Ms Duarte and Ms Santos.

Perhaps it was coloured in a certain way (red?) and said that publication of the files was prohibited - I dunno!
