Sky were reporting the ban was PERMANENT earlier but it isn't, just in case it still says that.

I think the judge has actually done us and Amaral a favour, the Mcs will go into the libel trial feeling a little bit cockier but that trial is by far the harder one, with all sorts of stuff being said again. In any case l would NEVER want the Mcs to be able to say they couldn't have a fair trial when the law eventually catches up with them so all in all l'm okay with the judgement.

.... and they will search on the internet to find mccann files, joanna morais etc - same as WE all did!
The McScams are finished anyway, destined to spend the rest of their lives fighting through the courts to defend themselves.

Yes it is still a temporary injunction!!!!!!!!!!Lizzy11268 wrote:HiDeHo wrote:So, as I understand it, this being the hearing for the temporary ban, means there will be a full trial for the libel claim, therefore forcing the Mc's to defend their case?
Thats good isn't it?
or....
Can they drop it at this stage?
They CAN drop it of course, its them that are bringing the case.
However, there would still need to be a FULL hearing re the book ban, before a permanent ban would be put in place.
I know people are worried and upset, so I think its important to point out again, just in case it makes y'all feel better (it does me!) that this is still only a TEMP injunction.

welshy,
i feel really upset,
the mccs have got away with too much and it turns my stomach each time,
its maddie i feel sorry for, they dont deserve to be parents with all the lies and diversion tactics they carry out,
lets live in hope and once more wait again for the libel trial,
hope more info comes out then and the mccs smirks are wiped off their annoying faces.

Thanks for trying to make us feel better. The problem is, the verdict tends to indicate which party has the support of the judicial system. Look what happened last time Amaral was up in court. Now I have even less faith that justice will be served, it's so bl**dy frustrating - I think mancdad is in for an earbashing tonight.

thank you Margaret.
Just got up to speed, how disappointing but I suspected as much.
The mccanns theory is as fictional as the vampires that their lawyer feels fit to talk of in a Court of law!!! I will try and avoid the press conference as every time I see them at the moment I feel grubby, almost like I have to wash my hands.

The Wheels of Justice grind very slowly in Portugal it seems, 6 months to decide the ban stays in place? I still don"t really understand why a decision couldn"t have been made to lift the injunction until the Trial takes
place, it"s seems like a done deal that the McCanns will win the Libel suit the way this has been handled.
Wasn"t the Appeal on the "Freedom of Speech" criteria?

Probably the McCanns claim that Amaral"s theory would stop people searching for Madeleine prevailed, so
Freedom of Speech lost. I am getting heartily sick of the McCanns pestering people to search for Madeleine,
when they have wasted so much money on bogus Investigators.

Exactly. However, in a Lib elk suit the McCanns will have to prove that Madeleine is still alive, hen.ce the Posters outside the Courthouse. I would have thought that Amaral"s Witnesses had proved that it is more
unlikely that Madeleine is dead and IF they go to Trial what evidence will they have to prove their claim.?

Law enforcements in uk and portugal arent looking for her, is the book to blame for that...no.
Its not down to US to look for her after all thats why they are paying p.i.s....we shouldnt be doing that it should be THEM.
Saying that, also, the book hasnt stopped the p.i.s looking either...something very dark going on here.
Last point....she was 3 when she went missing....we dont know what she looks like now, she could be sitting next to me and i wouldnt know....

Still think the British media see right through 'the pair'..
Telegraph website story is entitled:'McCanns win the bid to GAG Portuguese detective'..doesn't sound very pro-McCann to me.

Havn"t read any papers yet, but what you are quoting is encouraging. I said a while ago that I didn"t think
the McCanns would go to Trial and I still think it possible they will reconsider. They must be wondering what
else Amaral will come up with in Defense and with Murat suing Tanner a whole can of worms will open up and
Amaral has apparently acted as Witness.
What if...........the suing of Tanner is a cunning plan to discredit her story and force a reconstruction, without
opening the case? The PJ must be as sick of the McCanns as the population is and will resent any request by
them to re-open the case when they have spent so much money an time on the case.

Its a sprat to catch a mackeral...beattie, as you say.
Good point tho, discredit tanner, i wonder if robert murat is suing her because HE wants to or is doing it because he has been ASKED to.
One thing bugging me, k and m went to take out another criminal/libel writ in their lunch hour whilst in lisbon concerning the documentary and cd how did they know they were going to win the amaral case as one coincides with the other?
If they lost the injuction case then what would be the point in suing tvi etc.

Also find it interesting that the Daily Mail (dreadful paper IMO) is totally ignoring story..only paper doing so. Normally readers can leave comments so perhaps they want to avoid publishing them???

They must have known the result of the Hearing in advance, which is a blow for Justice and a big black mark
for the Portugese Judiciary IMO
Since TV1 are banned from commenting expect the McCanns to drop their charges against them, big fish to
threaten IMO. No News on the Amaral book "The English Gag" since it"s launch, anyone know if it available to
buy?

Beattie.
If they decide not to go to trial on the libel case, if they want the book to stay banned , there would have to be a full hearing in order to get it banned permanently.
So, at this stage, even if they were to decide the Libel trial was a step too far, they will still have to go back to court, and possibly more information will emerge.
I think I am reading that correctly.

Mail have the story in their world news section. Have red arrowed a few comments and sent in my own, but doubt they'll put it up as it mentions Lee rainbow's conviction of parents' involvement and Eddie's recent find in Orkney!
