Expresso and Marinho Pinto Published Leonor Cipriano Forged Pictures

Allegedly Faked or Photoshoped Pictures of Leonor Cipriano with (and without) bruises have just emerged in the Media. The Expresso newspaper published an article written by the actual bar of the Lawyers Order using the alleged fake pictures in 2004, one of those pictures is used as evidence against the 5 PJ Inspectors.
The question remains: Why?
A possible why and my personal opinion
Firstly, we don't know how long the bruises took to appear after the staircase fall, I assume it was not immediately. Though Leonor was taken to the hospital the same evening of the suicidal attempt we don't know when where the pictures taken, or by whom. We don't even know if it was after the prison director told Leonor she could ask compensations in money and argue/or request another appeal to diminish her 16 year jail sentence. As it is common Knowledge people that are child molesters, abuser or killers do get beaten up in jail. By the way the pictures were taken inside the jail not in the Hospital.
Secondly, the raccoon eyes picture published in 2004 by the jornalist/layer Marinho Pinto in Francisco Balsemão Expresso had one purpose only, and that was not one with high morals or in defense of the Human Rights. The game here like it has always been is a fight of power between three chess masters, the Public Ministry, the MAI and the PJ.
Thirdly, the suspicious photos published in Expresso at the hand of the actual bar of the Order Association of Lawyers Marinho Pinto, the use of pawns like Marcos Aragão Correia, a previously discredited lawyer, the suspicions raised about five PJ officers, who are most of them legends in their professional activities and amongst colleagues, is all but a coincidence, in a timing where a figure of a 'super cop' who oversees all the investigative police forces like the PJ, SIS and the PSP and who only answers straight to the to the the Prime Minister and to the MAI (Ministry of Internal Affairs).

Faro Court – Five Judiciária inspectors stand accused of aggressions upon Leonor Cipriano

Defense places bets on computer experts who discredit aggression marks on the photos
The photographs where Leonor appears covered in hematomas and that are being used as evidence in the process of alleged aggressions practiced by Polícia Judiciária inspectors may have been manipulated “by any person with a knowledge of computers”.
This is the interpretation made by António Pragal Colaço, the lawyer of four out of the five inspectors that stand accused of torture, and that is going to be used as a strategy to show the Court in Faro, which postponed the start of the trial yesterday due to the death of the mother-in-law of one of the case’s judges. On Monday the arguidos return to the bench.
According to Pragal Colaço, “it is evident” that the images could have been altered. “One cannot carry out medical analyses on files from other files, from floppy disks to CDs”, the defendant of Paulo Cristóvão, Marques Bom, Leonel Marques and António Cardoso alerted. “Those are not photographs. Those are prints from computer files”, the lawyer stated yesterday upon exiting Faro Court.
The original file of the images that are included in the process has disappeared, and the defense of four out of the five inspectors has requested Portuguese Microsoft to carry out an expert analysis in order to attest that the simple manipulation of files can alter the images’ properties, changing the look of the exhibited lesions.
The Public Ministry’s accusation refers that “unidentified individuals” were the ones who inflicted the aggressions upon Joana’s mother, “following indications” and upon agreement with three of the arguidos.
Pragal Colaço warns that what is included in the process does not correspond to what happened and recalls that there is not “a gang of bandits” on trial but rather “persons who have helped to solve the biggest crimes in this country”, like the cases of the ‘cash machine gang’, of terrorist Abu Salem or the FP25 [a Portuguese communist terrorist organization].
António Cabrita, the defender of Gonçalo Amaral, who stands accused of failing to denounce, says that the accusation is “absurd”, because it implies that Amaral would have to “suspect every one of his subordinates”.
Compensation for Amaral
If he is acquitted, the former Polícia Judiciária coordinator, Gonçalo Amaral, will advance a request for compensation against the Portuguese state.
“It’s a strong possibility, if there is an acquittal”, his lawyer, António Cabrita, said yesterday.
This posture appears before the start of the trial, just like the lawyer of four of the accused inspectors had already announced: Pragal Colaço asserts that if his clients are acquitted, he will file a request for a compensation of approximately five million euros, which is to be handed over to the Polícia Judiciária.
Order doesn’t pay taxes and gets fined
The Lawyers’ Order was fined over approximately 200 euros because it failed to pay the amount of judicial expenses to become an assistant in the process, within the deadlines.
According to what CM was able to establish with a judicial source, it wasn’t until yesterday morning, when the trial was scheduled to begin, that the payment was made. Thus, the constitution as an assistant cost the double amount: almost 500 euros, including the fine. The Order had interpreted that there were no judicial expenses to pay.
“We weren’t notified. This is what we call a drawer or pocket veto”, the head of the Order, António Marinho Pinto, commented yesterday.
“It is not admissible that the Order pays fines like this one due to not being able to read and understand the Judicial Expenses’ Code”, Pragal Colaço, the lawyer of four of the inspectors on trial lamented yesterday upon leaving the Court of Faro.

Faro: First day of PJ inspectors’ trial

The expression on the jurors’ faces changed as soon as Leonor Cipriano started contradicting herself, during the trial of the five Polícia Judiciária inspectors that stand accused of assaulting her.
She started out by saying that she had seen “who assaulted” her but then denied it “because there was a plastic bag over my head”. A bag that she asserted before the judges and jurors was “plastic and blue”. But moments later she stated it was “green or blue”.
But the contradictions continued. During the inquiry, Leonor said that she had been “assaulted more than once” and yesterday stated that it had been “only once”. She said that she was beaten between 6 and 8 p.m., because she had seen the time on the clock inside the room, but yesterday described the room without said clock.
She enumerated the alleged aggressions that she suffered in order to confess to the death of her daughter, on the 14th of October 2004, but forgot that she had already confessed all these facts to the PJ one day earlier, in the presence of her then lawyer, Célia Costa. “I never had a female lawyer. I don’t remember having confessed”, she told the court.
The memory failures continued – the only thing that was described with precision was the aggressions that she says she suffered. She asserted that the doctor at the prison in Odemira observed her the day after the assault – but in the Public Ministry’s accusation, the medical report is dated the 18th, three days later. The same lack of certainties happened concerning the date when the photographs were taken. Leonor says that they were taken “on the following day”, but the process refers that they were taken days later. And the defense recalls that the images can be “manipulated”.
Details
Telephone book – Leonor says that she was beaten with a phone book while she had a bag over her head. She stated to the court that at that point in time “she couldn’t see anything”.
Room light at night – The room where the photographs were taken at the prison was “bright and with light”, according to Joana’s mother – but everything happened at night. Therefore, according to the witness, they were taken after the employees’ normal working hours.
Without explanation for bruises on her body
A set of photographs that were sent by Odemira prison and that were included in the process don’t match those that were used to write the forensics report on the hematomas. In some of the images Leonor presents hematomas in her face, but on others those bruises are not visible. When she was confronted with those images, Joana’s mother was not able to explain which ones were real. She asserted the court that “photographs were taken only once”, always “inside the prison” by two employees. The colour of the bra was also questioned, given the fact that Leonor stated she only wears white or black underwear.
Plaintiff’s lawyer wants to call Alípio
Leonor Cipriano’s lawyer is going to ask for Alípio Ribeiro to testify in the process, so the former PJ national director can explain the exit of Gonçalo Amaral from the institution. At the end of the session, Aragão Correia launched serious accusations against the former PJ coordinator, connecting the cases of Joana and Madeleine. “The British police has carried out a private investigation on Gonçalo Amaral and has detected several crimes.”
Amaral says that Leandro is guilty
Gonçalo Amaral was the protagonist of the key moment yesterday when he pointed at Joana’s stepfather as someone who was involved in the child’s disappearance. ”He’s the one who should be on trial”, he referred, while pointing at Leandro, who is a witness in the process.
As far as CM was able to establish, the accusations are related to a process of rape upon Joana, in which Leandro was a suspect and which was investigated after the mother was accused of homicide.
At that time, sperm was found in little Joana’s underpants, which was an almost full match with Leandro’s DNA. The collection of sperm was requested, but Leandro refused.
Leandro interprets Amaral’s accusation because he is “desperate and anguished because he knows that he’s guilty”.
Defense wants to show series of statements
During the audience, António Pragal Colaço, the defense lawyer for four out of the five arguidos, showed a lengthy document which he stated included “a series of contradictions” that Leonor made throughout the investigation.
As an example, Pragal Colaço referred to a situation when Leonor said she had been beaten with a cardboard tube, at the same time when she stated that she had a bag over her head and couldn’t see anything.
At the end of the trial’s first session, the lawyer excused himself from making a statement to the media. “I don’t want to talk”, he said. Nevertheless, CM knows that the document that was exhibited by António Pragal Colaço in court has not been appended to the process yet and the lawyer will only present it over the coming days.
António Cabrita, Gonçalo Amaral’s defense lawyer, questioned the reason why the doctor at the Health Centre in Odemira failed to denounce the aggressions that Leonor denounced when she was examined. António Cabrita asked if the doctor should not be accused of omission to denounce, just like his client.
Many members of the public watching
Throughout the day, the main room at the Court in Faro was literally overfilling and there wasn’t enough space for the numerous members of the public that wanted to watch the trial. At the door, many persons waited for someone to leave in order to obtain a place. Contrary to what was requested by Leonor’s lawyer, there was no metal detector control, but Leonor was constantly surrounded by prison guards. The trial proceeds on Wednesday morning.

Accusation: Different crimes – Inspectors Leonel Lopes, Pereira Cristóvão and Marques Bom stand accused of torture. Nunes Cardoso, of forgery of a document; Gonçalo Amaral, of false testimony and of failure to denounce.
Condemned: Her daughter’s death – Leonor is presently fulfilling a 16-year prison sentence over the death of her daughter and the concealment of her cadaver. The case was appealed until the Supreme Court, which confirmed the sentence.
Order: Normal lapses – Rodrigo Santiago, one of the most renowned lawyers in the country, is the assistant who represents the Order. Concerning the contradictions, he says that “they are natural because [Leonor] has been imprisoned for several years”.

Telephone book – Leonor says that she was beaten with a phone book while she had a bag over her head. She stated to the court that at that point in time “she couldn’t see anything”.
Room light at night – The room where the photographs were taken at the prison was “bright and with light”, according to Joana’s mother – but everything happened at night. Therefore, according to the witness, they were taken after the employees’ normal working hours.
Without explanation for bruises on her body
A set of photographs that were sent by Odemira prison and that were included in the process don’t match those that were used to write the forensics report on the hematomas. In some of the images Leonor presents hematomas in her face, but on others those bruises are not visible. When she was confronted with those images, Joana’s mother was not able to explain which ones were real. She asserted the court that “photographs were taken only once”, always “inside the prison” by two employees. The colour of the bra was also questioned, given the fact that Leonor stated she only wears white or black underwear.
Plaintiff’s lawyer wants to call Alípio
Leonor Cipriano’s lawyer is going to ask for Alípio Ribeiro to testify in the process, so the former PJ national director can explain the exit of Gonçalo Amaral from the institution. At the end of the session, Aragão Correia launched serious accusations against the former PJ coordinator, connecting the cases of Joana and Madeleine. “The British police has carried out a private investigation on Gonçalo Amaral and has detected several crimes.”
Amaral says that Leandro is guilty
Gonçalo Amaral was the protagonist of the key moment yesterday when he pointed at Joana’s stepfather as someone who was involved in the child’s disappearance. ”He’s the one who should be on trial”, he referred, while pointing at Leandro, who is a witness in the process.
As far as CM was able to establish, the accusations are related to a process of rape upon Joana, in which Leandro was a suspect and which was investigated after the mother was accused of homicide.
At that time, sperm was found in little Joana’s underpants, which was an almost full match with Leandro’s DNA. The collection of sperm was requested, but Leandro refused.
Leandro interprets Amaral’s accusation because he is “desperate and anguished because he knows that he’s guilty”.
Defense wants to show series of statements
During the audience, António Pragal Colaço, the defense lawyer for four out of the five arguidos, showed a lengthy document which he stated included “a series of contradictions” that Leonor made throughout the investigation.
As an example, Pragal Colaço referred to a situation when Leonor said she had been beaten with a cardboard tube, at the same time when she stated that she had a bag over her head and couldn’t see anything.
At the end of the trial’s first session, the lawyer excused himself from making a statement to the media. “I don’t want to talk”, he said. Nevertheless, CM knows that the document that was exhibited by António Pragal Colaço in court has not been appended to the process yet and the lawyer will only present it over the coming days.
António Cabrita, Gonçalo Amaral’s defense lawyer, questioned the reason why the doctor at the Health Centre in Odemira failed to denounce the aggressions that Leonor denounced when she was examined. António Cabrita asked if the doctor should not be accused of omission to denounce, just like his client.
Many members of the public watching
Throughout the day, the main room at the Court in Faro was literally overfilling and there wasn’t enough space for the numerous members of the public that wanted to watch the trial. At the door, many persons waited for someone to leave in order to obtain a place. Contrary to what was requested by Leonor’s lawyer, there was no metal detector control, but Leonor was constantly surrounded by prison guards. The trial proceeds on Wednesday morning.

Condemned: Her daughter’s death – Leonor is presently fulfilling a 16-year prison sentence over the death of her daughter and the concealment of her cadaver. The case was appealed until the Supreme Court, which confirmed the sentence.
Order: Normal lapses – Rodrigo Santiago, one of the most renowned lawyers in the country, is the assistant who represents the Order. Concerning the contradictions, he says that “they are natural because [Leonor] has been imprisoned for several years”.

Inconformado com o facto de o padrasto de Joana não ter ser pronunciado por envolvimento na morte da menina, Gonçalo Amaral continua a acusá-lo de a ter violado.
O ex-inspector, não conseguindo disfarçar a irritação, declarou ao jornal 24 horas que era «uma pena que o processo daquele senhor não tenha chegado a julgamento».
Apesar de haver «fortes suspeitas» de violação o Ministério Público acabou por arquivar o processo, depois de sugestão nesse sentido avançada pela Directoria de Faro da PJ.
De acordo com os elementos recolhidos pelos inspectores da Polícia Judiciária, foram encontrados vestígios biológicos que podiam ser de sémen e sangue na zona vaginal de umas cuecas.
Gonçalo Amaral garantiu ao jornal 24 horas que «o sangue era dela, o esperma era, com 90% de hipóteses de Leandro».
Leandro ainda chegou a ser constituído arguido, mas reclamou o direito de se recusar a doar sémen.
O ex-inspector lamenta que a verdade não tenha sido apurada e que não se tenha feito justiça.

Being dissatisfied with the fact that the stepfather of Joan has not be decided by involvement in the death of the girl, Gonçalo Amaral continues to accuse him of having violated.
The former inspector, unable to disguise the anger, told the newspaper that 24 hours was "a shame that the process that you have not come to trial.
Although there are "strong suspicion" of the violation prosecutors finally close the file, after suggestion to that effect made by the Directory of Faro PJ.
According to evidence gathered by inspectors of the Judicial Police, were found that could be biological traces of semen and blood in the vaginal area of some underpants.
Gonçalo Amaral said the newspaper 24 hours that the blood was hers, the sperm was, with 90% of potential Leandro.
Leandro also came to be made defendant, but claimed the right to refuse to donate sperm.
The former inspector regrets that the truth has not been established and it has not done justice.
