The decision was taken in a bid to prevent further publication of Mr Amaral's "deeply offensive" book The Truth of the Lie and his television documentary.
The McCann's UK lawyer, Edward Smethurst, said the first step will be to apply for a gagging order at Lisbon's main civil court.
"There is no evidence that Madeleine is dead. Therefore not only is this book damaging and libellous, but it's also damaging the search for Madeleine."
He said he was confident the injunction would be granted.
this is on the BBC website, the rest is the same as on Sky News..... Wonder if they will just apply to get an order to 'gag' Amaral and then take it no further?
this country should gag them 2 and that pink fairy. i'm sick to death of em wanting everyone to be gagged while they keep on about an abductor that dont exist.

Re: McCanns to sue Goncalo Amaral Thread....
Other books have been banned in the past and they get printed in another country. There will be a way around this don't worry. The McCanns are a shifty pair, and will do their very best to stop publication of this book and the contents that they don't want anyone to read. Nothing would stop Mr Amaral going on TV, say in Australia, though, to speak to the media.

Re: McCanns to sue Goncalo Amaral Thread....
Mr Amaral has not defamed the McCanns at all, but simply told what happened during the investigation, and the leads and the conclusions reached. Namely, that Madeleine died in the apartment as the result of an accident whilst the parents were not there to take care of her.
Which happens, by the way, to be the same conclusion that the Portuguese Official Investigation reached with the Prosecutors deciding not to bring charges against the McCanns for negligence because they thought they had suffered enough already. They also concluded there was no abduction.
Mr Amaral has always wanted the McCanns to bring charges so that he can bring this information out in court and challenge the McCanns that Madeleine was taken by an abductor.
The McCanns may be having to resort to this in order to try and stop the publication of 'The Truth of the Lie' in English as they may not have been able to get an injunction to stop it.
This may also open a whole can of worms for Brown and interference in what was an ongoing criminal case.

brown cant help them out in this either as his priotity is telling the whole world he's so sorry for all the money pinching going on for 2nd homes

Re: McCanns to sue Goncalo Amaral Thread....
Sky newspaper review just now featured a newspaper article about the McCanns. The reviewer, an Irishman named John something explained Gonçalo Amaral had written a book which had sold over 20,000 copies and been printed in several languages, also sold in the USA and had been on the market for over a year. He and Mark Longhurst thought it odd that "the McCanns" should be taking such action at this late stage. They discussed the point that Gonçalo Amaral was eager for a court appearance and pointed out that "the McCanns", if they proceeded with this, would have to face questions in a court. Mark Longhurst described it as a high risk strategy.
Didn't get the feeling that either of them had much sympathy for "the McCanns" but were being a bit cagey.
Sorry, didn't catch the name of the newspaper or the surname of the reviewer.

A rep point for that Harvesmom.
I am wondering if this is a last desperate grab at the sympathy vote. They know they have to do something as more and more people are questioning their reluctnce to take action, either against Gonçalo Amaral, Tony Bennett and all the bloggers and forums which Clarence Mitchell has threatened and bullied.
They might plan on starting legal action then, sob sob, have to withdraw due to lack of funds. What little money they have has to be spent searching for Madeleine rather than protecting their reputation.
Could the fact that the roof is falling in on Gordon Brown have anything to do with this?
Things are certainly getting interesting.

Actually I find it disgusting they have even brought their twins names into this....they should be left out of it.....or are they telling them that Amaral is the monster?
Just what I was thinking Amber. Why burden poor Madeleine and the twins with all the legal stuff ? They are the adults, let them make the decisions and take the action.
They didn't bother asking the kids what they thought when they were left alone night after night did they? And when Madeleine told them, they just ignored her and did what they wanted to do. DISGUSTING.
Obviously Sean and Amelie are included in the threat to sue because they've been told over and over and over and over again that she's alive, and goodness knows, when Amelie puts on Madeleine's clothes and wears her shoes, and draws pictures that include her, it would be such an emotional wrench for her to read that her sister is dead after all this time.

I think that they're wrong the way that they bring Madeleine's name into everything that they do with the twins. For example when Amelie was getting her hair cut Kate made a point of telling her that her big sister used to sit in that seat.

Well hope he is after all he has said! He keeps saying we're close to a big revealation and soon the whole world will know, that's yet to happen and they still have a lot of support. With regard to how they'll pay for the court case I don't know the answer to that but I do know that Oprah doesn't pay for interviews.

Kate and Gerry McCann, parents of missing Madeline are in talks with a £1million pounds ($2 Million US dollars) deal with two of America's biggest chat show stars. McCanns’ claim they want to use these funds to locate Madeline.
The parents of Madeleine McCann are at the middle of the bidding war between Oprah Winfrey and Barbara Walters. Both the talk show experts are desperate to land an exclusive deal with the McCanns to talk about the missing Madeline McCann. This deal will be the largest amount paid for any interview so far.
The McCanns say they are forced to take this interview after their £1.2million ($2.4 million dollars) “Find Madeleine appeal fund” is expected to run out by June. Both the McCanns are out of work now, so they rely on this fund as well as use it to search their daughter.
The couple's representatives have already met with producers to discuss turning the eight-month investigation into the disappearance into a film and could earn up to another £1million from selling the film and book rights.

SUE: Kate and Gerry McCann are sueing Goncalo Amaral for defamation
Sunday May 17,2009
THE PARENTS of Madeleine McCann last night announced they will sue the former Portuguese police chief who botched the probe into her disappearance.
Kate and Gerry McCann are to take action against Goncalo Amaral who claimed publicly that Maddie was dead and they had helped to hide her body.
In a statement, Kate, 41, and Gerry, 40, said: “We, together with our three children Madeleine, Sean and Amelie, are taking this legal action against Goncalo Amaral over his entirely unfounded and grossly defamatory claims – made in all types of media, both within Portugal and beyond – that Madeleine is not only dead but that we, her parents, were somehow involved in concealing her body.”
Their decision was taken to try to prevent further publication of Amaral’s “deeply offensive” book The Truth of the Lie, his TV documentary and his “disgraceful thesis” that the parents were involved in their daughter’s disappearance.
The statement continued: “The primary reason for our legal action is simple: to stop any negative effect that these absurd and deeply hurtful claims may be having on the ongoing search for Madeleine.
“We can no longer stand back and watch as Mr Amaral tries to convince the entire world that Madeleine is dead.
“Nor can we allow this blatant injustice to Madeleine, with its obvious risk of hindering our attempts to find her, to continue. Mr Amaral’s entirely unjustified claims have not only brought indescribable devastation and suffering to our lives, they have hugely compounded the already immense pain and anxiety we have endured since Madeleine’s abduction.”
Amaral was sacked from the investigation after criticising British police for siding with Kate and Gerry.
Earlier this month, the McCanns’ spokesman Clarence Mitchell criticised him for trying to cash in on Madeleine’s disappearance by selling TV interviews at £75,000 a time.
SEARCH UK NEWS for:
According to his representative Luis Varela Marreiros, his main concern since leaving Policia Judiciaria has been “to reveal the facts that occurred during the investigation”.
The couple, from Rothley, Leicestershire, recently marked the second anniversary of Madeleine going missing from their holiday flat in Praia da Luz, southern Portugal, just days before her fourth birthday.
The McCanns’ investigators believe her kidnapping was a planned two-man operation.

How to Get On Oprah
23/12/08 3:59 PM
In my 20 years in the public relations business, if I had a nickel for every time a client asked me to get them on Oprah it is safe to say that I would be a very wealthy woman at this point in my career!Oprah is indeed the gold standard, and her show carries weight not only because of Oprah’s massive viewership, but also because they’re loyal. She brings with her tens of millions of loyal viewers who trust her so implicitly, that they buy practically any book she recommends, any product she endorses and follow her advice on just about every topic from politics and parenting to bowling and basket-weaving.And when most PR Agencies are faced with that request, they smile and nod and tell their clients they’ll do their best, but we all know what it really takes to get on Oprah.
* Oprah is NOT a Product Peddler - The Oprah Winfrey Show does not exist to “provide coverage” for your product, company or book. Her mission is to inform and entertain her viewers so that they keep tuning in, and her company can sell advertising at top dollar. The more engaged and sizeable her viewership, the more revenue she takes in.
* Her show is a true “No Spin Zone” - You can’t “spin” yourself into a guest spot on her show, because her staff scrutinizes her guests more severely than the press dissect political candidates. You can’t disguise any element of your past, and you can’t use PR techniques to make yourself look more credible or noteworthy than you actually are. Her people are media pros and will see through it.
They don’t see their roles as bookers or producers - they see themselves as caretakers of a multi-billion brand name and a television personality whose name is synonymous with credibility and trust. Protecting her show and her name is tantamount to protecting themselves and their roles in shaping a media juggernaut. You can’t fool them - either you got the goods, or you don’t.
* You don’t call her, she calls you - This is the one thing no publicist ever tells a client they hope to sign. Why? Simply because they are afraid it will make their agency or service irrelevant to the client who can sign the big check. 95 percent of Oprah’s guests are invited, and are rarely booked because a publicist made a phone call and pitched a client. It’s rare that any of her staff even make themselves available to hear pitches from publicists.
Seeing a guest similar to yourself on her show does not move you to the top of the list - If anything, seeing a competitor or guest similar to yourself on her show actually makes her less interested in you.
With that being said, a publicity campaign is absolutely critical if your eventual goal is to get on Oprah’s show. Contradictory? Not really. Here are some critical tips to give you the best shot at getting on her staff’s radar screen:
Start locally - Earlier, I mentioned that 95 percent of her guests are invited without a pitch from a publicist, but that doesn’t mean publicity wasn’t involved. Her bookers and producers find out about unique guests by reading the news. They scour the Internet and local newspaper sites, looking for unique individuals and stories from all over the country. All those national headlines you read every day about the guy whose 8-year-old saved his life by giving him CPR, or the woman whose dog dialed 911, didn’t happen in Anywhere, USA. They happened somewhere, and in that somewhere was a local TV or print reporter who found out about it and wrote about it. The foundation of any campaign to get in the national media is to prove you were at least interesting enough to make your hometown papers or TV newscasts.
Stand for Something - The mistake a lot of people make when hitting the media is to be all things to all people, to appeal to the broadest sector of the population, to cast a wide net. However, most of the people you’ll see on Oprah are not good for all time zones - they are passionate, opinionated people who hold strong views and may pick a position that cab upset some element of the viewing audience. Controversy and conflict is what drives most talk shows. Imagine how interesting Crossfire would be to watch if everyone agreed, and you’ll see my point.
Have an Impact - Just because you write a book that exposes hidden injustice in some area of society, it’s not enough to just stand behind the book. You have to be an activist, a clarion voice of passion who actively campaigns to right the wrongs you’ve exposed. Having an impact on people’s lives, and earning the news coverage in your local community, is the highest-percentage way to get on the radar screen of Oprah’s staff, if not Oprah herself.
At the end of the day, there is no magic potion you can take, no staffer or producer you can pay off, and no stunt you can pull that will get you on Oprah. But if you are truly unique, you have an impact on people’s lives and have the support of your local media, you’ve got as good a shot of being featured on Oprah’s show as any of the people she’s already put on the air.
It doesnt mention money but I would be surprised if it did and I think different interviewees would get different fees.

McCanns sue detective over book claim that Maddy died in tragic accident By Daniel Boffey

Comments (0) Add to My Stories Defiant: Detective Goncalo Amaral is looking forward to his day in court when he will face layers acting for Kate and Gerry McCann
Kate and Gerry McCann are suing a detective who claims their daughter Madeleine died in an ‘accident’ at their holiday flat on the night she vanished.
They want to force the pulping of the book The Truth About The Lie, by Goncalo Amaral, who led the police investigation into Madeleine’s disappearance in the Portuguese resort of Praia da Luz two years ago.
But a source said the McCanns could be forced to give evidence in court in their action against Mr Amaral – presenting him with a stage from which to attack the couple.
His publisher, Mario Sena Lopes, said he was ‘looking forward’ to his day in court.
He is seeking a British publisher for his book after selling 250,000 copies on the Continent, including 175,000 in Portugal.
An English version has already been produced for America.
The McCanns also want to make sure a documentary produced by Mr Amaral for Portuguese TV does not win a wider audience.
Their defamation case, lodged yesterday in Lisbon, alleges that Mr Amaral has damaged their reputation ‘causing indescribable devastation and suffering’ and put in danger the well-being of their children, twins Sean and Amelie, four, and particularly Madeleine.
Mr Amaral was forced off the inquiry in October 2007 for criticising British police.
He was partly responsible for making the McCanns arguidos, formal suspects, in the case.
His book claims Madeleine, then aged three, died in a ‘tragic accident’ in the holiday flat on the night she disappeared.
Mr Amaral has never claimed that heart surgeon Gerry and GP Kate, of Rothley, Leicestershire, killed her.
He has reportedly said his only regret was failing to carry out a reconstruction of events soon after Madeleine vanished, but says he was put under ‘serious pressure’ not to.
The McCanns said they were taking action over Mr Amaral’s claims ‘that Madeleine is not only dead but that we, her parents, were somehow involved in concealing her body’.
They said it was ‘a disgraceful thesis that we are somehow involved in the disappearance of our much loved daughter Madeleine’.
They added: ‘We can no longer stand back and watch Mr Amaral try to convince the entire world that Madeleine is dead.’
Mystery: Madeleine disappeared two years ago aged just three-years-old
They included their children as complainants in the action as ‘Sean and Amelie require protection as they prepare to start school this autumn. Madeleine requires protection from those who are obstructing the possibility of her being found’.
Mr and Mrs McCann have hired one of Portugal’s top libel lawyers, Isabel Duarte, 54.
They can force the book off Portuguese shelves and bar the country’s TV stations from repeating his claims if they can prove that he has accused them ‘even in the form of a suspicion...of something which is offensive to their honour or esteem’.
Mr Amaral must show he had good reason to believe his allegations were true and he made them in good faith.
Unlike in the UK, the McCanns would be eligible for only nominal compensation. But a source said their motivation in suing Mr Amaral was simply to ‘censure him’. ‘He has been publicising his book across Europe and they just think enough is enough.’
Last month Mr Amaral announced plans to start his own ‘international’ private investigation to solve the mystery.
He intends to send his findings to judicial chiefs in Portugal with a request to reopen the case.
His publisher, Ms Lopes, said: ‘The conclusions of the book are also the conclusions of many Portuguese and British police involved in the inquiry.
‘We are looking for a publisher in the UK, but the McCanns have a very powerful influence in British society and a lot of pressure is being made to prevent the book being published. We have had a lot of letters from UK people who want it published there.’

No but her fans will log onto the site and make donations. Having read this I'm more surprised that they got on than anything. The story is so controversial for example. Oprah got a big sigh from her audience [the only interaction with the audience during the interview] when she showed Kate's first appeal and said she found it amazing that people accused her of showing no emotion. She could have shown the 'clunk whooosh' moment or thousands of others. On one hand I felt that they had her support on the other I was surprised she didn't fawn all over them - I thought she would but actually thought she was remarkably restrained [for an American].

Gonçalo Amaral: “There are things that I haven’t said yet”
Allegations made by the former PJ inspector are considered to be defamatory
by Cláudia Lima da Costa /HB
The parents of Madeleine McCann, the little English girl that disappeared in the Algarve on the 3rd of May 2007, have announced that they are going to sue former Polícia Judiciária (PJ) inspector Gonçalo Amaral for defamation. The former police inspector, who was responsible for the investigation into the child’s disappearance, has already reacted to the news and says that there are “things that he hasn’t said yet and that he can prove in court”.
The information was advanced by BBC, citing the couple’s spokesperson, who said that this legal action was prompted by “entirely unfounded and grossly defamatory claims”.
“We - together with our three children Madeleine, Sean and Amelie - are taking this legal action against Gonçalo Amaral over his entirely unfounded and grossly defamatory claims”.
Gonçalo Amaral reacted to the couple’s spokesperson’s statements and told TVI that he is a “tranquil man” and that he receives the news “calmly”. The former PJ inspector says that the “situation was awaited”, especially after the broadcast of the documentary, that was produced by the couple, and the interview to Oprah didn’t achieve “the desired effect”.
“There are things that I haven’t said yet”
Gonçalo Amaral further stated that he trusts the Portuguese Justice and that he has “no doubts” that the process will be reopened. “Let’s go to court! That is a way to reopen the process”, he said in a statement to tvi24.pt, alleging that there are still diligences to be made and that he has “the right” to defend himself.
The former inspector has not been officially notified of the decision, but he reacts indignantly: “This is an intimidation attempt that could backfire for them, because there are things that I haven’t said yet, things that I can prove in court”, he said.
As far as tvi24.pt was able to establish, the McCann couple already has a lawyer in the city of Lisbon who wants to pursue the process that targets not only Gonçalo Amaral, but also editor Guerra e Paz, that was responsible for the book launch, and against Valentim de Carvalho [producers of the ‘Truth of the Lie’ documentary].
The statements that are at issue are, according to the British couple, allegations that “Madeleine is not only dead”, but also that they, the child’s parents, “were somehow involved in concealing her body”, BBC cites.
It’s further explained that this process was filed in order to prevent the publication of Gonçalo Amaral’s book “The Truth of the Lie” and a television documentary by the former PJ inspector, about the case.
“We can no longer stand back and watch as Mr Amaral tries to convince the entire world that Madeleine is dead”, reads the press release that is cited by the British media chain.

McCanns Trying to Gag Amaral
Kate and Gerry McCann are to take action over comments made in the media by the man who previously led the inquiry into Madeleine's disappearance.
In a statement, the parents of the missing girl said: "We - together with our three children Madeleine, Sean and Amelie - are taking this legal action against Gonçalo Amaral over his entirely unfounded and grossly defamatory claims -made in all types of media, both within Portugal and beyond - that Madeleine is not only dead, but that we, her parents, were somehow involved in concealing her body."
The decision was taken in a bid to prevent further publication of Amaral's "deeply offensive" book The Truth of the Lie, his television documentary and his "disgraceful thesis" that the parents are involved in their daughter's disappearance.
The statement continued: "The primary reason for our legal action is simple: to stop any negative effect that these absurd and deeply hurtful claims may be having on the ongoing search for Madeleine.
"We can no longer stand back and watch as Mr Amaral tries to convince the entire world that Madeleine is dead.
"Nor can we allow this blatant injustice to Madeleine, with its obvious risk of hindering our attempts to find her, to continue.
"Mr Amaral's entirely unjustified claims have not only brought indescribable devastation and suffering to our lives, they have hugely compounded the already immense pain and anxiety we have endured since Madeleine's abduction."

Meanwhile regarding this news above, this was meant for the 3 arguidos, but since it's relevant will go here as well:
Message from Gonçalo Amaral and Sofia Leal
I've just spoken to Sofia and Gonçalo Amaral on the phone, they sent a message to the forum and to the members on this thread 'Financial Support For Amaral - Please Sign' particularly.
They asked me to say that they are both fine, they are very touched and wish to thank you for the support.
As well they will wait to see what this claim is all about, since the claim will be done in a civil court in Lisbon by a new lady lawyer named Isabel Duarte. Carlos Pinto de Abreu and Rogério Alves [who are no longer working for the McCanns] were always against this move since it would most likely reopen the process, so it's time to wait and see if this is not a mere threat as both the book and the documentary are based on facts/per investigation and Public Ministry process and if the McCanns will in fact act in a way where the archived process will have to be legally reopened*.
*For the McCann's claim against Gonçalo Amaral's book and documentary, legal certificates have to be extracted from the process, and that requires the opening of the same.

At the end of the day he is a policeman and not a spokesman. He doesnt need to brainwash the public into believing him. His day will come
